            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, February 1, 2007, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chris E. Landry, President, presiding, and the following members present:

            Also present were Mr. S. Mark McMurry, Parish Administrator; Mr. Bryan Beam, Assistant Parish Administrator; Mrs. Coleen Clark, Executive Secretary; Mrs. Cheryl Heisser, Director of Human Resources; Mr. Jerry Milner, Director of Finance; Mr. Claude Smart, Parish Engineer; Mr. Allen L. Smith, Jr., of the firm of Plauche, Smith and Nieset, General Counsel; Ms. Kathy P. Smith, Recording Secretary; Mr. Gerry Trahan, Director of Facilities Maintenance; and Mr. Jim Vickers, Director of Planning and Development.


            President Landry called the meeting to order. The invocation was pronounced by Pastor Freddie Brown of Mount Pilgrim Baptist Church which was followed by the Pledge of Allegiance led by Mr. Guillory. The roll was called with the result being as outlined above.


            President Landry welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.


            President Landry advised that a plaque had been received from the American Arbitration Association on January 30, 2007, in appreciation of the Police Jury having allowed said organization, on behalf of the Louisiana Department of Insurance, to temporarily use office space in the Calcasieu Parish Courthouse for the Department’s Hurricane Mediation Program for mediation/hearing sites. President Landry pointed out that the Police Jury was the fourth recipient of this award, previous awards having been given to former President Jimmy Carter, former Attorney General Janet Reno, etc.


            President Landry recognized Mayor Randy Roach as being present at the meeting on this date. Mayor Roach reported on, and invited participation in, an upcoming project being sponsored by a national non-profit organization called KABOOM which built playgrounds throughout the country, and the organization had made it available across the Gulf Coast region for those areas affected by Hurricanes Katrina and Rita. Mayor Roach further advised that this was a partnership with Home Depot which provided equipment, and the entity selected to participate provided volunteer labor. He stated that Lake Charles had been selected for a project at Lloyd Oaks Housing Development off of 18th Street on Dixie Drive, and February 19th would be a preparation day for volunteers, with the actual building day to be held February 22nd. Mayor Roach encouraged anyone who was interested in volunteering to do so.


            President Landry advised that a report would be received at this time from staff with reference to a review performed by Wilbur Smith Associates related to the feasibility of consolidating the facilities of Lake Charles Regional Airport and Chennault International Airport.


            Mr. McMurry presented copies of a report by Ms. Pamela Keidel-Adams, Vice-President of Wilbur Smith Associates, the firm which had taken the reports done by the airports to determine (1) if the issues cited in the reports were valid, and if so, (2) what the costs of consolidation were. Mr. McMurry stated that the report done by Wilbur Smith Associates indicated that the issues were valid and that the costs associated therewith were estimated by her firm to be approximately $115 - $125 million (Lake Charles Regional had estimated $200 million, and Chennault had estimated $100 million).


            Mr. McMurry stated that the report also indicated that consolidating the two airports was not financially feasible and cited a review of facilities across the United States where facilities were being replaced, not relocated. He pointed out that a board was in place to study the feasibility of developing an airport similar to Dallas/Fort Worth that would serve the New Orleans/Baton Rouge area, which would be big enough to attract flights like Houston or Atlanta might.


            Mr. McMurry drew attention to a paragraph in the report by Wilbur Smith Associates which stated that:

 

“It is important to note that changing the community’s location of where the commercial airline service is provided (at LCH or at CWF) would not alter the type of service provided to the community. The type and level of service provided in the Lake Charles/Calcasieu Parish region is based on the existing characteristics of the community including population, employment, the demand for scheduled airline service, and the region’s location relative to other commercial service airports. The airlines would not look at the Lake Charles/Calcasieu Parish region differently if service were provided at another location.”


            Mr. McMurry pointed out that in a lot of the discussions about consolidating the facilities, there had been a myth that consolidation would equate to obtaining another airline to service the area, however, the report indicated that this was not supported by evidence and that several comments had previously been made by different airlines to that effect.


            Mr. Manuel asked what the status of discussions was pertaining to consolidation of the boards, to which Mr. McMurry responded that at the Regular Meeting on December 21, it was agreed that a committee would be formed comprised of representatives of each airport authority, and key staff members, to develop a list of pros and cons which could be presented to the Police Jury to see if that was the avenue they wished to pursue. Mr. McMurry stated that perhaps Wilbur Smith and Associates could take a look at that list to compare it with what other airports are doing around the country.


            Mr. McMurry explained that letters had been sent on December 29, 2006, to the President of each board asking them to designate two of their members, and key staff, and responses had been received that Glen James, Jane Dufrene (board members) and Charles Harvey (staff) would represent Chennault, and Dr. John Moffett, Allen Smith (board members) and Heath Allen (staff) would represent Lake Charles Regional. Mr. McMurry further explained that over the next 60 to 90 days, the group would be meeting and developing a report which in addition to pros and cons of consolidating the boards, would also include whatever legal or legislative matters would be necessitated by consolidation, i.e., the Chennault board was a State-created board with representation from the City of Lake Charles, the Police Jury, the Calcasieu Parish School Board, etc.


            Mr. Moon stated that the concern of the traveling public was the number of airlines serving the area, not the governance of the boards, and he suggested that a quarterly report be given to the Police Jury so that the public could be kept informed. He asked about the status of general aviation at Lake Charles Regional, and Mr. Smith stated that general aviation was very important in supporting any facility and was part of a “three-legged stool.” Mr. Smith pointed out that there were several aircraft-related businesses at the airport and that getting an additional carrier was as much a financial decision as anything.


            Mr. Smith advised that the airport was currently negotiating with an airline to come into the area, hopefully in the second quarter of 2007. He stated that the proposal was for the airline to provide an airplane and two pilots, and the airport would provide all support services, i.e., ticket sales and baggage handling, etc. Mrs. Griffin asked that local companies and businesses be used as much as possible if the negotiations referred to by Mr. Smith came to fruition.


            Motion was made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously that the report as presented by staff on this date be received.

            Chairman Brame advised that the purpose of the meeting on this date was to review the proposed agenda for the Regular Meeting of the Police Jury to be held on February 1, 2007.


            Following review of the items to be considered by the Police Jury on February 1st, and after recommendations for appointments to various boards of special service districts were made by members of the Committee, it was unanimously recommended that the proposed agenda be accepted as presented by the staff.


            There being no further business, Chairman Brame declared the meeting to be adjourned.

            Said Committee:

 

1.         Received report from staff on status of completion of the Highway 108 at-grade railroad crossing wherein it was reported that the long-awaited completion of this project was in the final stages, and a ribbon-cutting ceremony was anticipated to be held in mid-March, 2007. The Committee recommended that family members of the late-Louis P. Beglis, former police juror credited for the initiation and coordination of the project, be invited to the ceremony, as well as former police juror Dale Bayard who also invested much time and effort on the project. 2.         Recommended that a resolution be adopted accepting Crown Point Phase I Subdivision located on Prewitt Road and Moore Road in Section 21, Township 8 South, Range 9 West, in Ward Six. (Police Jury District 11, Mrs. Treme)

 

3.         Recommended that a resolution be adopted accepting Orleans Run Subdivision located on Khamiel Drive in Section 25, Township 8 South, Range 9 West, in Ward One. (Police Jury District 1, Mr. Manuel)

 

NOTE: Orleans Run Subdivision was preliminarily approved by the Planning and Zoning Board as River Run Subdivision, and the developer chose to change the subdivision name.

 

4.         Recommended that a resolution be adopted proclaiming February 27, 2007, as “Spay Day USA 2007” throughout Calcasieu Parish, and further, authorizing the Department of Animal Services and Adoption Center to remove the cost for spays and neuters of all animals adopted from the Center for the week of February 26, 2007, through March 3, 2007, in honor of “Spay Day USA.” (Mr. Landry)

 

5.         Recommended that the Parish Administrator be authorized to advertise for bids for Calcasieu Parish Project No. 2007-02 (Overlaying of Various Roads), Calcasieu Parish Project No. 2007-03, (Hardsurfacing of Various Roads and Bridge/Realignment), Calcasieu Parish Project No. 2007-04 (Overlaying of Various Roads), Calcasieu Parish Project No. 2007-05 (Overlaying of Various Roads), Calcasieu Parish Project No. 2007-06 (Overlaying of Various Roads), and Calcasieu Parish Project No. 2007-07 (Overlaying and Safety Improvements of Various Roads).

 

6.         Recommended that the Parish Purchasing Agent be authorized to advertise for bids for a crematory for use by the Department of Animal Services and Adoption Center.

            As a result of approval of the foregoing report and all recommendations contained therein, the following resolutions were adopted:

            WHEREAS, John Moore, subdivided certain property in Ward Six of Calcasieu Parish, Louisiana, known as Crown Point Phase I Subdivision, a subdivision in Section 21, Township 8 South, Range 9 West, Calcasieu Parish, Louisiana; and


            WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana; and


            WHEREAS, said subdivision plat was prepared by Virgil T. Collins, P.L.S., Registered Land Surveyor No. 4390, and certification was made that the subdivision plat was prepared in accordance with R.S. 33:5051 and all other laws of the State of Louisiana; and


            WHEREAS, said subdivision plat will be filed for record in the Office of the Clerk of Court on February 2, 2007, and will bear File No. 2795527.

RESOLUTION


            WHEREAS, cats and dogs provide companionship to and share homes of over 63,000,000 individuals in the United States; and


            WHEREAS, two unaltered cats and their offspring can produce 420,000 more cats in seven years and two unaltered dogs and their offspring can produce 67,000 more dogs in six years; and


            WHEREAS, humane societies and shelters have to perform euthanasia on approximately 5,000,000 cats and dogs each year, although many of them are healthy and adoptable, simply because there are not enough good homes; and


            WHEREAS, the problem of companion animal overpopulation costs the taxpayers of this country over a billion dollars annually through animal control programs aimed at coping with the millions of unwanted cats and dogs; and


            WHEREAS, spaying and neutering cats and dogs has been shown to drastically reduce the cat and dog overpopulation; and


            WHEREAS, veterinarians, humane societies, national and local animal protection organizations, and private citizens have joined together again to advocate the spaying and neutering of companion animals on “Spay Day USA 2007".


        NOW, THEREFORE, BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, that February 27, 2007 is designated as “Spay Day USA” throughout Calcasieu Parish.


            BE IT FURTHER RESOLVED that the Calcasieu Parish Department of Animal Services and Adoption Center is authorized to remove the cost for spays and neuters of all animals adopted from the Center for the week of February 26, 2007 through March 3, 2007 in honor of “Spay Day USA”.


        BE IT FURTHER AND FINALLY RESOLVED that the Calcasieu Parish Police Jury does hereby call upon the people of Calcasieu Parish to observe the day by having their own cats or dogs spayed or neutered or by sponsoring the spaying or neutering of another person’s cat or dog.

            As a result of passage of the foregoing motion, the following ordinances were adopted:


ORDINANCE NO. 5220

 

AN ORDINANCE authorizing the Police Jury to declare the property described as: S 1/3 Lot 17, Blk N, D J Reid Sub, Plat 3; (AP03-362-07; Tax Assessment No. 591777); 200 Block of Jackson Street - vacant lot in Ward Three, Lake Charles, Louisiana, surplus property and to authorize the sale of said lot to Mr. Alvin James Pete, his designated agent, or assignee for the consideration of $700.00 (seven hundred dollars) cash, or to the highest offer or which is accompanied by a certified check or money order in the amount of $225.00 ($150 appraisal fee plus $75).

 

        WHEREAS, the Parish of Calcasieu owns property described as: S 1/3 Lot 17, Blk N, D J Reid Sub, Plat 3; (AP03-362-07; Tax Assessment No. 591777); 200 Block of Jackson Street - vacant lot in Ward Three, said property having been adjudicated to the Parish for unpaid property taxes; and


        WHEREAS, all Members of the Local Services Agreement have recommended that the property be declared surplus and no longer needed for public purposes; and


        WHEREAS, a request has been received by the Division of Planning & Development from Mr. Alvin James Pete, to purchase said property for the consideration of $700.00 (seven hundred dollars) cash, at the time of sale; and


        WHEREAS, no written opposition or higher offer has been filed with the Division of Planning & Development Office; and


        WHEREAS, the Calcasieu Parish Police Jury is of the opinion that this property is surplus and no longer needed for public purposes and that it would be in the public interest to convey the above mentioned property to Mr. Alvin James Pete, for the offered consideration.


        NOW, THEREFORE,


        BE IT ORDAINED BY THE POLICE JURY OF THE PARISH OF CALCASIEU, convened in Regular Session on the 1st day of February, 2007, that it does hereby approve the following criteria for the sale and disposition of adjudicated property:


        Section 1.       The property described as: S 1/3 Lot 17, Blk N, D J Reid Sub, Plat 3; (AP03-362-07; Tax Assessment No. 591777); 200 Block of Jackson Street - vacant lot in Ward Three, Lake Charles, Louisiana, is hereby declared to be surplus and no longer needed for public purpose.


            Section 2.       Ten days after the final adoption of this ordinance, if no restraining order has been obtained, the President or the Director of the Division of Planning & Development, is authorized to execute an act of cash sale in which the Parish of Calcasieu conveys the above described property to Mr. Alvin James Pete, his designated agent, or assignee for and in consideration of $700.00 (seven hundred dollars). However, neither the President, nor the Director of the Division of Planning & Development, shall execute the act of cash sale until the Adjudicated Property Section of the Division of Planning & Development has certified in writing the following:

 

            (1)        Purchaser has certified in writing to the Adjudicated Property Section of the Division of Planning & Development that the Adjudicated Property Section has been provided a Mortgage and Conveyance Certificate or an equivalent by an abstract company doing business in Calcasieu Parish certifying that an examination of the mortgage and conveyance records of the Clerk of Court of Calcasieu Parish was made to obtain the names and last known addresses of all owners, mortgagees, and other persons who might have vested or contingent interests in the property, or who have filed requests for notice as provided for in LSA-R.S. 47:2261, and a list of those names and addresses is attached to the certification. The written certification shall contain an indemnification and hold harmless clause by the purchaser in favor of the Parish of Calcasieu, its officers, agents and employees if the purchase should fail to request notification to an interested party or should incorrectly identify or locate any interested party.

 

            (2)       Purchaser has made written request to the Adjudicated Property Section of the Division of Planning & Development to notify those persons identified above in accordance with LSA-R.S. 33:4720.17 and LSA-R.S. 47:2261 and has paid the Parish the sum of five dollars per notice and/or the sum of thirty dollars per notice by publication requested.

 

            (3)       Upon written request from the Adjudicated Property Section of the Division of Planning and Development, the Purchaser shall remit 25% of the purchase price as earnest money to be held in escrow by the Calcasieu Parish Police Jury for application to the purchase price at closing, or to be retained by it in the event Purchaser fails to complete the purchase.

 

            (4)       The Adjudicated Property Section of the Division of Planning & Development has provided purchaser with proof of notice, and purchaser has recorded same in the conveyance records of Calcasieu Parish and has provided the Adjudicated Property Section of the Division of Planning & Development a stamped copy of the recorded proof of notice.

AN ORDINANCE authorizing the Police Jury to declare the property described as: Lot 8 Williams Sub of Blk 9; (AP03-367-07; Tax Assessment No. 553174); 813 Williams Street in Ward Three, Lake Charles, Louisiana, surplus property and to authorize the sale of said lot to Mr. Joseph Johnny Jones, his designated agent, or assignee for the consideration of $5,000.00 (five thousand dollars) cash, or to the highest offer or which is accompanied by a certified check or money order in the amount of $325.00 ($250 appraisal fee plus $75).


        WHEREAS, the Parish of Calcasieu owns property described as: Lot 8 Williams Sub of Blk 9; (AP03-367-07; Tax Assessment No. 553174); 813 Williams Street in Ward Three, said property having been adjudicated to the Parish for unpaid property taxes; and


        WHEREAS, all Members of the Local Services Agreement have recommended that the property be declared surplus and no longer needed for public purposes; and


        WHEREAS, a request has been received by the Division of Planning & Development from Mr. Joseph Johnny Jones, to purchase said property for the consideration of $5,000.00 (five thousand dollars) cash, at the time of sale; and


        WHEREAS, no written opposition or higher offer has been filed with the Division of Planning & Development Office; and


        WHEREAS, the Calcasieu Parish Police Jury is of the opinion that this property is surplus and no longer needed for public purposes and that it would be in the public interest to convey the above mentioned property to Mr. Joseph Johnny Jones, for the offered consideration.


        NOW, THEREFORE,


        BE IT ORDAINED BY THE POLICE JURY OF THE PARISH OF CALCASIEU, convened in Regular Session on the 1st day of February, 2007, that it does hereby approve the following criteria for the sale and disposition of adjudicated property:


        Section 1.       The property described as: Lot 8 Williams Sub of Blk 9; (AP03-367-07; Tax Assessment No. 553174); 813 Williams Street in Ward Three, Lake Charles, Louisiana, is hereby declared to be surplus and no longer needed for public purpose.


            Section 2.       Ten days after the final adoption of this ordinance, if no restraining order has been obtained, the President or the Director of the Division of Planning & Development, is authorized to execute an act of cash sale in which the Parish of Calcasieu conveys the above described property to Mr. Joseph Johnny Jones, his designated agent, or assignee for and in consideration of $5,000.00 (five thousand dollars).
