The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, March 18, 2004, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Brent Clement, President, presiding, and the following members present:
Mesdames Elizabeth Conway Griffin and Sandra J. Treme; and Messrs. Francis Andrepont, Mike Danahay, Tony Guillory, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, Tony Stelly, and Alvin Stevens
Absent: Mr. Calvin Collins (recuperating from surgery)
Also present were Mr. S. Mark McMurry, Parish Administrator; Mr. Bryan Beam, Assistant Administrator; Mr. Tim Conner, Assistant Parish Engineer; Mr. Richard Gremillion, Director of Emergency Preparedness; Mrs. Cheryl Heisser, Director of Human Resources; Mr. Jerry Milner, Director of Finance; Mr. Allen L. Smith, Jr. of the firm of Plauche, Smith and Nieset, General Counsel; Mrs. Kathy P. Smith, Recording Secretary; Mr. Gerry Trahan, Director of Facility Management; and Mr. Jim Vickers, Director of Planning and Development.
President Clement called the meeting to order. The invocation was pronounced by Mr. Stevens which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.
President Clement welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
President Clement called on Dr. Mackey at this time to present a trophy and certificates to the coaches and players of the St. Louis Saints Division III Boys State Soccer Championship Team.
Head Coach Jason Oertling received the trophy and certificates on behalf of the team and pointed out that this was the fourth time St. Louis had won the State championship in soccer. He stated that it meant a lot to the team to share this moment with the Police Jury.
Coach Oertling then introduced the following members of the team, pointing out that all of them had done a great job whether it was the star player or the guy on the bench cheering his heart out:

Coach Oertling expressed his appreciation for the support of the school and the area. He stated that all that was visible in the stands at the championship game were the colors orange and blue (St. Louis’s school colors) and that there had been virtually no fans representing the opposing team even though the school was only ten minutes away from the stadium.
Mrs. Treme advised that there had been a lot of people in her district in the northern part of the Parish who had pulled for St. Louis, as well as Lake Charles/Boston and Sulphur in their endeavors. She encouraged the players to continue to be the best they could possibly be throughout their lifetimes.
President Clement stated that a public hearing would be held at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., to receive comments regarding the proposed reduction of the boundaries of the Calcasieu-Cameron Hospital Service District to exclude all of Ward One of Calcasieu Parish, Louisiana, less and except property located at 602 Sam Houston Jones Parkway in Ward One.
Mr. Tim Broussard, Administrator of Calcasieu-Cameron Hospital, appeared before the Police Jury and stated that there had been some concerns which had recently appeared in the newspaper but he wanted to assure the Police Jury and citizens that there had been no board action taken in any way pertaining to any construction projects. Mr. Broussard further stated that no action had been taken to pursue any property taxes since the Board (of the Calcasieu Cameron Hospital Service District) had not determined any construction needs at the present time but was continuing to pursue a determination of what those needs would be in the future.
Mr. Broussard advised that he had recently received a copy of the Parish’s Board Member Manual which he said he would review and present to the Board so that it could take any actions necessary to be in compliance with said manual. He pointed out that the board members had received a copy of the manual on this date. Mr. Broussard stated that in addition to any review or action by the Police Jury or its staff, they welcomed any review, action or recommendations to do a better job whether it pertained to the Board, the leadership and/or staff of the Hospital.
Mr. Andrepont stated that the recent editorial in the newspaper stated that the Hospital was not in competition with other hospitals which he felt was not the truth.
Mr. Broussard advised that the State statutes allow competition, and the Hospital certainly wanted to do a good job as a service district hospital and provide what was needed in the community. He further advised that the community was rather large and that the Hospital did well when it had a strong patient base. Mr. Broussard stated that there was a form of competition in that the Hospital wanted patients to stay at said Hospital and wanted to be a good service to the community as stated in the Hospital’s mission statement.
Mr. Charlie Atherton, 122 Vine Street, Sulphur, appeared before the Police Jury and stated that the public very much appreciated the Police Jury in its calling of a public hearing on this date and that it had done so spoke highly of the Police Jury. Mr. Atherton advised that at the invitation of the Board (of the hospital service district), he had met with them and that he had been impressed and surprised at the cooperation and interest in meeting with him to go through the list of public concerns. Mr. Atherton stated that he left the meeting with the feeling that the Hospital would do exactly what Mr. Broussard had said they would do. Mr. Atherton further stated that he felt the Board and staff would continue to have this openness with the public and would probably reduce the number of closed-door meetings.
Mr. Atherton again thanked the Police Jury for allowing the public the opportunity to voice comments because he felt the only time the public had an opportunity to voice concerns, especially about a special service district, was when there was an item on the Police Jury’s meeting agenda which he said usually did not happen unless money was involved.
Mr. Atherton stated that he thought the public would benefit from this as well as the Hospital in resolving some long-time festering concerns and in proposing possible solutions. He reminded the jurors that the hospital service district board was just one of 70-something boards under the umbrella of the Police Jury, and he appreciated the recent action of the Jury regarding an annual financial review of those districts by the Parish’s Division of Finance.
Mr. Atherton stated that the Board of the hospital service district had convinced him that they were open to any recommendations by the Police Jury and by picking up a copy of the Board Member Manual, he felt they were wanting to make sure they were following the Police Jury’s policies and procedures, as well as State law.
Motion was made by Mr. Manuel, seconded by Mrs. Treme and carried unanimously that the boundaries of the Calcasieu-Cameron Hospital Service District be reduced to exclude all of Ward One of Calcasieu Parish, Louisiana, less and except property located at 602 Sam Houston Jones Parkway in Ward One; whereupon, the following ordinance was adopted:
ORDINANCE NO. 4699
An ordinance amending Ordinance No. 706, adopted by the Calcasieu Parish Police Jury on August 1, 1950 (as heretofore amended by Ordinance No. 3514, adopted on March 3, 1994) and Chapter 12, Article II, Hospital Service Districts, Division 3, Calcasieu-Cameron, of the Code of Ordinances of Calcasieu Parish, Louisiana, to reduce the boundaries of the Calcasieu-Cameron Hospital Service District to exclude Ward One of Calcasieu Parish, less and except certain property owned and operated by the District.
WHEREAS, by Ordinance No. 706, adopted by the Calcasieu Parish Police Jury on August 1, 1950, the Calcasieu Parish Police Jury created the Calcasieu-Cameron Hospital Service District (the “District”) consisting of the whole of Wards 4 and 7 of Calcasieu Parish and the whole of Ward 6 of Cameron Parish, Louisiana; and
WHEREAS, by Ordinance No. 25-B adopted by the Cameron Parish Police Jury on August 7, 1950, the Cameron Parish Police Jury consented to and approved the creation of the District and the inclusion of the whole of Ward Six of Cameron Parish within the District; and
WHEREAS, Ordinance No. 3514, adopted by the Calcasieu Parish Police Jury on March 3, 1994, amended Ordinance No. 706 and Chapter 12, Article II, Hospital Service Districts, Division 3, Calcasieu-Cameron, of the Code of Ordinances of Calcasieu Parish, Louisiana, to enlarge and expand the boundaries of the District to include Ward One of Calcasieu Parish, which amendment and enlargement was approved by the Cameron Parish Police Jury on March 1, 1994; and
WHEREAS, the Board of Commissioners of the District on January 27, 2004, adopted a resolution requesting that the Calcasieu Parish and Cameron Parish Police Juries redefine the boundaries of the District to exclude from the boundaries of the District all of Ward One of Calcasieu Parish EXCEPT property owned by the District in said Ward One, which is located at 602 Sam Houston Jones Parkway in Ward One; and
WHEREAS, the Calcasieu Parish Police Jury called a public hearing and published a notice thereof on February 19, February 26 and March 4, 2004; and
WHEREAS, such public hearing was duly held on Thursday, March 18, 2004, at 5:30 p.m., in the Police Jury Meeting Room on the first floor of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, at which public hearing no objections were made, and no objections were made in writing to the President of the Police Jury; and
WHEREAS, the change in the boundaries of the District to exclude Ward One of Calcasieu Parish EXCEPT property owned by the District in said Ward One which is located at 602 Sam Houston Jones Parkway in Ward One will not cause an impairment of the obligations of any contract of the District.
NOW, THEREFORE,
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 18th day of March, 2004, that:
SECTION 1. Under and by virtue of the authority conferred by Chapter 10, Title 46 of the Louisiana Revised Statues of 1950, as amended, and other constitutional and statutory authority, the boundaries of the Calcasieu-Cameron Hospital Service District (the “District”) are hereby altered and amended to exclude Ward One of Calcasieu Parish, less and except the property owned and operated by the District, which is located at 602 Sam Houston Jones Parkway in Ward One. The boundaries of the District shall hereafter comprise and embrace all of that territory within (i) Ward 4 and Ward 7 of Calcasieu Parish, (ii) the property owned and operated by the District located at 602 Sam Houston Jones Parkway in Ward One, and (iii) Ward 6 of Cameron Parish.
SECTION 2. The District, as the boundaries are altered and amended hereby, shall continue to be known as “Calcasieu-Cameron Hospital Service District” and, as such, shall have all the rights, powers and privileges granted and conferred by the Constitution and Statues of the State of Louisiana, including the authority to incur debt, to issue bonds and to levy taxes.
SECTION 3. The domicile of the District shall continue to be Sulphur, Louisiana, which domicile is within the corporate limits of the District.
SECTION 4. This ordinance shall be published in full in the official journal of the Parish after adoption.

BE IT KNOWN AND REMEMBERED that on this 18th day of March, 2004, at 5:30 o’clock p.m., in accordance with a resolution adopted November 20, 2003, by the Police Jury of Calcasieu Parish, Louisiana (the “Police Jury”), the governing authority of Calcasieu Parish, Louisiana (the “Parish”), and recorded in the records of the Police Jury, being a quorum thereof, met at the regular meeting place of the Police Jury, in the Police Jury Meeting Room located on the first floor of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, and according to law, received the certified tabulation sheets and results of the voting machines from the Commissioners and Commissioners-in-Charge of the election held in the Parish on March 9, 2004, in accordance with said resolution and there proceeded to count the ballots to determine the vote on the following proposition:
ROAD AND DRAINAGE TAX CONTINUATION
SUMMARY: Continuation of a ten (10) year 4.06-mill property tax by the Calcasieu Parish Police Jury for improving roads, bridges and drainage, and continuation of a road and drainage trust fund in the amount of $1,000,000 annually.
“Shall the Calcasieu Parish Police Jury (the “Police Jury”), serving as the governing authority of Calcasieu Parish, Louisiana, (the “Parish”) be authorized to levy and collect a continuation of a four and six one-hundredths (4.06)-mill tax, on all property subject to taxation in the Parish for a period of ten (10) years, beginning in 2004, for the purposes of paying the cost of expenses, equipment and supplies related to construction, hardsurfacing and improving roads, highways, and bridges, and the necessary ditching and drainage related thereto; continuation of a road and drainage trust fund in the amount of $1,000,000 annually to be appropriated to projects which have local, state, or federal matching funds; and in the event the proposition carries, for authority to levy the special tax provided for in the proposition?”
