The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, June 21, 2007, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chris E. Landry, President, presiding, and the following members present:
Mesdames Elizabeth Conway Griffin and Sandra J. “Sandy” Treme; and Messrs. Francis Andrepont, Guy Brame, Brent Clement, Calvin Collins, Michael E. Danahay, Kevin Guidry, Tony Guillory, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornelius “Cornie” Moon, and Tony Stelly

President Landry called the meeting to order. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.
President Landry welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
President Landry advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for an oil, gas, and mineral lease on certain tracts of land (3.59 acres, more or less) in Ikeland Acres Subdivision in Section 25, Township 8 South, Range 10 West, in Ward Six, and appropriate action would be taken thereon.
Mr. McMurry then proceeded to open the only bid submitted from Charleston Energy on behalf of Mayne and Mertz, the details of which are outlined in the following resolution which was adopted upon motion made by Mrs. Treme, seconded by Mrs. Griffin and carried unanimously:

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in Regular Session convened on the 21st day of June, 2007, that it does hereby accept the bid of Mayne & Mertz, Inc. for a mineral lease on the following described property, to-wit:

for a three-year lease with a cash bonus of Eight Hundred Ninety Seven and 50/100 Dollars ($897.50) and an annual rental of Eight Hundred Ninety Seven and 50/100 Dollars ($897.50) and with the Calcasieu Parish Police Jury to receive twenty-five percent (25%) of all oil produced and saved, twenty-five percent (25%) of all sulphur produced and saved, and twenty-five percent (25%) of all other liquid or gaseous hydrocarbon minerals produced and saved.
BE IT FURTHER AND FINALLY RESOLVED that the President of the Police Jury, or his designee, when appropriate, is hereby authorized to execute the necessary lease contract to consummate this transaction.

President Landry advised that bids would also be received and opened at this time, as advertised in accordance with law, for Exterior Renovations, Magnolia Building, and appropriate action would be taken thereon.
Mr. McMurry proceeded to open the following bids:

There being no other bids, motion was made by Mrs. Griffin, seconded by Mr. Guidry and carried unanimously that the bids be referred to the staff for final tabulation with further action thereon to be taken by the Police Jury at its Regular Meeting on July 5, 2007.
President Landry advised that a report would be received at this time from Mr. Heath Allen, Deputy Director at the Lake Charles Regional Airport, regarding the status of airport projects. Mr. Allen reported that funding for the biggest project – the new 45,000 square foot passenger terminal building – was in place, with said funding totaling $26,101,748 and derived from the Federal Aviation Administration (FAA), insurance proceeds, FEMA, Louisiana Department of Transportation and Development, and the passenger facility charge. Mr. Allen stated that bids would be received on July 19, 2007, and that the project was anticipated to be complete in March of 2009.
Mr. Allen reported that the FAA was currently moving back into the air traffic control tower after having paid 100% of the costs of repair and renovations of said building.
Mr. Allen advised that ERA Helicopters, Inc., (ERA) was working to establish an international training facility with simulators for new aircraft coming on line and planned to have the first simulator at the Airport by the end of 2007. Mr. Allen stated that the Airport had purchased a building for this purpose and would need to do approximately $200,000 in renovations. He further stated that he would continue to work with the Louisiana Department of Economic Development on this project and for an additional administrative building for ERA. Mr. Allen pointed out that this would create 50 additional jobs right away and that there would be 600 employees coming through the facility to train for a one to one and one-half week period which would be a good economic impact for the community.
Mr. Allen stated that PHI (Petroleum Helicopters, Inc.) had a lot of equipment that was very susceptible to salt breezes, and said company planned to spend $400,000 enlarging helipads, etc. He pointed out that there were currently five helicopters but that number was expected to increase to ten which meant two to three hundred people coming into the area, parking at the Airport, shopping at local stores, etc.
Some of the other information shared by Mr. Allen included: (1) Continental Airlines had recently been ranked highest among legacy carriers in customer satisfaction according to J.D. Powers, and this airline made 12 daily round trips to and from Houston, (2) Allegiant Airline Charters was providing charter flights for businesses, (3) the FAA had ranked Lake Charles second in net new growth in the Southwest Region which included Louisiana, Texas, Oklahoma, Arkansas, and New Mexico, (4) the Airport was still working with American Airlines to provide service, and (5) the Airport Master Plan was nearing completion and that it was basically a 20-year planning document required by the FAA.
In answer to a question by Mr. Moon, Mr. Allen stated that the old terminal was approximately 30,000 square feet in size as compared to the new one which would be 45,000 square feet. Mr. Moon complimented Mr. Allen and the Airport Authority for all the work they had done since Hurricane Rita, and he stated that the plans looked very good.
Motion was made by Mr. Andrepont, seconded by Dr. Mackey and carried unanimously to receive the report as presented by Mr. Allen.
Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Danahay and carried unanimously, the following application for a liquor and beer permit was approved and the issuance of the Special Events Permit was ratified as listed below:

Motion was made by Mr. Andrepont, seconded by Mr. Collins and carried unanimously that the minutes of the Regular Meeting of the Police Jury dated May 17, 2007, be approved, and the reading of same was dispensed with.
President Landry advised that action was needed on RZ03-015–07 which was a request by Prairie Land Company to rezone from A-1 (Agricultural) to R-1 (Single Family Residential) to allow resident subdivision development on Opelousas Street in Ward Three, Police Jury District 2 (Mr. Collins’ district). He further advised that the Planning and Zoning Board had met on Tuesday, June 19, 2007, and voted unanimously to recommend that the request be granted.
Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Collins and carried unanimously, the recommendation of the Planning and Zoning Board was upheld with respect to RZ03-015-07, and the request to rezone was granted; whereupon, the following ordinance was adopted:

President Landry advised that action was needed on RZ03-013-07 which was a request by HD Truck and Tractor, LLC, to rezone from I-1 (Light Industrial) to I-2 (Heavy Industrial) to allow a concrete recycling facility on Cappo Road in Ward Three, Police Jury District 2 (Mr. Collins’ district). He further advised that the Planning and Zoning Board had met on June 19, 2007, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that the development be limited to a concrete recycling facility only; (3) that all buildings must have a facade that is non-metal (i.e. brick, stucco, hardy-plank, or vinyl); that a landscaping plan must be submitted and approved by the Division of Planning and Development, and landscaping must be installed prior to issuance of occupational license; (5) that all signs must be low-profile monument signs; and (2) provide a 40-foot buffer at the tree line on the southern boundary property line separating the DuRousseau property and the Cooper property. When north prevailing winds are eminent, water will be used on the conveyor as concrete is being crushed to minimize the amount of dust blowing towards Mr. Cooper’s place of business.
Upon motion made by Mr. Collins, which was duly seconded by Mr. Guillory and carried unanimously, the recommendation of the Planning and Zoning Board was upheld with respect to RZ03-013-07, and the request to rezone was granted with the stipulations outlined by said Board; whereupon, the following ordinance was adopted:

President Landry advised that action was needed on RZ08-014-07 which was a request by Seventh District Pavilion to rezone from A-1 (Agricultural) to R-1 (Single Family Residential) to allow residential subdivision development on McCown Road in Ward Eight, Police Jury District 10 (Mr. Stelly’s district). He further advised that the Planning and Zoning Board had met on June 19, 2007, and voted ten (against) to one (for) and recommended that the request be denied.
Motion was made by Mr. Stelly and seconded by Mr. McMillin that the recommendation of the Planning and Zoning Board be upheld with respect to RZ08-014-07 and that the request to rezone be denied.
Mr. Byron Racca, Design Engineer with Meyer and Associates, Inc., appeared before the Police Jury representing Seventh District Pavilion to answer any questions. He stated that the proposed site was approximately 114 acres and that the subdivision would have about 118 lots. Mr. Racca advised that no drainage study had been conducted, and he thought the homes being proposed were a minimum of 1,350 square feet of living area.
Mr. Russell Moss, 1830 Boys Village Road, Iowa, appeared before the Police Jury in opposition to the proposal and stated that he was very concerned about drainage problems and the density of the project, pointing out that this was a rural area. He stated that he wanted better construction in said area, such as brick versus vinyl, pointing out how much of the latter was destroyed during Hurricane Rita. Mr. Moss closed by saying that he did not feel the development fit in his neighborhood.
A vote taken on the motion on the floor carried unanimously, and the recommendation of the Planning and Zoning Board was upheld with respect to RZ08-014-07, and the request to rezone was denied.

With regard to the tenth structure located at 1711 Miller Street in the Moss Bluff area, Mr. Robinson recommended that the manufactured home and accessory building be condemned and removed within thirty days.
President Landry asked if anyone was present in the audience who wished to address the Police Jury with regard to this proposed condemnation, and Mr. Danny Cantrell of 1711 Miller Street, Moss Bluff, appeared before the Police Jury and stated that the manufactured home belonged to his brother who wanted to repair it to make it livable. Mr. Cantrell further stated that he had been trying to tear down the accessory building since Hurricane Rita but his work schedule, weather conditions, and lack of finances had prevented him from doing so.
Mrs. Treme thanked him for his honesty and said she wished he had the wherewithal to do it, but she could imagine his neighbors were not happy. Mr. Cantrell stated that if they were, he would not be happy with them.
Mr. Andrepont told Mr. Cantrell that if he was unable to do the demolition, the Parish would have to do so and add it to his taxes, and Mr. Cantrell stated that he could not believe the Police Jury had not already done that.
Mrs. Treme and Mr. Andrepont suggested that Mr. Cantrell be allowed 60 days to remove the buildings. Mr. Vickers confirmed with them that in the event nothing was done in 60 days, the staff would have authority to go ahead and perform the demoliton.
President Landry cautioned Mr. Cantrell that it would be in his best interest in the long run if he could take care of this, because it would cost him more for the Parish to do it particularly due to requirements which had been imposed on the Parish to check for asbestos.
Motion was made by Mrs. Treme, seconded by Mr. Andrepont and carried unanimously that the structures be condemned and removed within sixty days; whereupon, the following ordinance was adopted:
ORDINANCE NO. 5315
AN ORDINANCE ordering condemnation and demolition of one manufactured home and accessory building on property located at 1711 Miller Street (Lot 38 Seal Subdivision); Tax Assessment No. 00809837, Moss Bluff area of Ward One, Calcasieu Parish, Louisiana, and currently owned by Dennis Allen Cantrell.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in Regular Session on the 21st day of June, 2007, that:
SECTION 1. The facts as set forth at the meeting of the Police Jury of Calcasieu Parish, Louisiana, on this date, justify an order of this Police Jury, and it is hereby ordered that the manufactured home and accessory building on property located at 1711 Miller Street (Lot 38 Seal Subdivision); Tax Assessment No. 00809837, Moss Bluff area of Ward One, Calcasieu Parish, Louisiana, and currently owned by Dennis Allen Cantrell, be demolished and removed within sixty (60) days from the date of this ordinance. This order requires that all development permits be secured for demolition and all debris be removed from the premises. This order is made this 21st day of June, 2007, and is final unless appealed within ten (10) business days.
SECTION 2. If the manufactured home and accessory building on the premises hereinabove described in the Parish of Calcasieu, Louisiana, is not demolished and removed within sixty (60) days from the date of this order, notice is hereby given that the Director of Parish Planning and Development shall have work commenced on the demolition and removal of said manufactured home and accessory building, in which case the Police Jury shall not be liable for damages and shall have a lien and privilege against the property upon which the manufactured home and accessory building was situated for the cost of demolishing and removing said manufactured home and accessory building, and for the cost of maintaining the property.
SECTION 3. The Director of Parish Planning and Development is hereby authorized and directed to give notice of said demolition and removal as required by law.
SECTION 4. The Director of Parish Planning and Development is hereby authorized to enter into a contract to accomplish the demolition of the manufactured home and accessory building, if necessary, and to pay the fees of the contractor from appropriate Parish funds, and to pay any and all costs associated with the demolition. Any amounts expended by the Parish of Calcasieu shall be included in the statement of costs in accordance with Chapter 6 of the Code of Ordinances of Calcasieu Parish, Louisiana, and the Parish of Calcasieu shall have a lien and privilege for all costs resulting from the demolition.
SECTION 5. This ordinance shall become effective immediately.

President Landry asked if anyone was present in the audience who wished to address the Police Jury with regard to this proposed condemnation and hearing no comments, motion was made by Mr. Brame, seconded by Mr. Guidry and carried unanimously that the structure be condemned and removed within thirty days; whereupon, the following ordinance was adopted:

With regard to the twelfth structure located at 6461 Johnny Jones Road in the Carlyss area, Mr. Robinson recommended that the manufactured home be condemned and removed within thirty days.
President Landry asked if anyone was present in the audience who wished to address the Police Jury with regard to this proposed condemnation, and Mr. Frank Lemaire, attorney at law, appeared on behalf of Mr. Perry Alan Hunsicker who had purchased this property in February of 2007. He stated that the manufactured home was actually encroaching on Mr. Hunsicker’s property and that it was not owned by him. Mr. Lemaire further stated that he was in the process of obtaining a legal survey to prove this fact.
In answer to a question by Mr. Vickers, Mr. Lemaire stated that the encroachment was a little bit less than one-half the length of the manufactured home. Mr. Lemaire further stated that Mr. Hunsicker wanted the structure off of his property, and they would try to take care of having it removed instead of the Parish demolishing it.
Motion was made by Mr. Andrepont, seconded by Mr. Danahay and carried unanimously that action on condemnation of the manufactured home located at 6461 Johnny Jones Road in the Carlyss area be deferred for thirty days.
Upon motion made by Mr. Collins, which was duly seconded by Mrs. Griffin and carried unanimously, action was deferred for thirty days on rescinding Ordinance No. 4288, Zoning Case No. RZ03-024-01 which was a request by Jewery B. Webb to rezone the property from C-2 (General Commercial) to I-2 (Heavy Industrial), due to cease of business located at 101 Carpenter Lane in Ward Three, Police Jury District 2 (Mr. Collins’ district). [On July 19, 2001, the Police Jury approved a request from Jewery B. Webb to rezone from C-2 (General Commercial) to I-2 (Heavy Industrial) to allow a salvage yard, with the stipulation that should the business cease, the I-2 (Heavy Industrial) zoning classification was non-transferable, and the property would automatically revert to R-2 (Mixed Residential). Action on the request to rescind Ordinance No. 4288, as stated above, was deferred for thirty days at the Regular Meeting of the Police Jury on April 19, 2007, and again on May 17, 2007.]
It was moved by Mr. Andrepont, seconded by Mr. Collins and carried unanimously to adopt the following resolutions:
RESOLUTION
WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by La Riviere, L.L.C. to clear and grade a 8.74 acre tract, dredge to deepen and extend an existing canal and strategically place approximately 26,000 cubic yards of re-distributed onsite earthen material, all as necessary to establish a single family residential subdivision with waterfront access. Project implementation would impact approximately 2.57 acres of jurisdictional wetlands. Said project is located off of Mims Road, approximately 1.2 miles east of its intersection with Miller Avenue, Westlake, in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of La Riviere, L.L.C., relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in Regular Session on the 21st day of June, 2007, that it does hereby indicate no objection to the proposal of La Riviere, L.L.C. to clear and grade a 8.74 acre tract, dredge to deepen and extend an existing canal and strategically place approximately 26,000 cubic yards of re-distributed onsite earthen material, all as necessary to establish a single family residential subdivision with waterfront access. BE IT FURTHER RESOLVED that the no objection position of the Police Jury in this permit application is based solely on the evaluation of the parish staff of the project’s effect on current parish ordinances and provisions, provided said work meets with the rules and regulations of the Corps of Engineers and the Louisiana Department of Environmental Quality, subject to Best Management Practices during the course of construction as set forth by EPA guidelines, and approvals are received from all appropriate state and federal agencies, and further, that all necessary development permits are obtained from the Calcasieu Parish Division of Planning and Development prior to commencement of the project.
