            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, March 23, 2006, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Michael E. Danahay, President, presiding, and the following members present:

 

Mesdames Elizabeth Conway Griffin and Sandra J. Treme; and Messrs. Francis Andrepont, Brent Clement, Guy Brame, Calvin Collins, Kevin Guidry, Tony Guillory, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, and Tony Stelly

 

Absent: None


            Also present were Mr. S. Mark McMurry, Parish Administrator; Mr. Bryan Beam, Assistant Parish Administrator; Mr. Richard Gremillion, Director of the Office of Homeland Security and Emergency Preparedness; Mrs. Cheryl Heisser, Director of Human Resources; Mr. Jerry Milner, Director of Finance; Mr. Allen L.             President Danahay called the meeting to order. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.


            Motion was made by Mrs. Treme, seconded by Mr. Clement and carried unanimously to suspend the rules by a two-thirds majority vote to adopt the following proclamation:


PROCLAMATION


            WHEREAS, injuries and deaths from motor vehicle crashes bring loss and suffering to the citizens of our community; and


            WHEREAS, research shows that using seat belts and child safety seats are still the single most effective ways to reduce injuries and save lives in motor vehicle crashes; and


            WHEREAS, about thirty (30) percent of the general population in America still does not buckle up, and it has been proven that when a driver is unbuckled, 76 percent of the time children in the motor vehicle are also unbuckled; and


            WHEREAS, the loss of a beloved child, Miss Jamie Cooper, daughter of Bryan and Corliss Cooper, of DeQuincy, Louisiana, has resulted in a very dedicated foundation, the “Hey, Remember Me! Buckle Up in My Memory - Jamie Cooper”, that has sought to prevent further tragedy in Calcasieu Parish by touching everyone possible through billboards, bumper stickers and special messages.


        NOW, THEREFORE,


            BE IT PROCLAIMED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, that the week of March 19 - 25, 2006, shall hereinafter be known as:

 

“Buckle Up Week”


            BE IT FURTHER AND FINALLY PROCLAIMED that the Calcasieu Parish Police Jury does hereby call upon the citizens of Calcasieu Parish to observe this week by using seat belts and child safety seats while riding in motor vehicles, in loving memory of Miss Jamie Cooper.

            Mrs. Corliss Cooper and Ms. Pam Cormier appeared before the Police Jury to accept the proclamation, and Mrs. Treme stated that she admired Mrs. Cooper’s courage, because she was utilizing a very personal and tragic accident to mount a campaign to try and educate other parents and children about the importance of using seatbelts.


            Upon motion made by Mrs. Treme, which was duly seconded by Mrs. Griffin and carried unanimously, the rules were suspended by a two-thirds majority vote to adopt the following resolution:


RESOLUTION

 

A RESOLUTION AUTHORIZING APPROVAL OF A LOAN FROM CALCASIEU PARISH PUBLIC TRUST AUTHORITY OF AN AMOUNT NOT TO EXCEED ONE MILLION FIVE HUNDRED THOUSAND AND NO/100 ($1,500,000) DOLLARS AT AN INTEREST RATE NOT TO EXCEED 4.5% PER ANNUM FOR A TERM OF ONE (1) YEAR TO WATERWORKS DISTRICT NO. ELEVEN OF THE PARISH OF CAMERON, LOUISIANA, TO FUND ACQUISITION AND INSTALLATION OF EMERGENCY ADDITIONS TO AND IMPROVEMENTS OF THE DISTRICT’S WATERWORKS SYSTEM, AND PROVIDING FOR OTHER MATTERS WITH RESPECT THERETO.


            WHEREAS, the Waterworks District No. Eleven of the Parish of Cameron, Louisiana (“District”), provides portions of Calcasieu Parish, Louisiana, with municipal water;


            WHEREAS, following the arrival of Hurricane Rita on September 24, 2006, the District has experienced a dramatic increase in water demand;


            WHEREAS, the District’s waterworks system cannot indefinitely maintain water production and distribution at the increased level, and with the coming summer months will not be able to produce the volume of water to serve the District’s increased population, resulting in water rationing or loss of waterworks system pressures below those required by the State’s Sanitary Code;


            WHEREAS, the District must make immediate emergency improvements to the waterworks system to accommodate the dramatic increase in population and to enable the District to meet the minimum system pressure requirements of the State Sanitary Code;


            WHEREAS, on March 15, 2006, the District, adopted a resolution declaring a public emergency within the District, authorizing the District to borrow not exceeding $1,500,000 for acquisition and establishment of emergency additions to and improvements of the District’s waterworks system, and authorizing application to the Louisiana State Bond Commission in connection therewith;

 

            WHEREAS, the Authority is an “on behalf of issuer” for and on behalf of Cameron Parish, Louisiana, and its various governmental entities and agencies;


            WHEREAS, on March 20, 2006, the Calcasieu Parish Public Trust Authority (the “Issuer”) adopted a Resolution authorizing a loan not to exceed $1,500,000 at an interest rate not to exceed 4.5% per annum for a term of one (1) year to the District;


            WHEREAS, the Parish of Calcasieu, as the beneficiary of the Issuer, must approve by resolution all loans of the Issuer;


            NOW, THEREFORE, BE IT RESOLVED by the Police Jury, the governing authority of the Parish of Calcasieu, Louisiana, as follows:


            SECTION 1. The undertaking and lending of the Calcasieu Parish Public Trust Authority to Waterworks District No. Eleven of the Parish of Cameron, of an amount not exceeding $1,500,000 at an interest rate not to exceed 4.5% per annum for a term of one (1) year, is hereby authorized and approved.


            SECTION 2. All other resolutions in conflict herewith be, to the extent of such conflict, and the same are hereby repealed.

RESOLUTION

 

A RESOLUTION AUTHORIZING ISSUANCE BY THE CALCASIEU PARISH PUBLIC TRUST AUTHORITY OF NOT EXCEEDING $10,000,000 OF ITS SINGLE FAMILY MORTGAGE REVENUE BONDS, SERIES 2006A & 2006B, AND PROVIDING FOR OTHER MATTERS WITH RESPECT THERETO.


            WHEREAS, on December 14, 2005, the Calcasieu Parish Public Trust Authority (the “Issuer”) adopted a Notice of Intention to issue not to exceed $10,000,000 of its Single Family Mortgage Revenue Bonds, Series 2006 (the “Bonds”); and


            WHEREAS, on February 16, 2006, the Louisiana State Bond Commission gave preliminary approval and authority to proceed with the development of its single family housing project for Calcasieu Parish, and approval to issue, sell and deliver Single Family Mortgage Revenue Bonds, Series 2006, of the Issuer in the principal amount not to exceed $10,000,000, all in accordance with the provisions of Chapter 2-A of Title 9 of the Louisiana Revised Statutes of 1950, as amended (the “Act”); and


            WHEREAS, on March 8, 2006, pursuant to notice, a copy of which is annexed hereto, the Issuer conducted a public hearing to allow all interested persons and elected representatives to express their views with regard to the proposed issuance of the Bonds by the Issuer, in satisfaction of the requirements of Section 147(f) of the Internal Revenue Code of 1986 regarding the public approval prerequisite to assure the exemption from federal income taxation of the interest on the Bonds; and


            WHEREAS, no one appeared at the public hearing to ask questions or give statements or comments (pro or con) concerning the Bonds; and


            WHEREAS, the Issuer intends to apply for an allocation from the Qualified Gulf Opportunity Zone Bond Pool, as well as an allocation from the State of Louisiana Private Activity Bond Cap for calendar year 2006 in an aggregate principal amount not to exceed $10,000,000;


            WHEREAS, the Parish of Calcasieu, as the beneficiary of the Calcasieu Parish Public Trust Authority, must approve by resolution all bonds of the Issuer;


            NOW, THEREFORE, BE IT RESOLVED by the Police Jury, the governing authority of the Parish of Calcasieu, Louisiana, as follows:


            SECTION 1. The issuance, sale and delivery by the Calcasieu Parish Public Trust Authority of its Single Family Mortgage Revenue Gulf Opportunity Zone Bonds, Series 2006A-1, and its Single Family Mortgage Revenue Bonds, Series 2006A-2, in an aggregate principal amount not exceeding $10,000,000, is hereby authorized and approved.


            SECTION 2. All other resolutions in conflict herewith be, to the extent of such conflict, and the same are hereby repealed.

            President Danahay advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for the Replacement of Dave Dugas Road Bridge in Calcasieu Parish, Louisiana, more particularly described as Calcasieu Parish Project No. 2005-05, and appropriate action would be taken thereon.


            Mr. McMurry then proceeded to open the following bids:

            There being no other bids, motion was made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously that the bids be referred to the Parish Engineer for final tabulation, with further action thereon to be taken at the Regular Meeting of the Police Jury on April 6, 2006.


            Mr. Clement asked what the time line would be for shutting down Dave Dugas Road for this project and explained that it was a major artery in his district. Mr. Smart advised that it would be approximately one month before the contractor would start but that he would like to see the work completed before Summer of 2006.


            Mr. Clement asked that the work be coordinated with the Fire Department in that area, pointing out that alternatives had been looked at, including putting in a temporary bridge, however, the anticipated cost for doing that was in excess of $400,000. Mr. Clement stated that while no price tag could be placed on public safety, the jurors did have to take care of public money the best they could and that there were also some right-of-way issues, so there would not be a temporary bridge.


            President Danahay advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for the Overlaying and Reconstruction of Various Roads in Calcasieu Parish Louisiana, more particularly described as Calcasieu Parish Project No. 2006-02, and appropriate action would be taken thereon.


            Mr. McMurry then proceeded to open the following bids:

            R. E. Heidt Construction Company, Inc.                        $2,042,154.05


            There being no other bids, motion was made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously that the bids be referred to the Parish Engineer for final tabulation, with further action thereon to be taken at the Regular Meeting of the Police Jury on April 6, 2006.


            President Danahay recognized Mayor Ron LeLeux of the City of Sulphur, and Mayor LeLeux briefly addressed his candidacy and platform in the upcoming mayoral election on April 1, 2006.


            Senator Willie Mount appeared before the Police Jury at this time, on behalf of the entire Calcasieu Legislative Delegation, with reference to the upcoming 2006 Regular Session of the Legislature, scheduled for March 27 through June 19, 2006. Senator Mount advised that there were some issues which came out of the Special Sessions of the Legislature related to Hurricanes Katrina and Rita which would be fine-tuned during the upcoming Session and urged the jurors to be sensitive to those changes. She stated that Calcasieu Parish was well represented in both the Senate and the House.


            Mrs. Treme asked if another attempt would be made by the Legislature to change the State’s election dates to coincide with the Presidential Primary which would save approximately $6 million in election costs. Senator Mount stated that legislation had been pre-filed for the upcoming Session relating to this matter, and the possibility of it coming up for action was very likely.


            Ms. Angie Quienalty, Calcasieu Parish Registrar of Voters, appeared before the Police Jury at this time and advised that absentee voting no longer existed, except for absentee voting by mail for military and out-of-town people, and that as of January, 2006, “early voting” had taken its place. Ms. Quienalty also advised that Calcasieu Parish was one of the ten sites around the State to conduct early voting for displaced voters who wanted to vote in the New Orleans elections scheduled for April 22 and May 20, 2006. Ms. Quienalty stated that this applied to displaced Orleans Parish voters who were registered to vote on or before September 24, 2005, and those who were not could call her office or the Secretary of State’s office to find out what they needed to do.


            Ms. Quienalty also advised that there were some voters displaced by Hurricane Rita who were eligible to vote in the upcoming City of Sulphur mayoral and council election, and efforts were being made by her office to take care of those voters.


            Various members of the Police Jury expressed their appreciation to Ms. Quienalty and her staff.


            Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Guidry and carried unanimously, the following application for a liquor and beer permit was approved:

            With reference to the foregoing, Mr. Vickers stated that the Division of Planning and Development was recommending that these condemnations be temporarily deferred until the Regular Meeting of the Police Jury on May 4, 2006, so they could be grouped with other structures which needed to be condemned, and further, that approximately 150 structures would be presented to the Jury on May 4th. Mr. Vickers explained that the staff was working with the Corps of Engineers and the Federal Emergency Management Agency (FEMA) to make sure all properties which needed to be demolished as a result of Hurricane Rita were included.


            Motion was made by Mr. McMillin, seconded by Mrs. Griffin and carried unanimously that a public hearing on condemnation of the structures as listed heretofore be deferred until the Regular Meeting of the Police Jury on May 4, 2006.


            Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Guidry and carried unanimously, the minutes of the Regular Meeting of the Police Jury dated February 16, 2006, were approved, and the reading of same was dispensed with.


            President Danahay advised that action was needed on RZ02-011-06 which was a request by JNJ Ridge Estates to rezone from A-1 (Agricultural) to R-1 (Single Family Residential) to allow a single-family residential subdivision at the intersection of Highway 14 and Highway 397 in Ward Two, Police Jury District 10 (Mr. Stelly’s district). President Danahay further advised that the Planning and Zoning Board had met on Tuesday, March 21, 2006, and voted unanimously to recommend that the request be granted.

            President Danahay advised that action was needed on a revision to RZ04-007-01 which was a request by Joy Abshire to amend Ordinance No. 4254 by temporarily suspending Stipulations 1 and 2 for a period not to exceed two years to facilitate a roofing business at 509 Chenault Street in Ward Four, Police Jury District 15 (President Danahay’s district). President Danahay further advised that the Planning and Zoning Board had met on Tuesday, March 21, 2006, and voted eight (for) to one (against) to recommend that the request be granted.


            [On March 22, 2001, the Police Jury granted the petitioner’s request to rezone from R-2 (Mixed Residential) to C-1 (Light Commercial) to allow operation of a garage door business. Due to Hurricane Rita, the petitioner requested that Ordinance No. 4254, Stipulation (1) that the building only be used for a garage door business, and Stipulation (2) should the business cease, the property would revert back to R-2 (Mixed Residential), be temporarily suspended in order to allow a roofing company contracted by the Federal Emergency Management Agency (FEMA) and several insurance companies to lease the property for two years. The petitioner moved to a new location and planned to utilize the property for storage.]


            Motion was made by Mrs. Treme and seconded by Dr. Mackey that the recommendation of the Planning and Zoning Board be upheld with respect to a revision to RZ04-007-01 which was a request by Joy Abshire to amend Ordinance No. 4254 by temporarily suspending Stipulations 1 and 2 for a period not to exceed two years to facilitate a roofing business at 509 Chenault Street in Ward Four, Police Jury District 15 (President Danahay’s district).


            Mr. McMillin stated that there was a concern at this location about the building not having restroom facilities, and he asked if a portable toilet could be provided. Mr. Vickers advised that this had been discussed at the Planning and Zoning Board meeting, but the opposition did not want a portable toilet there, however, it was his opinion that Ms. Abshire would be happy to provide that if that was what the Police Jury wanted.


            Mr. McMillin stated that he would like to see that included in the motion, and Mrs. Treme stated she had no problem with amending her motion to provide a stipulation for providing a portable toilet.


            Mr. Manuel questioned whether the applicant would adhere to that stipulation, pointing out that one of the original stipulations had been that when the garage door business ceased, the zoning would revert back to R-2 (Mixed Residential), and he said that had not happened.


            Mr. Vickers explained that the garage door business had not gone out of business but had changed the location of its office and that equipment and materials for the business were still being stored at 509 Chenault Street. Mr. Vickers further explained that all of this would not have even been an issue had Hurricane Rita not occurred but that there was a roofing business which needed space to store roofing materials. He pointed out that there were still 3700 FEMA units in Calcasieu Parish, and people were desperately needing roofing services, so this was actually part of the recovery process from the hurricane. Mr. Vickers also pointed out that after two years, all of the stipulations would go back into effect.


            Ms. Joy Abshire appeared before the Police Jury and stated that her company’s new office building was located at 715 Patch Street, Sulphur, but she had no intention of selling the other building (on Chenault Street). Ms. Abshire advised that when she had been contacted by the roofing company needing space, she sent a letter dated November 4, 2005, to the Planning and Zoning Board, and she thought it had been approved at that point.


            Mr. Clement stated that he had the same concerns, about the lack of restroom facilities, and he did not think a porta-potty should be next door to a residence for two years. Mr. Clement further stated that it was his understanding that the roofing business was hauling materials in from Texas, while local contractors were getting their supplies locally.


            Ms. Abshire responded by saying that the roofing company occupying her building was from Dallas, Texas, and was doing work in Southwest Louisiana and in the New Orleans area. She also stated that not all local roofers were getting their materials locally.


            Mr. Clement asked if the business was going to be trucking materials in on 18-wheelers through this residential neighborhood, and Ms. Abshire stated that she could not answer his question but that she had not witnessed them doing so.


            Mr. Clement advised that he formerly represented this area and while he very seldom voted against a recommendation of the Planning and Zoning Board, he could not support the request knowing there were no restroom facilities in the building.


            Ms. Abshire explained that when she purchased the building, the only utility it had was electricity, and she had gone to the Board of Health at that time to get a permit for a sewer septic system, however, the neighbor on the west side had “atrocious” problems with her system, and Ms. Abshire was concerned that if she followed through with her plans to put in a sewer system, the State would require her neighbor’s system to be fixed which would put her neighbor in a serious financial situation. Ms. Abshire further explained that out of respect for her neighbor, she had not put in a sewer system but was fully prepared to do that and had no problem doing so.


            Ms. Abshire stated that the roofing business would be much less disturbance to the neighborhood than when the building was being used as a garage door business. She advised that never would she have dreamed that her business would have grown like it had and that after the hurricane, the amount of business was sometimes overwhelming but that it meant growth and progress.


            Mrs. Treme amended her motion on the floor, and Dr. Mackey accepted said amendment, to include another stipulation that a State approved sewer system and permanent restroom facility be installed immediately on the property.


            In answer to a question by Mr. Clement, Mr. Vickers explained that as long as Ms. Abshire was storing materials related to her garage door business at this location, it would continue to be classified as C-1 (Light Commercial) and that at such time as the building was no longer used for that purpose, the zoning would revert back to R-2 (Mixed Residential).


            A vote was taken on the motion on the floor, as amended, which was to uphold the recommendation of the Planning and Zoning Board with respect to a revision to RZ04-007-01 which was a request by Joy Abshire to amend Ordinance No. 4254 by temporarily suspending Stipulations 1 and 2 for a period not to exceed two years to facilitate a roofing business at 509 Chenault Street in Ward Four, and further, that another stipulation be added to provide that a State approved sewer system and permanent restroom facility be installed immediately on said property.             President Danahay advised that no action was needed on ST03-001-05 which was a request by the Police Jury to conduct a feasibility study for a zoning overlay and reclassification study of property located on Lake Street, from Country Club Road to Gauthier Road in Ward Three, Police Jury Districts 6 and 7 (Mr. Moon’s and Mr. Landry’s districts, respectively), due to the fact that the Planning and Zoning Board had met on Tuesday, March 21, 2006, and deferred action for thirty days on this item.

 

            President Danahay advised that action was needed to amend the Code of Ordinances of Calcasieu Parish, Louisiana, with reference to subdivision regulations and minimum lot development in the R-1 (Single Family Residential) and R-2 (Mixed Residential) zoning district classifications. He further advised that the Planning and Zoning Board had met on Tuesday, March 21, 2006, and voted unanimously to recommend that the Code be amended.

 

            It was moved by Mr. Manuel, seconded by Mrs. Griffin and carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to these amendments to the Code; whereupon, the following ordinances were adopted:

 

ORDINANCE NO. 5078

 

AN ORDINANCE amending Chapter 26 – Zoning, of the Code of Ordinances of the Parish of Calcasieu, Louisiana.

                          

            BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 23rd day of March, 2006, that it does hereby amend Chapter 26 – Zoning, of the Code of Ordinances of Calcasieu Parish, Louisiana, as follows:

 

            SECTION I.   Article IV, Division 3, Sec. 26–28. Minimum Requirements, Chart A - Schedule of Zoning District Regulations: Zoning District: R-1 (Single Family Residential), is amended as follows:

 

(5)Sixty feet wide and a total surface area of not less than 7,500 square feet (private community sewer system or public sewer system with public water, community water, or private wells).

 

            SECTION II. Article IV, Division 3, Sec. 26–28. Minimum Requirements, Chart A - Schedule of Zoning District Regulations: Zoning District: R-2 (Mixed Residential), is amended as follows:

 

(5)Sixty feet wide and a total surface area of not less than 7,500 square feet (private community sewer system or public sewer system with public water, community water, or private wells).

 

            BE IT FURTHER ORDAINED that this ordinance shall become effective immediately upon adoption.

 

            BE IT FURTHER ORDAINED that any ordinance or parts of any ordinance in conflict herewith are hereby repealed.

 

            BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

            SECTION I.   Sec. 23–6. Standards for development; all subdivisions, (a) Lots, (1), is amended as follows:

 

(e)Sixty feet wide and a total surface area of not less than 7,500 square feet (private community sewer system or public sewer system with public water, community water, or private wells).
