The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, May 17, 2007, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chris E. Landry, President, presiding, and the following members present:
Mesdames Elizabeth Conway Griffin and Sandra J. “Sandy” Treme; and Messrs. Francis Andrepont, Guy Brame, Brent Clement, Calvin Collins, Michael E. Danahay, Kevin Guidry, Tony Guillory, Don Manuel, Hal McMillin, Cornelius “Cornie” Moon, and Tony Stelly

Also present were Mr. S. President Landry called the meeting to order. The invocation was pronounced by Mrs. Treme which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.
President Landry welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
Mr. McMillin was granted a point of personal privilege to announce that Lake Charles Cogeneration LLC had been successful in its application for $1.3 billion in Gulf Opportunity Zone Act funding for a pet coke fueled gasification project. (The Police Jury adopted a resolution in support of the project at its meeting on May 3, 2007.) Mr. McMillin advised that the plant would be built near Citgo and would be a tremendous asset to Calcasieu Parish.
President Landry advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for Calcasieu Parish Project No. 2007-05 (Overlaying of Various Roads in Calcasieu Parish, Louisiana), and appropriate action would be taken thereon.
Mr. McMurry then proceeded to open the following bids:
Bessette Development Corporation $4,243,490.75
Prairie Contractors, Inc. $3,889,827.00
R. E. Heidt Construction Company, Inc. $3,241,403.10
There being no other bids, motion was made by Mr. Andrepont, seconded by Mr. Danahay and carried unanimously that the bids be referred to the Parish Engineer for final tabulation, with further action thereon to be taken by the Police Jury at its Regular Meeting on June 7, 2007.
President Landry advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for Calcasieu Parish Project No. 2007-10 (Old Highway 90 Park Improvements in Calcasieu Parish, Louisiana), and appropriate action would be taken thereon.
Mr. McMurry then proceeded to open the bids which had been received, the first being from ATS (American Tool Service) Construction. Before opening said bid, Mr. McMurry advised that the contractor’s license number was not noted on the outside envelope which he thought was required by law.
Motion was made by Mr. Andrepont and seconded by Mrs. Griffin to reject the bid of ATS (American Tool Service) Construction due to said company not making a notation of its contractor’s license number on the outside of the bid.
Mr. McMurry suggested that the bid be opened and read into the record but held in abeyance until a determination could be made as to whether it complied with law and that if it did not, it would be summarily rejected. He stated that the staff would report back to the Police Jury on this matter at its next meeting.
Mr. Andrepont withdrew his motion, and Mrs. Griffin withdrew her second.
Mr. McMurry then proceeded to open the following bids:

There being no other bids, motion was made by Mr. Andrepont, seconded by Mr. Collins and carried unanimously that the bids be referred to the Parish Engineer for final tabulation with further action to be taken by the Police Jury at its Regular Meeting on June 7, 2007.
President Landry advised that Dr. Mackey had asked him to take care of the next item of business on his behalf, since he was unable to attend the meeting on this date, and President Landry asked Mr. Guidry to join him at the podium to present a trophy and certificates to the St. Louis Catholic High School Girls Tennis Team who recently won their third consecutive Class 3A State Championship.
President Landry read aloud and presented the following proclamation to Mrs. Nomica Guillory and Ms. Kim Hornsby of the Southwest Louisiana Area Health Education Center (AHEC), for which they expressed their appreciation:
PROCLAMATION
WHEREAS, the Southwest Louisiana Area Health Education Center (AHEC) directs the AmeriCorps Health Corps with 108 members assigned to improving health and human services in the southwestern region of Louisiana; and
WHEREAS, the AHEC AmeriCorps members provide more than 170,000 direct service hours annually to communities and citizens throughout Southwest Louisiana; and
WHEREAS, the AmeriCorps program, since its inception in 1994, has proven to be an effective way to engage Americans in meeting a wide range of local needs and promote the ethic of service and volunteering, with a total of 500,000 citizens across the nation having taken the AmeriCorps Pledge to “get things done for America” by becoming AmeriCorps members; and
WHEREAS, those same individuals have served a total of more than 637 million hours nationwide, helping to improve the lives of our community’s most vulnerable citizens, protecting our environment, contributing to our public safety, and strengthening our educational system, and in return for their service, have earned nearly $1.2 billion to use to further their own educational advancement at colleges and universities; and
WHEREAS, AmeriCorps members, after their terms of service end, remain engaged in our communities as volunteers, teachers, and nonprofit professionals in disproportionately high levels; and
WHEREAS, the inaugural national AmeriCorps Week, May 13-20, 2007, is an opportune time for the people of Calcasieu Parish to salute AmeriCorps members and alumni for their powerful impact, to thank all of AmeriCorps’ community partners in Calcasieu Parish and throughout our region/state, and to bring more Americans into service.
NOW, THEREFORE,
I, Chris E. Landry, President of the Calcasieu Parish Police Jury, do hereby proclaim the week of May 13 - 20, 2007, as
National AmeriCorps Week
throughout Calcasieu Parish, and in so doing, urge all citizens to join in a national effort to salute AmeriCorps members and alumni and raise awareness about the importance of national and community service.

With regard to the foregoing, Mr. McMillin advised that he had the opportunity to speak to some of the AmeriCorps volunteers during the recent alternative spring break, and he thanked the local AmeriCorps office for making them feel so welcome and for all of their efforts.
President Landry read aloud and presented the following proclamation to Mr. Karl Corbello, Key Accounts Manager, and Ms. Marlene C. Hobbs, Anniversary Event Coordinator, both of Lake Charles Coca-Cola:

WHEREAS, Lake Charles Coca-Cola is celebrating their 100th Anniversary, having been established in Lake Charles in April, 1907; and
WHEREAS, Lake Charles Coca-Cola generates 55-60 million dollars annually to the economic impact in the community; and
WHEREAS, Lake Charles Coca-Cola remains one of the largest contributors to area charitable organizations; and
WHEREAS, Lake Charles Coca-Cola’s employees have served their community in many civic and charitable organizations and clubs; and
WHEREAS, Lake Charles Coca-Cola has contributed to area educational programs and institutions; and
WHEREAS, Lake Charles Coca-Cola remains a large contributor to area youth programs in the area.

Mr. Corbello and Ms. Hobbs expressed their appreciation for the proclamation and for the support of the local community during the past 100 years. Mr. Corbello advised that the company would be having “Coca-Cola Community Days” during the month of June and would be traveling the different communities giving out free Coca-Cola.
President Landry advised that a report would be received at this time from staff regarding the current status of the operations of Gravity Drainage District No. Eight of Ward One.
Mr. McMurry stated that a request had been received from Mr. George Wilkinson, President of the Board of Commissioners of the drainage district, asking that the Parish Division of Engineering and Public Works perform a lateral survey and engineering study of Laterals 1-B and 3-B which the staff was willing and able to do. He further stated that there were some rights-of-way which were very necessary for proper drainage, but the property owner did not want to sign that over without a study being performed showing the right-of-way was necessary.
Motion was made by Mr. Manuel, seconded by Mr. Collins and carried unanimously that the Division of Engineering and Public Works be authorized to conduct a lateral survey and engineering study of Laterals 1-B and 3-B in Ward One.
Mr. Manuel stated that one problem was with Little Indian Bayou and that Engineering had found three obstructions which he felt he could get FEMA to take out. Mr. Manuel pointed out that Little Indian Bayou drained a big part of Moss Bluff and a large portion of Beauregard Parish. He further stated that the legislators had asked him to file for emergency funding in the amount of $50,000 to help dredge the Bayou, which he had done, and he anticipated receiving the funding in 2007. Mr. Manuel also stated that he had applied for $400,000 in State Capital Outlay Funding for next year. He noted that the District was doing the best it could with the money and manpower available.
Motion was made by Mr. Manuel and seconded by Mr. Collins that in accordance with the request of the Board of Commissioners of Gravity Drainage District No. Eight of Ward One, that a resolution be adopted authorizing the Parish Division of Engineering and Public Works to take over the day-to-day operations of said District on a temporary basis, with a formal letter of request from the Board to be delivered to Mr. McMurry on the following date (May 18, 2007).
Mr. Clement asked what was meant by “temporary,” and Mr. Manuel responded that the District had only four employees and needed expertise to restructure its operation.
Mr. Clement stated that each district had a tax and asked if the District would reimburse the Parish for manpower. Mr. McMurry explained that the District’s Supervisor was currently on extended leave, and the request was primarily for supervisory help, not to move employees and equipment up to Ward One, and it was his impression that reimbursement would not be needed for supervisory time. Mr. McMurry further explained that “temporary” could mean up to two months and that if the Police Jury would like a report in a couple of months on the status of this endeavor, the staff could provide that. He stated that what he thought the Board was looking for was some managerial expertise that would help bring structure and organization to the workforce in place, and this was currently being done when necessary throughout the Parish when other districts or entities asked for assistance.
Mr. Clement stated that prior to Mr. McMurry’s explanation, he was worried about the impact on the Public Works budget if a lot of equipment and manpower were taken off of normal duties to work for the drainage district, but following the explanation, he was 100% in support of the proposal.
Mr. Danahay asked if this would require a Joint Services Agreement between the Police Jury and the District, to which Mr. McMurry stated that would probably be best.
Mr. Manuel amended his motion to include a Joint Services Agreement between the Police Jury and the District, and Mr. Collins (who seconded the motion) accepted said amendment.
In answer to a question by Mr. Andrepont, Mr. McMurry stated that the Board would not be suspended, and it would still meet and keep minutes, and further, the Parish’s supervisory employees assigned to this project would work with said Board.
A vote taken on the motion as amended carried unanimously, said motion being that in accordance with the request of the Board of Commissioners of Gravity Drainage District No. Eight of Ward One, that a resolution be adopted authorizing the Parish Division of Engineering and Public Works to take over the day-to-day operations of said District on a temporary basis, with a formal letter of request from the Board to be delivered to Mr. McMurry on the following date (May 18, 2007), and with the provisions of this proposal to be included in a Joint Services Agreement between the Police Jury and the District.
RESOLUTION
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in Regular Session convened on the 17th day of May, 2007, that it does hereby authorize a Joint Services Agreement between the Police Jury and Gravity Drainage District No. Eight of Ward One (the District) whereby the Calcasieu Parish Police Jury’s Division of Engineering and Public Works will temporarily assume the day-to-day operation of the District, and more particularly, will provide a review, assessment and immediate corrective action when necessary of the current operation of the District based on the policies and procedures presently being utilized by the Division of Engineering and Public Works relative to, but not limited to, maintenance operations, accounting methods, personnel, inventory control, employee performance standards and accountability, work order priority system, and right-of-way acquisition.
BE IT FURTHER RESOLVED that the President of the Police Jury, or his designee when appropriate, is hereby authorized to execute all documents related thereto.

It was moved by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously to approve the minutes of the Regular Meeting of the Police Jury dated April 19, 2007.
President Landry advised that action was needed on a revision to RZ04-005-07 which was a request by John C. Trouth to amend Ordinance No. 5266 Stipulation No. 2 to read that a six-foot wood privacy fence be installed around the east and west property lines on Susan Street in Ward Four, Police Jury District 15 (Mr. Danahay’s district). He further advised that the Planning and Zoning Board had met on Tuesday, May 15, 2007, and voted unanimously to recommend that the request be granted. [On April 19, 2007, the Police Jury granted a request by the petitioner to rezone from R-2 (Mixed Residential) to I-1 (Light Industrial) to allow employee parking and laydown yard, and the petitioner wanted to revised Stipulation No. 2 which required that a landscaping plan must be submitted and approved by the Division of Planning and Development for the east and west property lines.]

President Landry advised that action was needed on a reversion of RZ02-045-97 which was a request by Aaron Natali to rescind Ordinance No. 3928 and revert to C-2 (General Commercial) to allow commercial development (monogram shop and hair salon) at 5611 Highway 14 East in Ward Two, Police Jury District 10 (Mr. Stelly’s district). He further advised that the Planning and Zoning Board had met on Tuesday, May 15, 2007, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; and (2) that the development be limited to monogram shop and hair salon uses only. [On October 16, 1997, the Police Jury granted a request to allow the petitioners to rezone the property from C-2 (General Commercial) to R-2 (Mixed Residential) to allow a manufactured home for rental purposes.]
Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Stelly and carried unanimously, the recommendation of the Planning and Zoning Board was upheld with respect to a reversion of RZ02-045-97, and the request for the reversion was granted with the stipulations outlined by said Board; whereupon, the following ordinance was adopted:

President Landry advised that action was needed on a revision to RZ03-002-07 which was a request by John K. Broussard to amend Ordinance No. 5253 Stipulation No. 4 to read that the west side of the building(s) must have a vinyl facade upon completion of each building located at 6515 Lake Street in Ward Three, Police Jury District 7 (President Landry’s district). He further advised that the Planning and Zoning Board had met on Tuesday, May 15, 2007, and voted unanimously to recommend that the request be granted. [On March 22, 2007, the Police Jury granted the petitioner’s request to rezone from A-1 (Agricultural) to C-2 (General Commercial) to allow a recreational vehicle and boat storage facility, and the petitioner was requesting to amend the stipulation to allow a vinyl facade in place of the brick facade.]
Motion was made by Mr. Moon and seconded by Mrs. Griffin that the recommendation of the Planning and Zoning Board be upheld with respect to a revision to RZ03-002-07 and that the request to revise Stipulation No. 4 be granted.
In answer to a question by President Landry, Mr. Vickers advised that the petitioner was going to do some landscaping and fencing and that this work would need to be inspected by the Division of Planning and Development before the petitioner would be permitted to construct the other two buildings.
A vote was taken on the motion on the floor, and said motion carried unanimously; whereupon, the following ordinance was adopted:

BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in Regular Session on the 17th day of May, 2007, that Ordinance No. 5253, adopted by the Police Jury on March 22, 2007, (Zoning Case RZ03-002-07), Stipulation No. 4 is hereby amended to read in its entirety as follows: that the west side of the building(s) must have a vinyl facade upon completion of each building, on the following property:

President Landry advised that action was needed on RZ03-011-07 which was a request by Multi Task to rezone from I-1 (Light Industrial) to R-MHP (Manufactured Home Park) to allow a recreational vehicle park (60 spaces) on Highway 90 East in Ward Three, Police Jury District 2 (Mr. Collins’ district). He further advised that the Planning and Zoning Board had met on Tuesday, May 15, 2007, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; and (2) that a 15' natural buffer must remain along all property lines.
Upon motion made by Mr. Collins, which was duly seconded by Mrs. Griffin and carried unanimously, the recommendation of the Planning and Zoning Board was upheld with respect to RZ03-011-07, and the request to rezone was granted with the stipulations outlined by said Board; whereupon, the following ordinance was adopted:

President Landry advised that action was needed on RZ04-009-07 which was a request by Carl Hardy to rezone from R-1 (Single Family Residential) to I-1 (Light Industrial) to allow light industrial development (electrical contractor shop) at Highway 108 and Ridgecrest Street in Ward Four, Police Jury District 15 (Mr. Danahay’s district). He further advised that the Planning and Zoning Board had met on Tuesday, May 15, 2007, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that a 6' wood privacy fence must be installed along the North property line within 30 days of zoning approval; and (3) that a landscaping plan must be submitted and approved by the Division of Planning and Development, and the landscaping must be installed upon completion of the building.
Motion was made by Mr. Guillory and seconded by Mr. Manuel that the recommendation of the Planning and Zoning Board be upheld with respect to RZ04-009-07 and that the request to rezone be granted with the stipulations outlined by said Board.
Mr. Clement asked if the business was going to be selling electrical equipment or manufacturing same, to which Mr. Carl Hardy (the petitioner), 4114 Maplewood Drive, Sulphur, responded that it would be a repair shop for some of the local plants and would employ five or six people. In further answer to Mr. Clement’s questions, Mr. Hardy stated that it would not be a 24-hour operation and would not pose a noise issue. He further stated that there would be a driveway on Ridgecrest for light-duty trucks only, and the main entrance would be on Highway 108.
A vote taken on the motion on the floor carried unanimously; whereupon, the following ordinance was adopted:

President Landry advised that action was needed on SV07-001-07 which was a request by Phillip Wilton Parker for a subdivision variance to allow residential development without public road frontage on Secretariat Drive in Ward Seven, Police Jury District 12 (Mr. Clement’s district). He further advised that the Planning and Zoning Board met on Tuesday, May 15, 2007, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that a permit must be obtained within five days of zoning approval; and (3) that the manufactured home must be removed upon completion of the house.
Motion was made by Mr. Andrepont and seconded by Mrs. Griffin that the recommendation of the Planning and Zoning Board be upheld with respect to SV07-001-07 and that the request for a subdivision variance be granted.
Mr. Allen Smith, General Counsel, reminded the jurors that this was one of several variances that had been acted upon by the Police Jury for this particular road, and Mr. Parker had signed an affidavit acknowledging that he would not look to the Parish for help in hardsurfacing Secretariat Drive, nor would he further re-subdivide his property, said affidavit having been filed in the Clerk of Court’s office and becoming part of the deed to the property.
A vote taken on the motion on the floor carried unanimously.
Upon motion made by Mr. Collins, which was duly seconded by Mrs. Griffin and carried unanimously, action was deferred for thirty days on rescinding Ordinance No. 4288, Zoning Case RZ03-024-01, which was a request by Jewery B. Webb to rezone the property from C-2 (General Commercial) to I-2 (Heavy Industrial), due to cease of business at 101 Carpenter Lane in Ward Three, Police Jury District 2 (Mr. Collins’ district). [On July 19, 2001, the Police Jury approved a request from Jewery B. Webb to rezone from C-2 (General Commercial) to I-2 (Heavy Industrial) to allow a salvage yard, with the stipulation that should the business cease, the I-2 (Heavy Industrial) zoning classification would be non-transferrable, and the property would automatically revert to R-2 (Mixed Residential).]
