The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, October 7, 2004, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Brent Clement, President, presiding, and the following members present:
Mrs. Elizabeth Conway Griffin; and Messrs. Francis Andrepont, Calvin Collins, Mike Danahay, Kevin Guidry, Tony Guillory, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, and Tony Stelly

President Clement called the meeting to order. The invocation was pronounced by Reverend Michael Stewart, Associate Pastor of Trinity Baptist Church in Lake Charles, which was followed by the Pledge of Allegiance led by Mr. Kleckley. The roll was called with the result being as outlined above.
President Clement welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
Motion was made by Mr. Manuel, seconded by Mr. McMillin and carried unanimously to suspend the rules by a two-thirds majority vote to discuss adopting a resolution requesting the Calcasieu Legislative Delegation to intervene with the Louisiana Department of Transportation and Development (DOTD) and the Division of Administration to reinstate the state matching funds for the Motorist Assistance Patrol (MAP) Program currently in operation in Calcasieu Parish under a joint agreement between the State, Police Jury, and Sheriff’s Office, and further, to approve sharing the discontinued state matching share on a 50/50 basis with the Sheriff’s Office for a period of thirty days.
Mr. McMurry advised that the Sheriff’s Office had been advised the previous day, October 6, 2004, via DOTD that the State was stopping its funding of the MAP Program and that Mr. Rob McCorquodale, legal counsel to the Sheriff’s Office, was present to address the Police Jury regarding this matter.
Mr. McCorquodale appeared before the Police Jury and pointed out that the program was a wonderful example of intergovernmental cooperation and that Sheriff Tony Mancuso considered the program to be a safety and law enforcement issue as well as a good program. Mr. McCorquodale explained that he was told by someone in Baton Rouge that the funding had not been permanently cut, but instead there were problems getting the funding approval coordinated between the Governor’s Office and DOTD. He further explained that DOTD had told him to contact the area legislators and that Sheriff Mancuso had sent a letter to the delegation. Mr. McCorquodale cautioned that it would be much more expensive to start the program back up than to keep it going on a 50/50 basis between the Police Jury and Sheriff’s Office for thirty days while efforts were made to get the funding reinstated.
Mr. McCorquodale also advised that the Lake Charles City Council had adopted a resolution asking the State to reconsider its error and commended the Sheriff’s Office and Police Jury for making every effort to keep the program going.
In answer to a question by Mr. Danahay, Mr. McMurry advised that the cost to the Parish for the thirty-day period would be approximately $4,900.
Mr. Andrepont stated that MAP was a vital program, and he would not be opposed to going to Baton Rouge to meet with whomever necessary to remedy the problem, and Mr. Moon stated he would be willing to join him. Mrs. Griffin, Mr. Guidry, and Mr. McMillin also talked about the value of the program.
In answer to a question by Mr. McMillin, Mr. McCorquodale stated that Sheriff Mancuso had asked that funding by the State be reinstated retroactively.
Upon motion made by Dr. Mackey, which was duly seconded by Mr. Kleckley and carried unanimously, the rules were suspended by a two-thirds majority vote to adopt the following resolution:
RESOLUTION
WHEREAS, the Motorist Assistance Program, known as MAP, has assisted motorists and improved traffic flow by providing free services to stranded motorists in the metro areas of Baton Rouge, Lake Charles, Shreveport-Bossier City and New Orleans; and
WHEREAS, the MAP program, which was established in Calcasieu Parish approximately five years ago, has been a great success in that it has improved traffic safety, reduced traffic congestion and provided a generally safer environment on Interstate 10 and 210 in Calcasieu Parish, and is sponsored by the Calcasieu Parish Police Jury, Calcasieu Parish Sheriff’s Office and the State of Louisiana; and
WHEREAS, MAP has helped hundreds of people with motor vehicle problems while traveling through Louisiana and many of those people, who come from all over the U.S.A., have written expressing thanks for the services MAP provided that enabled them to safely continue their journey; and
WHEREAS, there is a law enforcement benefit to getting stranded people back on the road quickly and safely, due to the increased risk of crime against persons stranded on roadways; and
WHEREAS, with no advance notice the State of Louisiana has terminated its portion of the funding for the MAP program effective October 6, 2004.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 7th day of October, 2004, that it respectfully requests the Calcasieu Legislative Delegation to intervene with the Louisiana Department of Transportation and Development and Division of Administration to retroactively reinstate the state matching funds for the Motorist Assistance Patrol program currently in operation in Calcasieu Parish under a joint agreement between the State of Louisiana, the Calcasieu Parish Police Jury and the Calcasieu Parish Sheriff’s Office.
BE IT FURTHER RESOLVED that the Police Jury agrees to jointly fund the discontinued state matching share on a 50/50 basis with the Sheriff’s Office to keep this vital service operational for a period of thirty days.
BE IT FURTHER AND FINALLY RESOLVED that certified copies of this resolution are hereby forwarded to Governor Kathleen Blanco, the Louisiana Department of Transportation and Development, the Louisiana Division of Administration, members of the Calcasieu Legislative Delegation, members of the Lake Charles City Council, and the Calcasieu Parish Sheriff’s Office.

Mrs. Griffin asked Mr. Danahay and Mr. Collins to join her in presenting a check in the amount of $5,000.00 to the Toys for Tots Foundation 2004 Campaign by the Office of Community Services (OCS). Mrs. Griffin, as President of the OCS Administering Board, presented the check to representatives of the Al Worley Detachment #1157 of the U.S. Marine Corps League and explained that OCS had chosen to partner with this young organization that had been busy breaking records at the national and state level for successful recruitment of new members, pointing out that the detachment had earned first place in the State and third place at the national level for recruiting the most members in 2004.
Mr. John Lamar, Commandant of the Detachment, thanked the Police Jury for its dedication to the Toys for Tots Drive, and in particular, Mrs. Griffin, Mr. Danahay, and Mr. Guidry. He expressed a special thanks to Mr. Andrepont and presented him with an autographed baseball from the St. Louis Cardinals. Mr. Lamar introduced the Senior Vice Commandant of the Detachment, Ms. Donna Thomas, as well as the Toys for Tots Drive Chairman, Corporal Jordan Conn. Mr. Lamar also thanked Ms. Sandy Mason, Executive Director of OCS, for her efforts and stated that the Detachment had voted that with the Police Jury’s permission, Ms. Mason be appointed as Co-Vice-Chairman of the Toys for Tots Drive.
Upon recommendation by Mr. McMurry, motion was made by Dr. Mackey and seconded by Mr. McMillin that Ms. Mason be named as “Honorary Co-Vice Chairman” of the Toys for Tots Drive.
Ms. Mason appeared before the Police Jury and stated that this year’s goal was to provide Christmas gifts for 1200 children in the Parish, and she felt the program would be a huge success.
A vote was taken on the motion on the floor, and said motion carried unanimously.
President Clement recognized Mayor Riggins of the Town of Vinton, as well as Mr. Kenneth Stinson of the Vinton Board of Aldermen, as being present in the audience on this date.
Ms. Kerry Andersen, Public Relations Manager of L’auberge Hotel and Casino, appeared before the Police Jury at this time to provide an update on construction activity at the (Pinnacle) site. (A copy of Ms. Andersen’s PowerPoint presentation, as well as a brochure outlining many facets and amenities of the new complex is on file in the archives of the Calcasieu Parish Police Jury.)
Ms. Andersen advised that “L’auberge du lac”, french for “inn on the lake”, was selected as the name of the facility to pay homage to the french heritage of the area. In addition to the facts contained in the brochure and PowerPoint presentation as referenced above, Ms. Andersen stated that the total project had recently increased by an additional $40 million, making it the largest single level riverboat casino in the United States, and opening was set for the Spring of 2005. Ms. Andersen also stated that the hotel tower “topped out” on October 4, 2004, the external glass was going up on the hotel tower, the foundation had been laid for the villas, the steelwork was going up on the conference center, and the golf course was complete.
Ms. Andersen strongly encouraged persons to apply for the 1500 - 2000 available positions and advised that the facility was committed to hiring 80% of its employees from Louisiana. She also encouraged participation by companies wanting to do business with L’auberge, particularly minority-owned and female-owned, Louisiana businesses.
Motion was made by Mr. Andrepont, seconded by Mr. Danahay and carried unanimously to receive the report given by Ms. Andersen.
Mr. Andrepont was granted a point of personal privilege to commend Mr. Allen Wainwright, Public Works Operations Manager, for the position he took relative to a recent segment which aired on KPLC-TV involving a complaint by Mr. Raymond Davis about a parish employee driving to his home to use the restroom while on the job.
Mr. Kleckley agreed, pointing out that the bottom line was the employee was approximately one and one-half to two miles from his home, there were no convenience stores or other buildings which offered restroom facilities nearby, so he chose to go home for that purpose only. Mr. Kleckley pointed out that the parish vehicles had GPS (geographical positioning systems) which kept records of where those vehicles went during the day, and he said the complaint was an effort by someone to make a mountain out of a molehill. Mr. Kleckley closed by saying that with almost 800 parish employees, there would be some slip-ups, but that this was definitely not one of them.
President Clement advised that a presentation would be given at this time by Mr. Lucas Terracina, Mosquito Control Director, relative to expiration of the current authorized levy of ad valorem tax for the Mosquito Control Program and that the Police Jury would need to take appropriate action thereon.
Mr. Terracina appeared before the Police Jury and stated that raising taxes was not something anyone desired but to continue the program at the level to which the public had become accustomed, it was essential in this case. He stated it was necessary to generate a level of funding that would allow for maintenance of equipment and necessary manpower to meet the demanding needs in the protection of human health and the well-being of the citizens of Calcasieu, to address the increased cost of supplies and materials, and to continue the program made in operating a state-of the-art mosquito control program.
Mr. Terracina pointed out that he had just completed his budget submittal for FY 2005, and it was anticipated that total expenditures would exceed total revenues by almost $500,000 for FY 2004. He stated that the factors contributing to the increase in expenses had been mosquito-borne viruses such as West Nile virus, St. Louis encephalitis, Eastern Equine encephalitis, and LaCrosse encephalitis, the increased cost of materials/supplies, and the population growth in unincorporated areas, particularly south Lake Charles, Carlyss, Moss Bluff, Houston River, and LeBleu Settlement. Mr. Terracina advised that the increase in oil prices had affected the cost of chemicals and of fuel for vehicles.
Mr. Terracina recommended that the public be asked to vote on a 2.41-mill property tax (up from 1.81 mills) which would generate approximately $2.2 million annually, an increase of approximately $540,000 per year, and which would also yield approximately $2.5 million annually when combined with other revenues.
Mr. Kleckley stated that he hated to see any increase in taxes but as he talked to the staff and looked at the numbers, he discovered that the bottom line was that Mr. Terracina was running a very efficient operation. He pointed out that ten years ago, no one had ever even heard of West Nile virus, and the Police Jury had to be proactive in matters such as this.
Mr. Kleckley asked about Mosquito Control’s operating reserve, and Mr. McMurry responded that it had been going down by about $500,000 for the past four years and currently was approximately $2.3 million.
Mr. Kleckley responded by saying that an operating reserve was crucial to fall back on when needed, and he said it spoke very highly of the manner in which the Mosquito Control program had been handled. He said he saw no other option than to ask for a small increase to cover operating costs and hopefully to build the reserve back up.
Mr. Terracina advised that his office had always tried to properly manage the funds it had and planned ahead. He pointed out that because they had a reserve, they were able to build a new facility and purchase a new airplane without having to go back to the voters (for an increase in funding). Mr. Terracina pointed out that he had a lot of good employees working for Mosquito Control.
Mr. Kleckley stated that everyone expected increased costs due to inflation but no one would have thought that fuel prices would have increased the way they had.
Mr. Manuel stated he would do everything he could to promote the tax and help get it passed, and Calcasieu Parish needed to keep the program going because it set a standard for the State.
Mr. Smart pointed out that an owner of a home assessed at $100,000 would only pay an additional $1.50 per year as a result of the increased tax, and he felt that was relatively inexpensive for the health and safety of the family of that homeowner.
Mr. Charlie Atherton, 122 Vine Street, Sulphur, appeared before the Police Jury and stated that he had been very impressed with how accountably the Mosquito Control Program had been run. He pointed out that some of the other special service districts had millages of 15 mills and to not fund Mosquito Control properly would really be irresponsible because, for example, it was necessary to have adequate mosquito control for people to enjoy the tax dollars they were spending on new ball fields through a recreation tax. Mr. Atherton stated that the Mosquito Control Program helped tourism in the area, and the public wanted it funded properly. He closed by saying that just like the Parish’s Office of Homeland Security and Emergency Preparedness, it had to be funded, and the Parish could not afford to not fund it properly.
Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Manuel and carried unanimously, the following resolution was adopted:
RESOLUTION
A resolution ordering and calling a special election to be held in Calcasieu Parish, Louisiana, to authorize the levy and collection of a property tax in the amount of two and forty-one one-hundredths (2.41) mills, on each dollar of assessed valuation on all property subject to taxation in Calcasieu Parish, Louisiana, for ten (10) years, beginning with the year 2005, for the purpose of maintaining and operating the facilities and services of the Calcasieu Parish Mosquito Control Program, as well as improving or constructing mosquito control facilities.
BE IT RESOLVED BY THE POLICE JURY OF THE PARISH OF CALCASIEU, LOUISIANA, acting as the governing authority of Calcasieu Parish, Louisiana, as follows:
Section 1. Subject to the approval of the State Bond Commission and under the authority conferred by Article VI, Sections 26 and 32 of the 1974 Louisiana Constitution, Chapter 6A of Title 18, Sections 301 through 317, inclusive, of Title 47, and other constitutional and statutory authority supplemental thereto, a special election be and the same is hereby called and ordered to be held in Calcasieu Parish, Louisiana (the “Parish), on Saturday, January 15, 2005, between the hours of six o’clock (6:00) a.m. and eight o’clock (8:00) p.m., in compliance with the provisions of the Louisiana Election Code, and that at said election there shall be submitted to all registered voters of the Parish qualified and entitled to vote at said election under the Constitution and Laws of the State and the Constitution of the United States, the following Proposition:
PARISHWIDE MOSQUITO CONTROL TAX
SUMMARY: Levy and collection of a 2.41 mill property tax for ten (10) years, for the purpose of maintaining and operating the facilities and services of the Calcasieu Parish Mosquito Control Program, as well as improving or constructing mosquito control facilities.
PROPOSITION
“Shall the Calcasieu Parish Police Jury, the governing authority of Calcasieu Parish, Louisiana, levy and collect a 2.41-mill special tax on all properties within the boundaries of the Parish for a period of ten (10) years, beginning in 2005, for the purpose of maintaining and operating the facilities and services of the Calcasieu Parish Mosquito Control Program, as well as improving or constructing mosquito control facilities?”
Section 2. There shall be published in the “Lake Charles American Press”, a daily newspaper of general circulation within the Parish, published in Lake Charles, Louisiana, and being the official journal of the Calcasieu Parish Police Jury and the Parish, once a week for four consecutive weeks, with the first publication to be not less than forty-five (45) days nor more than ninety (90) days prior to the date fixed for the election, notice of said election, which notice shall be substantially in accordance with the Notice of Special Election annexed hereto as “Exhibit A” and incorporated herein by reference the same as if it were set forth herein in full.
Section 3. This Calcasieu Parish Police Jury, acting as the governing authority of the Parish, shall meet at its regular meeting place, the Police Jury Meeting Room, Calcasieu Parish Government Building, Lake Charles, Louisiana, on Thursday, January 20, 2005, at 5:30 p.m., and shall then and there in open and public session proceed to examine and count the votes, examine and canvass the returns, and declare the results of said special election.
Section 4. The polling places set forth in the aforesaid Notice of Special Election and situated within the corporate limits of the Parish, be and the same are hereby designated as the polling places at which to hold said election, and the Commissioners and Commissioners-in-Charge shall be those persons referred to in said Notice of Special Election.
Section 5. The officers designated to serve as Commissioners and Commissioners-in-Charge, or such substitutes therefor as may be selected and designated in compliance with the Louisiana Election Code, shall hold the special election as herein provided, shall make due returns of said election for the meeting of the Police Jury to be held on Thursday, January 20, 2005, and the compensation of said officers be and the same is hereby fixed at the sum prescribed by law. All registered voters in the Parish are entitled to vote at said special election, and voting machines shall be used in said special election.
Section 6. The Secretary of the Calcasieu Parish Police Jury be and he is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election the necessary equipment, forms and other paraphernalia essential to the proper holding of said election.
Section 7. Certified copies of this resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines in and for the Parish of Calcasieu, Louisiana, and the Registrar of Voters in and for said Parish, as notification of the special election herein called in order that each may prepare for said election and perform their respective functions as required by law.
Section 8. Application be and the same is hereby formally made to the State Bond Commission for consent and authority to hold the aforesaid special election as herein provided, and in the event the aforesaid Proposition is carried, for authority to levy and collect and adopt an ordinance providing for such levy and collection of the Tax as authorized by said Proposition. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of the Parish, together with a letter requesting the prompt consideration and approval of this application.
Section 9. A certified copy of this resolution, together with other showings required by Section 5 of the Voting Rights Act and regulations pertaining thereto, shall be submitted to the United States Attorney General for approval, should such submission be required.
Section 10. If any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this resolution which can be given effect without the invalid provisions, items, or applications, and to this end, the provisions of this resolution are hereby declared severable.
Section 11. All resolutions, ordinances or parts thereof in conflict herewith are hereby repealed.

The polls will be opened at 6:00 a.m. and will be closed at 8:00 p.m., in compliance with the provisions of Title 18 of the Louisiana Revised Statutes of 1950. Voting machines will be used in the conduct of the election.
The special election will be held in accordance with the provisions of the Louisiana Election Code, and the officers appointed to hold the said election, pursuant to L.R.S. 18:1286, or such substitutes therefor as may be selected and designated in compliance with the Louisiana Election Code, will make due returns thereof to the Parish and NOTICE IS HEREBY FURTHER GIVEN that said Police Jury, governing authority of the Parish, will meet at its regular meeting place, the Police Jury Meeting Room, Calcasieu Parish Government Building, Lake Charles, Louisiana, on January 20, 2005, at 5:30 p.m. and will then and there in open and public session examine and count the votes, examine and canvass the returns and declare the majority of the votes of the qualified electors of the Parish voting in said election. All registered voters in the Parish are entitled to vote at said special election, and assessed valuations shall not be voted.

President Clement advised that a report would be received at this time from Mr. David Robinson of the Division of Planning and Development regarding the Parish’s participation in the Southwest Louisiana Team Green’s new program, Neighborhood Pride.
Mr. Robinson appeared before the Police Jury and reminded the jurors that Mr. Don Elfert of Southwest Louisiana Team Green had appeared before the Public Works Committee on August 26, 2004, and asked the Police Jury to consider joining this initiative, and that the Police Jury had subsequently approved his request.
Mr. Robinson advised that he had basically “retrofitted” Team Green’s existing program so it would work in the unincorporated area of the Parish, and he felt it would work well with and be a complement to the Parish’s litter program. (A copy of the report presented by Mr. Robinson is on file in the archives of the Police Jury.)
He explained that the Neighborhood Pride Program would be a program totally operated by the citizens on a voluntary basis, and it would be up to the people in the community to take charge of their own areas. Mr. Robinson briefly went over the objectives of the program and an organizational chart, pointing out that a District Coordinator would be selected to serve as a liaison between the Neighborhood Pride Coordinators and the Police Juror for their individual district and also to submit requests to proper parish departments concerning problems that needed to be addressed, as well as to work with the Constables to address litter law violations. Mr. Robinson also explained that the District Coordinator, along with the Neighborhood Pride coordinators, would seek volunteers through school clubs, neighborhood watch groups, civic organizations, church groups, etc.
Mr. Robinson advised that the Neighborhood Pride Coordinator’s function would be to organize neighborhood or community groups for clean up and/or beautification projects in accordance with Parish ordinances, safety concerns, etc.
Mr. Robinson closed by saying that he felt this was a quality of life issue in that it would give people an opportunity to take charge of where they live and make it a better place. He stated that he would serve the program in an advisory capacity.
Motion was made by Mrs. Griffin, seconded by Dr. Mackey and carried unanimously to receive the report given by Mr. David Robinson on this date pertaining to the Neighborhood Pride Program and to implement said program in Calcasieu Parish.
