The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, April 22, 2004, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Brent Clement, President, presiding, and the following members present:
Mesdames Elizabeth Conway Griffin and Sandra J. Treme; and Messrs. Mike Danahay, Tony Guillory, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, Tony Stelly, and Alvin Stevens
Absent: Mr. Francis Andrepont and Mr. Calvin Collins (recuperating from surgery)

President Clement called the meeting to order. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.
President Clement welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
President Clement advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for the Calcasieu Parish Health Unit Parking Addition.
Mr. McMurry then proceeded to open the following bids:

There being no other bids, motion was made by Mrs. Griffin and seconded by Mrs. Treme that the bids be referred to the project architect, Mr. David Moss, for final tabulation, with further action thereon to be taken later in the meeting on this date.
Mr. Greg Bertrand, President of the Moss Bluff Girls Softball Program, appeared before the Police Jury at this time and presented a plaque to Mr. Manuel in appreciation for his many contributions to recreation in Moss Bluff. Mr. Manuel thanked Mr. Bertrand for recognizing him in this manner.
Mr. Guillory presented a plaque to Mr. Martin W. Guillory, Principal of Oak Park Middle Professional Development School, in recognition of being named Louisiana Middle School Principal of the Year. Mr. Guillory thanked the Police Jury for the plaque, pointing out that he had not earned the honor by himself but with the help of the parents, teachers, and students of his school.
Mrs. Griffin advised that Mr. Guillory was a member of the Office of Community Services’ Executive Board, and she thanked him for his efforts in that regard.
Upon motion made by Mr. Landry, which was duly seconded by Dr. Mackey and carried unanimously, the following applications for liquor and beer permits were approved, and the issuance of the following special events permits was ratified:

It was moved by Mrs. Griffin, seconded by Mr. Stevens and carried unanimously to approve the minutes of the Regular Meeting of the Police Jury dated March 18, 2004.
With reference to bids received earlier in the meeting on this date and in accordance with the recommendation of the project architect, motion was made by Mr. Kleckley, seconded by Mr. Moon and carried unanimously that the low bid in the amount of $186,390.00 and Alternate No. One in the amount of $5,200.00 as submitted by Lewing Construction Company, Inc. be accepted for construction of the Calcasieu Parish Health Unit Parking Addition, and further, that the President of the Police Jury be authorized to execute the contract documents and any amendments or modifications thereto in conjunction with said project.
President Clement advised that action was needed on a request to amend stipulation number (4) in conjunction with RZ03-001-04 which was a request by Michael and Norman McVey to rezone from R-2 (Mixed Residential) to C-2 (General Commercial) to allow a restaurant and future expansion of a nonconforming use (Mary’s Lounge) on Broad Street in Ward Three, said amendment being to allow the use of cal-base (4015 East Broad Street, Police Jury District 2). [On January 22, 2004, the Police Jury granted the request for rezoning with one of the stipulations being that all parking and driveways must be hardsurfaced (asphalt or concrete).]
President Clement further advised that the Planning and Zoning Board had met on Tuesday, April 20, 2004, and voted ten (for) to one (against) to recommend that the request be granted.
It was moved by Mrs. Treme, seconded by Mr. Stelly and carried unanimously to uphold the recommendation of the Planning and Zoning Board and to approve the request to amend stipulation number (4) in conjunction with RZ03-001-04; whereupon, the following ordinance was adopted:
ORDINANCE NO. 4715
AN ORDINANCE amending Ordinance No. 4683, adopted by the Police Jury on January 22, 2004, (Zoning Case RZ03-001-04), Stipulation No. 4.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 22nd day of April, 2004, that Ordinance No. 4683, adopted by the Police Jury on January 22, 2004, (Zoning Case RZ03-001-04); Stipulation No. 4 is hereby amended to read in its entirety as follows: that all roads must be hardsurfaced (asphalt, concrete, or cal-base); on the following property:
Lots One (1), Two (2), Three (3) and Four (4) of Block Three (3) of Airport Acres.
BE IT FURTHER ORDAINED that the above described property is hereby classified and ratified as C-2 (General Commercial).

President Clement advised that action was needed on Zoning Case RZ04-008-04 which was a request by Anthony J. Palermo, Jr. to rezone from C-1 (Light Commercial) to C-2 (General Commercial) to allow a restaurant (consumption of alcohol on premises) at 861 Houston River Road in Ward Four, Police Jury District 14. President Clement further advised that the Planning and Zoning Board had met on Tuesday, April 20, 2004, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development, (2) that a parish occupational license must be obtained, (3) that all required parking spaces (9 spaces) and driveways must be hardsurfaced (asphalt or concrete) prior to opening of business, (4) that each driveway must be marked as an entrance or exit, and (5) that the dumpster must be placed behind the building with a privacy fence enclosure prior to opening of the business.
Motion was made by Mr. McMillin and seconded by Mrs. Treme that the recommendation of the Planning and Zoning Board be upheld with respect to RZ04-008-04 and that the request to rezone be granted with the stipulations outlined by said Board.
Ms. Sue Brooks, 1229 East Houston River Road, Sulphur, appeared before the Police Jury in opposition to the rezoning request. She stated that she had been told a video store was going in at this location, and she had later found out it would be a restaurant with a bar and video poker. Ms. Brooks stated her reasons for opposition as follows: (1) the area was a residential area with nice, well-maintained homes and a quiet atmosphere, (2) terrible wrecks had occurred not far from the location at a traffic light on Highway 27 which had been labeled “Suicide Junction”, (3) there had been nothing but trouble at a bar previously located on Houston River Road, (4) children in the area walked and rode bicycles to the nearby convenience store, and the elderly walked for exercise, (5) Houston River Road was heavily traveled by workers going to and from the industries, and (6) while she felt people had a right to drink, they did not have the right to drink and drive.
Ms. Brooks asked that the Police Jury defer action on this matter until the residents in this area could be made aware that the rezoning would not be for a video store and get their input.
Mr. Stelly asked if the convenience store to which Ms. Brooks had referred sold alcohol, and Mr. Vickers advised that it did.
Mr. Lonnie Gothrup, Pastor of Houston River Baptist Church located at 114 West Houston River Road, appeared before the Police Jury and asked for a deferral so that he could circulate a petition to determine the wishes of the majority of people residing in this area. Mr. Golthrup stated that there had been no opposition at the Planning and Zoning Board meeting because very few residents knew about it. He also stated that the threat of a pizzeria was not a great threat, but the possibility of rezoning from light commercial to general commercial was very worrisome to him.
Mr. McMillin withdrew his motion on the floor, and Mrs. Treme withdrew her second to said motion.
Motion was then made by Mr. McMillin and seconded by Mrs. Griffin to defer action until the Regular Meeting on May 6, 2004, with respect to Zoning Case RZ04-008-04. He stated that if the property could be developed as a bar, that concerned him.
Mr. Landry stated that it appeared to him that the area in question was a residential area, and Mr. Vickers advised that the property was located on the west side of the intersection of Judie Street and Houston River Road which was a commercial area. Mr. Vickers further advised that it was his understanding that the property owner wanted to lease the property to another gentleman who operated a similar establishment in DeQuincy where alcohol was served and where there were three video poker machines.
In answer to questions by Mr. Landry, Mr. Vickers stated that the property was probably originally zoned in the 1980's during comprehensive zoning of the Parish, and he did feel it had been zoned correctly at that time.
Mr. Stelly asked if the permit to be required would only apply to beer, to which Mr. Vickers responded that it was not specific and that there were two different types of permits, liquor and beer. He pointed out that the proposed establishment would be eligible for both. Mr. Vickers stated that the applicant had not yet applied for a liquor permit due to the fact that the property had to be zoned correctly first.
President Clement asked if Mr. Shane Nelson, the potential lessee of the property, was present in the audience to answer questions, and he was not.
Mrs. Griffin asked why the stipulation requiring an occupational license was made by the Planning and Zoning Board since it was her impression that this was a standard requirement. Mr. Vickers explained that when a rezoning request involved a new business, this was made a part of the stipulations to make sure the applicant knew everything that was required.
Mr. McMillin asked Mr. Vickers to get with Mr. Golthorp to suggest to him where he should circulate his petition(s).
A vote taken on the motion on the floor carried unanimously, and action on Zoning Case RZ04-008-04 was deferred until the Regular Meeting on May 6, 2004.
President Clement advised that action was needed on Road Abandonment Case RA04-001-04 which was a request by Sasol North America for road abandonment of Laurel Road in Ward Four, Police Jury District 14. He further advised that the Planning and Zoning Board had met on Tuesday, April 20, 2004, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that Waterworks District No. Two of Ward Four be allowed to remove any salvageable or reusable portion of the existing water system for future use, (2) that the existing waterlines serving these areas are properly disconnected from the remaining water system, and (3) that the existing sanitary sewer lines serving these areas are properly disconnected from the remaining system.
Motion was made by Mr. McMillin and seconded by Mr. Landry to uphold the recommendation of the Planning and Zoning Board with respect to Road Abandonment Case RA04-001-04 and to approve the request to abandon with the stipulations outlined by said Board.
Mr. Charlie Atherton, 122 Vine Street, Sulphur, appeared before the Police Jury with regard to this and the other road abandonment requests by Sasol North America which were on the agenda. He stated that his main concern was the abandonment of quite a bit of infrastructure and the possibility of recovering a portion of the public money spent on these improvements. Mr. Atherton spoke of the decline in the customer base for both the water and sewer districts in this particular area and the associated negative impact on the financial operation of these districts, and he felt that Sasol North America could be requested to assist the community. Mr. Atherton encouraged the continuance of negotiations to obtain matching funds for a federal grant to provide sewer improvements to the west end of Mossville.
Mr. McMurry advised that Sasol had provided some assistance in welding manhole covers, and he agreed that Sasol’s buy-out of this property in Mossville had taken quite a bit of the customer base for the sewer and water districts.
With regard to Mr. Atherton’s concerns regarding the abandonment of these roads, Mr. McMurry explained that when a road no longer served a public purpose, it quickly became a dumping ground, and that there was always a liability problem should an accident occur, so he felt it was a good idea to abandon these roads since there was no longer a need for the public to traverse them.
Mr. McMurry also stated that he agreed that efforts to help the community should be pursued with Sasol, particularly with regard to the loss of customer base for the sewer district. He pointed out that the Police Jury had a grant application at the current time to make the sewer improvements on the west side of Mossville.
In answer to a question by Mr. Manuel, Mr. Vickers explained that there were still two customers in this area served by the sewer district but that the abandonments would not prevent any property owner from having ingress and egress to their property. Mr. Vickers stated that the area was very isolated and that there was a serious problem with dumping.
Mr. Atherton stated that he did not recall this much public infrastructure being abandoned, and that had led him to ask questions in order to assist the Mossville community.
A vote was taken on the motion on the floor which was to uphold the recommendation of the Planning and Zoning Board with respect to Road Abandonment Case RA04-001-04 and to approve the request to abandon with the stipulations outlined by said Board, and said motion carried unanimously; whereupon, the following resolution was adopted:

With respect to the first piece of property located at 168 Champagne Circle in the Moss Bluff area, Mr. Wes Crain, Assistant Director of Development, recommended that the accessory structure be condemned and removed within thirty days.

SECTION 1. The facts as set forth at the meeting of the Police Jury of Calcasieu Parish, Louisiana, on this date, justify an order of this Police Jury, and it is hereby ordered that the accessory structure on property located at 168 Champagne Circle (Lot 64, Block 2, Groesbeck Subdivision; Tax Assessment No. 00012378), Moss Bluff area of Ward One, Calcasieu Parish, Louisiana, and currently owned by William Eugene McDaniel, Jr., et ux, be demolished and removed within thirty (30) days from the date of this ordinance. This order requires that all development permits be secured for demolition and all debris be removed from the premises. This order is made this 22nd day of April, 2004, and is final unless appealed within five (5) days.
SECTION 2. If the accessory structure on the premises hereinabove described in the Parish of Calcasieu, Louisiana, is not demolished and removed within thirty (30) days from the date of this order, notice is hereby given that the Director of Parish Planning and Development shall have work commenced on the demolition and removal of said accessory structure, in which case the Police Jury shall not be liable for damages and shall have a lien and privilege against the property upon which the accessory structure was situated for the cost of demolishing and removing said accessory structure, and for the cost of maintaining the property.
SECTION 3. The Director of Parish Planning and Development is hereby authorized and directed to give notice of said demolition and removal as required by law.

With respect to the fourth piece of property located at 4318 King Street in the Mossville area, Mr. Crain advised that no action was needed due to the fact that the manufactured home had been removed.
With respect to the fifth piece of property located at 413 Orange Street in the DeQuincy area, Mr. Crain recommended that the house be condemned and removed within thirty days.
In answer to a question by Mrs. Treme, Mr. Crain explained that the notice was mailed to 431 Orange Street but that the property was located at 413 Orange Street. Mrs. Treme stated that she had passed by the property a million times but had not seen it. She asked if Mr. O’Connor was still the owner or if he had sold the property to someone else, to which Mr. Crain answered that according to the tax records, the property still belonged to Mr. O’Connor.
Mr. Landry asked if the property owner had signed the receipt for the certified letter of notice, and Mr. Crain stated that the signature was hard to read, but it appeared to be Mr. O’Connor’s signature. He pointed out that the staff had notified him in December of 2003, and a Lawrence O’Connor had signed for that certified letter which had been mailed to 431 Orange Street, the address which appeared in the tax records for property physically located at 413 Orange Street.
President Clement asked if there was anyone present in the audience to address the Police Jury with respect to this property and hearing no comments, motion was made by Mrs. Griffin, seconded by Mr. Stevens and carried unanimously to approve the staff’s recommendation and to adopt the following ordinance:
