The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, October 21, 2004, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Brent Clement, President, presiding, and the following members present:
Mesdames Elizabeth Conway Griffin and Sandra J. Treme; and Messrs. Francis Andrepont, Calvin Collins, Mike Danahay, Kevin Guidry, Tony Guillory, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, and Tony Stelly

Also present were Mr. S. Mark McMurry, Parish Administrator; Mr. Bryan Beam, Assistant Administrator; Mr. Richard Gremillion, Director of Homeland Security and Emergency Preparedness; Mrs. Cheryl Heisser, Director of Human Resources; Mr. Jerry Milner, Director of Finance; Mr. Claude Smart, Parish Engineer; Mr. Ed McGuire of the firm of Plauche, Smith and Nieset, General Counsel; Mrs. Kathy P. Smith, Recording Secretary; Mr. Gerry Trahan, Director of Facilities Management; and Mr. Jim Vickers, Director of Planning and Development.
President Clement called the meeting to order. The invocation was pronounced by Pastor Norman Thomas of New Life Family Worship Center in Lake Charles, which was followed by the Pledge of Allegiance led by Mr. Guidry. The roll was called with the result being as outlined above.
President Clement welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
Louisiana Senator Don Cravins, appeared before the Police Jury with reference to his candidacy for the U. S. Congress, 7th District. He was introduced by Mr. Guillory who pointed out that Senator Cravins was related to both he and Louisiana Representative Elcie Guillory.
Senator Cravins applauded the Police Jury for its beautifully-renovated facility which he had toured prior to the meeting. He stated he had served in the Senate for the past 13 years and that what Louisiana needed was effective leadership in Washington – someone who would fight for Louisiana and give it the resources to meet the infrastructure demands it had.
Senator Cravins stated when he was first elected to represent St. Landry Parish, it was one of the poorest parishes in the State but now it was one of the fastest growing. He further stated that education, economic development and health care all needed to be addressed, and he pointed out that he had helped establish a program to provide free medication to persons needing affordable pharmaceutical care in St. Landry and Evangeline parishes.
Senator Cravins closed by saying he hoped everyone would take a look at his record, his past accomplishments, leadership, and what he stood for, and vote for him in the upcoming election.
President Clement stated that Louisiana Senator Willie Mount would at this time address the Police Jury with regard to her candidacy for the U. S. Congress, 7th District. She appeared before the Police Jury and offered effective leadership and new energy, as well as the ability to bring people together to get things done.
Senator Mount advised that she had served six years as Mayor of the City of Lake Charles and during that time had dealt with unfunded mandates, EPA issues concerning federal highway infrastructure, water and sewer systems, dogs howling in the middle of the night, and she understood the needs of real people and local government.
Senator Mount also advised that she was serving her fifth year as a Louisiana Senator and was Chairman of the Revenue and Affairs Committee, working together with 38 other senators across the State with different views in order to reach a consensus for what was best for this area and the State.
Senator Mount offered a willingness to fight for the area and to work hard and stated she was very committed to southwest Louisiana and loved public service. She commended the Police Jury for an excellent job in promoting the diversity of the area’s economic base and stated that was why the Parish was successful in its endeavors, because it knew how to work together in efforts of which she had been part of the team. Senator Mount closed by saying there were issues to be addressed such as health care and education, and she asked for the jurors’ vote in the upcoming election.
With reference to an item on the agenda to present a plaque to Mr. Ray McClelland in recognition and appreciation of approximately 25 years of service as Fire Chief of Ward Seven Fire Protection District No. One, President Clement advised that Mr. McClelland was unable to attend the meeting on this date but that a function was being planned for him later in the month which he would attend and would present the plaque to Mr. McClelland at that time.
Motion was made by Mr. Andrepont, seconded by Mr. McMillin and carried unanimously that the rules be suspended by a two-thirds majority vote to present a plaque to Mr. George Tuttle in recognition and appreciation of 32 years of service as a member of the Board of Commissioners of West Calcasieu Port, Harbor and Terminal District.
Mr. Andrepont asked Mrs. Griffin, Mr. McMillin, President Clement, and Mr. Danahay to join him in presenting the plaque to Mr. Tuttle. Mr. Andrepont stated that Mr. Tuttle had served unselfishly and that he had the privilege of working with Mr. Tuttle as liaison to the West Calcasieu Port, Harbor and Terminal District. Mrs. Griffin, Mr. McMillin, Mr. Danahay, and President Clement also expressed their appreciation for his years of service.
Mr. Tuttle stated that he had enjoyed his service on the Board of Commissioners and offered his assistance in the future should the Police Jury need it.
President Clement advised that presentation of the following 2005 Trust Fund Awards from the Calcasieu Parish Road and Drainage Trust Fund would be made at this time, and he recognized Mayor Randy Roach of the City of Lake Charles, Mayor Ron Leleux of the City of Sulphur, and Mayor Dudley Dixon of the City of Westlake, all of whom would be accepting the awards on behalf of their municipalities:

It was moved by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously to approve the minutes of the Regular Meeting of the Police Jury dated September 23, 2004, and the reading of same was dispensed with.
President Clement advised that no action was needed on Road Abandonment Case RA01-007-04 which was a request by residents of Green Leaf Subdivision for road abandonment of a portion of Verna Lane (approximately 70 feet in length) in Ward One, Police Jury District 2, due to the fact that the application had been withdrawn. President Clement noted that the Planning and Zoning Board had deferred action on September 21, 2004, for thirty days, and the Police Jury had subsequently deferred action on September 23, 2004, for thirty days.
President Clement advised that action was needed on Road Abandonment Case RA04-008-04 which was a request by Beatrice Vincent to abandon an undeveloped right-of-way off of Claiborne Street in Ward Four, Police Jury District 11. He further advised that the Planning and Zoning Board had met on Tuesday, October 19, 2004, and voted unanimously to recommend that the request be granted.
Motion was made by Mr. Andrepont, seconded by Mr. Manuel and carried unanimously that the recommendation of the Planning and Zoning Board be upheld with respect to RA04-008-04 and that the request to abandon be granted; whereupon, the following resolution was adopted:

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 21st day of October, 2004, that it does hereby abandon the road right-of-way off Claiborne in Ward Four of Calcasieu Parish, Louisiana, as requested by Beatrice Vincent and recommended by the Calcasieu Parish Planning and Zoning Board, on the property described as:

President Clement advised that action was needed on Zoning Case RZ01-035-04 which was a request by Jack Manuel to rezone from R-2 (Mixed Residential) to R-M (Multi-Family Residential) to allow resubdivision of property for existing houses on Georgia Road in Ward One, Police Jury District 2. President Clement further advised that the Planning and Zoning Board had met on Tuesday, October 19, 2004, and voted unanimously to recommend that the request be granted with the stipulation that the development adhere to the site plan on file with the Division of Planning and Development.
Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Manuel and carried unanimously, the recommendation of the Planning and Zoning Board was upheld with respect to Zoning Case RZ01-035-04, and the request to rezone was granted with the stipulations outlined by said Board; whereupon, the following ordinance was adopted:

With respect to the first piece of property (as outlined above), Mr. Wes Crain, Assistant Director of Development, advised that it was the staff’s recommendation that the structures be condemned and removed within thirty days.
Mrs. Treme advised that the owner of the property, Ms. Ethel Mae (Foots) Jones was deceased, and the heirs were attempting to get everything straightened out. She further advised that the family was trying to keep the grass mowed and the property kept up but was having a hard time of things. Mrs. Treme requested a 45-day extension so that the property could legally be put in the correct name and so that the family could get bids on the three houses to see which one(s) would be worth fixing.
Motion was made by Mrs. Treme and seconded by Mr. Andrepont that the heirs of Ms. Ethel Mae (Foots) Jones be given a 45-day extension on condemnation of the property in question. Mr. Andrepont pointed out that his seconding of the motion was predicated on a report from the Jones’ family in 45 days.
Mr. Ellis R. Spikes, 1206 Christina Drive, DeRidder, appeared before the Police Jury on behalf of the late Ms. Ethel Jones and Henry Jones and stated he was Ms. Jones’ son-in-law and that he was very appreciative of the time extension.
A vote taken on the motion on the floor carried unanimously.With respect to the second piece of property located at 6934 Choupique Road in the Carlyss area, Mr. Crain advised that no action was necessary on this piece of property.
Regarding the third piece of property located at 1205 West Dave Dugas Road in the Carlyss area, Mr. Crain recommended that the manufactured home be condemned and removed within thirty days.
President Clement asked if there was anyone present in the audience to address the Police Jury relative to this piece of property and hearing no comments, motion was made by Mr. Landry, seconded by Mr. Collins and carried unanimously that the staff’s recommendation be approved and that the following ordinance be adopted:

AN ORDINANCE ordering condemnation and demolition of one manufactured home on property located at 1205 W. Dave Dugas Road (Com 660 FT E and 30 FT N of SW Cor SW SW 21.10.10 TH E 335.4 FT N 630 FT W 335.5 FT S 630 FT to Beg; Tax Assessment No. 00129550), Carlyss area of Ward Four, Calcasieu Parish, Louisiana, and currently owned by Sandra Kay Demarest.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 21st day of October, 2004, that:
SECTION 1. The facts as set forth at the meeting of the Police Jury of Calcasieu Parish, Louisiana, on this date, justify an order of this Police Jury, and it is hereby ordered that the manufactured home on property located at 1205 W. Dave Dugas Road (Com 660 FT E and 30 FT N of SW Cor SW SW 21.10.10 TH E 335.4 FT N 630 FT W 335.5 FT S 630 FT to Beg; Tax Assessment No. 00129550), Carlyss area of Ward Four, Calcasieu Parish, Louisiana, and currently owned by Sandra Kay Demarest, be demolished and removed within thirty (30) days from the date of this ordinance. This order requires that all development permits be secured for demolition and all debris be removed from the premises. This order is made this 21st day of October, 2004, and is final unless appealed within five (5) days.
SECTION 2. If the manufactured home on the premises hereinabove described in the Parish of Calcasieu, Louisiana, is not demolished and removed within thirty (30) days from the date of this order, notice is hereby given that the Director of Parish Planning and Development shall have work commenced on the demolition and removal of said manufactured home, in which case the Police Jury shall not be liable for damages and shall have a lien and privilege against the property upon which the manufactured home was situated for the cost of demolishing and removing said manufactured home, and for the cost of maintaining the property.
SECTION 3. The Director of Parish Planning and Development is hereby authorized and directed to give notice of said demolition and removal as required by law.
SECTION 4. The Director of Parish Planning and Development is hereby authorized to enter into a contract to accomplish the demolition of the manufactured home, if necessary, and to pay the fees of the contractor from appropriate Parish funds, and to pay any and all costs associated with the demolition. SECTION 3. The Director of Parish Planning and Development is hereby authorized and directed to give notice of said demolition and removal as required by law.

Regarding the fifth piece of property located on Elliot Road in the South Lake Charles area, Mr. Crain advised that no action was necessary due to the fact that the manufactured home had been removed.
With respect to the sixth piece of property located on Hargrove Loop in the DeQuincy area, Mr. Crain advised that no action was necessary due to the fact that the house had been removed.
Regarding the seventh piece of property located at 3503 Hebert Drive in the north Sulphur area, Mr. Crain advised that the staff had learned there was a new owner of said property and requested a 30-day deferral of this matter, or until the Regular Meeting on November 18, 2004.
Motion was made by Dr. Mackey, seconded by Mr. Stelly and carried unanimously that action on condemnation of property located at 3503 Hebert Drive in the north Sulphur area be deferred for thirty days.
With respect to the eighth piece of property located at 719 Landry Street in the Westlake area, Mr. Crain advised that the current owner, Philip W. and Lisa G. Quinn had bought this piece of property at a tax sale and that the three-year redemptive period had expired. He also advised that the Quinns had a buy/sell agreement with a purchaser. Mr. Crain recommended that action be deferred for thirty days regarding this piece of property.
It was moved by Mrs. Griffin, seconded by Mr. McMillin and carried unanimously to defer action for thirty days on condemnation of property located at 719 Landry Street in the Westlake area.
President Clement advised that action was needed on Zoning Request RZ04-034-04 which was a request by Glen A. James et al and Raymond W. Vincent et al to rezone from I-1 (Light Industrial) and R-1 (Single Family Residential) to R-MHP (Manufactured Home Park) to allow a recreational vehicle park (400 units) on Mosswood Drive in Ward Four, Police Jury District 15. President Clement further advised that the Planning and Zoning Board had met on Tuesday, October 19, 2004, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that the use be limited to the RV park; (3) that the petitioner provide permanent, adequate sanitation facilities for the tenants (i.e. public restrooms and showers) within six months of RV park permit issuance; (4) that the development adhere to the document titled “Grand Acadian RV Resort Campground” on file with the Division of Planning and Development; and (5) that a six-foot chain link fence be constructed along the west property line for a length of 1,120 feet more or less or to the south boundary of property owned by Mr. Monteith.

President Clement further advised that the Planning and Zoning Board had met on Tuesday, October 19, 2004, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; and (2) that a 50-foot green belt buffer be established along the north side of Hafer Road with underground utilities permitted within the buffer area.
With regard to this zoning case, Mr. Vickers advised that for the record, a Mr. Kenneth Moss had spoke at the Planning and Zoning Board hearing, and said Board had taken his comments under advisement. Mr. Vickers explained that Mr. Moss had also delivered a “conditional” letter stating that he and the other property owners were not opposed to the rezoning request but that there were some conditions (which he had outlined to the Board) that they would like to see made part of the rezoning. (The letter written by Mr. Moss is on file in the archives of the Police Jury.) Mr. Vickers pointed out that the Board had included a buffer area, as requested by Mr. Moss, and he did want to acknowledge receipt of Mr. Moss’s letter on this date.

WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers by Westport Oil & Gas Company, L.P. to modify Department of the Army Permit 23437 by adding additional fill and structures to the original authorization in order to drill two additional wells from the previously authorized slip location. The original permit authorized one 10-foot by 20-foot wellhead protector for the E.W. Brown, Jr. No. 1 Well and 1,011 cubic yards of shell material to construct a 200-foot by 60-foot shell pad for the marine drilling barge. The applicant proposes an additional two 10-foot by 20-foot wellhead protectors for the E.W. Brown, Jr. Nos. 2 & 3 Wells. Said project is located in a borrow ditch off the Sabine River, in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Westport Oil & Gas Company, L.P. relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.
NOW THEREFORE,

BE IT FURTHER RESOLVED that a study on the environmental impact of the aforementioned project has not been made due to lack of expertise of the parish staff to accomplish such a study, and the Police Jury requests that agencies and/or individuals with such expertise make an environmental review of said project and forward their findings to the U.S. Corps of Engineers.

RESOLUTION
WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Conoco Phillips to dredge and place approximately 85,005 cubic yards of material to construct 5,280 linear feet of perimeter levee, construct 565 feet of 30 feet wide limestone access road, and trench and backfill to install two 16-inch diameter effluent pipes 1,250 feet in length, all to implement a 40-acre dredge material disposal site to accommodate maintenance dredging activities on the Calcasieu River. Approximately 19.82 acres of jurisdictional scrub-shrub/forested wetlands would be impacted through project implementation. Said project is located approximately 5 miles southeasterly from Sulphur, near Vincent Landing, in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Conoco Phillips relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 21st day of October, 2004, that it does hereby indicate no objection to the proposal of Conoco Phillips to dredge and place approximately 85,005 cubic yards of material to construct 5,280 linear feet of perimeter levee, construct 565 feet of 30 feet wide limestone access road, and trench and backfill to install two 16-inch diameter effluent pipes 1,250 feet in length, all to implement a 40-acre dredge material disposal site to accommodate maintenance dredging activities on the Calcasieu River. Approximately 19.82 acres of jurisdictional scrub-shrub/forested wetlands would be impacted through project implementation. Said project is located approximately 5 miles southeasterly from Sulphur, near Vincent Landing, in Calcasieu Parish, Louisiana.
BE IT FURTHER RESOLVED that the no objection position of the Police Jury in this permit application is based solely on the evaluation of the parish staff of the project’s effect on current parish ordinances and provisions, provided said work meets with the rules and regulations of the Corps of Engineers and the Louisiana Department of Environmental Quality, subject to Best Management Practices during the course of construction as set forth by EPA guidelines, and approvals are received from all appropriate state and federal agencies, and further, that all necessary development permits are obtained from the Calcasieu Parish Division of Planning and Development prior to commencement of the project.
BE IT FURTHER RESOLVED that a study on the environmental impact of the aforementioned project has not been made due to lack of expertise of the parish staff to accomplish such a study, and the Police Jury requests that agencies and/or individuals with such expertise make an environmental review of said project and forward their findings to the U.S. Corps of Engineers.

BE IT FURTHER AND FINALLY RESOLVED that the President of the Police Jury, or his designee, when appropriate, is authorized to execute all documents related thereto.
