            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, February 15, 2007, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chris E. Landry, President, presiding, and the following members present:

 

Mesdames Elizabeth Conway Griffin and Sandra J. “Sandy” Treme; and Messrs. Francis Andrepont, Guy Brame, Brent Clement, Calvin Collins, Michael E. Danahay, Kevin Guidry, Tony Guillory, Charles S. Mackey, D.D.S., Don Manuel, Cornelius “Cornie” Moon, and Tony Stelly

            President Landry called the meeting to order. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance led by Mr. Collins. The roll was called with the result being as outlined above.


            President Landry welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.


            President Landry advised that bids would be received and opened at this time for an oil, gas and mineral lease on certain tracts of land (17.94 acres, more or less) in the West Half (W/2) of Section 16 and the Northwest Quarter of the Northeast Quarter (NW/4 of NE/4) of Section 21, Township 10 South, Range 10 West, Calcasieu Parish, Louisiana, in Ward Four (Police Jury District 12), and appropriate action would be taken thereon.


            Mr. McMurry then proceeded to open the only bid received, of Duncan Oil Partners, the details of which are outlined in the following resolution which was adopted upon motion made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously:

            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in Regular Session on the 15th day of February, 2007, that it does hereby accept the bid of Duncan Oil Partners for a mineral lease on the following described property, to-wit:

for a three-year lease with a cash bonus of Four Thousand Five Hundred Thirty Eight and 82/100 Dollars ($4,538.82) and an annual rental of Four Thousand Five Hundred Thirty Eight and 82/100 Dollars ($4,538.82) and with the Calcasieu Parish Police Jury to receive twenty two and one-half percent (22.5%) of all oil produced and saved, twenty two and one-half percent (22.5%) of all sulphur produced and saved, and twenty two and one-half percent (22.5%) of all other liquid or gaseous hydrocarbon minerals produced and saved.

            Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Moon and carried unanimously, the minutes of the Regular Meeting of the Police Jury dated January 18, 2007, were approved, and the reading of same was dispensed with.


            President Landry advised that action was needed on Zoning Case RZ06-042-03 which was a request by Dalton Wilkins to rescind Ordinance No. 4621 and revert the property to A-1 (Agricultural) due to cease of business at 844 G. Cooley Road in Ward Six, Police Jury District 11 (Mrs. Treme’s district). President Landry advised that the Planning and Zoning Board had met on Tuesday, February 13, 2007, and voted unanimously to recommend that the request be granted. It was noted that on September 18, 2003, the Police Jury had approved a request from Dalton Wilkins to rezone from A-1 (Agricultural) to I-1 (Light Industrial) to allow manufacturing of pallets.


            It was moved by Mrs. Treme, seconded by Mr. Manuel and carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to RZ06-042-03 and to grant the request to rezone; whereupon, the following ordinance was adopted:


ORDINANCE NO. 5231

 

AN ORDINANCE repealing Ordinance No. 4621, adopted by the Police Jury on September 18, 2003, which rezoned the following property in Ward Six, in Zoning Case RZ06-042-03 from A-1 (Agricultural) to I-1 (Light Industrial), since the business located on this property has ceased operation on the property described as: The West 275 feet of the following property - The N/2 of the SW/4 of the SE/4 of the NE/4 of S11, T8S, R10W.

 

            BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in Regular Session on the 15th day of February, 2007, that Ordinance No. 4621, adopted by the Police Jury on September 18, 2003, is hereby repealed and declared to be null and void and of no effect.

            President Landry advised that action was needed on Road Abandonment Case RA02-001-07 which was a request by Joycelyn M. Spears to abandon a 16' alley between Bienville Street and Cadillac Street in Hayes in Ward Two, Police Jury District 10 (Mr. Stelly’s district). He further advised that the Planning and Zoning Board met on Tuesday, February 13, 2007, and voted 10 (for) to 1 (against) to recommend that the request be granted.


            Motion was made by Mr. Andrepont and seconded by Mr. Moon that the recommendation of the Planning and Zoning Board be upheld and that the request to abandon be granted. Mr. Stelly advised that he would like to defer action on this matter; whereupon, Mr. Andrepont withdrew his motion and Mr. Moon withdrew his second.


            It was then moved by Mr. Stelly, seconded by Mr. Clement and carried unanimously to defer action on RA02-001-07 for thirty days.


            Upon motion made by Mrs. Treme, which was duly seconded by Mr. Moon and carried unanimously, the following ordinance was adopted:


ORDINANCE NO. 5232

 

AN ORDINANCE rescinding Ordinance No. 5137, adopted by the Police Jury on September 7, 2006, which ordered demolition of one house located at 1027 Bill Phillips Road (Com SE Cor NE SE SE 12.7.11, W 700 Ft, N 100 Ft etc; Tax Assessment No. 00226882), DeQuincy area of Ward Six, Calcasieu Parish, Louisiana, and currently owned by Travis Maddox.


            BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in Regular Session on the 15th day of February, 2007, that it does hereby rescind Ordinance No. 5137, adopted by the Police Jury on September 7, 2006, which ordered demolition of one house located at 1027 Bill Phillips Road (Com SE Cor NE SE SE 12.7.11, W 700 Ft, N 100 Ft etc; Tax Assessment No. 00226882), DeQuincy area of Ward Six, Calcasieu Parish, Louisiana, and currently owned by Travis Maddox, due to the fact that said property was sold at an adjudicated property sale, the new owners want to repair the structure and bring it up to code, and further, the Parish Building Inspector has inspected the structure and determined that it is repairable.

            President Landry advised that a report would be received at this time from staff with reference to the Police Jury’s LPDES Phase II Storm Water Permit as it relates to the adoption of a new Small MS4 Storm Water Ordinance.


            Mr. Allen Wainwright, Public Works Engineer, gave a PowerPoint presentation wherein the following important dates and timeline were outlined: in 1972, the passage of the Clean Water Act, which was the basis of everything being discussed on this date, and formation of National Pollutant Discharge Elimination System (NPDES); in 1990, Phase I of the Stormwater Program was implemented targeting communities with greater than 100,000 population; in 1998, Phase II Small Municipal Separate Storm Systems was implemented which brought Calcasieu Parish and a number of its municipalities into play; in 1999, the EPA final rule on small municipal separate storm sewer systems (MS4s) was issued; in 2002, the Louisiana Department of Environmental Quality (DEQ) issued a Storm Water General Permit to Calcasieu Parish, Lake Charles, Sulphur, and Westlake, who would operate as co-permittees; and on December 5, 2007, the five-year permit was due for renewal.


            Mr. Wainwright stated that the general requirements for the 2002 permit included a stipulation that within five years of the initial permit date, the co-permittees shall develop, implement and enforce a storm water management program designed to reduce the discharge of pollutants from the Small MS4 to the maximum extent practicable (MEP) to protect water quality. Mr. Wainwright explained that the MS4 was a municipal separate storm sewer system which included a system of piping, storm drains, and curb drains within cities, as well as open drainage ditches and canals in outlying areas of the Parish that emptied into the Calcasieu River which would include all components of the storm water conveyance system.


            Mr. Wainwright advised that the Parish and its co-permittees submitted a Storm Water Management Plan in March of 2003 to the DEQ, outlining the implementation schedule (timeline) that would be followed to remain in compliance with the Storm Water Permit. He further advised that the plan was developed in accordance with EPA guidelines that required six minimum control measures, as follows: (1) public education/outreach, (2) public involvement/participation, (3) illicit discharge detection and elimination, (4) construction site runoff control, (5) post-construction site runoff management, and (6) pollution prevention/good housekeeping. Mr. Wainwright stated that Ms. Barbara Monroe of the Public Works Department was developing a public education/outreach program, inspecting the Parish’s sites for good housekeeping measures, and implementing public involvement/participation, but that items numbered (3), (4), and (5) above would need action by the Police Jury in the form of an ordinance, because these involved construction sites, etc.


            Mr. Wainwright stated that examples of categories of illicit discharges included illicit dumping into storm drain inlets, sediment runoff from roadways, overuse of pesticides, trash and litter, pavement cleaning, and pet waste, and what was needed was development of a plan to control illicit discharges, implement public education and awareness, and enforce the plan through the proposed storm water ordinance.


            Mr. Wainwright also gave examples of construction site discharges such as sediment, solid and sanitary wastes, nutrients, pesticides, oil and grease, construction debris and chemicals, and concrete truck washout, and he pointed out that input would be solicited from developers, contractors, and architects with respect to proper discharge of these wastes. Mr. Wainwright stated that the recommended Best Management Practices (BMP) for construction sites were to minimize disturbance, preserve natural vegetation, good housekeeping, erosion controls, and sediment controls. He further stated that permit requirements included a regulatory mechanism, site plan review, inspections and penalties, encouragement of BMP, and enforcement escalation. Mr. Wainwright explained that the ordinance would provide authority for enforcement, with penalties if necessary, and he encouraged the jurors to give him their suggestions for changes or revisions to the draft of the ordinance.


            Mr. Wainwright reported that with regard to post-construction site runoff management, forms of substantial impact included an increase in type and quantity of pollutants picked up and carried off-site by storm water, as well as increased impervious surfaces which interrupted the natural cycle of gradual percolation of water through vegetation and soil. He gave examples of post-construction controls such as bioretention areas in parking lots, infiltration basins, constructed wetlands, pervious parking lots, and swales, and stated further that permit requirements included a regulatory mechanism, the development of strategies that included structural and non-structural BMP, a site plan review, inspections and penalties, and enforcement escalation.


            With regard to the proposed storm water ordinance, Mr. Wainwright explained that this was required for compliance with the MS4 Storm Water Permit, it would serve as a legal mechanism for enforcement, and it would address illicit discharges, as well as construction and post-construction site MCMs. Mr. Wainwright pointed out that it had become the Parish’s job to go out and inspect and enforce these sites and that DEQ could inspect construction sites and fine both the owner/operator and the MS4 for non-compliance with respective permits. Mr. Wainwright stated that civil penalties ranged from cost of cleanup to penalties of up to $1 million for wilful discharge or disposal that caused irreparable or severe damage to the environment or endangerment of human life or health and further, that criminal penalties varied depending on the violation, whether it was a first or second offense, etc., and he gave a breakdown of those penalties.


            Mr. Wainwright advised that input would be solicited from developers, architects, contractors, police jurors, etc. until March 1st, on which date the draft ordinance would be placed on the Public Works Committee agenda for a recommendation of approval, with formal action by the full Jury scheduled for the Regular Meeting on March 8th, following which the approved ordinance would be submitted to the DEQ on March 10th as part of the required annual report.


            In answer to a question by Mr. Clement, Mr. Wainwright stated that all farming operations were exempt from the storm water management regulations.


            President Landry announced that the time was 6:02 p.m., and a public hearing had been scheduled and advertised for 6:00 but that the discussion underway would be completed prior to the hearing.


            Mr. Smart pointed out that contractors should have been following the requirements for four or five years since the time they had become law and that Baton Rouge, Shreveport and New Orleans had been working under these provisions for the last 25 years. Mr. Smart also stated that the Parish might have some discretion when it came to enforcement, and he felt that a good educational program would take care of a lot of issues and concerns and would be key to successful development of the program.


            Following a brief discussion, motion was made by Mrs. Griffin, seconded by Mr. Brame and carried unanimously that the report as presented by staff be accepted.


            President Landry advised that 6:00 action would be taken up at this time which was to hold a public hearing, as a result of notice provided to the owner of properties described below, in accordance with Article II-Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, ordering said owners to show cause as to why the structures on said properties should not be condemned:

AGENDA NOTE: a public hearing was held on September 7, 2006, and the Police Jury deferred action on the proposed condemnation for 60 days, and in November, 2006, the Planning Staff administratively gave another 30 days, at the request of Mr. Clement.             With regard to the eighth structure located at 1205 North Perkins Ferry Road in the Moss Bluff area, Mr. Robinson advised that no action was necessary, since the structure had already been removed.


            With regard to the ninth structure located at 8700 Roy Road in the south Lake Charles area, Mr. Robinson recommended that the house be condemned and removed within thirty days.


            Mr. Andrepont stated that it was his understanding that this was one of the hurricane-damaged dwellings for which FEMA assistance had been applied to demolish it, but no assistance had been forthcoming. Mr. Andrepont also stated that the Police Jury had voted to act on each of these on a case-by-case basis, and he felt this was one of the structures for which the Police Jury should provide assistance to the property owners, since were financially unable to demolish it themselves.


            President Landry agreed, pointing out that he had worked with the owners of this house for the past few months, and this was a case that had fallen through the cracks where they needed financial assistance.


            Motion was made by Mr. Andrepont and seconded by Mr. Moon that the house located at 8700 Roy Road in the south Lake Charles area be demolished at the Parish’s expense.


            President Landry advised that Mr. Vickers had suggested that the property owners apply to the Road Home Program for assistance and if that was forthcoming, that they be required to reimburse the Police Jury for the cost of demolition.


            Mr. Andrepont amended his motion, and Mr. Moon agreed to the amendment, to stipulate that if the property owners were successful in their application for assistance from the Road Home Program, that the Police Jury would be reimbursed for the cost of demolition.


            A vote taken on the motion as amended carried unanimously.


            With regard to the tenth item related to structures located at 1509 San Ann Drive in the Sulphur area, Mr. Robinson recommended that the three manufactured homes and one accessory structure be condemned and demolished within thirty days.


            President Landry asked if there was anyone present in the audience who wished to comment on the proposed condemnation of these structures, and hearing no comments, it was moved by Mr. Collins, seconded by Mrs. Griffin and carried unanimously to accept the staff’s recommendation and to adopt the following ordinance:

He further stated that he just wanted to make sure they had at least thirty days to finish.


            Mr. Andrepont advised that if they made a good effort but found out that thirty days was not sufficient, the Police Jury would consider giving him additional time.


            Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Manuel and carried unanimously, the staff’s recommendation was accepted, and the following resolution was adopted:

            SECTION 2.   If the house on the premises hereinabove described in the Parish of Calcasieu, Louisiana, is not demolished and removed within thirty (30) days from the date of this order, notice is hereby given that the Director of Parish Planning and Development shall have work commenced on the demolition and removal of said house, in which case the Police Jury shall not be liable for damages and shall have a lien and privilege against the property upon which the house was situated for the cost of demolishing and removing said house, and for the cost of maintaining the property.


            SECTION 3.   The Director of Parish Planning and Development is hereby authorized and directed to give notice of said demolition and removal as required by law.


            SECTION 4.   The Director of Parish Planning and Development is hereby authorized to enter into a contract to accomplish the demolition of the house, if necessary, and to pay the fees of the contractor from appropriate Parish funds, and to pay any and all costs associated with the demolition. Any amounts expended by the Parish of Calcasieu shall be included in the statement of costs in accordance with Chapter 6 of the Code of Ordinances of Calcasieu Parish, Louisiana, and the Parish of Calcasieu shall have a lien and privilege for all costs resulting from the demolition.


            SECTION 5.   This ordinance shall become effective immediately.

            With regard to the thirteenth structure located at 3916 Wildflower Drive in the Carlyss area, Mr. Robinson recommended that the manufactured home be condemned and removed within thirty days. President Landry asked if there was anyone present in the audience who wished to comment on the proposed condemnation of this structure, and hearing no comments, it was moved by Mr. Andrepont, seconded by Mr. Clement and carried unanimously to accept the staff’s recommendation and to adopt the following ordinance:

AN ORDINANCE ordering condemnation and demolition of one manufactured home on property located at 3916 Wildflower Drive (Lot 26, Rosemont Subdivision No. 3); Tax Assessment Nos. 01346210 and 01359935, Carlyss area of Ward Four, Calcasieu Parish, Louisiana, and currently owned by Floyd Phillip LeBlanc, Jr.


            BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in Regular Session on the 15th day of February, 2007, that:


            SECTION 1.   The facts as set forth at the meeting of the Police Jury of Calcasieu Parish, Louisiana, on this date, justify an order of this Police Jury, and it is hereby ordered that the manufactured home on property located at 3916 Wildflower Drive (Lot 26, Rosemont Subdivision No. 3); Tax Assessment Nos. 01346210 and 01359935, Carlyss area of Ward Four, Calcasieu Parish, Louisiana, and currently owned by Floyd Phillip LeBlanc, Jr., be demolished and removed within thirty (30) days from the date of this ordinance. This order requires that all development permits be secured for demolition and all debris be removed from the premises. This order is made this 15th day of February, 2007, and is final unless appealed within five (5) days.

            Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Guidry and carried unanimously, the following resolution was adopted:


RESOLUTION


            WHEREAS, at the current time, there is only one contractor (Waste Management) under contract with the Police Jury to provide solid waste collection in the unincorporated areas within the Parish; and


            WHEREAS, the possibility exists for additional solid waste collection contractors to execute a contract with the Police Jury to serve the Ward One area of the Parish; and


            WHEREAS, the “Solid Waste Management Manual”, which is incorporated as a part of any solid waste collection contract, currently includes some provisions that are not applicable parishwide.


            NOW, THEREFORE,


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in Regular Session on the 15th day of February, 2007, that it does hereby approve specific revisions to the “Solid Waste Management Manual” to remove those particular provisions that do not apply parishwide.

            Motion was made by Mr. Brame, seconded by Mr. Andrepont and carried unanimously that the following resolution be adopted:

            WHEREAS, the Louisiana Department of Transportation and Development has received bids for State Project No. 744-10-0018: Federal Aid No. ENH-1003(531) (Park Road Sidewalk approximately 1300" north of Recreation Boulevard and ending at Pine Cone Drive in Ward One of Calcasieu Parish); and


            WHEREAS, the Louisiana Department of Transportation and Development has requested approval of the Calcasieu Parish Police Jury of the low bid in the amount of $324,517.60 of F. Miller Construction, LLC.


            NOW THEREFORE, BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in Regular Session convened on the 15th day of February, 2007, that it does hereby accept the low bid in the amount of $324,517.60 of F. Miller Construction, LLC, for State Project No. 744-10-0018: Federal Aid No. ENH-1003(531) (Park Road Sidewalk approximately 1300' north of Recreation Boulevard and ending at Pine Cone Drive in Ward One of Calcasieu Parish).

            

        BE IT FURTHER AND FINALLY RESOLVED that the President of the Police Jury, or his designee, when appropriate, is authorized to execute all documents related thereto.

            With regard to the foregoing, Mr. Manuel stated that this project had been in the works for approximately three and one-half years and was very important to the jurors who represented Ward One (Mr. Manuel, Mr. Collins, and Mrs. Treme). Mr. Manuel explained that the proposed sidewalk would extend from the Moss Bluff Middle School to Pinecone Road which would make it safer for the many children who rode bicycles or walked along that section of Park Road to and from school. Mr. Manuel thanked the Engineering Department for their assistance in this project, as well as the residents on Park Road who had given right-of-way for the project.


            It was moved by Mrs. Griffin, seconded by Mr. Brame and carried unanimously to adopt the following resolution:


RESOLUTION


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in Regular Session convened on the 15th day of February, 2007, that it does hereby authorize the Director of the Office of Juvenile Justice Services to negotiate the terms and conditions for the renewal of a contract between the Police Jury and the Educational and Treatment Council, Inc. (ETC) for an amount up to $26,665 for the provision of child abuse counseling services to juveniles who are victims of crime.


        BE IT FURTHER RESOLVED that should additional funds become available, the contract can be amended to increase this amount.


            BE IT FURTHER AND FINALLY RESOLVED that the President of the Police Jury, or his designee, when appropriate, is authorized to execute all documents related thereto.

            Upon motion made by Mr. Brame, which was duly seconded by Mrs. Griffin and carried unanimously, the Parish Administrator was authorized to execute agreements for renewal of leases with Southwest Louisiana Legal Services, and Sylvia C. Pastrano, Inc., tenants and users of the Magnolia Building, in accordance with parameters established by the Police Jury Liaison Group for such purpose.


            Motion was made by Mr. Clement, seconded by Mr. Collins and carried unanimously that the following resolution be adopted:

            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in Regular Session convened on the 15th day of February, 2007, that it does hereby approve an Amendment to the Lease Agreement with the Southwest Louisiana Partnership for Economic Development to modify the space leased within the Magnolia Building, and approving the renewal of the lease for a one-year term beginning March 1, 2007, for the Business Incubator of Southwest Louisiana.

            With reference to the foregoing, Mr. Clement explained that the Business Incubator worked with small businesses just starting up by providing business space to develop and assistance from McNeese State University with such things as accounting and developing a business plan. He pointed out that there had been several success stories of businesses that had graduated from the Incubator and gone out into the open market and that the program had been so successful, there were more applications to participate than there were spaces to accommodate them.


            It was moved by Mr. Andrepont, seconded by Mr. Moon and carried unanimously to adopt the following resolution:


RESOLUTION


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in Regular Session convened on the 15th day of February, 2007, that it does hereby authorize the Housing Department to submit its Streamlined Annual Plan for Fiscal Year 2007.

            With regard to the above resolution, Mrs. Griffin asked what could be done to assist individuals with special needs who needed housing but did not want and/or need to be in a nursing home. Mr. Tarek Polite, Office of Federal Programs, stated that there were some HUD housing programs the Parish could apply for, pointing out that he was still awaiting word on an application he had filed October 6, 2006, and would hopefully receive an answer in the next few weeks. He further stated that if the Parish was successful in obtaining this grant, it would have seven Shelter Plus vouchers for persons with special needs.


            In answer to questions by Mrs. Griffin and Mr. Guidry concerning requirements and criteria for participation in the program, Mr. Polite stated that he would be happy to do some research and get back with them with answers to their questions.


            Upon motion made by Mr. Brame, which was duly seconded by Mr. Danahay, the Re-Roofing of the Calcasieu Parish Health Unit Annex (Coroner’s Office) was accepted as substantially complete.


            Motion was made by Mrs. Treme and seconded by Mr. Manuel that the rules be suspended by a two-thirds majority vote to adopt a resolution of recognition to the West Calcasieu Parish Community Center Authority for its success in getting the Louisiana Rodeo Cowboys Association (LRCA) State Finals Rodeo at the West Calcasieu Arena on February 22 through 24, 2007.


            Mrs. Treme stated that this was the first time in a 40-year history of the LRCA that the finals had been staged anywhere in south Louisiana. She advised that she would be unable to attend, due to the upcoming annual conference of the Louisiana Police Jury Association (where she would be sworn in as Third Vice-President of the Executive Board of the Association), but she would ask Harper Morgan Rodeo to get someone from the area to present the resolution of recognition. Mrs. Treme stated that this was a great opportunity for economic development and tourism and that the rodeo had been held in Shreveport at the State Fair for many years and the last several in Monroe, but it had never been held south of Monroe.
