The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, April 6, 2006, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chris Landry, Vice-President, presiding, and the following members present:
Mesdames Elizabeth Conway Griffin and Sandra J. Treme; and Messrs. Francis Andrepont, Brent Clement, Guy Brame, Calvin Collins, Kevin Guidry, Tony Guillory, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, and Tony Stelly

Vice-President Landry called the meeting to order. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance led by Mr. McMillin. The roll was called with the result being as outlined above.
Malorie Wall, a McNeese State University student and President of the Student Government Association at said university, appeared before the Police Jury relative to an upcoming event called “Extreme Spring Break” whereby approximately 200 students from McNeese and Southeastern Louisiana University would be spending their spring break in Hammond, Covington, and Lake Charles helping Habitat for Humanity with hurricane recovery efforts. Ms. Wall further stated that approximately 75 students would be working out of the old Stine Lumber parking lot on Country Club Road, building storage units for about 1100 homes.
Ms. Wall invited the jurors to attend the end-of-the-week celebration on Saturday, April 20, 2006, where the featured speaker would be Mr. Michael Woods, a member of the Louisiana Recovery Authority. Ms. Wall closed by saying that the students were taking very seriously the responsibility of rebuilding Louisiana, and the jurors expressed their appreciation for these efforts.
Vice-President Landry advised that a plaque would be presented at this time to the Police Jury, and its Division of Finance, commemorating the recent award of the Certificate of Achievement for Excellence in Financial Reporting by the Government Finance Officers Association for the fiscal year ending December 31, 2004.
Mr. McMurry asked that Mr. Jerry Milner and Mrs. Tammy Bufkin join him at the podium for this presentation. Mr. McMurry advised that this was the 14th consecutive year the Parish had received this award which resulted in the Parish having a better standing insofar as interest rates on bonds, and he pointed out that only 5% of communities in the United States received the award, with only two in the parish/police jury form of government having received it in Louisiana.
Mr. McMurry stated that receipt of the award meant that the Parish’s financial accounting and reporting were in the upper echelon – the top 5% of all city and county governments in the U.S. – and represented the highest form of recognition in the area of governmental accounting and reporting, a significant accomplishment by a government and its management.
Mr. Milner stated that he and his staff were appreciative of the congratulations, but he wanted to point out that the Division of Finance was just one part of an outstanding team, from the Police Jury to each division of the Parish’s operation.

Chairman Moon advised that the purpose of the meeting on this date was to review the proposed agenda for the Regular Meeting of the Police Jury to be held on April 6, 2006.
Following review of the items to be considered by the Police Jury on April 6th, it was unanimously recommended that the proposed agenda be accepted as presented by the staff.
Also, recommendations for appointments to various boards of special service districts were made by members of the Committee.
The Committee went into executive session to discuss Lawsuit No. 2006-918 (Robinson vs. Henderson et al). Following the executive session, the Committee voted to receive the report given by legal counsel during the executive session.
There being no further business, Chairman Moon declared the meeting to be adjourned.

6. Advised that the Annual Rabies Clinic would be held on Saturday, April 22, 2006, from 1:00-4:00 p.m., and further, that Animal Services was issuing an invitation to all parish and city officials, as well as any administration employees, to join the volunteers at said parish wide clinics.

(2) Recommended approval of a Cooperative Endeavor Agreement between the Police Jury and Community Center and Playground District No. Two of Ward Four (SPAR) for financial assistance in the amount of $25,000 for the costs related to the LHSAA Girls State Fast Pitch 56 Softball Tournament to be held in Sulphur on April 28-29, 2006, with said funding being provided from the Parish wide Riverboat Economic Development allocation, and further, recommended authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.
(3) Recommended approval of Cooperative Endeavor Agreements between the Police Jury and the following entities for financial assistance from the carryover of Delta Downs Gaming Funds in the following wards and/or respective Police Jury districts, and further, recommended authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto:
Ward One – Community Center and Playground District No. Four of Ward One in the amount of $50,000 for the purchase of furnishings for the Senior Center and improvements to the parking lot;
Ward Two – Jefferson Davis Water District in the amount of $3,100 for the extension of waterlines into Calcasieu Parish;
Ward Four (Police Jury District 12) – National Organization of Parents of Murdered Children, Inc., in the amount of $3,000 for assistance to establish a local chapter;
Ward Four (Police Jury District 14) – Rebuilding Together (formerly Christmas in April Program) in the amount of $2,000 for transportation assistance for volunteers being sent to Calcasieu Parish for clean-up efforts related to Hurricane Rita; and
Ward Eight (Police Jury District 10) – Ward Eight Fire Protection District No. Two (LeBleu Settlement) in the amount of $2,700 for the purchase of a fire hydrant at the fire station located in Hecker.
(4) Recommended approval of a request from Ward Five Fire Protection District No. One (Starks) to utilize $28,500 from a previously-awarded grant in the amount of $37,868 for fire department improvements, to be used instead for the purchase of a tract of land for a new main station, and further, recommended authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto. (It was noted that on May 5, 2005, the Police Jury awarded a grant, from the Ward Five Special Projects by Ward and Special Service District allocations of the Riverboat Fund, in the amount of $37,868 to said fire district for fire department improvements, and the district wanted to utilize $28,5000 of the $37,868 for the purchase of a tract of land to be used for a new main station, and the remainder for the improvements.)
(5) Recommended approval of a request for a six-month time extension (September, 2006) from Southwest Louisiana Sickle Cell Anemia, Inc., related to the completion of capital expense improvements to said agency’s local office, due to a delay caused by Hurricane Rita. (It was noted that on January 20, 2005, the Police Jury awarded a grant in the amount of $10,000 for start-up costs related to capital expense improvements to the local office, with said funding having been allocated from the Ward Three Delta Downs Slots Revenue, and further, that a requirement of this funding was that the project be completed within twelve months.)

In conjunction with approval of the Budget Committee Report, motion was made by Mrs. Treme, seconded by Dr. Mackey and carried unanimously that a budget item be approved in the amount of $5,000 from the Parish Promotion account, as well as $5,000 from the economic development line item in the gaming fund, for the purpose of co-sponsoring the upcoming Outdoor Writers’ Association Convention being hosted by the Southwest Louisiana Convention and Visitors Bureau. Mr. McMurry pointed out that it was anticipated that Southwest Louisiana would receive $2 million in free publicity as a result of hosting this convention.
Motion was made by Mr. Andrepont, seconded by Mr. Brame and carried unanimously that funding be approved in the amount of $38,500 from the economic development line item in the gaming fund, as well as $7,000 from the carry-over of Delta Downs - Ward Four gaming revenues, to serve as matching money to a grant obtained by the West Calcasieu Airport from the State for the purpose of resurfacing the road leading into Southland Field, and further, that the remainder of the cost of resurfacing said road be funded by the Police Jury as a loan to be reimbursed within a two-year period by the West Calcasieu Airport.
Mr. McMurry advised that Dr. B. J. Foch, Parish Health Officer, had presented a proposal for the Parish to be involved through the local health unit in the Medical Reserve Corps, a branch of the federal government akin to Americorps, which would enhance public health preparedness in times of emergency or disaster, and which would cost approximately $60,000.
It was moved by Mrs. Treme, seconded by Dr. Mackey and carried unanimously to approve an expenditure of approximately $60,000 from the Health Unit’s budget for the Parish to be involved in the Medical Reserve Corps to enhance public health preparedness in times of emergency or disaster.
Motion was made by Mr. Collins and seconded by Mr. Stelly to approve the Litter Abatement and Solid Waste Committee Report dated April 6, 2006, and all recommendations contained therein, as follows:

A meeting of the Litter Abatement and Solid Waste Committee was held at 4:45 p.m. on Thursday, April 6, 2006, in the Police Jury Meeting Room on the first floor of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with Mr. Calvin Collins, Chairman, presiding and the following members present:

Said Committee:
1. Received and recommended approval of the plan as presented by the Division of Engineering and Public Works for the transition from storm debris removal in the Parish to normal waste pickup. (A copy of the plan is attached hereto and made a part of this report.) Mr. Rex Dansby, 317 Fontenot Road, Lake Charles, appeared before the Committee and asked for assistance in getting a determination from the federal government as to whether debris near his residence was storm-related and whether it was eligible for pick-up under the FEMA/Corps of Engineers debris removal program. Also, Mrs. Treme asked that the record reflect that Mr. P.J. Guidry, a resident of Foreman Road in her district, had called to express his appreciation to the Parish, particularly Mr. Autry Thibodeaux, for removal of a large tree stump and digging of ditches.

Mr. Collins, Chairman of the Committee, cautioned the public about waiting until the last minute to have their hurricane-related debris removed, and he urged everyone to take advantage of the Corps of Engineers’ debris removal program prior to the end of said program, pointing out that it would be very expensive for them if they did not.
Mr. Allen Wainwright, Public Works Operations Manager, advised that the Corps’ last pass for storm debris removal in the Parish was approximately 25% complete. He explained that the Parish had been divided into sections and once a particular section was closed out by the Corps, it would be the property owner’s responsibility to dispose of the debris. Mr. Wainwright also advised that the application process for storm debris removal on private property would continue until mid-April whereby the Parish was utilizing the Corps and its contractors to remove qualifying private property debris, with full costs to be covered by FEMA within the disaster declaration period.
Mr. Wainwright stated that Waste Management had resumed household garbage pickup shortly after the storm and while said company would be picking up waste covered under the Parish’s contract, items that were clearly storm debris would be tagged by Waste Management as being ineligible for pickup and in those cases, residents would be responsible for removing the debris.
Mr. Wainwright reported that the Parish was in the process of initiating an improved litter abatement program and that the Public Works Department would be coordinating the hiring and utilization of temporary employees to bag litter along roadways, as well as arranging for the necessary supervision and vehicles needed for this task, which was expected to last throughout the summer of 2006.
Mr. Manuel asked that a meeting be set up for he and some of the other police jurors with FEMA to discuss pick-up of concrete house slabs which he said had originally been deemed eligible by FEMA but was now considered not eligible. Mr. Wainwright stated that he would arrange such a meeting with FEMA.
Mr. Guillory asked when the debris removal from private property would commence, and Mr. Mark Chester of the Corps appeared before the Police Jury to address this question. He stated that there had been approximately 165 applications for the program which would be reviewed by FEMA and once the Corps received approval, requests for proposals would be issued, a contract price negotiated, and then the work would actually begin.
Mr. Chester stated that the Corps would like to make sure that communications with the Parish took place on a daily basis, and he pointed out that they had experienced great communication with the Parish and its representatives. Mr. Chester further stated that the Corps had all intentions of having everything completed by the June 30, 2006, deadline. He pointed out that the Corps had approximately 79 demolition packages and that the Parish had identified even more of them.
A vote taken on the motion on the floor carried unanimously which was to approve the Litter Abatement and Solid Waste Committee Report dated April 6, 2006, and all recommendations contained therein as outlined heretofore.
The hour being 6:00 p.m., Vice-President Landry advised that a public hearing would be held at this time, in accordance with Article II-Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, requesting authorization to immediately condemn the structures listed below due to the structures being in imminent danger of collapse and constituting a menace to public safety due to damages sustained from Hurricane Rita:
