            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, July 10, 2003, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chuck Kleckley, President, presiding, and the following members present:

 

Mesdames Luvertha August, Elizabeth Conway Griffin, and Sandra J. Treme; and Messrs. Francis Andrepont, Algie Breaux, Brent Clement, Calvin Collins, Mike Danahay, Chris Landry, Charles S. Mackey, D.D.S., and Don Manuel

 

Absent: Messrs. Enos Derbonne (medical check-up in Houston), Hal McMillin (out-of-town on business), and Cornie Moon (out-of-town for annual NACo Conference)


            Also present were Mr. S. Mark McMurry, Parish Administrator, Mr. Bryan Beam, Assistant Administrator, Mrs. Coleen Clark, Executive Secretary, Mr. Richard Gremillion, Director of Emergency Preparedness, Mrs. Cheryl Heisser, Director of Human Resources, Mr. Jerry Milner, Director of Finance, Mr. Claude D. Smart, Parish Engineer, Mr. Allen Smith of the firm of Plauche, Smith and Nieset, Legal Counsel, Mrs. Kathy P. Smith, Recording Secretary, Mr. Gerry Trahan, Director of Facilities Management, and Mr. Jim Vickers, Director of Planning and Development.

 

            President Kleckley called the meeting to order. The invocation was pronounced by Reverend Norman Thomas of New Life Family Worship Center which was followed by the Pledge of Allegiance led by President Kleckley. The roll was called with the result being as outlined above.

 

            President Kleckley welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.

 

            President Kleckley advised that sealed bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for Calcasieu Parish Project No. 2003-04 (Overlay and Improvements to the following roads: Ward One – Victoria Drive, Sutherland Road, Gillis Cutoff Road, Santa Anna Drive, Cascio Road, Georgia Road, and Debra Lane; Ward Six – Douglas Road, Grape Street, Dunn Ferry Road, Marcantel Road, William Still Road, Arthur Irwin Road, Holbrook Park Road, Ruth Street, D. Pruitt Road, and Edgerly-DeQuincy Road.

 

            Mr. McMurry then proceeded to open the following bids, announcing the license numbers written on the outside envelope of each bid which were required to be so noted by the bid documents:

            There being no other bids, motion was made by Mrs. Griffin, seconded by Mrs. August and carried unanimously that the bids be referred to the Parish Engineer for final tabulation with further action thereon to be taken by the Police Jury at its next Regular Meeting scheduled for July 24, 2003.

 

            Mrs. August was granted a point of personal privilege to inform her colleagues and the media that due to the efforts of Representative Elcie Guillory, Senator Willie Mount, and representatives of Gravity Drainage District No. Four of Ward Three, relief from erosion problems along the Missouri-Pacific drainage lateral was one step closer to reality. She explained that the State Capital Outlay Bill had been amended to include $650,000 for this purpose, and while these funds would have to be matched by the drainage district, the funding had met Priority 3 status in the Capital Outlay Bill which meant that it could move up in priority in subsequent years.

 

            Mrs. August also expressed her appreciation to the residents of this area who remained closely involved with this issue and pointed out that years of struggling had finally paid off.

 

            Mrs. Treme asked that an agenda item be taken out of sequence at this time, to receive a report from staff with reference to the recent United States Supreme Court ruling regarding computer filtering as it relates to the Calcasieu Parish Library System.

 

            Mr. McMurry explained that this related to a June 23, 2003, Supreme Court decision that held that the First Amendment to the Constitution did not prohibit the U.S. Congress from requiring public libraries to filter computers under the Children’s Internet Protection Act of 2000. He further explained that this had been a “non-issue” for the Calcasieu Parish Library System due to the fact that it had already instituted filtering and had already developed a Board-approved internet access policy, and therefore, whatever federal funds the Library System received were never in jeopardy.

 

            Mr. McMurry stated that the Library System felt, as did the Supreme Court, that they were not now, nor had they been, violating any First Amendment rights of their users because (1) they used a filter that blocked pornographic web sites, not “key words” like the use of the word “breast”, (2) if they found a site that needed to be blocked, it could be blocked, but if a site needed to be unblocked for a patron, that could be done also, and (3) while no filter system was perfect, the Library System felt they were making a good faith, reasonable effort to be in compliance.

 

            Mr. McMurry pointed out that Mr. Jeffrey Rippel, Director of the Calcasieu Parish Library System, was present at the meeting if the jurors had any further questions.

 

            Mrs. Griffin stated that her main reason for putting this item on the agenda was to make the public aware of safeguards being taken by the local library system to protect area children. In answer to a question posed by Mrs. Griffin, Mr. Rippel stated that on the occasions when a computer needed to be unblocked for a patron, this was done by the Library System’s computer services department at Carnegie Memorial Library, not at a specific library.

 

            Mr. Monty Collins, Project Manager, Duke Energy Gas Transmission Company, appeared before the Police Jury at this time with reference to the Lake Charles Express Project. He stated that Duke Energy was also known as Texas Eastern Pipeline Company. Mr. Collins introduced the following persons who were also present at the meeting representing his company: Mr. Mike Benge, Project Land Manager, Rights-of-Way Engineering Services; Mr. James M. Winston, Right-of-Way Representative; and Mr. Kyle Hamrick, Director, Origination.

 

            Mr. Collins stated that he and his colleagues basically wanted to introduce themselves to the Police Jury and let them know of a project their company was currently working on. He explained that Texas Eastern was working with British Gas which had entered into a long-term lease with the Trunkline LNG facility at the south end of the Parish to develop a pipeline to deliver gas into an inter-and intra-state grid. Mr. Collins further explained that they were proposing an approximately 41-mile pipeline to deliver to major gas pipeline transmission companies in Calcasieu and three adjacent parishes.

 

            Mr. Collins advised that they had done preliminary surveys and made contacts with all landowners that would potentially be affected by the project. He pointed out that they were paralleling Trunkline LNG’s existing facilities into the Iowa Processing Plant and from there, following Texas Eastern’s existing facilities, so that they were utilizing as much as possible the least intrusive route for their pipeline routing.

 

            Mr. Andrepont asked if this was the old Dynegy Project or a new one, and Mr. Collins explained that it was a new project developed by British Gas. He further explained that said company had gone into a long-term lease with Trunkline LNG for utilization of that facility to transport their gas out of existing pipeline systems. Mr. Collins concluded his remarks by stating that they were looking to expand their system and get gas into new markets that Trunkline LNG did not currently offer.

 

            Upon motion made by Mrs. Griffin, which was duly seconded by Mrs. August and carried unanimously, the following applications for liquor and beer permits were approved, and the issuance of the following Special Events Permit was ratified:

            Chairman McMillin advised that the purpose of the meeting on this date was to review the proposed agenda for the regular meeting of the Police Jury to be held on July 10, 2003.


            Following review of the items to be considered by the Police Jury on July 10th, it was unanimously recommended that the proposed agenda be accepted with the following additions:

 

Take appropriate action on a vacancy on the Board of Commissioners of Ward One Fire Protection District No. One which was created by the resignation of Mr. Kenneth R. Spears. (Mr. Spears represents District 14. Mr. Manuel is the liaison, and he recommends that Mr. L. J. “Berk” Fontenot be appointed.)

 

Take appropriate action on a vacancy on the Board of Commissioners of Waterworks District No. Seven of Wards Four and Six which was created by the resignation of Ms. Donna Koppie. (Consensus recommendation of the jurors representing Districts 11, 13, 14 and 15, with the liaison being responsible for seeing that a consensus has been reached. Mrs. Treme is the liaison.)

 

Consideration of receiving a report from staff with reference to the recent United States Supreme Court ruling regarding computer filtering as it relates to the Calcasieu Parish Library System. (Mrs. Griffin)


            Also, recommendations for appointments to various boards of special service districts were made by members of the Committee.

(3)       Recommended that reduced rates be implemented for use of parish camper/recreational vehicle facilities by handicapped persons, similar to the reduced rates provided for senior citizens. (Mr. Andrepont)

            Motion was made by Mrs. August, seconded by Mrs. Griffin and carried unanimously that Recommendation Nos. 1 and 2 of the Public Works Committee as outlined heretofore be approved; whereupon, the following ordinance was adopted:

AN ORDINANCE amending Chapter 17, Art. II, Div. 2. Speed Limits, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to cancel the 25-mph speed limit on Sara Street in Ward Four of Calcasieu Parish.


            BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, that it does hereby amend Chapter 17, Art. II, Div. 2. Speed Limits, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, as follows:


            SECTION 1.   Sec. 17-64, Twenty-five miles per hour, of the Code of Ordinances is amended by removing the following road in the provisions of said section:


            Sara Street in Ward 4


            BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

            With reference to Recommendation No. 3 of the Public Works Committee as previously stated, Mr. Andrepont thanked Mr. Mike Quienalty, Public Works Operations Manager, for putting together a proposal which had been presented at the Committee meeting which outlined the federal government’s policies with regard to reduced rates for handicapped persons under what was called the Golden Access Passport program.

 

            It was moved by Mr. Andrepont, seconded by Mr. Manuel and carried unanimously to approve Recommendation No. 3 of the Public Works Committee and to honor at all Parish parks the reduced rates authorized by the federal government’s Golden Access Passport for handicapped persons who had met the necessary requirements for and who had been issued a Golden Access Passport.

 

            Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Manuel and carried unanimously, Recommendation No. 4 of the Public Works Committee as outlined heretofore was approved; whereupon, the following resolution was adopted:

            In answer to a question by Mr. Landry regarding Recommendation No. 1 of the Public Works Committee, Mr. Vickers explained that according to Mr. Domingue’s deed, the developer was required to provide a public road to his property, and that was the condition on which Mr. Domingue had purchased the property. Mr. Vickers further explained that Mr. Domingue would be building an accessory building first, then a house, and that there was another private road that led to this particular area which could be an extension of the road in question. Mr. Vickers stated that there was another means to get to the property from Walker Road which was currently under construction.

 

            Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Manuel and carried unanimously, Recommendation No. 5 of the Public Works Committee as outlined heretofore was approved; whereupon, the following resolution was adopted:

        WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by the Carlyss Fire Department to clear, grade, and place approximately 1,400 cubic yards of earthen and aggregate fill material to construct a fire station and a 500,000 gallon water tower, each with access driveways. Project implementation would impact approximately 0.7 acres of jurisdictional wetlands. The project is located off of Mosswood Drive, near Sulphur, in Calcasieu Parish, Louisiana; and


            WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of the Carlyss Fire Department relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and

 

        WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.


        NOW THEREFORE,


        BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 10th day of July, 2003, that it does hereby indicate no objection to the proposal of the Carlyss Fire Department to clear, grade, and place approximately 1,400 cubic yards of earthen and aggregate fill material to construct a fire station and a 500,000 gallon water tower, each with access driveways.             Mrs. August asked Mr. Manuel to explain what was currently transpiring with regard to the Lorrain Bridge. Mr. Manuel advised that he would be forwarding a copy of the proposed agreement to each of the jurors but that basically it would involve the previous agreement of the Calcasieu Parish Police Jury to provide 25% of the costs for rehabilitation and maintenance of the bridge in the amount of $83,600, and further, that Representative Dan Morrish had been successful in obtaining a state grant of $50,000, a rural development grant of $15,000, which when combined with the $16,000+ additional money raised by the Lorrain Bridge Association, would offset most of Jefferson Davis Parish’s share of 25% of the costs ($83,600). Mr. Manuel stated that part of the proposed agreement included a stipulation that if costs exceeded the estimate, Jefferson Davis Parish would fund the additional costs.

 

            Mr. Manuel asked that the jurors read over the proposed agreement before too many details were discussed, and he said that he would have a copy faxed to them the next day, with further discussion thereon to take place at the Public Works Committee meeting on July 31, 2003.

 

            Mr. Breaux stated that Mr. Manuel had “taken the ball and run with it” with regard to this issue because he (Mr. Breaux) could not (because of illness), and he wished to publicly thank Mr. Manuel for his efforts.

 

            With regard to the foregoing resolution of no objection, Mr. Landry asked where Mr. Hoffpauir planned to launch the barge. Mr. Vickers explained that he did not know, that the staff only reviewed these proposals to make sure they did not violate any parish ordinances or provisions.

 

            Dr. Mackey pointed out that a lot of cypress logs had a bluish color when they were removed from the water and were very valuable.

 

            The hour being 6:00 p.m., President Kleckley advised that a public hearing would be held at this time, as a result of notice provided to the owners of the following properties, in accordance with Article II-Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, ordering said owners to show cause as to why the structures on said properties should not be condemned:

            SECTION 2.      If the camp structure on the premises hereinabove described in the Parish of Calcasieu, Louisiana, is not demolished and removed within thirty (30) days from the date of this order, notice is hereby given that the Director of Parish Planning and Development shall have work commenced on the demolition and removal of said camp structure, in which case the Police Jury shall not be liable for damages and shall have a lien and privilege against the property upon which the camp structure was situated for the cost of demolishing and removing said camp structure, and for the cost of maintaining the property.


            SECTION 3.      The Director of Parish Planning and Development is hereby authorized and directed to give notice of said demolition and removal as required by law.


            SECTION 4.      The Director of Parish Planning and Development is hereby authorized to enter into a contract to accomplish the demolition of the camp structure, if necessary, and to pay the fees of the contractor from appropriate Parish funds, and to pay any and all costs associated with the demolition. Any amounts expended by the Parish of Calcasieu shall be included in the statement of costs in accordance with Chapter 6 of the Code of Ordinances of Calcasieu Parish, Louisiana, and the Parish of Calcasieu shall have a lien and privilege for all costs resulting from the demolition.


            SECTION 5.      This ordinance shall become effective immediately.

            With reference to the fourth piece of property located at 5143 Goos Ferry Road, Old Town Road area, Mr. Crain recommended that the structure be condemned and removed within thirty days.

 

            President Kleckley asked if there was anyone present in the audience to address the Police Jury with respect to this property and hearing no comments, motion was made by Mr. August, seconded by Mrs. Griffin and carried unanimously to accept the staff’s recommendation and to adopt the following ordinance:

AN ORDINANCE ordering demolition of one camp structure on property located at 5143 Goos Ferry Road (Part of Lot 6, Section 2, Township 9, Range 8 (W #8), Lot 65 as per provided plat; Tax Assessment No. 00017515), Old Town Road area of Ward One, Calcasieu Parish, Louisiana, and owned by Bel Commercial Limited Liability Company, et al, c/o John A. Bel, Agent.


            BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 10th day of July, 2003, that:


            SECTION 1.      The facts as set forth at the meeting of the Police Jury of Calcasieu Parish, Louisiana, on this date, justify an order of this Police Jury, and it is hereby ordered that the camp structure on property located at 5143 Goos Ferry Road (Part of Lot 6, Section 2, Township 9, Range 8 (W #8), Lot 65 as per provided plat; Tax Assessment No. 00017515), Old Town Road area of Ward One, Calcasieu Parish, Louisiana, and owned by Bel Commercial Limited Liability Company, et al, c/o John A. Bel, Agent, be demolished and removed within thirty (30) days from the date of this ordinance. This order requires that all development permits be secured for demolition and all debris be removed from the premises. This order is made this 10th day of July, 2003, and is final unless appealed within five (5) days.
