The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, September 23, 2004, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Brent Clement, President, presiding, and the following members present:
Mesdames Elizabeth Conway Griffin and Sandra J. Treme; and Messrs. Francis Andrepont, Calvin Collins, Mike Danahay, Kevin Guidry, Tony Guillory, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, and Tony Stelly
Absent: None
Also present were Mr. S. Mark McMurry, Parish Administrator; Mr. Bryan Beam, Assistant Administrator; Mr. Richard Gremillion, Director of Emergency Preparedness and Homeland Security; Mrs. Cheryl Heisser, Director of Human Resources; Mr. Jerry Milner, Director of Finance; Mr. Claude Smart, Parish Engineer; Mr. Allen Smith of the firm of Plauche, Smith and Nieset, General Counsel; Mrs. Kathy P. Smith, Recording Secretary; and Mr. Jim Vickers, Director of Planning and Development.
President Clement called the meeting to order. The invocation was pronounced by Dr. Mackey which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.
President Clement welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
The Honorable Rick Bryant, Calcasieu Parish District Attorney, conducted a swearing-in ceremony and administered the oath of office to Mr. Kevin Guidry, who had been elected on September 18, 2004, to represent Police Jury District Nine. Mr. Guidry received a standing ovation after taking his oath of office and stated that it had been a long fight, but he was grateful to the members of the Police Jury for having faith and belief in him during the struggle. He thanked God for giving him the strength and ability to keep the faith, his family whom he asked to stand for recognition, and Mr. Rocke Palermo, his attorney.
President Clement congratulated Mr. Guidry on behalf of the Jury and stated he was looking forward to working with him.
President Clement advised that bids would be received and opened at this time for an oil, gas, and mineral lease on certain roads and/or streets in Henry C. LeBleu Subdivision, Henry C. LeBleu Subdivision Part 2, Scheufens Subdivision, and Scheufens Subdivision No. 2 in Sections 27 and 28, Township 10 South, Range 7 West in Ward Eight (Police Jury District 4).
There being no other bids to be turned in, Mr. McMurry proceeded to open the only bid received, from Basin Properties on behalf of Mayne and Mertz, Inc., and outlined the details of said bid which are set forth in the following resolution which was offered by Mr. Andrepont, seconded by Dr. Mackey and carried unanimously:
RESOLUTION
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 23rd day of September, 2004, that it does hereby accept the bid of Mayne and Mertz, Inc. for a mineral lease on the following described property, to-wit:
Tract 1: that certain tract of land containing 6.41817 acres, more or less, situated in the Northeast Quarter of the Northeast Quarter (NE/4 NE/4) of Section 28, Township 9 South, Range 7 West and in the Northwest Quarter of the Northwest Quarter (NW/4 NW/4) of Section 27, Township 9 South, Range 7 West, Calcasieu Parish, Louisiana, and being more particularly identified as the streets known as Delcome Street, Huval Street, Ernie Benoit Street and all adjacent and adjoining easements as shown on that plat survey titled Henry C. LeBleu Subdivision and dated April 15, 1957, prepared by R. E. Oxford and recorded in Plat Book 9, Page 138, bearing File No. 685746 of the conveyance records of Calcasieu Parish, Louisiana and on that plat survey titled Henry C. LeBleu Subdivision Part 2 and dated June 22, 1957, prepared by R. E. Oxford and recorded in Plat Book 10, Page 17, bearing File No. 706521 of the conveyance records of Calcasieu Parish, Louisiana.
Tract 2: that certain tract of land containing 3.9018 acres, more or less, situated in the West Half of the Southeast Quarter (W/2 SE/4) of Section 28, Township 9 South, Range 7 West, Calcasieu Parish, Louisiana, and being more particularly identified as a street known as Scheufens Road and all adjacent and adjoining easements as shown on that plat of survey titled Scheufens Subdivision, dated July 3, 1956, prepared by E. L. Gorham and recorded in Plat Book 9, Page 117, bearing File No. 678026 of the conveyance records of Calcasieu Parish, Louisiana and on that plat survey titled Scheufens Subdivision No. 2 and dated July 29, 1960, prepared by A. R. Walton and recorded in Plat Book 12, Page 44, bearing File No. 815150 of the conveyance records of Calcasieu Parish, Louisiana.
All tracts and/or parcels of land described above containing 10.32 acres, more or less.
for a three-year lease with a cash bonus of Two Thousand Sixty Four and no/100 Dollars ($2,064.00) and an annual rental of One Thousand Thirty Two and no/100 Dollars ($1,032.00) and with the Calcasieu Parish Police Jury to receive 22.0% of all oil produced and saved or utilized, 22.0% of all gas produced and saved or utilized, 22.0% of all sulphur produced and saved, and 22.0% of all other liquid or gaseous hydrocarbon minerals produced and saved.
BE IT FURTHER RESOLVED, that the President of the Police Jury be, and he is hereby authorized to execute the necessary lease contract to consummate this transaction.

President Clement stated that one purpose of the meeting was to canvass and tabulate the returns of the special election held September 18, 2004, in Calcasieu Parish, Louisiana.
The Police Jury then proceeded to canvass the returns from the election held in Calcasieu Parish, Louisiana, on September 18, 2004, and after receiving the tabulation sheets and results of the voting machines from the election officials of the polling places, the following Proces Verbal was offered by Mr. Chuck Kleckley, seconded by Mrs. Sandy Treme, and adopted by the following vote:

BE IT KNOWN AND REMEMBERED that on this 23rd day of September, 2004, at 5:30 o’clock p.m., in accordance with a resolution adopted March 18, 2004, by the Police Jury of Calcasieu Parish, Louisiana (the “Police Jury”), the governing authority of Calcasieu Parish, Louisiana (the “Parish”), and recorded in the records of the Police Jury, being a quorum thereof, met at the regular meeting place of the Police Jury, in the Police Jury Meeting Room located on the first floor of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, and according to law, received the certified tabulation sheets and results of the voting machines from the Commissioners and Commissioners-in-Charge of the election held in the Parish on September 18, 2004, in accordance with said resolution and there proceeded to count the ballots to determine the vote on the following proposition:

SUMMARY: AUTHORITY TO EXEMPT CERTAIN DRILLING RIGS FROM PROPERTY TAXES PURSUANT TO ARTICLE VII, SECTION 21(J) OF THE LOUISIANA CONSTITUTION OF 1974, AS AMENDED.
Shall the Parish of Calcasieu, State of Louisiana (the “Parish”) under the authority of Article VII, Section 21(J) of the Constitution of the State of Louisiana of 1974, as amended, exempt from property taxes, drilling rigs used exclusively for the exploration and development of minerals outside the territorial limits of the State of Louisiana (the “State”) in Outer Continental Shelf waters which are within the Parish for the purpose of being stored or stacked for use outside the territorial limits of the State, or for the purpose of being converted, renovated, or repaired and any property in the Parish for the purpose of being incorporated in, or to be used in the operation of said drilling rigs?
