The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, April 1, 2004, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Brent Clement, President, presiding, and the following members present:
Mesdames Elizabeth Conway Griffin and Sandra J. Treme; and Messrs. Francis Andrepont, Mike Danahay, Tony Guillory, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, Tony Stelly, and Alvin Stevens

Also present were Mr. S. Mark McMurry, Parish Administrator; Mr. Bryan Beam, Assistant Administrator; Mr. Richard Gremillion, Director of Emergency Preparedness; Mrs. Cheryl Heisser, Director of Human Resources; Mr. Jerry Milner, Director of Finance; Mr. Claude Smart, Parish Engineer; Mrs. Kathy P. President Clement called the meeting to order. The invocation was pronounced by Mr. McMurry which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.
President Clement welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
President Clement advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for Calcasieu Parish Project No. 2004-04 (Hardsurfacing, Overlaying, and Drainage Improvements of Various Roads in Calcasieu Parish).
Mr. McMurry then proceeded to open the following bids:
Prairie Contractors, Inc. $2,631,644.50
R. E. Heidt Construction Company, Inc. $2,355,966.27
There being no other bids, motion was made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously that the bids be forwarded to the Parish Engineer for final tabulation, with further action thereon to be taken at the Regular Meeting on April 22, 2004.
President Clement advised that Mr. Vic Stelly, former State Representative, would appear before the Police Jury at this time with reference to his new position, University/Community Liaison for McNeese State University.
Mr. Stelly jokingly stated that the older he got, the more “formers” he got in front of his name. He stated that he felt people heard too much bad news and not enough good news and gave an example of a recent article in the newspaper about 22 states having their bond rating downgraded because of financial problems said states were having, yet almost as a postscript to the article was a statement that Louisiana was the only state that had experienced an upgrade in its bond rating. Mr. Stelly explained that he felt the latter should have made headlines, particularly since the upgrade could mean a difference in 1% when a political subdivision went to borrow money and/or sell bonds.
Mr. Stelly advised that McNeese State University had almost 8,000 students enrolled and had experienced an increase in enrollment for nine consecutive semesters. He pointed out that over 2,000 people worked at the university and other than the Calcasieu Parish School Board, it was the number one employer in the Parish. Mr. Stelly stated that McNeese had an economic impact of $437 million annually.
Mr. Stelly stated that his new job as University/Community Liaison consisted of going to the Police Jury and the municipalities and letting people know the good things about McNeese, a facility which meant so much to the community. He offered his services to the Police Jury and urged the jurors to call him anytime they needed something of McNeese and to keep the university in the forefront. Mr. Stelly urged everyone to do something to help McNeese whether it was with the Banner Series or one of the various organizations affiliated with the university.
Mr. Manuel thanked Mr. Stelly for his presentation, and in particular, the portion regarding the upgrade in Louisiana’s bond rating which he felt was very important.
President Clement advised that a plaque would be presented to the Police Jury at this time from the Southwest Louisiana District Senior Games. Mrs. Griffin presented the plaque on behalf of said organization and asked President Clement and Mr. Danahay to join her in the presentation. Mrs. Griffin explained that while the Louisiana Senior Games was a statewide event, it required local sponsors, and the Police Jury through its Office of Community Services was a proud sponsor of the Southwest Louisiana area. She advised that 107 seniors from the local area would participate in the games scheduled for October 18 - 29, 2004.
President Clement expressed appreciation for the consideration shown by the Southwest Louisiana District Senior Games organization in giving the Jury a plaque.
Mrs. Griffin then read the plaque which was inscribed as follows: “In appreciation to the Police Jury for your outstanding dedication and support of the Southwest Louisiana District Senior Games.”
Upon motion made by Dr. Mackey, which was duly seconded by Mr. Moon and carried unanimously, the following applications for liquor and beer permits were approved:

Following review of the items to be considered by the Police Jury on April 1st, it was unanimously recommended that the proposed agenda be accepted as presented by the staff, with the following addition:
Presentation of a plaque to the Calcasieu Parish Police Jury from the Southwest Louisiana District Senior Games.
Also, recommendations for appointments to various boards of special service districts were made by members of the Committee.

(3) Dr. Larry Thompson, 2760 Smith Ferry Road, Westlake, Pastor of First Baptist Church of Westlake, appeared before the Committee on behalf of the Westlake Ministerial Alliance in opposition to an x-rated video store, Chix News, located on Westwood Road in Westlake. Dr. Thompson presented petitions containing 1278 signatures opposing the video store, and he asked for guidance as to what could be done to prevent this business from being in the area. Mr. Allen Smith, General Counsel to the Police Jury, advised that the Police Jury had no authority in this matter but that the Sheriff’s Department could be requested to investigate, and the results of the investigation could then be turned over to the District Attorney’s Office to determine if the business was violating the State obscenity laws which required compliance with community standards. Mr. Jameson Gibson, 318 Atwood Daniels Road, Ragley, owner of Chix News, also appeared before the Committee and stated he was willing to work with the community in relocating his business, particularly if he could receive financial assistance from the Westlake Ministerial Alliance to do so. Mr. Ronnie Rossito, First Assistant District Attorney, also appeared before the Committee and offered the assistance of his office in resolving this matter.
(4) Received report from staff on the various options for the new I-10 bridge. Mr. Abe Fontenot, Transportation Director for IMCAL and the Lake Charles metropolitan planning area, appeared before the Committee and advised that a meeting would be held Monday, March 29, 2004, of the Policy Committee of the Metropolitan Planning Organization to discuss the various alternatives. Concerns voiced by members of the Committee were: (1) a taller bridge might allow more businesses to locate in the North Lake Charles area; (2) there was a possibility of disruption/diversion of traffic associated with a span bridge that opened to allow seagoing vessels room to pass under it; (3) the existing Union Pacific railroad bridge just north of the existing I-10 bridge was an impediment to boat traffic; and (4) the need for a grade separation at Sampson Street in Westlake should remain the first improvement to be accomplished in this project.
(5) Recommended that a resolution be adopted ratifying the names or renaming the following non-parish maintained public roads, and further, removing Rosin Road, East Sapling Square, and Evergreen Entrance in Ward One from the Master Private Road List, since said roads were accepted for future maintenance by the Police Jury on January 8, 2004:

It was moved by Mrs. Griffin, seconded by Mr. Kleckley and carried unanimously to approve Recommendation No. One of the Public Works Committee, and further, in accordance with the recommendations of the Project Architect and District Attorney Rick Bryant, that the low bid in the amount of $320,000.00 of Bessette Development Corporation be accepted for the Calcasieu Parish District Attorney’s Office First Floor Renovations, said bids having been received by the Police Jury on March 25, 2004 and further, that the President of the Police Jury be authorized to execute the contract documents and any amendments or modifications thereto in conjunction with said project.
Motion was made by Mr. Landry, seconded by Mr. Moon and carried unanimously that Recommendation No. Two of the Public Works Committee be approved.
Upon motion made by Mr. McMillin, which was duly seconded by Mr. Manuel and carried unanimously, Recommendation No. Three of the Public Works Committee as stated heretofore was approved. Mr. McMillin advised that Chix News was going to close down which he said was good news for his district. He thanked his fellow jurors for the opportunity for full discussion of this issue at the Public Works Committee meeting.

ORDINANCE NO. 4702
AN ORDINANCE amending Chapter 23 – Subdivision and Chapter 26 – Zoning, of the Code of Ordinances of the Parish of Calcasieu, Louisiana.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 1st day of April, 2004, that it does hereby amend Chapter 23 – Subdivision, Section 23-8 (c), and Chapter 26 – Zoning, Section 26-15 (b), of the Code of Ordinances of Calcasieu Parish, Louisiana, to remove Rosin Road, East Sapling Square and Evergreen Entrance in Ward One from the revised Master Private Road List, as follows:
SECTION 1. Section 23-8. Administration and violation, is amended as follows:
(c) Variance on Private Road. No application for variance request shall be processed by the commission staff for authorization of a development permit on a private road other than those shown on Calcasieu Parish’s Master Private Road List officially adopted by the Police Jury on June 20, 2002, with revisions adopted on May 1, 2003, June 5, 2003, November 6, 2003, and April 1, 2004, a copy of which is attached hereto and made a part hereof, and which is also hereby incorporated in the Code of Ordinances of Calcasieu Parish, Louisiana, as Exhibit A in the Appendix Chapter. Procedures for applying for development permits without public road frontage requirements.
SECTION 2. Section 26-15. Procedures for applying for development permits without public road frontage requirements, is amended as follows:
(b) No application for variance request shall be processed by the Division of Planning and Development for authorization of a development permit on a private road other than those shown on Calcasieu Parish’s Master Private Road List officially adopted by the Police Jury on June 20, 2002, with revisions adopted on May 1, 2003, June 5, 2003, November 6, 2003 and April 1, 2004, a copy of which is attached hereto and made a part hereof, and which is also hereby incorporated in the Code of Ordinances of Calcasieu Parish, Louisiana, as Exhibit A in the Appendix Chapter.
BE IT FURTHER ORDAINED that this ordinance shall become effective immediately upon adoption.
BE IT FURTHER ORDAINED that any ordinance or parts of any ordinance in conflict herewith are hereby repealed.
BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

President Clement advised that the next item on the agenda was to consider amending the Code of Ordinances of Calcasieu Parish, Louisiana, as it related to the zoning ordinance and floodplain ordinance. He further advised that the Planning and Zoning Board had met on Tuesday, March 16, 2004, and voted nine (for) and two (against) to recommend that the zoning ordinance be amended, and voted unanimously to recommend that the floodplain ordinance be amended. President Clement pointed out that the Police Jury had on March 18, 2004, deferred action until the meeting on this date.
Mr. Vickers advised that due to the circumstances surrounding Mrs. Treme’s loss of her mother, he had not had an opportunity to meet with her as she had requested regarding these changes. Mr. Vickers respectfully requested that additional time be given in order to accomplish that.
It was moved by Mrs. Treme and seconded by Mr. Stevens to defer action on this matter for thirty days.
Mr. McMillin stated that the jurors had received a number of letters from different developers regarding this matter, and he felt there could be a problem with economic development if the amendments were enacted. Mr. McMillin asked that Mr. Vickers meet with the developers and then report back to the Police Jury.
Mr. Andrepont stated that he thought there was a “disconnect” between the Parish and the developers due to the fact that some of them who contacted him said they were caught off guard with this. Mr. Andrepont also stated that he knew it was difficult to reach everybody, but he felt it was important to establish a line of communication with different cross sections of the community regarding development of the Parish. Mr. Andrepont stated he was not criticizing anyone because neither the staff or the jurors could be on top of everything but that perhaps they could be more available to the public.
President Clement asked if there had been a committee appointed by the Police Jury at one time which was to meet with the developers, and Mr. Vickers advised that said committee had been appointed to discuss the formulation of the sewer ordinance and was no longer active. Mr. Vickers stated that he thought the staff could come back to the Police Jury and maybe propose the amendments, which he said were basically technical in nature, a little differently.
Mr. Vickers also stated that most of the developers would not be affected by the amendments at all, and the purpose of said amendments was to focus on the big developments that would create large amounts of traffic in urban areas and a lot of water run-off. He explained that the rural areas would most likely not get that type of development, i.e., a shopping center or industrial plant. Mr. Vickers stated that the staff needed some tools to make those developers include in their plans such things as turn lanes.
Mr. Vickers pointed out that the amendments were an effort to look toward the future and that some areas of the Parish were rapidly becoming suburbanized with the out-migration of people who were leaving the city limits and moving into the unincorporated areas. He advised that a residential development would not be impacted by the proposed amendments and pointed out that the language states “may” (instead of “shall”), and it also provided for an appeal.
Mr. Manuel stated that while he understood that Mr. Vickers would meet with Mrs. Treme, he would like to see a committee appointed to sit down with Mr. Vickers and get a better idea of what needed to be done with respect to the amendments.
Mr. Andrepont agreed, stating that the Police Jury needed some representation in such issues.
Mr. McMillin stated that he would hate for the Parish to lose a big project because of required studies, and he felt the Parish needed to do everything possible to be pro-active with respect to economic development. Mr. McMillin pointed out that many times the Parish gave incentives to companies to locate in the area, not deter them, and he felt the lines of communication needed to be opened.
Mr. Landry stated that he agreed, but even if there was a $50 million company that was thinking of locating in the Parish, if said company would mess up traffic and drainage, he would rather they not come in. He stated that this had happened in the past, and he appreciated what Mr. Vickers was attempting to do.
President Clement asked Mr. Vickers to let him know when he would be meeting with Mrs. Treme, and he would ask two or three of the police jurors who had expressed an interest in this matter to join them for a discussion.
Mr. Vickers pointed out that the Police Jury had a Planning and Zoning Liaison Group which might be the appropriate task force to give input on this matter.
A vote was taken on the motion on the floor which was to defer action for thirty days on amending the Code of Ordinances of Calcasieu Parish, Louisiana, as it related to the zoning ordinance and the floodplain ordinance, and said motion carried unanimously.
The hour being 6:00 p.m., President Clement advised that the Police Jury would hold a public hearing, as a result of notice provided to the owner of properties described below, in accordance with Article II-Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, ordering the following property owners to show cause as to why the structures as listed should not be condemned:

With respect to the fifth piece of property located at 510 John Stine Road in the Westlake area, Mr. Crain advised that the staff had talked to someone who had purchased this property who was in the process of repairing the mobile home. Mr. Crain recommended that the new owners be given sixty days to repair the structure.
President Clement asked if there was anyone present in the audience to address the Police Jury with respect to this property and hearing no comments, motion was made by Mrs. Griffin, seconded by Mr. Manuel and carried unanimously to accept the staff’s recommendation and to allow the new owners sixty days to repair the structure located at 510 John Stine Road in the Westlake area.
With respect to the sixth piece of property located on Kathy Drive in the south Sulphur area, Mr. Crain advised that no action was necessary due to the fact that the structure had been repaired.
With respect to the seventh piece of property located at 912 Kingery Road in the Topsy area, Mr. Crain recommended that the structure be condemned and removed within thirty days.
Motion was made by Mr. Andrepont and seconded by Mr. Stelly that the recommendation of the staff be approved.
Mr. Manuel stated that he had received a telephone call about this structure, and Mr. Crain advised that he had also and that the owners were in the process of removing the structure.
President Clement asked if there was anyone present in the audience to address the Police Jury with respect to this property, and Ms. Julie (last name inaudible) appeared before the Police Jury and stated she had pictures showing they were tearing the structures down.
Mr. Stevens advised that he had spoken with a Ms. Joanna Walker and with Mr. Manuel, and it was his understanding that the tearing down of the two manufactured homes could be accomplished in two weeks.
