            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, July 7, 2005, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Hal McMillin, President, presiding, and the following members present:

 

Mesdames Mary Kaye Eason, Elizabeth Conway Griffin, and Sandra J. Treme; and Messrs. Francis Andrepont, Mike Danahay, Kevin Guidry, Tony Guillory, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Cornie Moon, and Tony Stelly

 

Absent: Messrs. Brent Clement (ill) and Calvin Collins (out-of-town funeral)


            Also present were Mr. S. Mark McMurry, Parish Administrator; Mr. Bryan Beam, Assistant Parish Administrator; Mrs. Coleen Clark, Executive Secretary; Mr. Richard Gremillion, Director of the Office of Emergency Preparedness and Homeland Security; Mrs. Cheryl Heisser, Director of Human Resources; Mr. Jerry Milner, Director of Finance; Mr. Allen L. Smith, Jr. of the firm of Plauche, Smith and Nieset, General Counsel; Mr. Claude Smart, Parish Engineer; Ms. Kathy P. Smith, Recording Secretary; Mr. Gerry Trahan, Director of Facility Management; and Mr. Jim Vickers, Director of Planning and Development.

 

            President McMillin called the meeting to order. The invocation was pronounced by Mrs. Treme which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.

 

            President McMillin welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.

 

            President McMillin asked the jurors to refer to the Government Access Channel when talking about the Parish’s television channel, rather than Channel 61 (for CommuniComm customers) or Channel 63 (for Cox Communications customers), to avoid any confusion for the viewing public.

 

            President McMillin advised that he had visited Mr. Clement, who was in the hospital recovering from an appendectomy, and Mr. Clement had sent his best wishes to his colleagues and staff. Mr. Clement also conveyed his appreciation to all who had visited and prayed for him, as well as those who had sent cards and/or flowers.

 

            President McMillin asked the jurors to continue to keep Mr. Collins in their prayers. He explained that there was a death in Mr. Collins’ family, and he was out-of-town for the funeral.

 

            President McMillin advised that the Calcasieu Parish Police Jury Comprehensive Annual Financial Report for the year ending December 31, 2004, would be presented at this time. Mr. Milner thanked the members of the financial team who had been instrumental in compiling the report, particularly Mrs. Tammy Bufkin and Ms. Kelly Fontenot. He also thanked the auditors for the work done on the report.

 

            Mr. Gus Schram of the Parish’s auditing firm, Gus Schram and Company, Ltd., appeared before the Police Jury and stated that his firm had merged with another local firm, McElroy, Quirk and Burch. He stated that one of the goals he hoped to accomplish in the merger would benefit the Parish, to supplement auditing capabilities and bolster staff resources, as well as a personal desire to get some work load relief. Mr. Schram introduced Mr. Michael McGee and Mr. Marty Chehotsky of his firm.

 

            Mr. Chehotsky then appeared before the Police Jury to give a brief overview of the report. He congratulated the Jury for receiving the Government Finance Officers Association’s Certificate of Excellence in Financial Reporting which was the 13th consecutive year the Jury had received this prestigious award. Mr. Chehotsky stated that for the year ending December 31, 2004, the Police Jury’s primary governmental net assets totaled $594,581,495, and the net assets of the component units required to be included in the overall report were $165,323,393, for a total of Parish net assets in the amount of $759,904,888. Mr. Chehotsky pointed out that the net increase from last year for the primary government was $14,366,233 and for the component units, $2,079,072.

 

            Mr. Chehotsky stated that tests were done to ensure compliance with federal laws governing the approximately $10 million received in federal funding. He advised that all of the findings from the previous year had been satisfied except for one which dealt with segregation of duties in an “outside” office that did not have enough employees to properly segregate those duties. Mr. Chehotsky advised that the internal audit department of the Division of Finance had been working with this outside office to make sure all controls were being monitored.

 

            Mr. Chehotsky thanked Mr. Milner and Ms. Kelly Fontenot of the Division of Finance, and particularly Mrs. Tammy Bufkin, for the cooperation and assistance they rendered in performing and completing the audit by the deadline of June 30th.

 

            Motion was made by Mr. Andrepont, seconded by Dr. Mackey and carried unanimously to receive the report relative to the Calcasieu Parish Police Jury Comprehensive Annual Financial Report for the year ending December 31, 2004.

 

            It was moved by Mrs. Griffin, seconded by Mr. Landry and carried unanimously to approve the following applications for liquor and beer permits, and further, to ratify the issuance of the following special events permits:

            Chairman Stelly advised that the purpose of the meeting on this date was to review the proposed agenda for the regular meeting of the Police Jury to be held on July 7, 2005. He pointed out that a public hearing relative to the levy of ad valorem tax milages within Calcasieu Parish would be held at the regular meeting on July 7th at 5:30 p.m.


            Following review of the items to be considered by the Police Jury on July 7th, it was unanimously recommended that the proposed agenda be accepted as presented by the staff.


            Also, recommendations for appointments to various boards of special service districts were made by members of the Committee.


            There being no further business, Chairman Stelly declared the meeting to be adjourned.

2.         Presented a proclamation to Mr. Samuel Hartley proclaiming Thursday, June 30, 2005, as “Samuel Hartley Day” in Calcasieu Parish in recognition for being named Deputy of the Year for the Calcasieu Parish Sheriff’s Office.

 

3.         Appearance of Mr. T.A. Jones with the Lake Charles Fire Department to discuss concerns regarding the use of fireworks during the 4th of July weekend due to the current drought conditions in the Parish.

 

4.         Considered the request of Mr. Henry Misse, 1315 West Parish Road, Sulphur, that the Parish share in the cost of 36-inch pipe required along Currie Drive to provide proper drainage of his development, Sandia Estates Phase II, and further, that he provide a ten-foot easement along Currie Drive which he estimated to be valued at $8,000. (Current parish practice in situations where it is necessary to drain a subdivision along an existing road is for the Parish to provide labor and equipment to install the pipe, and the developer to pay for materials.) Mr. James Webb of Webb Engineering, 1015 Cleveland Street, Lake Charles, also appeared before the Committee on behalf of Mr. Misse. The Committee made two recommendations: (a) that the staff recommendation to follow current practice for the Parish to provide labor and equipment to install the pipe, and the developer to pay for materials, be adhered to in this case (voting against this recommendation were Mr. Andrepont, Mr. Clement, Mr. Danahay, Mr. Stelly, and President McMillin); and (b) that an ad-hoc committee be appointed to work with the engineering staff, Mr Misse, and Mr. Webb to attempt to negotiate a compromise in this matter (the vote on this recommendation carried unanimously). President McMillin appointed Mr. Andrepont, Mr. Danahay, Mr. Landry, and Dr. Mackey to serve on the ad-hoc committee.

 

5.         Received report from staff concerning regulatory authority over solicitation or “panhandling” at intersections of parish roads. The Committee recommended that the Calcasieu Parish Sheriff’s Office be informed of the current state law (LSA-R.S. 32:218) which pertains to solicitation or panhandling at intersections.

 

NOTE: on June 2, 2005, the Police Jury deferred action to June 30, 2005, to allow the Police Jury’s Legal Counsel to look into said matter.

 

6.         Received report from Legal Counsel and the Engineering Staff with reference to the authority to widen drainage outlets under railroad tracks wherein Mr. Smith advised that the Meyer Group engineering firm was currently doing a study of the High Hope Road area in Sulphur which precipitated this issue. He further advised that he would ask for engineering recommendations as soon as said study was completed, after which he would meet with representatives of Kansas City Southern Railroad Company, and report back to the Police Jury.

 

NOTE: on May 5, 2005, the Police Jury requested that the Staff and Legal Counsel look into this matter and report back.

 

7.         Recommended that a resolution be adopted accepting Holbrook Acres Subdivision Located in Section 28, Township 8 South, Range 9 West, off of Dunn Ferry Road in Ward Six. (Police Jury District 14, Mr. McMillin)

 

8.         Recommended that a resolution be adopted accepting the LeFev’ Estates Subdivision located in Section 29, Township 11 South, Range 8 West, off of Helms Road in Ward Three . (Police Jury District 7, Mr. Landry)

 

9.         Recommended that an ordinance be adopted amending the Code of Ordinances of Calcasieu Parish to establish a 40-mph speed limit on Lou Farley Road in Ward Five. (Police Jury District 11, Mrs. Treme)

 

10.       Recommended that an ordinance be adopted amending the Code of Ordinances of Calcasieu Parish to amend the Master Private Road List to include a 667-foot extension located off of the east end of Latiolais Lane located in Ward Six. (Police Jury District 11, Mrs. Treme)

 

11.        Recommended that the President of the Police Jury be authorized to execute the necessary documentation for the acquisition of right-of-way from Darby Luke Guillory on Red Davis Road in Ward Three. (Police Jury District 7, Mr. Landry, and Police Jury District 10, Mr. Stelly)

 

12.       Recommended that the President of the Police Jury be authorized to execute the necessary documentation for a temporary construction easement from Faye McGee and James Mistretta on South Perkins Ferry Road in Ward One. (Police Jury District 1, Mr. Manuel)

 

13.       Recommended that a resolution be adopted approving an Original Agreement between the Police Jury and the Louisiana Department of Transportation and Development (LA DOTD), and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto for the following projects.

 

Ward One (District 1): to widen Park Road to accommodate a left turn lane northbound and a thru and right turn lane southbound. Along Recreation Boulevard, extend the right turn lane storage length. Signals will be added if warranted. (State Project No. 700-10-0145 and Federal Project No. STP-1004(532) for pre-construction engineering services and State Project No. 742-10-0126 and Federal Project No. STP-1004(528) for construction costs, including construction engineering services and testing. The Federal Highway Administration (through LA DOTD) will fund 80% of approved expenses with the Police Jury providing the remaining 20%. After final acceptance of the project, the Police Jury shall assume the maintenance of the improvement at its expense.)

 

Ward Four (District 15): to repair Mosswood Drive Bridge under the Bridge Discretionary Program whereby the Parish will perform construction inspection services of said structure at their expense. (State Project No. 713-10-0106 and Federal Aid Project No. BDP-1005(506) has been assigned for the construction of the project. Federal Highway Administration (through LA DOTD) will match 80% of the cost not to exceed $94,570.67. The Parish will contribute 20% matching funds for an estimated amount of $23,642.66 toward the cost of construction. The Parish shall provide to LA DOTD funds in the amount of $23,642.66, which are in ratio to Federal Highway Administration’s maximum participation plus 100% of any additional cost above the total participating costs.)

 

14.       Recommended that a resolution be adopted accepting the necessary road and drainage rights-of-way from SVK, LLC, in exchange for the Police Jury making a legal commitment to construct the westerly extension of Ham Reid Road, one-half mile from Elliot Road to Vincent Road, by October 1, 2006, and approving an agreement between the Police Jury and the City of Lake Charles whereby the City of Lake Charles will reimburse any construction costs of said road to the Police Jury, if this area is annexed prior to completion of the construction of the Ham Reid Road westerly extension, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto. 15.       Recommended an amendment to the 2006 Road District No. Three Capital Improvement Plan to add the westerly extension of Ham Reid Road, one-half mile from Elliot Road to Vincent Road, in the amount of $900,000. (Police Jury District 8, Mrs. Eason)

 

16.       Recommended that the Parish Purchasing Agent be authorized to advertise for bids for bulk oil in various container sizes for use by the Division of Engineering and Public Works.

 

17.       Advised that the Police Jury Planning and Zoning Liaison Group met and reviewed proposed amendments (revisions) to the subdivision ordinance and recommended that these proposed amendments be forwarded to the Planning and Zoning Board for their consideration at their regular meeting in August with final action by the Police Jury at a later date.

 

18.       Recommended that a resolution be adopted accepting Highland Forest Subdivision Part 2, Phase 2, Phase 2 located in Section 19, Township 9 South, Range 8 West, located off of Forest Way Road and South Forest Way Road in Ward Four. (Police Jury District 3, Mrs. Griffin)

            Motion was made by Mr. Manuel, seconded by Mr. Moon and carried unanimously that Recommendation No. 1 of the Public Works Committee be approved and that in accordance with the recommendation of the Parish Engineer, the low bid in the amount of $141,199.35 of Highway Graphics, Inc. be accepted for Calcasieu Parish Project No. 2005-09 (Pavement Striping of Various Roads in Wards 1, 2, 3, 4, 5, 6, 7, and 8 of Calcasieu Parish), said bids having been received by the Police Jury at the Public Works Committee meeting on June 30, 2005, and further, that the President of the Police Jury be authorized to execute the contract documents and any amendments or modifications thereto in conjunction with Project No. 2005-09.

 

            It was moved by Mrs. Griffin, seconded by Mr. Guidry and carried unanimously to approve Recommendation No. 2 of the Public Works Committee.

 

            Upon motion made by Dr. Mackey, which was duly seconded by Mrs. Griffin and carried unanimously, Recommendation No. 3 of the Public Works Committee was approved.

 

            Motion was made by Mr. Andrepont and seconded by Mr. Danahay that Recommendation No. 4 of the Public Works Committee be approved. Mr. Andrepont reported that the ad-hoc committee had met, and several things had been brought to the table. He further reported that the ad-hoc committee had decided to defer any action for sixty days until more information could be presented to the Police Jury.

 

            A vote taken on the motion on the floor carried unanimously which was to approve Recommendation No. 4 of the Public Works Committee as stated heretofore.

 

            Upon motion made by Mr. Manuel, which was duly seconded by Mr. Stelly and carried unanimously, Recommendation No. 5 of the Public Works Committee was approved.

 

            It was moved by Mr. Moon, seconded by Mrs. Griffin and carried unanimously to approve Recommendation No. 6 of the Public Works Committee.

 

            Motion was made by Mrs. Griffin, seconded by Mr. Danahay and carried unanimously that Recommendation No. 7 of the Public Works Committee be approved; whereupon, the following resolution was adopted:

 

RESOLUTION


            WHEREAS, Wallace Nichols, Manager of Holbrook Acres, L.L.C., subdivided certain property in Ward Six of Calcasieu Parish, Louisiana, known as Holbrook Acres Subdivision, a subdivision in Section 28, Township 8 South, Range 9 West, Calcasieu Parish, Louisiana; and


            WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana; and


            WHEREAS, said subdivision plat was prepared by William L. Haymon Registered Land Surveyor No. 1823, and certification was made that the subdivision plat was prepared in accordance with R.S. 33:5051 and all other laws of the State of Louisiana; and


            WHEREAS, said subdivision plat will be filed for record in the Office of the Clerk of Court on July 20, 2005, and will bear File No. 2727924.


            NOW THEREFORE,


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 7th day of July, 2005, that it does hereby officially accept the plat of Holbrook Acres Subdivision in Ward Six of Calcasieu Parish, Louisiana, including East Holbrook Circle and South Holbrook Circle located within said subdivision, for future maintenance by the Parish.

            Upon motion made by Mr. Landry, which was duly seconded by Mr. Moon and carried unanimously, Recommendation No. 8 of the Public Works Committee was approved; whereupon, the following resolution was adopted:

 

RESOLUTION


            WHEREAS, Henry LeFevre subdivided certain property in Ward Three of Calcasieu Parish, Louisiana, known as LeFev’ Estates Subdivision, a subdivision in Section 29, Township 11 South, Range 8 West, Calcasieu Parish, Louisiana; and


            WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana; and


            WHEREAS, said subdivision plat was prepared by George A. Evans, Jr., Registered Land Surveyor No. 4750, and certification was made that the subdivision plat was prepared in accordance with R.S. 33:5051 and all other laws of the State of Louisiana; and


            WHEREAS, said subdivision plat will be filed for record in the Office of the Clerk of Court on July 12, 2005, and will bear File No. 2726761.


            NOW THEREFORE,


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 7th day of July, 2005, that it does hereby officially accept the plat of LeFev’ Estates Subdivision in Ward Three of Calcasieu Parish, Louisiana, including Dovick Road located within said subdivision, for future maintenance by the Parish.

            It was moved by Mrs. Treme, seconded by Dr. Mackey and carried unanimously to approve Recommendation No. 9 of the Public Works Committee; whereupon, the following ordinance was approved:

 

ORDINANCE NO. 4928

 

AN ORDINANCE amending Chapter 17, Art. II, Div. 2. Speed Limits, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to establish a 40 mph speed limit on Lou Farley Road in Ward Five of Calcasieu Parish.


            BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, that it does hereby amend Chapter 17, Art. II, Div. 2. Speed Limits, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, as follows:


            SECTION I.   Sec. 17-67, Forty miles per hour, of the Code of Ordinances is amended by including the following road in the provisions of said section:


            Lou Farley Road in Ward 5


            BE IT FURTHER ORDAINED that effective immediately, no vehicle shall travel in excess of the maximum speed limit established above.


            BE IT FURTHER ORDAINED that appropriate signs shall be posted along the road set forth above, at reasonable intervals, to warn the operators of vehicles of the speed limit herein imposed.


            BE IT FURTHER ORDAINED that anyone violating the provisions of this ordinance, upon conviction, shall be fined as provided in Section 1-9 of the Code of Ordinances of Calcasieu Parish, Louisiana.


            BE IT FURTHER AND FINALLY ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.


            This ordinance was adopted on the 7th day of July, 2005.

AN ORDINANCE amending Chapter 23 – Subdivision and Chapter 26 – Zoning, of the Code of Ordinances of the Parish of Calcasieu, Louisiana.

                          

            BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 7th day of July, 2005, that it does hereby amend Chapter 23 – Subdivision, Section 23-8 ©), and Chapter 26 – Zoning, Section 26-15 (b), of the Code of Ordinances of Calcasieu Parish, Louisiana, to include a 667-foot extension located off of the east end of Latiolais Lane located in Ward Six of Calcasieu Parish, to the revised Master Private Road List, as follows:


            SECTION 1.   Section 23-8. Administration and violation, is amended as follows:

 

            (c)       Variance on Private Road. No application for variance request shall be processed by the commission staff for authorization of a development permit on a private road other than those shown on Calcasieu Parish’s Master Private Road List officially adopted by the Police Jury on June 20, 2002, with revisions adopted on May 1, 2003, June 5, 2003, November 6, 2003, April 1, 2004, May 6, 2004, July 22, 2004, April 7, 2005 and July 7, 2005, a copy of which is attached hereto and made a part hereof, and which is also hereby incorporated in the Code of Ordinances of Calcasieu Parish, Louisiana, as Exhibit A in the Appendix Chapter. Procedures for applying for development permits without public road frontage requirements.

 

SECTION 2.Section 26-15. Procedures for applying for development permits without public road frontage requirements, is amended as follows:

 

            (b)       No application for variance request shall be processed by the Division of Planning and Development for authorization of a development permit on a private road other than those shown on Calcasieu Parish’s Master Private Road List officially adopted by the Police Jury on June 20, 2002, with revisions adopted on May 1, 2003, June 5, 2003, November 6, 2003, April 1, 2004, May 6, 2004, July 22, 2004, April 7, 2005 and July 7, 2005, a copy of which is attached hereto and made a part hereof, and which is also hereby incorporated in the Code of Ordinances of Calcasieu Parish, Louisiana, as Exhibit A in the Appendix Chapter.


            BE IT FURTHER ORDAINED that this ordinance shall become effective immediately upon adoption.


            BE IT FURTHER ORDAINED that any ordinance or parts of any ordinance in conflict herewith are hereby repealed.


            BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.
