Police Jury sells property - 16th Street
 

October 21 2003

 

The Parish Purchasing Agent, on behalf of the Calcasieu Parish Police Jury, will receive sealed bids for the sale of property located at 1021 16th Street in Ward Three in Calcasieu Parish, Louisiana, until Wednesday, November 12, 2003, at 2:00 p.m., in the Office of the Parish Purchasing Agent located on the Second Floor of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, or Post Office Box 1583, Lake Charles, Louisiana, 70602.

This property is described as follows: 

Lot 22 and the West Half of Lot 23 of Block 12 of Hi-Mount Addition, and one-half of the abandoned alley adjacent to Lot 22 and West Half of Lot 23 of Block 12 described as:  commencing at the Northwest Corner of Lot 22 of Block 12; thence go East 75 feet; thence go North 7.5 feet; thence go West 75 feet; thence go South 7.5 feet to the point of beginning, together with improvements, component parts, attachments, rights, privileges, advantages, servitudes, and accessories located at 1021 16th Street in Lake Charles, Louisiana. 

All bids must be submitted on PARISH BID FORMS, which may be obtained in the Office of the Parish Administrator in the Parish Government Building or by calling 337/721-3500.  Please contact Mr. Butch Roberts, Facilities Manager for the Calcasieu Parish Library System, 337/475-8798 to view the property and improvements. 

Minimum bid for this property is $39,000.00.  Sealed bids must include cashier’s check, certified check or bid bond in the amount of two percent (2%) of the amount of the bid.  The checks of all unsuccessful bidders will be returned.

The buildings and improvements described above are being sold by Seller to Purchaser in "AS IS, WHERE IS" condition.  Seller and Purchaser understand and agree that this means Purchaser does hereby waive all warranties provided by law, expressed or implied, with respect to the condition of the building or improvements and the land that they are situated on within the boundary lines as to the fitness of said items for any intended use or purpose.  This waiver includes, but is not limited to:

a)  all rights Purchaser may have under all warranties provided by law or otherwise to hold Seller responsible to replace or repair hidden or latent defects in building and related improvements, including, but not limited to, roof, walls, appliances, plumbing, electrical systems, air conditioning and heating systems, plumbing and sewerage systems, foundation, and all structural component parts relating to said items:

 

b)  all rights that Purchaser may have against Seller under all warranties provided by law to rescind the sale of the property as a result of any hidden or latent defects in the building or improvements or land or related component parts including those summarized above; and

 

c)  all rights and causes of action that Purchaser may have against Seller to seek damages or recover any expenses of sale under all warranties provided by law as a result of any hidden or latent defects in the building or improvements or land or related component parts including those summarized above.

Further, Buyers declare that they have examined the above described property prior to the date of this sale and they specifically waive all rights against Seller, including any and all claims that they may have for redhibitory defects and more particularly waive all of those rights provided for pursuant to Louisiana Civil Code Articles 2520 through 2548, inclusive.

Successful bidder will be responsible for obtaining an abstract or survey, if he/she so desires one.  The Parish will be responsible for drawing up the necessary document(s), and successful bidder will be responsible for the filing of the appropriate document(s) in the Calcasieu Parish Clerk of Court’s Office and providing the Parish with a copy of the recordation information for their files.

The Calcasieu Parish Police Jury will take official action on the sale of the property within thirty (30) days.

 All bids MUST be plainly marked on the outside of the sealed envelope:
