The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, November 2, 2006, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Michael E. Danahay, President, presiding, and the following members present:
Mrs. Elizabeth Conway Griffin; and Messrs. Francis Andrepont, Guy Brame, Brent Clement, Calvin Collins, Kevin Guidry, Tony Guillory, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, and Tony Stelly
Absent: Mrs. Sandra J. “Sandy” Treme (out of town) and Mr. Cornelius “Cornie” Moon (ill)
Also present were Mr. S. Mark McMurry, Parish Administrator; Mr. Bryan Beam, Assistant Parish Administrator; Mrs. Coleen Clark, Executive Secretary; Mr. Richard Gremillion, Director of Homeland Security and Emergency Preparedness; Mrs. Cheryl Heisser, Director of Human Resources; Mr. Jerry Milner, Director of Finance; Mr. Claude Smart, Parish Engineer; Mr. Ed McGuire of the firm of Plauche, Smith and Nieset, General Counsel; Ms. Kathy P. Smith, Recording Secretary; and Mr. Gerry Trahan, Director of Facilities Management.
President Danahay called the meeting to order. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.
President Danahay advised that a presentation scheduled to be held on this date would instead be held on November 16, 2006, said presentation to be given by the Office of Juvenile Justice Services on the selection of Calcasieu Parish as a participant in the Annie E. Casey Foundation’s Juvenile Detention Alternatives Initiative and selection as a site for the John D. And Catherine T. MacArthur Foundation’s Models for Change. President Danahay noted that both of these programs were national programs which focus on systems reform in juvenile justice and that only a limited number of sites were invited to participate.
Upon motion made by Mr. McMillin, which was duly seconded by Dr. Mackey and carried unanimously, the rules were suspended by a two-thirds majority vote to issue the following proclamation:
PROCLAMATION
WHEREAS, hospice and palliative care provides patients and families the highest quality care during life-limiting illness and at the end of life, through pain management and symptom control, caregiver training and assistance, and emotional and spiritual support, allows patients to live fully up until the final moments, surrounded and supported by the faces of loved ones, friends, and committed caregivers; and
WHEREAS, last year, more than 1.2 million Americans living with life-limiting illness, and their families, received care from the 4,000 hospice and palliative care programs in communities throughout the United States; and
WHEREAS, professional and compassionate hospice staff — including physicians, nurses, social workers, therapists, counselors, health aides, and clergy — provide comprehensive care focused on the wishes of each individual patient; and
WHEREAS, more than 400,000 trained volunteers contribute 18 million hours of service to hospice programs annually; and
WHEREAS, providing high-quality hospice and palliative care reaffirms our belief in the essential dignity of every person, regardless of age, health, or social status, and that every stage of human life deserves to be treated with the utmost respect and care; and
WHEREAS, hospice and palliative care providers encourage all people to learn more about options of care and to share their wishes with family, loved ones, and their healthcare professionals.
NOW, THEREFORE,
BE IT RESOLVED that I, Michael E. Danahay, President of the Calcasieu Parish Police Jury, by virtue of the authority vested in me, do hereby proclaim the month of November 2006, as
National Hospice/Palliative Care Month
throughout Calcasieu Parish, and encourage all citizens to increase their understanding and awareness of care at the end of life and to observe this month with appropriate activities and programs.

President Danahay and Mr. McMillin presented the proclamation to Ms. Carolyn Dickson who expressed her appreciation on behalf of Odyssey Healthcare and its staff.
Motion was made by Mr. Collins, seconded by Mrs. Griffin and carried unanimously to suspend the rules by a two-thirds majority vote to receive a plaque of appreciation from Rebuilding Together (formerly Christmas in April) to the Police Jury for participating in the recent Hurricane Rita Anniversary Law Enforcement Day.
Ms. Sheila Matte of Entergy presented the plaque and thanked the Police Jury for its support in this endeavor. She particularly thanked Mr. Smart for spearheading the project for the Police Jury and stated that the recipient was extremely excited about the work that was done on her house. Ms. Matte pointed out that the Police Jury’s group was the only one that did something special which was to landscape the front of the house.
It was moved by Mr. Manuel, seconded by Mr. Andrepont and carried unanimously to suspend the rules by a two-thirds majority vote to adopt the following resolution:
RESOLUTION
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in Regular Session convened on the 2nd day of November, 2006, that it does hereby ratify the Local Government Proclamation of Local Disaster Emergency signed by Vice-President Chris E. Landry on October 27, 2006, with reference to recent heavy rains and widespread property damage that may result from flooding of most waterways in the Parish of Calcasieu. The Proclamation reads as follows:
LOCAL DISASTER EMERGENCY
WHEREAS, the Parish of Calcasieu is presently faced with an emergency due to the heavy rains and flooding that began on October 26, 2006 and continuing, and the Parish of Calcasieu declares a State of Emergency, in accordance with the provisions of the Louisiana Emergency Assistance & Disaster Act of 1993, as amended, and wishes to utilize its resources to the fullest extent;
WHEREAS, there already exists a local emergency declared on flooding in the Parish of Calcasieu as the result of a severe storm which began on October 16, 2006, the impacts of which are ongoing, exacerbated by, and indistinguishable from the effects of this new storm impact;
NOW, THEREFORE,
BE IT RESOLVED BY CALCASIEU PARISH that it does hereby declare under the authority of the Louisiana Emergency Assistance & Disaster Act of 1993, as amended, that a state of disaster exists in Calcasieu Parish, and
BE IT FURTHER RESOLVED BY CALCASIEU PARISH that there already exists a local emergency declared on flooding in the Parish of Calcasieu as the result of a severe storm, which began on October 16, 2006, the impacts of which are ongoing, exacerbated by, and indistinguishable from the effects of this new storm impact.

Mr. Gremillion advised that during the early morning hours of Friday, October 27, 2006, various local fire districts, the Calcasieu Parish Sheriff’s Office, and the Louisiana Department of Wildlife and Fisheries, along with employees of Public Works and the Office of Community Services, rescued approximately 150 people due to extremely heavy rains occurring primarily in the Moss Bluff, Starks, and north Sulphur areas.
Mr. Steve Rinard of the National Weather Service (NWS) appeared before the Police Jury and stated that this weather system had been categorized as a 100-year rain event, and he did not know of any location in the country that could have experienced such an event without having significant flooding associated therewith. Mr. Rinard further stated that while the NWS had not predicted 15" of rain, it had forecasted rain amounts in the double digits.
Ms. Mickey Kriete, Brian Street in Sulphur, appeared before the Police Jury and stated that the ditches in her area were not draining properly, and she felt that was why houses in her area had flooded. Ms. Kriete stated that her concern was for the future and whether she and her neighbors would have to worry about flooding every time it rained.
Mr. McMillin advised that he had been throughout his district during the rain event, and he felt there could be virtually no drainage system capable of handling that much rainfall. Mr. McMillin further stated that he would help coordinate efforts between Gravity Drainage District No. Five of Ward Four to clean the laterals, and the Parish’s Public Works Department to clean the roadside ditches, in the vicinity of Brian Street.
In answer to a question by Mr. McMillin, Mr. Gremillion advised that the gates at the Saltwater Barrier had been open during the rain event, and President Danahay pointed out it was his understanding from the Corps of Engineers that the gates had been open since October 17th.
Mr. Manuel stated that there had been 18-21" of rain in some areas of Moss Bluff which had all fallen in a six-hour period in the early morning hours of October 27th, and he thanked all those who had helped insofar as rescuing people, clearing culverts, etc.
Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Collins and carried unanimously, the following applications for liquor and beer permits were approved, and issuance of the following special events permit was ratified:

Following review of the items to be considered by the Police Jury on November 2nd, and after recommendations for appointments to various boards of special service districts were made by members of the Committee, it was unanimously recommended that the proposed agenda be accepted as presented by the staff.
There being no further business, Chairman Moon declared the meeting to be adjourned.

Said Committee:
1. Recommended upholding the recommendation and stipulations of the Planning and Zoning Board to grant SV04-010-06 which was a request by Kenneth Walker for a subdivision variance to allow residential development without public road frontage. (off of Kim Street in Ward Four, Police Jury District 11, Mrs. Treme)
[The Planning and Zoning Board met on Tuesday, October 17, 2006, and voted unanimously to recommend that the request be granted with the following stipulations: 1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that a private road sign must be installed; and 3) that the property can not be resubdivided.]
2. Recommended that a resolution be adopted accepting Waterside Part Two Subdivision located on Arrozal Drive in Section 26, Township 10 South, Range 8 West, in Ward Three. (Police Jury District 9, Mr. Guidry)
NOTE: a re-subdivision of Lots 1 through 12 of Waterside Part One Subdivision (reconfiguration of those lots in subdivision previously approved).
3. Recommended that the staff be requested to review the ongoing problem of solid waste containers being left in the parish rights-of-way after weekly garbage collection, and report back to the Public Works Committee in November with recommendation as to measures available to alleviate problem.
4. Recommended that ordinances be adopted and/or existing ordinance(s) be amended with reference to the following located in Ward Three (Police Jury District 7, Mr. Landry):
4.1 establish a 25 mph speed limit on Alvin Acres Drive; and
4.2 establish a 25 mph speed limit on Clara Drive.
5. Recommended that the President of the Police Jury be authorized to execute all documents related to the donation of right of way from J and L Jardell Partnership for the construction of a turnaround on J. Jardell Road in Ward Seven. (Police Jury District No. 12, Mr. Clement)
6. Recommended that the Parish Administrator be authorized to advertise for bids for Calcasieu Parish Project No. 2005-08 (Shoreline Protection at Intracoastal Park). (Police Jury District 12, Mr. Clement)
7. Recommended that the Parish Purchasing Agent be authorized to advertise for bids for one 2007 one-half ton extended cab pickup truck, for use by the Division of Engineering and Public Works.
8. Recommended that an ordinance be adopted establishing “no parking” on Eva Street in Ward Four. (Police Jury District 13, Mr. Andrepont)
9. Received report from Mr. Dick Gremillion on the status of flooding in the Parish in conjunction with the declaration of emergency ratified by the Police Jury on October 19, 2006. He reported that flooding problems had already been reported in the Starks area and that the heavy rains which were predicted overnight, coupled with already high levels on various portions of the Calcasieu River, would most likely cause significant flooding for locations such as South Perkins Ferry Road in Moss Bluff, the Old Town Bay area on the east side of Highway 171, and some areas in Westlake. Mr. Gremillion pointed out that he planned to talk to the Sheriff’s Department about closing the Calcasieu River and its tributaries to boat traffic.

RESOLUTION
WHEREAS, Arrozal, L.L.C.; John C. Thielen, Manager, subdivided certain property in Ward Three of Calcasieu Parish, Louisiana, known as Waterside Subdivision Part Two, a subdivision in Section 26, Township 10 South, Range 8 West, Calcasieu Parish, Louisiana; and
WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana; and
WHEREAS, said subdivision plat was prepared by D. W. Jessen, Jr., Registered Land Surveyor No. 4646, and certification was made that the subdivision plat was prepared in accordance with R.S. 33:5051 and all other laws of the State of Louisiana; and
WHEREAS, said subdivision plat will be filed for record in the Office of the Clerk of Court on November 8, 2006, and will bear File No. 2782036.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in Regular Session on the 2nd day of November, 2006, that it does hereby officially accept the plat of Waterside Subdivision Part Two in Ward Three of Calcasieu Parish, Louisiana, including Arrozal Drive, located within said subdivision, for future maintenance by the Parish.

ORDINANCE NO. 5178
AN ORDINANCE amending Chapter 17, Art. II, Div. 2. Speed Limits, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to establish a 25 mph speed limit on Alvin Acres Drive and Clara Drive in Ward Three of Calcasieu Parish.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, that it does hereby amend Chapter 17, Art. II, Div. 2. Speed Limits, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, as follows:
SECTION I. Sec. 17-64, Twenty-five miles per hour, of the Code of Ordinances is amended by including the following roads in the provisions of said section:
Alvin Acres Drive in Ward 3
Clara Drive in Ward 3
BE IT FURTHER ORDAINED that effective immediately, no vehicle shall travel in excess of the maximum speed limit established above.
BE IT FURTHER ORDAINED that appropriate signs shall be posted along the roads set forth above, at reasonable intervals, to warn the operators of vehicles of the speed limit herein imposed.
BE IT FURTHER ORDAINED that anyone violating the provisions of this ordinance, upon conviction, shall be fined as provided in Section 1-9 of the Code of Ordinances of Calcasieu Parish, Louisiana.
BE IT FURTHER AND FINALLY ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, that it does hereby amend the Code of Ordinances of Calcasieu Parish, Louisiana, as follows:
