            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, November 3, 2005, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Hal McMillin, President, presiding, and the following members present:

            Also present were Mr. S.             President McMillin called the meeting to order. The invocation was pronounced by Pastor Edward Alexander which was followed by the Pledge of Allegiance led by Mr. Guillory. The roll was called with the result being as outlined above.


            President McMillin welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.


            Mr. Glen Vamvoras, 4359 Edgewater Drive, Lake Charles, appeared before the Police Jury with reference to his candidacy for Calcasieu Parish District Attorney. He gave a brief background of his experience, as well as the reasons why he was running for District Attorney, and stated he would appreciate everyone’s support in the upcoming election on November 12, 2005.


            Mr. McMurry was recognized for a point of personal privilege, and he advised that there was a special presentation the staff wanted to make in recognition of the assistance and efforts of Mr. David Parks, Response Operations Branch Chief of the Federal Emergency Management Agency (FEMA). Mr. McMurry stated that Mr. Parks had been in the area since immediately after Hurricane Rita and was returning home the following day. Mr. McMurry spoke very highly of Mr. Parks’ assistance and asked Mr. Gremillion to introduce him to those who had not yet had the opportunity to meet him.


            Mr. Gremillion stated that Mr. Parks’ office was in Philadelphia and that he had 13 years of experience with FEMA. Mr. Gremillion further stated that Mr. Parks had been of immeasurable assistance during the past six weeks, giving very practical advice, and had been a real “lifesaver”. He then presented a plaque to Mr. Parks which read as follows:

            Mr. Parks thanked the Jury and staff for the plaque. He advised that he had worked more than 50 of these types of emergency situations and that he had never seen a more cohesive group anywhere else in the country.


            Mrs. Treme expressed her appreciation to Mr. Parks, particularly for the mobile disaster recovery centers which brought “the mountain to the people” in the more remote areas of Calcasieu Parish and Cameron Parish.


            President McMillin expressed his appreciation and stated that the Parish had moved forward in the days following Hurricane Rita with Mr. Parks’ assistance.


            The following 2006 Trust Fund Awards totaling $1,100,583 from the Calcasieu Parish Road and Drainage Trust Fund Program were presented at this time:

 

City of Sulphur – $150,000 for Concrete Street Patching Project. Mayor Ron LeLeux and City Council member Chris Duncan accepted the award on behalf of the City of Sulphur.

 

City of Westlake – $252,950 for Westlake Recreational/Housing Development. Mayor Pro-Tempore Gerald Washington accepted the award on behalf of the City of Westlake.

 

City of DeQuincy – $85,533 for Overlay and Patching of City Streets. Mayor Jerry Bell and City Councilman Lawrence Henagan accepted the award on behalf of the City of DeQuincy.

 

Gravity Drainage District No. Six of Wards Five and Six – $270,000 for High Hope Comprehensive Improvements.

 

Town of Vinton – $105,320 for Horridge Street Improvements and $88,120 for 2005-2006 Street Program. Mayor David Riggins and Town Council Member Kenny Stinson accepted the award on behalf of the Town of Vinton.

 

Gravity Drainage District No. Two of Ward Seven – $70,000 for Ditch Spraying Program. Board Member Harry Aucoin accepted the award on behalf of the District.

 

Town of Iowa – $78,660 for Lateral 14B Drainage Improvements.


            President McMillin advised that a report would be received at this time from the staff concerning the possibility of putting together a program to provide removal of debris caused by Hurricane Rita for the elderly, handicapped, and/or those persons with medical conditions who were unable to bring the debris to the right-of-way for collection. Mr. McMurry stated that while there was a lot of merit to developing such a program, the staff needed more time to adequately study the idea and develop a proposal. He advised that there were inherent difficulties in having a plan that was workable and provided easy access for the public to be a part of it, as well as “passing muster” with FEMA as far as reimbursement.


            Mr. McMurry further advised that Mr. Gremillion had done some work with a consultant and that hopefully the staff would have a recommendation for the Police Jury at its next Regular Meeting on November 17, 2005.


            Motion was made by Dr. Mackey and seconded by Mr. Collins to receive the report as outlined by Mr. McMurry.


            Mr. Clement asked if the contractor for debris removal could be requested to appear before the Police Jury to give an update on the status of the clean-up efforts, and Mr. Wainwright advised that Mr. Smart was planning to have a representative of the U.S. Army Corps of Engineers (the Corps) at the Regular Meeting on November 17th.


            In answer to questions by Mrs. Griffin, Mr. McMurry explained that FEMA was responsible for removal of debris and would pay 100% of that cost for a certain period of time. He further explained that the Corps served as the responsible party or general contractor for the actual removal of debris, and in turn, the Corps hired private contractors to actually do the work. Mr. McMurry pointed out that governmental entities had the option of either contracting with the Corps or to hire another contractor(s) to do the work, and while the City of Westlake and the Town of Vinton had chosen the latter option, the Parish had contracted with the Corps which insured the 100% cost sharing by the federal government. Mr. McMurry stated that Crowder Gulf was the subcontractor actually removing the debris for the Parish.


            Mrs. Griffin stated that many of her constituents were under the impression that the City of Lake Charles was supposed to be picking up their garbage. She further stated that on some of the streets in her district including her own neighborhood, there had been trash and garbage sitting along the roadsides for five to six weeks and asked if there were problems being experienced by the removal company to cause such a delay. Mrs. Griffin spoke of her concerns of children having to walk past the piles of debris to and from their way to school, pointing out that the north side of her street (Jake Street) had become a dumping site.


            Mr. McMurry stated that collection of garbage was the City of Lake Charles’ responsibility (within the city limits of Lake Charles), just as it was the Parish’s responsibility in the unincorporated areas, and not the responsibility of the company doing storm debris removal. He further stated that the Corps contract was to pick up vegetative debris, metal debris, white goods (appliances), and construction and demolition debris associated with Hurricane Rita, and those items should be separated by the homeowner for pick-up.


            Mr. McMurry advised that the contractor had worked all the major storms along the Gulf coast, and they had never seen the amount of vegetative debris as they had seen after Hurricane Rita. He pointed out that the contractor had anticipated two to two-and-one-half million cubic yards of waste but that in reality, it appeared to be closer to four to five million cubic yards.


            Mrs. Griffin stated that when the waste was left unattended for such an extended period, it became a dumping ground which led to another problem. Mr. McMurry stated that perhaps these concerns should be directed to the City of Lake Charles.


            Mrs. Griffin advised that Mrs. Eason was having the same problems in her district. She stated that five or six weeks was too long for the debris to stay in front of someone’s home.


            Mr. McMurry asked the jurors to encourage their constituents to be patient and remind them that the storm was of great magnitude causing extensive damage but that the debris would get cleaned up. Mr. McMurry stated that to the extent that people were able to move the waste to the right-of-way as quickly as they could, they would be doing a great service not only to themselves but also to their fellow citizens. He pointed out that the sooner the debris was moved to the right-of-way, the more the federal government would pay for the expense of removing it, thus lessening the burden financially on local government.


            President McMillin pointed out that it was 6:00 p.m. at which time action had been scheduled but that debate on this issue would continue and be concluded prior to taking 6:00 action.


            Mr. Landry asked if the size of the pile of debris had any impact on the contractor’s decision to pick it up, and Mr. McMurry stated that several passes would be made before it was all collected. Mr. Wainwright pointed out that Public Works crews were going behind the contractor to collect the smaller stuff and bundle it into bigger piles.


            Mr. Smart stated that there had been some communication problems in dealing with the Corps, and he had asked several weeks ago that they provide a phone line for citizens to call and get minor problems taken care of. He advised that the contractor should be picking up everything they could even if it was smaller limbs or items. Mr. Smart stated he felt it was a good idea to have the Corps attend the next meeting of the Police Jury and that one of the Corps’ weaknesses had been communication with the Police Jury and its staff, as well as the public.


            Mrs. Eason asked if there was a deadline for the Parish’s eligibility for this type of assistance or would the contractor stay until the job was done. Mr. Smart advised that the contractor would make multiple passes until all items that posed danger or hazards to houses were removed. Mr. McMurry pointed out that after that happened, if there was still a large amount of waste on private property, the contractor would not wait around indefinitely for people to move it to the right-of-way.


            Mrs. Eason asked the staff to get information to the police jurors as to what time line the Corps anticipated for pickup, because the jurors were getting calls they could not answer, the primary question from their constituents being when their different types of waste would be picked up.


            Mr. McMurry advised that as of the prior week, the contractor had estimated having picked up 45-50% of waste which had been moved to the roadside, but if the staff got any other information from the Corps as requested by Mrs. Eason, it would be forwarded to the jurors.


            President McMillin requested that a representative of the Corps be present at the Regular Meeting of the Police Jury on November 17, 2005.


            A vote was taken on the motion on the floor, which was to receive the report given earlier in the meeting by Mr. McMurry concerning the possibility of putting together a program to provide removal of debris caused by Hurricane Rita for the elderly, handicapped, and/or those persons with medical conditions who were unable to bring the debris to the right-of-way for collection.


            The time being 6:12 p.m., President McMillin advised that the Police Jury would at this time, as advertised in accordance with law for action to be taken at 6:00 p.m., sit as a Board of Review to hear any protests on current tax assessments and take action accordingly. (The review period began on September 9, 2005, and ended on September 15, 2005, in the Calcasieu Parish Tax Assessor’s Office.)


            Mr. McMurry advised that this action had originally been scheduled for the Regular Meeting on September 22, 2005, but that meeting had been cancelled due to the mandatory evacuation for Hurricane Rita. He further advised that there was no need for the Police Jury to hear protests on this date, since the time period for protests had expired. Mr. McMurry stated that the Louisiana Tax Commission had made some decisions related to how assessments would be handled relative to damages to property sustained by Hurricane Rita, and he asked Mr. Richard Cole, Calcasieu Parish Tax Assessor, to address the Jury relative to those changes.


            Mr. Richard Cole then appeared before the Police Jury and advised that no appeals had been received in his office for the 2005 tax year and that he was proud of that. Mr. Cole stated that the tax assessment rolls had been prepared for January 1, 2006, but the law provided that when houses were destroyed or damaged because of a hurricane, the affected areas had to be reassessed, with a substitute tax roll required for the damaged areas.


            Mr. Cole advised that the certification for tax assessments would be filed under pre-Hurricane Rita circumstances, and then his office would reassess the damaged areas. He mentioned that the Legislature was considering legislation during the current session, with the encouragement of the delegation representing New Orleans and surrounding areas, to amend the law to include properties damaged by fire, wind, tornadoes, etc., and that would have to be taken into consideration if said legislation was approved.


            Mr. Cole estimated there were 15,000 area homes that were destroyed or damaged by Hurricane Rita, with approximately 2,200 of those homes being uninhabitable according to FEMA, and he felt certain his office would receive requests to reassess these properties.


            Mr. Charlie Atherton, 122 Vine Street, Sulphur, appeared before the Police Jury and commended the Jury and staff for the excellent job they were able to do after Hurricane Rita because of sound financial planning and full support of the Parish’s Office of Emergency Preparedness and Homeland Security. With regard to tax assessments, he stated that some agencies across the State wanted to maintain high tax levels even through the destruction (caused by Hurricanes Katrina and Rita), yet allow the Tax Assessors to “take the heat”, and he asked that the Police Jury support Mr. Cole in his endeavor to do what was fair and responsible for the public.


            Mr. Guidry expressed his appreciation for Mr. Cole spending so much of his personal time cooking meals at the Lake Charles Civic Center for the victims of both hurricanes.


            Motion was made by Dr. Mackey, seconded by Mr. Manuel and carried unanimously to receipt the report given by the Tax Assessor and to adopt the following resolution:


RESOLUTION


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, sitting as a Board of Review on the 3rd day of November, 2005, to receive protests from taxpayers in Calcasieu Parish, Louisiana, on assessments on the current tax rolls, it does hereby acknowledge and certify that no individuals or representatives of companies or corporations appeared before the Board to register any written or oral protest, nor were any protests received during the official review period which began on September 9, 2005 and ended on September 15, 2005, in the Calcasieu Parish Tax Assessor’s Office.


            BE IT FURTHER RESOLVED that it is hereby acknowledged that this hearing, originally scheduled to be held on September 22, 2005, was rescheduled for November 3, 2005, due to the mandatory evacuation and state of emergency created in Calcasieu Parish due to Hurricane Rita.

            President McMillin advised that action was needed on applications for liquor and beer permits. Mr. Vickers pointed out that for the first time, the list of permits included applications for liquor permits in the Moss Bluff area which were accepted by the staff pursuant to the legal opinion rendered by Mr. Allen Smith, General Counsel to the Police Jury, based on the recent Louisiana Supreme Court decision which allowed the permits to be issued in Moss Bluff.


            Mr. Manuel stated he knew there was nothing he could do about the issuance of the liquor permits in the Moss Bluff area, but he would have to vote in opposition.


            Motion was then made by Mr. Moon, seconded by Mrs. Griffin and carried, with Mr. Manuel voting against said motion, to approve the following applications for liquor and beer permits:

            Upon motion made by Mr. Guillory, which was duly seconded by Dr. Mackey and carried unanimously, the payment of all current invoices was approved.


            It was moved by Mr. Collins, seconded by Mrs. Griffin and carried unanimously to approve the minutes of the Regular Meeting of the Police Jury dated October 11, 2005.


            President McMillin advised that action was needed on RA06-004-05 which was a request by Andry LeGros for a portion of a road to be abandoned (696 Butler Lane in Ward Six, Police Jury District 11, Mrs. Treme’s district). He further advised that the Planning and Zoning Board had met on Tuesday, October 25, 2005, and voted unanimously to recommend that the request be granted.


            Motion was made by Mrs. Treme, seconded by Mr. Stelly and carried unanimously that the recommendation of the Planning and Zoning Board be upheld with reference to RA06-004-05 and that the request to abandon be approved; whereupon, the following resolution was adopted:



RESOLUTION


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 3rd day of November, 2005, that it does hereby abandon the west 40 feet of the road right-of-way for property located at 696 Butler Lane in Ward Six of Calcasieu Parish, Louisiana, as requested by Andy LeGros and recommended by the Calcasieu Parish Planning and Zoning Board, on the property described as:
