            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, October 4, 2007, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chris E. Landry, President, presiding, and the following members present:

 

Mesdames Elizabeth Conway Griffin and Sandra J. “Sandy” Treme; and Messrs. Francis Andrepont, Guy Brame, Brent Clement, Calvin Collins, Michael E. Danahay, Kevin Guidry, Tony Guillory, Don Manuel, Hal McMillin, Cornelius “Cornie” Moon, and Tony Stelly

 

Absent: Charles S. Mackey, D.D.S. (out of town)


            Also present were Mr. S.             President Landry called the meeting to order. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.


            President Landry welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or silenced so they would not interrupt the meeting.

            Following a brief report by Mr. McMillin, Chairman of the Budget Committee, motion was made by Mr. McMillin, seconded by Mr. Clement and carried unanimously that the Budget Committee Report dated September 27, 2007, and all recommendations contained therein, be approved as follows:

            A meeting of the Budget Committee was held at 4:45 p.m. on Thursday, September 27, 2007, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with Mr. Hal McMillin, Chairman, presiding and the following members present:

            Said Committee:

 

(1)        Recommended approval of the following requests for funding from the Parish’s Gaming Fund:

 

            (1.1)     grant in the amount of $15,000 from the Ward One allocation of the Gaming Fund to Gravity Drainage District No. Eight of Ward One which represents a grant match for the purchase of a crawler, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto. (The Drainage District received a grant in the amount of $25,000 from the State that will be used as a match to purchase this equipment.)

 

            (1.2)     grant in the amount of $15,000 from the Ward Four allocation (Police Jury District 14) of the Gaming Fund to Ward Four Fire Protection District No. Three for the purchase and installation of fire hydrants, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

            (1.3)     grant in the amount of $5,000 from the Ward Six allocation of the Gaming Fund to Community Center and Playground District No. One of Ward Six for parking improvements at their facilities, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

            (1.4)     grant in the amount of $20,000 from the Ward Seven allocation of the Gaming Fund to Community Center and Playground District No. Three of Ward Seven for bleachers and lighting improvements at Ted Lyons Ballpark, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

            (1.5)     grant in the amount of $25,000 from the Ward Seven (Delta) Infrastructure allocation of the Gaming Fund to Ward Seven Fire Protection District No. One for the purchase of a generator for the Edgerly Station, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

(2)       Recommended approval of a grant in the amount of $10,000 from the Police Jury’s Gaming Fund, Parishwide Needs, for sponsorship funds toward the exhibit entitled “Titanic: The Artifact Exhibition” which will be hosted by the City of Lake Charles at the 1911 Historic City Hall between October 6, 2007, and January 6, 2008, with the understanding that the Police Jury would be reimbursed on a pro-rated basis if a profit is realized at the conclusion of the exhibit. (Sponsorships in addition to the City of Lake Charles include the Southwest Louisiana Convention and Visitors Bureau, the Arts and Humanities Council of Southwest Louisiana, the Louisiana Office of Culture and Tourism, and several community businesses.

            Following a brief report by Mr. Guillory, Chairman of the Ambulance Regulatory Committee, it was moved by Mrs. Griffin, seconded by Mr. Collins and carried unanimously to approve the report of said Committee dated September 27, 2007, and the recommendation contained therein, as follows:


AMBULANCE REGULATORY COMMITTEE REPORT

            A meeting of the Ambulance Regulatory Committee was held at 5:00 p.m. on Thursday, September 27, 2007, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with Mr. Tony Guillory, Chairman, presiding and the following members present:

 

Mr. Mike Danahay, Mr. Cornie Moon, and President Chris E. Landry, Ex-Officio

 

Absent: Mrs. Elizabeth Conway Griffin, and Mr. Don Manuel


            Also present were Police Jurors Francis Andrepont and Tony Stelly, as well as staff members Mr. S. Mark McMurry, Mr. Bryan Beam, Mrs. Coleen Clark, Mr. Richard Gremillion, and Ms. Kathy P. Smith.

 

            Said Committee:

 

(1)        Received a status update regarding ambulance service in Calcasieu Parish which indicated that both ambulance providers, Acadian and West-Cal Cam Hospital, were meeting the response times required by the Parish’s ordinance, and further, only two complaints had been received since December of 2006, and both of those complaints had been satisfactorily resolved. With regard to a change from 24-hour to 12-hour full-time coverage in the Iowa area, the Committee recommended that any changes such as this be communicated in advance to the Office of Homeland Security and Emergency Preparedness (OHSEP) so that the affected juror(s) could be notified. The Committee also recommended that the fire departments be contacted about the importance of complying with the requirement that they be properly trained in night landing of helicopters, said training provided by Acadian Ambulance. (Mr. Lane Owers, Mr. Jerry Romero, and Mr. Randy Favre, of Acadian Ambulance appeared before the Committee.)

3.         Recommended adopting a resolution approving a Second Amendment to the Communications Site Lease Agreement (Tower) between Waterworks District No. Five of Wards Three and Eight and Nextel WIP Lease Corp., a Delaware Corporation, d/b/a Nextel Partners, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

NOTE: this amendment will increase the monthly rental from $600.00 to $1,500.00 for rental space on the water tower.

 

4.         Recommended adopting a resolution approving a Line Item Appropriations Cooperative Endeavor Agreement between the Police Jury and the Department of Treasury, State of Louisiana, on behalf of Gravity Drainage District No. Eight of Ward One, which will entitle the District to receive an appropriation of $25,000 from the State, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

            As a result of approval of the foregoing report and all recommendations contained therein, the following resolutions were adopted:


RESOLUTION


            WHEREAS, Matthew Linton Vincent, subdivided certain property in Ward Four of Calcasieu Parish, Louisiana, known as Lintonwood Subdivision, a subdivision in Section 9, Township 9 South, Range 10 West, Calcasieu Parish, Louisiana; and


            WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana; and


            WHEREAS, said subdivision plat was prepared by K. Carl Johnson, Registered Land Surveyor No. 4866, and certification was made that the subdivision plat was prepared in accordance with R.S. 33:5051 and all other laws of the State of Louisiana; and


            WHEREAS, said subdivision plat will be filed for record in the Office of the Clerk of Court on October 10, 2007, and will bear File No. 2836222.


            NOW THEREFORE,


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in Regular Session on the 4th day of October, 2007, that it does hereby officially accept the plat of Lintonwood Subdivision in Ward Four of Calcasieu Parish, Louisiana.

            Chairman Brame advised that the purpose of the meeting on this date was to review the proposed agenda for the Regular Meeting of the Police Jury to be held on October 4, 2007.


            Following review of the items to be considered by the Police Jury on October 4th, and after recommendations for appointments to various boards of special service districts were made by members of the Committee, it was unanimously recommended that the proposed agenda be accepted as presented by the staff with the following addition:

 

Consideration of adopting a resolution commending Mr. Jeremy Harper of the Lake Charles American Press for his thorough and unbiased coverage of the meetings of the Calcasieu Parish Police Jury during the past five years and wishing him much success in his new position with the Baton Rouge Advocate.


            There being no further business, Chairman Brame declared the meeting to be adjourned.

            (2)       Purchaser has made written request to the Adjudicated Property Section of the Division of Planning & Development to notify those persons identified above in accordance with LSA-R.S. 33:4720.17 and LSA-R.S. 47:2261 and has paid the Parish the sum of five dollars per notice and/or the sum of thirty dollars per notice by publication requested.

 

            (3)       Upon written request from the Adjudicated Property Section of the Division of Planning and Development, the Purchaser shall remit 25% of the purchase price as earnest money to be held in escrow by the Calcasieu Parish Police Jury for application to the purchase price at closing, or to be retained by it in the event Purchaser fails to complete the purchase.

 

            (4)       The Adjudicated Property Section of the Division of Planning & Development has provided purchaser with proof of notice, and purchaser has recorded same in the conveyance records of Calcasieu Parish and has provided the Adjudicated Property Section of the Division of Planning & Development a stamped copy of the recorded proof of notice.

            Section 3. If purchaser should fail to complete the requirements of Section 2 A) and B) within sixty (60) days of adoption of this ordinance, the President or the Director of the Division of Planning & Development, is authorized to execute an act of cash sale in which the Parish of Calcasieu conveys the above described property to anyone who shall complete the requirements of Section 2. If all of the requirements of Section 2 are not completed within one year from the date this ordinance is adopted, the authority of the President or Director of Planning and Development to execute an act of cash sale for this property shall cease, and any and all rights of the purchaser to this property shall terminate.


            Section 4. This act of sale shall be without any warranty or recourse whatsoever (including warranty of title), even for the return or any reduction of the purchase price, but with subrogation to all rights and actions of warranty the Parish of Calcasieu may have, and shall contain such warranty limitations and other provisions as are required by the Parish Attorney. The Parish of Calcasieu shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface rights of the said property.
