            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, November 4, 2004, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Brent Clement, President, presiding, and the following members present:

 

Mesdames Elizabeth Conway Griffin and Sandra J. Treme; and Messrs. Francis Andrepont, Calvin Collins, Mike Danahay, Kevin Guidry, Tony Guillory, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, and Tony Stelly

 

Absent: None


            Also present were Mr. S. Mark McMurry, Parish Administrator; Mr. Bryan Beam, Assistant Administrator; Mrs. Coleen Clark, Executive Secretary; Mr. Richard Gremillion, Director of Homeland Security and Emergency Preparedness; Mr. Jerry Milner, Director of Finance; Mr. Claude Smart, Parish Engineer; Mr. Allen L. Smith, Jr. of the firm of Plauche, Smith and Nieset, General Counsel; Mrs. Kathy P. Smith, Recording Secretary; Mr. Gerry Trahan, Director of Facilities Management; and Mr. Jim Vickers, Director of Planning and Development.

 

            President Clement called the meeting to order. The invocation was pronounced by Mr. Stelly, which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.

 

            President Clement welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.

 

            President Clement advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for Additions and Renovations to LSU Ag Center Extension Service, 7101 Gulf Highway 385, Lake Charles, and appropriate action would be taken thereon.

 

            Mr. McMurry then proceeded to open the following bids:

            There being no other bids submitted, motion was made by Mrs. Griffin, seconded by Mr. Manuel and carried unanimously that the bids be referred to the Project Architect for final tabulation.

 

            President Clement advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for an oil, gas, and mineral lease on certain tracts, parcels, or strips of land in Sections 30 and 31, Township 9 South, Range 6 West, and Section 25, Township 9 South, Range 7 West in Wards Two and Eight (Police Jury District 10).

 

            Mr. McMurry then proceeded to open the bid of Gray Production Company of Lafayette, the details of which are set forth in the following resolution which was adopted upon motion made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously:

 

RESOLUTION


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 4th day of November, 2004, that it does hereby accept the bid of Gray Production Company for a mineral lease on the following described property, to-wit:

 

That certain tract, parcel or strip of land situated in Section 30, Township 9 South, Range 6 West, Calcasieu Parish, Louisiana, and being more particularly described as follows: Part of the Southwest Quarter (SW/4) of Section 30, Township 9 South, Range 6 West, said strip of land being 60 feet wide across the entire one-quarter section, the center of said 60 foot strip being particularly defined as follows: commencing at the Southeast Corner of Section 25, Township 9 South, Range 7 West; thence in a Southeasterly direction to the Southwest Corner of the Town of Iowa; this town corner being at the one-quarter section post between Sections 30 and 31, Township 9 South, Range 6 West, which town corner is also described as being the point at the Southeast Corner of the Southwest Quarter (SE Corner of SW/4) of Section 30, Township 9 South, Range 6 West, the strip hereby described and leased being 30 feet in width on each side of the line hereinbefore described. Said strip of land described herein contains 3.80 acres, more or less, and is the same tract of land acquired by the Parish of Calcasieu from the Louisiana Western Railroad Company in that certain Sale of Land filed April 3, 1912, and recorded April 9, 1912, in Conveyance Book 130, Page 488, File No. 16311 of the public records of Calcasieu Parish, Louisiana.


for a three-year lease with a cash bonus of Six Hundred Sixty Five and no/100 Dollars ($665.00) and an annual rental of Six Hundred Sixty Five and no/100 Dollars ($665.00) and with the Calcasieu Parish Police Jury to receive one-fifth (1/5th) of all oil produced and saved or utilized, one-fifth (1/5th)of all gas produced and saved or utilized, one-fifth (1/5th) of all sulphur produced and saved, and one-fifth (1/5th) of all other liquid or gaseous hydrocarbon minerals produced and saved.


            BE IT FURTHER AND FINALLY RESOLVED that the President of the Police Jury is hereby authorized to execute the necessary lease contract to consummate this transaction.

            President Clement recognized Louisiana Representative Brett Geymann as being present at the meeting on this date. Representative Geymann stated that he was just visiting the meeting and was not there for any particular purpose.

 

            Mr. McMillin praised and thanked Representative Geymann for his prompt attention to various projects in which Mr. McMillin had particular interest, for example, an overpass at Sampson Street in Westlake, widening of the State highway between Westlake and Moss Bluff, etc.

 

            Mr. Kleckley presented an award from the Louisiana Chapter of the American Planning Association to the Calcasieu Parish Police Jury in recognition of the Nelson Road Overlay District as Smart Growth in Louisiana: Principles, Practices, and Projects. Mr. Kleckley advised that because of the work done by the Division of Planning and Development in getting the overlay district approved which he considered a very proactive move, the Police Jury had received this award, and he wanted to acknowledge the planning staff for this project and for the great work they did. Mr. Kleckley pointed out that this was the first time the Division of Planning and Development had received an award from the Louisiana Chapter of the American Planning Association.

 

            Mr. Vickers stated that the award would not have been possible without the Police Jury and the Planning and Zoning Board.

 

            President Clement advised that a report would be received at this time from the Parish’s Legal Counsel with reference to the Parish’s Noise Ordinance (Section 18-94 through 18-103, both inclusive, of the Code of Ordinances of Calcasieu Parish, Louisiana. (Mr. Mike Rushing appeared before the Public Works Committee on September 30, 2004, with reference to this matter.)

 

            Mr. Allen Smith, Legal Counsel, advised that he had talked with Mr. Rob McCorquodale, legal counsel for the Sheriff’s Office, in an attempt to find out if an amendment to the current ordinance which Mr. Smith had drawn up would be enforceable by the Sheriff’s deputies. Mr. Smith stated that once he received a final response from Mr. McCorquodale on that question, he would present the amendment to the Police Jury for consideration.

 

            Motion was made by Mrs. Griffin, seconded by Mr. McMillin and carried unanimously that the report given by Legal Counsel be accepted.

 

            It was moved by Mr. McMillin, seconded by Mr. Stelly and carried unanimously to approve the following applications for liquor and beer permits:
