The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, September 7, 2006, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Michael E. Danahay, President, presiding, and the following members present:
Mesdames Elizabeth Conway Griffin and Sandy Treme; and Messrs. Francis Andrepont, Brent Clement, Guy Brame, Calvin Collins, Kevin Guidry, Tony Guillory, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, and Tony Stelly

Smith, Jr. of the firm of Plauche, Smith and Nieset, General Counsel; Ms. Kathy P. Smith, Recording Secretary; Mr. Gerry Trahan, Director of Facilities Management; and Mr. Jim Vickers, Director of Planning and Development.
President Danahay called the meeting to order. The invocation was pronounced by Mr. Guidry which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.
President Danahay welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
Motion was made by Mrs. Griffin, seconded by Mr. Collins and carried unanimously that due to a printing error in the legal advertisement for bids which were to be received on this date for an oil, gas, and mineral lease on certain tracts of land (1.91 acres) in Creole Acres Subdivision in Section 34, Township 10 South, Range 11, West in Ward Seven, that this item be withdrawn from the agenda, and further, that the staff be authorized to publish another advertisement setting forth a new bid date for receipt of bids for same.
Ms. Sheila Matte, President of Rebuilding Together Calcasieu Area, Inc., appeared before the Police Jury with reference to “Rebuild Day” in Calcasieu Parish on Saturday, September 23, 2006. Ms. Matte explained that the organization was formerly named Christmas in April and that normally one big project was done in October, however, the group had been refurbishing homes throughout the year with a goal of providing security and rehabilitation of older homes. Ms. Matte stated that there were six houses to be worked on September 23, 2006, (one day before the anniversary of Hurricane Rita’s landfall), and she asked the Police Jury and staff to take responsibility for one of the houses.
Mr. Smart volunteered to organize the Parish’s efforts by recruiting workers, checking out the house to see what needed to be done, and working on “Rebuild Day”, for which the jurors and Ms. Matte expressed their appreciation for his offer.
President Danahay advised that a report would be received at this time from staff in reference to improvements made to the Calcasieu Parish hurricane response plan since Hurricane Rita.
Mr. Beam stated that the staff had previously given a report on improvements made to the Parish’s hurricane response plan from an internal viewpoint, but this report would cover external or parishwide agency improvements. Mr. Beam advised that the Police Jury had adopted a resolution on June 1, 2006, authorizing the Director of the Office of Homeland Security and Emergency Preparedness to enter into a program with the National Incident Management System (NIMS), which was a federal government program established following the terrorist attacks of September 11, 2001, to ensure consistent response to all types of emergencies.
Mr. Beam further stated that another key element was the formalization of the consensus model used before, during and after Hurricane Rita which allowed collaboration between the President of the Police Jury, area mayors, elected and appointed officials, and the Office of Emergency Preparedness in making major policy decisions such as evacuation and re-entry.
Mr. Gremillion reported that his office had given approximately 75 - 80 presentations since the hurricane to various groups regarding emergency preparedness. He discussed the time line used by local officials to determine various stages of preparation and pointed out that if an evacuation was called, local government agencies would be responsible for transporting persons who had no means of transportation, as well as special needs patients. Mr. Gremillion stated that a plan had been worked out for this with the Office of Community Services’ Transit Program, Calcasieu Parish School Board, ambulance services, etc., whereby these persons would be transported to a staging area, probably the Lake Charles Civic Center, and then transported by the State to approved shelters.
Mr. Gremillion also reported that a contract had been executed with Garner Environmental Services for generators and other emergency needs, and a survey had been conducted to determine the needs of various Parish agencies. He asked the police jurors for help in getting information on emergency needs of the special service districts, some of which had not yet responded to the Parish’s survey.
With respect to distribution of commodities, Mr. Gremillion advised that this was based on population density assessments, and there would be one center at the Lake Charles Civic Center, one in Sulphur, and one in Moss Bluff. He stated that this was part of the State’s plan and that the Parish had suggested the locations. Mr. Gremillion advised that volunteers or other public agencies were needed to help with the distribution plan.
Mr. Gremillion stated that there were very few communications problems associated with Hurricane Rita, because they had plans in place to deal with outages. He further stated that those plans had been strengthened and that a mobile operations center was in service that had the capability of providing radio and internet capabilities.
Mr. Beam advised that Mr. Tom Hoeffer, Director of C-Gov, had been named as the Parish’s Public Information Officer, and a determination made as to what information needed to get out to the public. He stated that the Police Jury’s internet website would be used more effectively and that daily updates would be e-mailed to the news media and others. Mr. Beam pointed out that telephone lines had been set up for police jurors and employees to obtain relevant information and that the staff continued to work on public education efforts.
Mr. Stelly asked how commodities such as drinking water and food would be distributed to the outlying areas of the Parish with there being just three distribution points, and Mr. Gremillion stated that it took about 100 people to run a distribution point with the necessary equipment. He further stated that arrangements had been made with the National Guard and Garner Environmental Services to deliver commodities out into the community. Mr. Gremillion advised that requests had been made to a few agencies, however, there had been reluctance on their part to commit to providing assistance because of a lack of personnel in the event of an evacuation. Mr. Gremillion stated that smaller public buildings, such as water or fire departments, could be used to store supplies, but OEP needed help with manpower.
Mrs. Griffin asked what kind of mobile operations were in place, and Mr. Gremillion advised that a bigger mobile command center had been purchased which would allow OEP to set up its radio system, internet access, voice over IP telephone system, etc. wherever it was necessary to do so.
Mr. Manuel stated that the biggest problem associated with Hurricane Rita was probably getting water to the public, and while his water district had emergency generators for its wells, he asked if this was being done parishwide. Mr. Gremillion stated that the staff had tried to get information on what was needed by each district so that power could be supplied to those facilities in an emergency but that some of the districts still needed to let OEP what their needs were.
Mr. Moon thanked the staff for the report, pointing out that public education was the reason he had asked for same, and since the meeting would be televised on C-Gov, it would give the public an opportunity to learn what the Parish was doing in preparation for disasters.

Chairman Moon advised that the purpose of the meeting on this date was to review the proposed agenda for the Regular Meeting of the Police Jury to be held on September 7, 2006.
Following review of the items to be considered by the Police Jury on September 7th, it was unanimously recommended that the proposed agenda be accepted as presented by the staff with the addition of the following item:
Take appropriate action on the vacancy on the Board of Commissioners of Ward Eight Fire Protection District No. Two created by the resignation of Mr. John LeBleu. (Mr. LeBleu represented District 10. Mr. Stelly is the liaison.)
Also, the following item was deleted from the agenda:
Take appropriate action on the expiration of the term of Mr. J. R. McCain as a member of the Board of Commissioners of Waterworks District No. One of Ward One. (Mr. McCain represents District 1. Mr. Manuel is the liaison.)

2. Received report from Planning and Development staff with reference to the enforcement requirements of recently adopted state statutes regarding emergency wind and flood mitigation standards and confusion over what was required by Act 12 of the 2005 First Extraordinary Session of the Legislature, as well as implementation of the 2006 version of the International Building Code in 11 parishes including Calcasieu effective January 1, 2007, subject to legislative oversight prior to implementation thereof, and more stringent elevation criteria set by FEMA (Federal Emergency Management Agency). Mr. Curt McCarty, Administrator of the Louisiana Code Council, appeared before the Committee in support of the Parish’s efforts thus far and advised that possible funding through the Louisiana Recovery Authority for implementation of the Code was currently being discussed, as well as development of training opportunities for building contractors. Mr. McCarty further advised that Calcasieu Parish should enforce the provisions of the 2003 International Residential Code and the 2003 International Building Code in all areas located north of the one hundred ten (110) mile per hour windspeed line. Senator Willie Mount and Representatives Brett Geymann and Ronnie Johns also appeared before the Committee regarding this matter, and Representative Johns advised that based on Florida’s experience, the implementation of building codes had lessened the devastation of homes due to hurricanes. He also advised that the implementation in Louisiana was being driven by the biggest issue in the State at the present time which was availability – not affordability – of insurance coverage. Mr. Chad Deshotel, 1640 Highway 384, Lake Charles, a member of the Louisiana Code Council, also appeared before the Committee and advised that based on personal experience, there had been an increase of approximately 15% in construction costs to build a house to meet the requirements of the 110-mph wind load.
3. Received report from staff with reference to the Highway 108 at-grade crossing and the Packinghouse Road crossing signal and gate installation. (Police Jury Districts 14 and 15) Representatives of Union Pacific Railroad were invited to attend the meeting to address this issue but were unable to attend, and the Committee recommended that said representatives be requested to attend the Regular Meeting on September 21, 2006, to discuss this matter.
4 Received report and recommendations from staff with reference to the storm debris close-out phase wherein it was reported that contractors for the Corps of Engineers had completed all demolitions (206 total) and private property debris removal (213 total), as well as removal of most of the eligible storm debris from public rights-of-way. An estimated 5,000 cubic yards of vegetative debris and 10,000 cubic yards of construction and demolition debris remain and will be picked up by Parish Public Works crews beginning on September 8, 2006, following which Waste Management will be requested to assess remaining residential debris for eligibility and removal within their contract. Any debris deemed ineligible under said contract would be removed by Public Works which will complete the storm debris removal mission. A flyer will be distributed to residents concerning completion of the mission along with a pamphlet setting forth the guidelines of pickup under the Parish’s contract with Waste Management. Brian Street in District 14, “leaners and hangars” in the City of Lake Charles, Rhett Road in District 1, Salter Bluff Road in District 11, and debris on State rights-of-way were cited by the jurors as still being problem areas.
5. Received a presentation by representatives of the Coastal Protection Restoration Authority — Integrated Planning Team with reference to the feasibility of a levee system throughout the coastal areas of south Louisiana. Appearing before the Committee with an update to the Louisiana Comprehensive Coastal Protection Master Plan were Mr. Lucien J. “Lu” Cutrera and Mr. Oneil Malborough of the Shaw Group.
6. Received a presentation by Mr. Lucas Terracina, Mosquito Control Director, with reference to the status of the Parish’s efforts toward the control of mosquitoes wherein he reported that Hurricane Rita’s storm surge had opened up many more breeding areas and killed a lot of mosquito predators. He also reported that increased costs for insecticides, fuel, personnel, and repairs to equipment had caused operational costs for January – May, 2006, to double, and the West Nile Virus was currently extremely active in the Parish and in the State.
7. Received a presentation from Ms. Wanda Clark of Capital One Bank regarding its Community Renewal Fund involving a $100 million allocation of new markets tax credit for use in recovery and redevelopment of the Hurricane Katrina Gulf Opportunity (GO) Zone by assisting businesses in revitalizing low-income communities with investments in both new development and rehabilitation to encourage job creation and job stabilization.
8. Recommended that a resolution be adopted authorizing the Division of Engineering and Public Works to submit applications to the Louisiana Department of Transportation and Development for the purchase of sign and accident inventory software. [NOTE: the Police Jury will be reimbursed for ninety-five percent (95%) of eligible expenses.]
9. Recommended that a resolution be adopted approving a Contract to Provide Services/Hold Harmless Agreement between the Police Jury and Euell and Sandra Simon for park keeper services at Alligator Park located in Ward Five, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.
10. Recommended that a resolution be adopted accepting Holmwood Ranch Subdivision located off of Highway 14 East in Section 28, Township 10 South, Range 7 West, in Ward Two. (Police Jury District 10, Mr. Stelly)
11. Recommended that a resolution be adopted accepting Campbell Court Subdivision located off of Goodman Road in Section 26, Township 9 South, Range 8 West, in Ward Three. (Police Jury District 2, Mr. Collins)
12. Recommended that a resolution be adopted accepting Ravenwood Subdivision located off of Joe Miller Road in Section 19, Township 8 South, Range 8 West, in Ward One. (Police Jury District 1, Mr. Manuel)
13. Recommended that a resolution be adopted urging the Louisiana Department of Transportation and Development to reinstall the traffic signal at the corner of Mill Street and Enterprise Boulevard.
14. Advised that the Police Jury had been awarded a Certificate of Appreciation by the Department of the Army for exceptional cooperation and professional support during Hurricane Rita recovery efforts.

With regard to Recommendation No. 1 of the Public Works Committee, it was noted that the recommendation of the Project Architect was to defer action on bids received for both projects until the Police Jury’s Regular Meeting on September 21, 2006.
With reference to Recommendation No. 2 of the Public Works Committee as outlined above, and in response to Mr. Clement’s request for an update, Mr. Vickers explained that a “gentleman’s agreement” had been struck with Mr. McCarty, Administrator of the Louisiana Code Council who had appeared before the Public Works Committee, wherein Mr. McCarty requested that the Parish enforce the 2003 version of the International Residential Code and the 2003 International Building Code in the areas north of the 110-mph wind speed area which would cover the remainder of the Parish. Mr. Vickers further explained that the Parish’s legal counsel had researched this matter, and it was unclear, thus, he recommended that legal counsel be authorized to obtain an Attorney General’s opinion so that the Parish staff would have that as “back up” in case the public questioned why the codes were being enforced.
Mr. Clement offered a motion to obtain an Attorney General’s opinion with regard to this matter.
Mr. Allen Smith, legal counsel, advised that Mr. Ed McGuire of his office had written Mr. McCarty a letter on this date asking for a copy of the legal opinion which Mr. McCarty had received. Mr. Clement then withdrew his motion.
With regard to Recommendation No. 11 of the Public Works Committee as outlined heretofore, Mr. Bob Davis appeared before the Police Jury and stated that in recent competition for tax credits, the State had granted such credits for 250 new affordable single-family homes throughout Calcasieu Parish – 50 in Vinton, 100 in the present location off of Goodman Road, and 100 in downtown Lake Charles. Mr. Davis thanked the staffs of Mr. McMurry and Mr. Vickers, as well as the Housing Authority, for their cooperation and assistance, pointing out that 170 homes had already been built in Calcasieu under this program.
A vote was then taken on the motion on the floor, which was to approve the Public Works Committee Report dated August 31, 2006, and all recommendations contained therein, and said motion carried unanimously; whereupon, the following resolutions were adopted:

WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana; and
WHEREAS, said subdivision plat was prepared by D. W. Jessen, Jr., P.L.S., Registered Land Surveyor No. 4646, and certification was made that the subdivision plat was prepared in accordance with R.S. 33:5051 and all other laws of the State of Louisiana; and

Mrs. Treme advised that Ms. Kathaleen Sue White had purchased this property through a tax sale, and she wanted to make sure that it was just the manufactured home that was being proposed for condemnation, to which Mr. Robinson answered that it was.

With reference to the foregoing, Mr. Landry asked if a lien would be placed against the property which Ms. White would ultimately have to pay, and Mr. Smith advised that Ms. White had purchased the property, but the manufactured home still belonged to the person who originally owned it and if they reclaimed it, the Parish could file a lien against them, but it was a situation where the Parish was probably out of luck in trying to recoup the expense of demolition.

The facts as set forth at the meeting of the Police Jury of Calcasieu Parish, Louisiana, on this date, justify an order of this Police Jury, and it is hereby ordered that the manufactured home located at 2501 Bonito Drive (Lot 268 and E 10 Ft Lot 267, County Pines North Subdivision, Part 5; Tax Assessment No. 01091530), south Lake Charles area of Ward Three, Calcasieu Parish, Louisiana, and currently owned by Gholam Hussein Abbasi, et ux, be demolished and removed within thirty (30) days from the date of this ordinance. This order requires that all development permits be secured for demolition and all debris be removed from the premises. This order is made this 7th day of September, 2006, and is final unless appealed within five (5) days.
SECTION 2. If the manufactured home on the premises hereinabove described in the Parish of Calcasieu, Louisiana, is not demolished and removed within thirty (30) days from the date of this order, notice is hereby given that the Director of Parish Planning and Development shall have work commenced on the demolition and removal of said manufactured home, in which case the Police Jury shall not be liable for damages and shall have a lien and privilege against the property upon which the manufactured home was situated for the cost of demolishing and removing said manufactured home, and for the cost of maintaining the property.
SECTION 3. The Director of Parish Planning and Development is hereby authorized and directed to give notice of said demolition and removal as required by law.
SECTION 4. The Director of Parish Planning and Development is hereby authorized to enter into a contract to accomplish the demolition of the manufactured home, if necessary, and to pay the fees of the contractor from appropriate Parish funds, and to pay any and all costs associated with the demolition. Any amounts expended by the Parish of Calcasieu shall be included in the statement of costs in accordance with Chapter 6 of the Code of Ordinances of Calcasieu Parish, Louisiana, and the Parish of Calcasieu shall have a lien and privilege for all costs resulting from the demolition.
SECTION 5. This ordinance shall become effective immediately.

With regard to the seventh structure located at 237 Chili Westlund Road, Carlyss area, Mr. Robinson recommended that the manufactured home be condemned and removed within thirty days.
Mr. Clement stated that he had recently spoken with Ms. Westlund and that this property had storm surge damage from Hurricane Rita, however, they had started cleaning the property, and Ms. Westlund had informed him that weather permitting, she felt the property could be completely cleaned up in two months.
Motion was then made by Mr. Clement and seconded by Mr. Stelly that action on this proposed condemnation be deferred for sixty days.
Mr. McMillin asked if this was a case were the Parish could clean up the property for the owner, to which Mr. Vickers stated that at the Committee Meeting night on September 28, 2006, a list of properties that were not formerly eligible for cleanup would be presented to the Jury with a report and discussion as to how best to proceed with handling these storm-damaged properties.
President Danahay asked if there was anyone present in the audience who wished to comment on the proposed condemnation of this structure and hearing no comments, a vote taken on the motion on the floor carried unanimously, and action on condemnation of the manufactured home located at 237 Chili Westlund Road was deferred for sixty days.
With regard to the eighth piece of property located at 245 Cypress Lake Road, north Sulphur area, Mr. Robinson recommended that the manufactured home be condemned and removed within thirty days.
