The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, February 19, 2004, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Brent Clement, President, presiding, and the following members present:
Mesdames Elizabeth Conway Griffin and Sandra J. Treme; and Messrs. Francis Andrepont, Calvin Collins, Mike Danahay, Tony Guillory, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, Cornie Moon, Tony Stelly, and Alvin Stevens

President Clement called the meeting to order. The invocation was pronounced by Father Alan Trouille’ which was followed by the Pledge of Allegiance led by Mr. Kleckley. The roll was called with the result being as outlined above.
President Clement welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.
President Clement advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for Calcasieu Parish Project No. 2004-03 (Hardsurfacing of Paul Bellon Road and Clyde Dulaney Road).
Mr. McMurry then proceeded to open the following bids:

There being no other bids, motion was made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously that the bids be referred to the Parish Engineer for final tabulation, with further action to be taken by the Police Jury at its Regular Meeting on March 4, 2004.

It was moved by Mr. Manuel, seconded by Mr. Stevens and carried unanimously to approve the minutes of the Regular Meeting of the Police Jury dated January 22, 2004, and the reading of same was dispensed with.
President Clement advised that action was needed on Zoning Case RZ02-004-04 which was a request by Arnold Natali to rezone from A-1 (Agricultural) to R-1 (Single Family Residential) to allow residential development (Clearfield Ranch) on Highway 14 East in Ward Two, Police Jury District 10. He further advised that the Planning and Zoning Board had met on Tuesday, February 17, 2004, and voted unanimously to recommend that the request be granted.
Motion was made by Mr. McMillin, seconded by Dr. Mackey and carried, with Mr. Stelly abstaining from voting, that the recommendation of the Planning and Zoning Board be upheld with respect to Zoning Case RZ02-004-04 and that the request to rezone be granted; whereupon, the following ordinance was adopted:

President Clement advised that action was needed on Zoning Case RZ03-003-04 which was a request by Primeaux Landz, L.L.C. to rezone from R-2 (Mixed Residential) to C-2 (General Commercial) and R-1 (Single Family Residential) to allow residential and commercial development on Carlo Henry Road in Ward Three, Police Jury District 10. He further advised that the Planning and Zoning Board had met on Tuesday, February 17, 2004, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; and (2) that all drives and parking must be hardsurfaced (concrete or asphalt) for the commercial development.
Mr. Vickers advised that the applicant had asked for a partial withdrawal of his original request. He explained that the original request was to rezone the west 1,070 feet of the applicant’s property from R-2 (Mixed Residential) to R-1 (Single Family Residential) to allow residential development, and further, to rezone the remaining 34.87 feet from R-2 (Mixed Residential) to C-2 (General Commercial) to allow commercial development. Mr. Vickers advised that the applicant wanted to withdraw his request to rezone the 34.87 feet from R-2 (Mixed Residential) to C-2 (General Commercial). He further advised that if this property was withdrawn from the rezoning request, there would no longer be any need for Stipulation No. 2 as recommended by the Planning and Zoning Board and as outlined heretofore.
Motion was made by Mrs. Griffin, seconded by Mr. Stevens and carried unanimously that the recommendation of the Planning and Zoning Board be upheld with respect to Zoning Case RZ03-003-04 and that the request to rezone be granted with the inclusion of Stipulation No. 1 as outlined by said Board; whereupon, the following ordinance was adopted:

President Clement advised that action was needed on amending the Code of Ordinances of Calcasieu Parish, Louisiana, relative to Off-Premise Outdoor Advertising Signs. He further advised that the Planning and Zoning Board had met on Tuesday, February 17, 2004, and voted unanimously to recommend that the Code of Ordinances be amended as follows:
Calcasieu Parish Code Section 6-93(d): Location of off-premises signs.
(d) Applications to petition for rezonings or exceptions for properties parallel to Interstate 10 shall only be taken in cases where an outdoor advertising company owner/lessee is reconstructing an existing billboard parallel to Interstate 10 or where an outdoor advertising company owner/lessee has removed an existing billboard parallel to Interstate 10 and would like to construct a new billboard in another location parallel to Interstate 10.
Calcasieu Parish Code Section 6-94(c): Prohibited signs and locations.
(c) No off-premises signs shall be located parallel to Interstate 10 in Sections 3 and 4 of Township 11 South, Range 13 West, and Sections 34, 35 and 36, Township 10 South, Range 13 West, Calcasieu Parish, Louisiana, other than those currently permitted by the state and parish, which may not be replaced.
Calcasieu Parish Code Section 6-108(d): Enforcement.
(d) In the absence of just compensation, all legal existing nonconforming signs shall may remain subject to the provisions of sections 6-106 and 6-108 hereof;. however, same may not be maintained, repaired or rebuilt by the owner(s) thereof in any manner that will increase the degree of nonconformity. In performing any maintenance or repair required hereunder, the owner/lessee shall not do anything to increase the degree of nonconformity.

It was moved by Mr. Manuel and seconded by Mrs. Griffin to uphold the recommendation of the Planning and Zoning Board and to amend the Code of Ordinances of Calcasieu Parish, Louisiana, relative to Off-Premise Outdoor Advertising Signs.
Mr. McMillin asked why the change was necessary, and Mr. Vickers explained that there had been some civil litigation, of which the Police Jury had not been a part, which involved billboards and as a result, he and Mr. Smith had looked at the Parish’s ordinance and found a need for some technical clarifications.
A vote taken on the motion on the floor carried unanimously; whereupon, the following ordinance was adopted:
ORDINANCE NO. 4694
AN ORDINANCE amending Chapter 6 – Buildings, Article IV. Off-Premises Outdoor Advertising Signs, of the Code of Ordinances of the Parish of Calcasieu, Louisiana.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 19th day of February, 2004, that it does hereby amend Chapter 6 – Buildings, Article IV. Off-Premises Outdoor Advertising Signs, Sections 6-93. Location of off-premises signs, 6-94. Prohibited signs and locations, and 6-108. Enforcement, of the Code of Ordinances of Calcasieu Parish, Louisiana, as follows:
SECTION I. Chapter 6, Article IV, Sec. 6-93 (d) is amended in its entirety to read as follows:
(d) Applications to petition for rezonings or exceptions for properties parallel to Interstate 10 shall only be taken in cases where an owner/lessee is reconstructing an existing billboard parallel to Interstate 10 or where an owner/lessee has removed an existing billboard parallel to Interstate 10 and would like to construct a new billboard in another location parallel to Interstate 10.

BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

Upon motion made by Mr. Manuel, which was duly seconded by Mr. Stevens and carried unanimously, the following resolutions were adopted:
RESOLUTION
WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Cyril Leonard to clear, excavate, grade and redistribute approximately 52,000 cubic yards of native earthen material and place an additional 13,000 cubic yards of hauled-in clay and aggregate fill, all to construct house pads, driveways, streets, and relocate and backfill an existing ditch, all to construct a residential subdivision. Project implementation would directly impact approximately 32.0 acres of which 7.0 acres have been determined to be jurisdictional wetlands and other waters of the United States. Said project is located in Maplewood, off Prater Road, in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Cyril Leonard relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 19th day of February, 2004, that it does hereby indicate no objection to the proposal of Cyril Leonard to clear, excavate, grade and redistribute approximately 52,000 cubic yards of native earthen material and place an additional 13,000 cubic yards of hauled-in clay and aggregate fill, all to construct house pads, driveways, streets, and relocate and backfill an existing ditch, all to construct a residential subdivision. BE IT FURTHER RESOLVED that a study on the environmental impact of the aforementioned project has not been made due to lack of expertise of the parish staff to accomplish such a study, and the Police Jury requests that agencies and/or individuals with such expertise make an environmental review of said project and forward their findings to the U.S. Corps of Engineers.

RESOLUTION

Approximately 3,961 cubic yards of hauled-in fill material would be deposited for construction of a new compressor station, road improvements, and ring levee needed to drill 300' x 300' brine disposal well. Also, an area approximately 100' x 100' would be cleared to assist a horizontal directional drill exit under the Sabine River Diversion Canal to facilitate pipeline tie-in. Project implementation would directly impact approximately 6.05 acres of mixed pine/hardwood wetland communities. Said project is located East of Louisiana Highway 109, near Starks, in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Starks Gas Storage, LLC, relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.

Motion was made by Mrs. Griffin, seconded by Mr. McMillin and carried unanimously that the following ordinance be adopted amending Article V, Littering, of Chapter 11, Garbage, Trash and Weeds, of the Code of Ordinances of Calcasieu Parish, Louisiana, to provide Parish Code Enforcement Officers the authority to conduct litter inspections and issue litter citations in accordance with State statutes:

AN ORDINANCE amending Article V. Littering, of Chapter 11 - Garbage, Trash and Weeds, of the Code of Ordinances of the Parish of Calcasieu, Louisiana.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 19th day of February, 2004, that it does hereby amend Article V. Littering, of Chapter 11 - Garbage, Trash and Weeds, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, as follows:
SECTION I. Sec. 11-119 should be titled and amended to read in its entirety as follows:
Sec. 11-119. Jurisdiction and procedure — Justice of the peace; constable; and parish code enforcement officer.
(a) A justice of the peace shall have concurrent jurisdiction over the litter violations occurring in the parish. In addition, a constable may issue summons and serve subpoenas anywhere in the parish all in accordance with LA—R.S. 13:2586. Prosecution of litter violations and compensation in criminal cases of a justice of the peace and constable shall be in accordance with LA—R.S. 13:2587.1 and LA—R.S. 13:2589.
(b) Pursuant to LA—R.S. 33:1236.2, parish code enforcement officers shall have concurrent authority with constables within Calcasieu Parish to inspect and issue citations for litter violations.
BE IT FURTHER ORDAINED that this ordinance shall become effective immediately upon adoption.
BE IT FURTHER ORDAINED that any ordinance or parts of any ordinance in conflict herewith are hereby repealed.
BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

Motion was made by Mrs. Griffin and seconded by Mr. McMillin to adopt a resolution approving a new policy which would call for an annual financial review by the Parish Division of Finance of each of the districts and units that are part of the Police Jury’s Comprehensive Financial Report, said review to be designed to examine internal controls and safeguards, and implement upgrades and changes where necessary, to insure the highest level of financial reporting and security.
Mr. Andrepont stated that in all of the Police Jury’s wisdom, he felt this was one of the better things that had been proposed recently, and he thought it would nip a lot of things in the bud before they happened.
Mr. Charlie Atherton, 122 Vine Street, Sulphur, appeared before the Police Jury and stated that he supported the proposed action and encouraged the Police Jury to adopt this policy. Mr. Atherton stated that the staff was professionally accountable and followed Police Jury policies, as well as State law, but for clarification he asked if it was the intent of the motion on the floor to require the special service districts to follow these same policies and laws that were adhered to by the staff. Mr. Atherton pointed out that he felt this was clearly implied in the motion but that it would give the public a greater comfort level if the Police Jury would clarify the motion to state that the districts would follow Police Jury policies and State laws.
Mr. McMurry explained that his interpretation was that the intent would be that as a result of annual reviews, if there were deficiencies in place in any of the districts, those deficiencies would more than likely be corrected by the district by implementing new policies and/or following the policies already in place for the Police Jury’s operation. Mr. McMurry stated that the only problem with a “shot gun” approach would be the differences in some of the districts, i.e., a waterworks district could be called an enterprise district because it sold water and provided a service for a fee which would cause such a district to have policies the Police Jury did not have. He also stated that the purpose of the annual review would be to find whatever deficiencies might exist and to suggest a new policy or adherence to an existing policy to remedy the deficiency.
Mr. Atherton advised that he had looked at the Police Jury’s policies and procedures and various manuals, which he felt were very pro-active, and he thought it would be beneficial for the Police Jury’s boards to follow them.
Mr. McMurry stated that he felt the motion on the floor was pro-active, and he did not think anything about it should create a “gotcha” feeling or tactic but instead, an effort to keep problems from becoming too big. He pointed out that it would be the staff’s intent to use the policies in place to correct whatever deficiencies were found.
Mr. Atherton stated that the staff had the tools it needed to do its job effectively with some consistency and uniformity.
Mr. Manuel advised that all the boards he had talked to were looking forward to the Police Jury’s action in this regard and that it would be like a safety net for them in that any problems could be corrected before they went too far.
Mr. Atherton pointed out that the Police Jury’s “Board Member Manual” was an excellent reference tool and that some of the boards might not be aware of its existence. Mr. Manuel stated that most of the boards he was affiliated with had copies of the manual.
A vote was then taken on the motion on the floor, and said motion carried unanimously; whereupon, the following resolution was adopted:

Resolution in Memoriam
Mr. Billy J. Moses
WHEREAS, the life and outstanding service of Mr. Billy J. Moses are engraved on memory’s table, and he will be remembered affectionately by those who proudly knew him; and
WHEREAS, Mr. Moses, a resident of Sulphur for 53 years, served his nation in the United States Navy during World War II; and
WHEREAS, Mr. Moses received many honors throughout his 40-year career of service to the Calcasieu Parish public school system as a teacher, coach, assistant principal and principal at Sulphur High School, and as assistant superintendent and superintendent of schools in Calcasieu Parish; and
WHEREAS, Mr. Moses was a member of Sulphur First Baptist Church, Masonic Lodge, Scottish Rite Lodge and Shriners, and for six years was an executive committee member of the Louisiana High School Athletic Association; and
WHEREAS, Mr. Moses served on the Calcasieu Communications District, Board of Directors of the YMCA, West Cal Airport Authority, Sulphur Industrial Board, Pioneer Club, Sulphur City Council, Arts Council, and most recently as Chairman of the West Calcasieu-Cameron Hospital Service District;
WHEREAS, in his passing, the Parish of Calcasieu feels the loss of an outstanding public-spirited citizen and friend, and he will be sorely missed.
NOW, THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 19th day of February, 2004, that it does hereby express sincere regret in the passing of Mr. Billy J. Moses.

It was moved by Mrs. Griffin, seconded by Mr. Collins and carried unanimously to reject the low bid of Billy Navarre Chevrolet, Inc. in the amount of $30,169.00 due to major deviations (15,000 GVWR minimum not being met) and to accept the bid of Bolton Ford, Inc. in the amount of $33,878.00 complete as per all specifications, for the purchase of one (1) 2004 crew cab and chassis (4x2) with mounted service body, for use by the Division of Engineering and Public Works (Special Drainage), said bids having been received by the Parish Purchasing Agent on February 11, 2004.
Upon motion made by Mr. Stevens, which was duly seconded by Mr. McMillin and carried unanimously, the low bid of Bolton Ford, Inc. in the amount of $49,436.00 was accepted, complete as per all specifications, for the purchase of four (4) 2004 spray trucks (one-half ton rating) for use by the Mosquito Control Department, said bids having been received by the Parish Purchasing Agent on February 11, 2004.
Motion was made by Mr. Manuel, seconded by Mrs. Griffin and carried unanimously that the bid of Lake Charles Music, Inc. in the amount of $28,451.50 be accepted, complete as per all specifications, for the purchase of sound equipment for use by the Burton Memorial Coliseum, said bids having been received by the Parish Purchasing Agent on February 19, 2004.
Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Stevens and carried unanimously, the Parish Purchasing Agent was authorized to advertise for bids for the purchase of one (1) 2004 one and one-half ton crew cab (four doors) flat dump bed truck, for use by the Facility Management Department.
It was moved by Mr. Manuel, seconded by Mrs. Griffin and carried unanimously to authorize the Parish Purchasing Agent to advertise for bids for the purchase of one (1) 2004 regular cab and chassis with Animal Control Transport Unit for use by the Division of Engineering and Public Works (Animal Control Department).
Motion was made by Mrs. Griffin, seconded by Mr. Stevens and carried unanimously that the Parish Administrator be authorized to advertise for bids for the Calcasieu Parish District Attorney’s Office first floor renovations at 1032 Ryan Street (Wasey Building).
Upon motion made by Mr. Manuel, which was duly seconded by Mr. Collins and carried unanimously, the Parish Administrator was authorized to advertise for bids for Calcasieu Parish Project No. 2004-04 (Hardsurfacing of Various Roads in Wards 4, 5 and 6), Calcasieu Parish Project No. 2004-5 (Hardsurfacing of Various Roads in Wards 5, 6 and 7), and Calcasieu Parish Project No. 2004-06 (Hardsurfacing of Various Roads in Wards 1 and 8).
Mr. Andrepont complimented Mr. Clement on the manner in which he had conducted the meeting on this date. He stated that he had been asked to inquire if the Police Jury meeting agendas could be put on the Parish’s website, to which Mr. McMurry advised that both the agendas and minutes were already on the site.
