            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, August 7, 2003, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chuck Kleckley, President, presiding, and the following members present:

 

Mesdames Luvertha August, Elizabeth Conway Griffin, and Sandra J. Treme; and Messrs. Francis Andrepont, Algie Breaux, Brent Clement, Calvin Collins, Mike Danahay, Enos Derbonne, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, and Cornie Moon

            Also present were Mr. S. Mark McMurry, Parish Administrator, Mr. Bryan Beam, Assistant Administrator, Mrs. Coleen Clark, Executive Secretary, Mrs. Cheryl Heisser, Director of Human Resources, Mr. Jerry Milner, Director of Finance, Mr. Claude D. Smart, Parish Engineer, Mr. Allen Smith of the firm of Plauche, Smith and Nieset, Legal Counsel, Mrs. Kathy P. Smith, Recording Secretary, Mr. Gerry Trahan, Director of Facilities Management, and Mr. Jim Vickers, Director of Planning and Development.

 

            President Kleckley called the meeting to order. The invocation was pronounced by Dr. Mackey which was followed by the Pledge of Allegiance led by Mr. Breaux. The roll was called with the result being as outlined above.

 

            President Kleckley welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.

 

            President Kleckley advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for an oil, gas, and mineral lease on certain roads and streets located in Twelve Oaks Subdivision, Sandia Estates Part I Subdivision, Spanish Pines Estates Subdivision, and in Sections 8, 9, 16, and 17, Township 10 South, Range 10 West, in Ward Four (Police Jury District 12).

 

            Mr. McMurry then proceeded to open the only bid received which was submitted by Loudon Exploration Inc. Following a reading of the bid, the details of which are contained in the resolution which follows, a motion was offered by Dr. Mackey, seconded by Mrs. Griffin and carried unanimously that the following resolution be adopted:

            At this time, a framed copy of a proclamation was presented by Messrs. McMillin and Danahay to Mr. Lasalle Williams, Sr. for having recently been chosen as an “Unsung Hero in the Church, Civic, and Corporate Community” by the Concerned Leadership Organizational Unity and Tenacity Ministerial Alliance.

 

            Mr. McMillin stated that Coach Williams and his wife, Betty, who was also present at the meeting on this date, were both life-long residents of Mossville. He further stated that the first time he met Coach Williams was when he was a freshman at Westlake High School and that Coach Williams had been a mentor to him and was always available when he had needed him for advice and/or answers to questions he had.

 

            Mr. Danahay pointed out that Coach Williams had been an inspiration to many of his students and that many of the young men who were currently coaching in Mossville were Coach Williams’ proteges.

 

            The proclamation was then read by Mr. McMillin as follows:

            WHEREAS, Mr. Lasalle C. Williams, a Mossville native, was honored on Friday, June 27, 2003, at the Fairmont Grand Ballroom in New Orleans by the Concerned Leadership Organizational Unity and Tenacity Ministerial Alliance by being chosen as an “Unsung Hero in the Church, Civic, and Corporate Community”; and


            WHEREAS, Mr. Williams has been married to Betty Vallery Williams for 50 years and is the father of five children; and


            WHEREAS, Mr. Williams is President of the West Calcasieu Branch of the NAACP, Past President of the West Calcasieu Kiwanis Club, Past President of the Calcasieu Parish Planning Commission, Board Member of the Calcasieu Parish Planning and Zoning Board, the Foreman-Reynaud Community Center, the Mossville Awareness Board, the Conoco/Phillips Refinery Advisory Panel, and the Interstate-10 Industrial Advisory Panel; and


            WHEREAS, Mr. Williams is a member of Mt. Zion Baptist Church where he serves as Superintendent of Sunday School, Chairman of the Deacon Board, and is involved in other church organizations.

            Coach Williams received a standing ovation. He thanked the jurors and staff for this recognition and also thanked his wife. Coach Williams shared “one little story” about Mr. McMillin, saying that when the local schools were integrated, no one wanted it, black or white, no one was prepared, and it had caused serious problems in Westlake. Coach Williams further stated that every time he was called out of class, Mr. McMillin, who was the only white person in a class of approximately 30 persons, would always take over the classroom. Coach Williams warned the jurors to “watch him” (Mr. McMillin), “because he will always try to take over.”

 

            Coach Williams expressed his appreciation for the kindness and generosity shown by the Police Jury, particularly in naming him Honorary Mayor of Mossville. He said that it had aroused his curiosity and that he would like to make it a reality.

 

            President Kleckley thanked Coach Williams, on behalf of the Police Jury, for his 18 years of service on the Planning Commission and the Planning and Zoning Board. He also jokingly extended his condolences to Coach Williams for having had to deal with Mr. McMillin.

 

            Mr. Manuel pointed out that he had served with Coach Williams on the Board of Directors of the Calcasieu Council on Aging and that Coach Williams was a “take charge person” himself.

 

            Upon motion made by Mr. Manuel, which was duly seconded by Mr. McMillin and carried unanimously, the rules were suspended by a two-thirds majority vote to present Certificates of Recognition to the players and coaches of The Louisiana Storm, a 10-and-under fast-pitch softball team from Moss Bluff, for winning the USSSA Fastpitch State Tournament.

 

            Mr. Manuel introduced the coaches of the team, Ms. Beth Jordan, Mr. Dan Kennedy, and Mr. Craig Wainwright, pointing out that Ms. Jordan was a Moss Bluff player who had made the starting lineup at McNeese State University as a freshman.

 

            Coach Wainwright stated that without Mr. Manuel’s guidance, he did not think the funding would have been available for the new ball fields. He thanked the players and their parents for making the team a success.

 

            Coach Kennedy stated it was important to note that every single girl on the team had come up through the ranks of the recreation program and that would not have been possible without the Police Jury’s help and support.

 

            Mr. Manuel stated that the improvements had not stopped for the recreation program in Moss Bluff, pointing out that approximately $200,000 in improvements were planned for the next couple of months, including playground equipment.

 

            Mr. Manuel then presented certificates of recognition to the following members and coaches of Louisiana Storm: Tiffany Degeyter, Kayla Hooper, Leslie Hull, Kimberly Kennedy, Kelli Langley, Randi Naquin, Annette Ramsey, Brandi Reed, Racissa Savoie, Pamela Wainwright, Taylor Wood, Coach Beth Jordan, Coach Dan Kennedy, and Coach Craig Wainwright.

 

            Mr. Milner addressed the Jury at this time with reference to the Calcasieu Parish Comprehensive Annual Financial Report for the year ending December 31, 2002. He thanked his staff, particularly Mrs. Tammy Bufkin, Assistant Director of Finance, for efforts in compiling the report during the time he was assisting at the Port of Lake Charles.

 

            Mr. Gus Schram of Gus Schram and Company, Ltd., the Parish’s auditing firm, appeared before the Police Jury and pointed out that the Parish had received the Government Finance Officers Association Certificate of Excellence in Financial Reporting for the eleventh year in a row, an accomplishment which not many governmental bodies had achieved. He then gave a brief synopsis of the financial report, stating that the Parish’s long-term debt was $614,000, with no bonded indebtedness as of the year 2002, which he said was a substantial accomplishment. He further stated that total liabilities were $32 million as compared to $281 million in assets.

 

            Mr. Schram advised that the revenues in the General Fund had increased by about $500,000, with the largest increase being attributable to a $430,000 increase in ad valorem taxes. He further advised that total revenues for 2002 were more or less similar to those of 2001. Mr. Schram pointed out that investment income was down due to lower rates in the markets but that one of the highlights was an increase of approximately $2.7 million in gaming revenues with the addition of income from Delta Downs.

 

            Mr. Schram advised that there was an increase in expenditures in the General Fund of 3.8% and in the Special Revenue Funds of approximately 5.6% but that there was more than enough in reserve to handle any differences.

 

            Mr. Schram stated that the financial report contained an explanation of GASB (Governmental Accounting Standards Board) Rule No. 34 which was implemented in 1999 and would be effective as of December 31, 2003. He explained that this would change the look of the financial report to more of a long-term focus and would cause a lot of work for the Finance Department to implement it, some of which had already been done. Mr. Schram further explained that GASB 34 would require the inclusion and depreciation of all infrastructure assets which would be a huge undertaking, as well as inclusion of more information regarding the actual cost of operating.

 

            Motion was made by Mrs. Griffin, seconded by Mrs. August and carried unanimously to accept the Calcasieu Parish Comprehensive Annual Financial Report for the year ending December 31, 2002, as presented on this date.

 

            Upon motion made by Mr. McMillin, which was duly seconded by Mr. Landry and carried, with Mr. Manuel voting in opposition, the following applications for liquor and beer permits were approved, and the issuance of the following Special Events Permit was ratified: (Mr. Manuel’s “no” vote was with reference to issuance of a liquor and beer permit to Kokomo Tans in his district.)

(1)        Recommended that the following provisions be approved with reference to the repair and rehabilitation of the Lorrain Bridge at a total estimated cost of $334,000 (Police Jury District 10):

 

(1.1) acceptance of a grant in the amount of $133,760 from the Louisiana Rural Development Program;

 

(1.2) acceptance of a grant in the amount of $45,000 from the Lorrain Bridge Association for the project and adoption of a resolution of appreciation to the Association for their dedication and generosity;

 

(1.3) approval of a Joint Services Agreement between the Police Jury and the Jefferson Davis Parish Police Jury related to the sharing of the remaining costs to repair and rehabilitate the Lorrain Bridge as follows:

 

Calcasieu Parish Police Jury50% of the remaining costs ($77,620+) and maintenance of 50% of the bridge and west approach and the engineering and administration necessary for the construction of the project.

 

Jeff Davis Parish Police Jury50% of the remaining costs ($77,620+) and maintenance of 50% of the bridge and the east approach


            (1.4) authorize the Parish Engineer to advertise for bids for the project.


NOTE: Jeff Davis Parish Police Jury secured an additional $65,000 from the Rural Development Program, and $10,000 from the Jeff Davis Tourist Bureau to help fund their share.


Appearing before the Committee with reference to this matter were: Representative Dan Morrish, Senator Gerald Theunissen, Ms. Pauline Poole of the Lorrain Bridge Association, Mr. Ray Bebee of the Jefferson Davis Parish Police Jury, and Ms. Sarah Klump of the Jefferson Davis Parish Tourist Bureau. A resolution of support for the project, adopted by the Board of Directors of the Southwest Louisiana Convention and Visitors Bureau, was introduced into the record by Mrs. Treme, Police Jury liaison to the Bureau. Mr. Manuel and Mr. Breaux expressed their appreciation to all who made the project possible.

 

(2)       Recommended that a new road, to be constructed from Highway 171 to Paul Bellon Road in Ward One, be officially named “Clyde Dulaney Drive,” in honor of the former Police Juror who represented this ward. The widow of the late-Mr. Dulaney, Sybil, and daughters Darlene and Alicia, were present at the meeting and expressed their appreciation to the Police Jury for this honor. (Police Jury District 1) (Mr. Manuel)

 

(3)       Received report from Mr. Allen Smith, General Counsel, as to the authority of the Parish to address complaints relative to an overgrown lot located on Fontenot Road. Mr. Smith advised that the current Parish ordinance pertaining to this issue provided authority for the cutting of overgrown grass and weeds, not the clearing of lots which would be required in this particular case. The Committee recommended that language be drafted by the staff, for presentation at the next Public Works Committee meeting, to amend the grass cutting ordinance, or to introduce legislation allowing the Parish to amend said ordinance, to give the Police Jury and staff the authority to alleviate the health and safety problems associated with overgrown lots throughout the Parish. (Police Jury District 9)

 

(4)       Recommended that a resolution be adopted accepting The Meadows Subdivision located in Section 16, Township 8 South, Range 8 West, off Topsy Road in Ward One. (Police Jury District 1)

(Police Jury District 8)


NOTE: Texaco Petrochemicals Pipeline, LLC, agrees to bear the expenses of all adjustments to its pipeline necessary to facilitate the Parish’s project.

            Motion was made by Mr. Breaux, seconded by Mr. Manuel and carried unanimously that Recommendation No. 1 of the Public Works Committee as outlined heretofore be approved in its entirety; whereupon, the following resolutions were adopted:

 

RESOLUTION


            WHEREAS, the Lorrain Bridge spanning Calcasieu Parish and Jefferson Davis Parish dates back to the early part of the Twentieth Century; and


            WHEREAS, this bridge has been memorialized in paintings by renowned Southwest Louisiana artist Elton Louviere and in articles by his historian wife, Pat Louviere; and


            WHEREAS, the Lorrain Bridge contributes to the ambiance of the Lacassine area and Southwest Louisiana and is well known as a favored tourist attraction for photography and painting enthusiasts; and


            WHEREAS, many tourists visit this site for its beauty, fishing, and peacefulness, and it has been the scene of weddings and many wedding proposals; and


            WHEREAS, the Lorrain Bridge was closed to vehicular traffic on March 2, 1998 due to weak pilings and unsafe conditions, a closure which now requires a vehicle to detour 25 miles to get from one side of the bayou to the other; and


            WHEREAS, in addition to its historical value, beauty, and peacefulness, many people used the bridge before it was closed to traffic to travel to and from the communities of Thornwell, Welsh, Jennings, Lacassine, Hayes, Bell City, Holmwood, and Lake Charles; and


            WHEREAS, since its closure, discussions and efforts have been made by the police juries of Calcasieu and Jefferson Davis Parishes, Representative Dan Morrish, Senator Gerald Theunnissen, and the Lorrain Bridge Association, a civic group interested in restoration of the bridge, to rebuild and /or repair the bridge; and


            WHEREAS, the Lorrain Bridge Association was formed by a group of interested persons throughout Southwest Louisiana who were willing to put forth the effort to explore all available avenues to raise funds to help preserve the Bridge, and then with an enormous amount of zeal, creativity, and passion, took the necessary measures to raise $45,000 to contribute toward the total cost of preserving the Bridge.


        NOW THEREFORE,


        BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 7th day of August 2003, that it does hereby gratefully accept the generous donation of $45,000 from the Lorrain Bridge Association and extends its sincere appreciation to the Association for its diligence and dedication in helping to preserve the Lorrain Bridge, a valuable tourist attraction and historical site in Southwest Louisiana.

•a grant from the Louisiana Rural Development Program in the amount of $133,760, and a grant from the Lorrain Bridge Association in the amount of $45,000, are hereby gratefully accepted.

 

•a Joint Services Agreement between the Police Jury and the Jefferson Davis Parish Police Jury related to the sharing of the remaining costs to repair and rehabilitate the Lorrain Bridge, is approved whereby 50% of the remaining costs ($77,620+) and maintenance of 50% of the bridge and west approach, and the engineering and administration necessary for the construction of the project will be the responsibility of the Calcasieu Parish Police Jury, and 50% of the remaining costs ($77,620+) and maintenance of 50% of the bridge and east approach will be the responsibility of the Jefferson Davis Parish Police Jury.

 

•the Parish Engineer is hereby authorized to advertise for bids for the project.

            Mr. Danahay asked if a letter of no objection had been received from Gravity Drainage District No. Five of Ward Four with reference to Recommendation No. 5 (acceptance of The Meadows Subdivision in Ward Four). Mr. Vickers stated that it was standard procedure for the staff to clear acceptance of subdivisions through the drainage districts.

            BE IT FURTHER ORDAINED that anyone violating the provisions of this ordinance, upon conviction, shall be fined as provided in Section 1-9 of the Code of Ordinances of Calcasieu Parish, Louisiana.


            BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

            WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Apostolic Temple of United Pentecostal Church, to clear, grub, grade an area and redistribute approximately 7,700 cubic yards of on-site earthen material and deposit about 4,000 cubic yards of hauled-in earthen material (clay) and aggregate fill (crushed limestone), all to construct a church, educational buildings, and parking lot. Project implementation would impact approximately 2.9 acres of bottomland hardwood wetlands. The proposed site is situated near Lake Charles, Louisiana, in Calcasieu Parish; and


            WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Apostolic Temple of United Pentecostal Church relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and


            WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, since the project is located within the city limits of Lake Charles.


            NOW THEREFORE,

Said project is located in an inlet off Bayou Guy and in Bayou Guy, Section 5, Township 11 South, Range 9 West, southwest from Lake Charles, in Calcasieu Parish, Louisiana; and


            WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Dr. James McGee relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and


            WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.


            NOW THEREFORE,

Said project is located near Maplewood, in Calcasieu Parish, Louisiana; and


            WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Charles Bird relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and

            WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Christ Community Church to clear, grub, grade and place approximately 2,500 cubic yards of earthen fill material all to construct foundations to support placement of a church and associated parking area. Project implementation would impact approximately 12.94 acres of which 3.11 are jurisdictional wetlands. The proposed project site is situated between U.S. Interstate 210 and West Prien Lake Road, near Prien, Louisiana, in Calcasieu Parish; and


            WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Christ Community Church relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and


            WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, since the project is located within the city limits of Lake Charles.
