The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, August 4, 2005, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Hal McMillin, President, presiding, and the following members present:
Mesdames Mary Kaye Eason, Elizabeth Conway Griffin, and Sandra J. Treme; and Messrs. Brent Clement, Calvin Collins, Mike Danahay, Kevin Guidry, Tony Guillory, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Cornie Moon, and Tony Stelly

President McMillin called the meeting to order. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.
President McMillin welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
At this time State Senator Willie Mount and Representative Chuck Kleckley addressed the Police Jury on the recent Regular Session of the State Legislature. Senator Mount distributed a publication entitled “Louisiana Positives” and reported that local government fared well during this fiscal session. She pointed out that with 1200 bills having to be dealt with in a 45-day period, things happened quickly and sometimes “bad” things happened in that process. Senator Mount expressed her pride in the fact that the State had balanced the budget and that the Legislature had done some very challenging things with respect to health care and education.
Senator Mount stated that as Chairman of the Revenue and Affairs Committee, she was pleased to tell the jurors that several of the projects funded by local matches from the Police Jury had been approved for State funding, those being improvements to the Burton Coliseum, drainage improvements in the High Hope Road area, and the sewer project in Mossville. Senator Mount also spoke of the reinstatement of the $500,000 maximum liability for damages for injured persons seeking restitution from local governments, as well as reinstatement of urban and rural funding.
Senator Mount advised that two pieces of legislation were enacted relative to railroad crossing issues, those being (1) DOTD, instead of local government, would be required to study and take action to prioritize crossings needing closure, repair, or new signage, and (2) creation of a fund for various fines related to railroad crossings.
Senator Mount also advised that a huge number of bills were enacted that positively affected economic development which would make the State more competitive regionally, statewide, and internationally.
Senator Mount commended the jurors and those who represented them at the Capitol for giving the legislators the vital information they needed to effectively do their jobs.
Representative Chuck Kleckley then appeared before the Police Jury and stated he had learned a lot in his first session of the Legislature, pointing out that serving five years as a police juror had provided him with a good foundation for his work as a legislator.
Representative Kleckley primarily talked about the passage of House Bill No. 668 with reference to demolition, removal, replacement, repair and maintenance of community or individual sewerage systems situated within Calcasieu Parish which endangered public safety or welfare. He stated that there were a lot of governmental bodies throughout the State that were envious of what Calcasieu had been able to accomplish in this regard, pointing out that it was a very proactive and aggressive stance on the part of the Police Jury. Representative Kleckley thanked Mr. Vickers, President McMillin, Mr. Landry, and Mr. Clement for testifying before committee on the importance of this legislation.
Mr. Clement expressed his appreciation for the efforts of the delegation in getting funding for the Southwest Louisiana Economic Development Partnership which served a five-parish area.
President McMillin voiced his gratitude, on behalf of the citizens, for the funding granted by the Legislature for the Mossville sewer project and the drainage improvements in the High Hope Road area.
Senator Mount reminded the jurors that planning for the State’s Capital Outlay for 2006 and 2007 was ongoing and that the deadline to submit items was November 1, 2005.
Mr. Guillory and Mr. Guidry presented certificates of recognition at this time to the following members, coaches, and manager of the 2005 Lake Charles Sluggers 10-U Girls Slow Pitch Softball Team: Manager Gary Seemion; Coaches Willie Clayton, Clivis Green, and Brinkley Davis (unable to attend); and players Raven Pappion, Kendra Bryant, Kailonee Clayton, Sierra Seemion, Clirissa Green, Kaitlin Jeanis, Taylor Guillory, Jasmine Miller, Whitney Carter, Morgan Davis, Ashley Fuselier, Katelyn Pappion, and Tressa Rigmaiden.
Mr. Guidry pointed out that the team’s accomplishments included the following: USSSA World Tournament Qualifier Champions, Lake Charles Fathers Day Classic Champions, Shelby Cormier Memorial Classic Champions, A.S.A. State Tournament Champions, USSSA State Tournament Champions, and the PONY National Champions. Mr. Guidry also pointed out that the team’s record was 32 - 0 which he said was extremely hard to accomplish when dealing with that many young girls and which he said was a tribute to an outstanding job by the coaches of the team.
Mr. Al Prebula, Vice President of Citgo Lake Charles, appeared before the Police Jury with reference to Citgo’s new wet gas scrubber project, an EPA-mandated project. He advised that this was a $100 million project which was nearing completion and which would forever change the skyline of Lake Charles. Mr. Prebula stated that his primary objective was to address the vapor plumes which would be produced by this project and to assure the public that it would not adversely affect the environment but would actually serve to clean up the atmosphere. He pointed out that while they may look like smoke, the plumes were actually water vapor and that the length of the plumes would be based on atmospheric conditions, i.e., on cold days with no wind blowing, the plume would get longer and longer.
Mr. Prebula gave a brief overview of Citgo, pointing out that it was the fourth largest refinery in the United States and that it had paid $10 million in property and sales use taxes.
The hour being 6:00 p.m., President McMillin advised that a public hearing would be held at this time, as a result of notice provided to the owners of properties described below, in accordance with Article II-Chapter Six of the Code of Ordinances of Calcasieu Parish, Louisiana, ordering said owners to show cause as to why the structures on said properties should not be condemned:

With reference to the first piece of property located at 300 Dobbertine Road, southeast Lake Charles area, Mr. Wes Crain, Assistant Director of Development, recommended that action be deferred for thirty days due to the fact that there was a new owner of said property.
President McMillin asked if there was anyone in the audience who wished to address the Police Jury regarding this piece of property, and hearing no comments, motion was made by Mr. Stelly, seconded by Mr. Moon and carried unanimously that the staff’s recommendation be approved and that action be deferred for thirty days on this proposed condemnation.
With reference to the second piece of property located at 2276 Highway 388, Vinton area, Mr. Crain advised that no action was necessary due to the fact that the house located on said property had been removed.
With reference to the third piece of property located at 759 Long Drive, Moss Bluff area, Mr. Crain recommended that the house and shop be condemned and removed within thirty days.
President McMillin asked if there was anyone in the audience who wished to address the Police Jury regarding this piece of property, and hearing no comments, motion was made by Mr. Collins, seconded by Mrs. Griffin and carried unanimously that the staff’s recommendation be approved and that the house and shop located at 759 Long Drive be condemned and removed within thirty days; whereupon, the following ordinance was adopted:

With reference to the fourth piece of property located at 339 Neely Road, north Westlake area, Mr. Crain advised that the owner of said property had asked for additional time to repair the manufactured home. Mr. Crain recommended that the property owner be allowed 90 days to repair.
Motion was made by Dr. Mackey and seconded by Mr. Stelly to approve the staff’s recommendation and to give the owner of property situated at 339 Neely Road, north Westlake area, a 90-day period of time to repair the manufactured home.
President McMillin asked if there was any one in the audience who wished to address the Police Jury regarding this piece of property, and Mr. Robert Joseph Owens, owner of the property, appeared before the Jury and stated that he and his wife both had several health problems. He further stated that he wanted to keep the mobile home where it was located and fix it up so that someday it could be rental property. Mr. Owens also stated that there were other properties in his area that looked worse than his, and he had pictures to prove that claim.
In answer to a question by Mr. Manuel, Mr. Owens stated that he would probably need six months to a year to repair the manufactured home, because he and his wife were having to go back and forth to Houston, Texas, for medical treatments.
President McMillin pointed out that this was located in his district, and he told Mr. Owens that granting six months would be unprecedented. He assured Mr. Owens that if he could show some positive results in 90 days, he did not foresee a problem with the Jury granting another extension. President McMillin further assured Mr. Owens that the Police Jury was willing to work with him and suggested that he pass along the information about the other properties in this area to Mr. Vickers or Mr. Crain, and those would be dealt with.
President McMillin pointed out that the manufactured home had been brought onto the property in 2004, and that it was time for Mr. Owens to make a positive move on repairing it for the sake of the neighbors who considered it an eyesore.
Mr. Owens stated that the manufactured home had been vandalized by children in the neighborhood but that he had replaced the broken windows and doors.
Mr. Landry pointed out that this problem had been going on for one and one-half years and asked why it was just now being brought before the Police Jury. Mr. Crain explained that in some cases, the staff tried to work with the owner to get them to comply prior to bringing it to the Jury.
A vote was then taken on the motion on the floor, which was to approve the staff’s recommendation and to allow the owner of property situated at 339 Neely Road, north Westlake area, a 90-day period of time to repair the manufactured home, and said motion carried unanimously.
With reference to the fifth piece of property located at 1662 Thompson Road, Moss Bluff area, Mr. Crain recommended that the structure be condemned and removed within thirty days.
President McMillin asked if there was anyone present in the audience to address the Police Jury regarding this property and hearing no comments, motion was made by Mr. Collins, seconded by Mr. Manuel and carried unanimously that the staff’s recommendation be approved; whereupon, the following ordinance was adopted:

President McMillin asked if there was anyone present in the audience to address the Police Jury regarding this property and hearing no comments, motion was made by Mr. Landry, seconded by Mr. Guillory and carried unanimously that the staff’s recommendation be approved and that action be deferred for thirty days.
With reference to the seventh piece of property located at 1535 Georgia Road, Moss Bluff area, Mr. Crain recommended that the manufactured home situated on said property be condemned and removed within thirty days.
President McMillin asked if there was anyone present in the audience to address the Police Jury regarding this property and hearing no comments, motion was made by Mr. Collins, seconded by Mrs. Griffin and carried unanimously that the staff’s recommendation be approved; whereupon, the following ordinance was adopted:
