            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, May 1, 2003, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chuck Kleckley, President, presiding, and the following members present:

            President Kleckley called the meeting to order. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance led by Mrs. August. The roll was called with the result being as outlined above.

 

            President Kleckley welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.

 

            President Kleckley advised that sealed bids would be received and opened at this time for Additions to the Office of Community Services. Mr. McMurry then proceeded to open the following bids, announcing the license numbers written on the outside envelope of each bid as required by the bid documents:

            President Kleckley advised that an item on the agenda would be taken out of sequence and that a report and recommendation would be received at this time from the Coastal Conservation Association “Fishin’ for a Name” Contest Committee relative to selection of a name for the new boat launch and park at the Industrial Canal.

 

            Mr. Rusty Vincent of said association appeared before the Police Jury and stated that a committee of the Association had been named to go to all of the fifth grade classes in the Parish asking for participation in the contest. Mr. Vincent stated there had been good participation and after going through many proposed names, the Committee came up with one it wanted to recommend to the Police Jury, that being “Calcasieu Point Landing”. He explained that the name was most appropriate because the location was on the old Calcasieu River when the Industrial Canal was dug, the geographical boundaries of the park made a point, and it was also a landing.

 

            Motion was made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously that the report and recommendation of the Coastal Conservation Association be approved and that the new boat launch and park at the Industrial Canal be named “Calcasieu Point Landing”.

 

            In response to a question by Mr. Landry, Mr. Vincent replied that the winning name was submitted by Master Christian Kitzmiller of St. John Elementary School in Lake Charles. Mr. Vincent invited the jurors to attend the Association’s annual banquet being held on this date at which the awards would be presented to the winners of the “Fishin’ for a Name” contest.

 

            President Kleckley thanked the Association for its help in naming the park and for input on development of the boat launch and recreational facility. President Kleckley stated that the Association’s assistance, as well as federal grants, had made it all possible, and it would be one of the finest facilities not only in Southwest Louisiana but all of the South.

 

            Mr. Vincent pointed out that there were over 24,000 saltwater fishermen in Calcasieu Parish alone but that the first-class park would be a beautiful site for non-fishermen to enjoy also.

 

            Upon motion made by Mrs. August, which was duly seconded by Mrs. Griffin and carried unanimously, the payment of all current invoices was approved.

 

            It was moved by Mr. Andrepont, seconded by Dr. Mackey and carried unanimously to approve the minutes of the Regular Meeting of the Police Jury dated April 3, 2003.

 

            Motion was made by Mrs. Griffin, seconded by Mr. McMillin and carried unanimously that the Agenda Committee Report dated April 24, 2003, be approved as follows:

            Chairman McMillin advised that the purpose of the meeting on this date was to review the proposed agenda for the regular meeting of the Police Jury to be held on May 1, 2003.


            Following review of the items to be considered by the Police Jury on May 1st, it was unanimously recommended that the proposed agenda be accepted.


            Also, recommendations for appointments to various boards of special service districts were made by members of the Committee.


             There being no further business, Chairman McMillin declared the meeting to be adjourned.

            At this time Dr. Mackey presented a plaque to the St. Louis High School Soccer Team and Coaches for having recently won the 2003 Division III State Championship. Individual certificates were also presented to the following players, trainers, and coaches: Players Jimmy Thompson, Stephen Reed, Nick Lemoine, Ross Thevenot, Jud Norman, Blake Thevenot, Jonathan Puckett, Ryan Duplechain, Craig Greenman, Jay Honore’, Miller Flynt, Edward Ellington, Brett Marino, Casey Byrd, Adam Kholer, Logan Fontenot, Hank Chol, Jay Landry, Lee Boudreaux, Joseph Lapira, Jacob Manceaux, George Jordan, Chris Snyder, Britt Richey, John McGrath, Matt Griggs, James Yarbrough, Daniel Hennigan, Stephen Winkles, Ross Byrley, and Brian Pitre; Trainers Katie Price, Kati Hale, Katie Huber, Liz Primeaux, Ashley Miller, and Erin Hebert; Head Coach Jason Oertling and Assistant Coaches Ben Williams, Paul Burgess, and Luke Pousson.

 

            Head Coach Jason Oertling thanked the Police Jury on behalf of St. Louis High School and the Soccer Team for this recognition. He stated that no matter where the team had played, at every game the St. Louis fans outnumbered the opponent’s fans by three or four to one, and he was very appreciative of the area’s support.

 

            Dr. Mackey pointed out that in addition to the team’s success in the championship, Coach Oertling had also been named Outstanding Coach of the Year.

 

            Mr. Manuel was granted a point of personal privilege to introduce Mr. Wallace Nichols who was present at the meeting on this date and who had recently run the Boston Marathon.

            A meeting of the Public Works Committee was held on Thursday, April 24, 2003, in the Police Jury Meeting Room on the first floor of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with Mr. Chris Landry, Chairman, presiding and the following members present:

            Said Committee: 

 

(1)        Presented a resolution of condolences to the family of Pfc. Wilfred Davy Russell Bellard who was represented by his mother, Mrs. Janet Bellard-Brooks, and his wife, Mrs. Latricia Bellard. Mrs. August and President Kleckley made the presentation on behalf of the Police Jury.

 

(2)       Received an update from Mr. Jerry Whatley, Calcasieu Parish County Agent, with reference to the Agricultural Center’s programs and activities in the following areas of interest to the public: 4-H Youth Development, Family and Consumer Sciences, Agriculture, Horticulture, Forestry, Termites, and Water Shed. Mr. Whatley reminded the jurors and the public of the upcoming (May 3rd) election to continue the maintenance millage for the Burton Coliseum and agricultural services.

 

(3)       Received report from Mrs. Elizabeth Griffin, Litter Abatement and Solid Waste Committee Chairperson, regarding the committee’s visit to the Lafayette Compost Facility on Tuesday, April 22nd, wherein she advised that Lafayette’s start-up cost (excluding the cost of land which they did not have to purchase) had been $500,000 and that the program was basically a breakeven operation. Several of the jurors expressed their opinions that given the potential cost of a recycling program, other problems in Calcasieu Parish, such as drainage and sewer, were more pressing at this point in time. The Committee recommended that the staff conduct an in-house study on the feasibility of a compost facility in Calcasieu Parish.

 

(4)       Recommended that a resolution be adopted accepting Shady Pines Subdivision located in Section 27, Township 10 South, Range 7 West, off of Amoco Road and Nick Martone Road in Ward Two. (Police Jury District 10)

 

(5)       Recommended that an ordinance be adopted amending the Calcasieu Parish Master Private Road list to include the following private roads:

(6)       Recommended that the President of the Police Jury be authorized to execute the necessary documents for acquisition of right-of-way from Rodney Joseph Molbert and Constance Renee LeBleu Molbert, and Clifton Joseph Conner and Debra Ann Willis Conner on Nelson Road in Ward Three (Calcasieu Parish Project No. 1999-07).

 

(7)       Recommended that a Joint Services Agreement be approved between the Police Jury and Gravity Drainage District No. Six of Wards Five and Six for the improvement of a drainage outfall lateral at the corner of Grimes Road and Dougharty Road. (Police Jury District 11)

 

NOTE:the improvements include enlarging approximately 120 feet of existing 24-inch culverts to 42-inch culverts and installing an additional 80 feet of new 42-inch culverts in previously unimproved portion of the lateral. The Parish agrees to pay half of the cost of the 120-feet of replacement pipe and to supply the equipment. The Drainage District will pay the balance of the labor, materials, and fuel cost. The total estimated project cost is $13,526.00.

 

(8)       Recommended that the Parish Administrator be authorized to advertise for bids for Calcasieu Parish Project No. 2003-06 (Ward 1: Highline Road and Ward 8: Boys Village Road Bridge).

 

(9)       Recommended that a report be received from the staff at the Regular Meeting on May 1st regarding completion of Christy Acres Subdivision located off of Coffey Road in Ward One, in Section 25, Township 8 South, Range 9 West, and if applicable, to adopt a resolution accepting said subdivision.

            Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Collins and carried unanimously, Recommendation Nos. 1 and 2 of the Public Works Committee as outlined heretofore were approved.

 

            It was moved by Mrs. Griffin, seconded by Mrs. August and carried unanimously to approve Recommendation No. 3 of the Public Works Committee.

 

            Motion was made by Mr. Manuel, seconded by Mr. Landry and carried unanimously that Recommendation No. 4 of the Public Works Committee be approved; whereupon, the following resolution was adopted:

 

RESOLUTION


            WHEREAS, Jevon Natali, subdivided certain property in Ward Two of Calcasieu Parish, Louisiana, known as Shady Pines Subdivision, a subdivision in Section 27, Township 10 South, Range 7 West, Calcasieu Parish, Louisiana; and


            WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana; and


            WHEREAS, said subdivision plat was prepared by W. L. Haymon, Registered Land Surveyor No. 1823, and certification was made that the subdivision plat was prepared in accordance with R.S. 33:5051 and all other laws of the State of Louisiana; and


            WHEREAS, said subdivision plat was filed for record in the Office of the Clerk of Court on May 13, 2003, bearing File No. 2625507.


            NOW THEREFORE,


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 1st day of May, 2003, that it does hereby officially accept the plat of Shady Pines Subdivision in Ward Two of Calcasieu Parish, Louisiana, including Brady Joseph Lane located within said subdivision, for future maintenance by the Parish.

            Upon motion made by Mr. Clement, which was duly seconded by Mr. McMillin and carried unanimously, Recommendation No. 5 of the Public Works Committee was approved, and the following ordinance was adopted:

 

ORDINANCE NO. 4538

AN ORDINANCE amending Chapter 23 – Subdivision and Chapter 26 – Zoning, of the Code of Ordinances of the Parish of Calcasieu, Louisiana.

                          

            BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 1st day of May, 2003, that it does hereby amend Chapter 23 – Subdivision, Section 23-8 (c), and Chapter 26 – Zoning, Section 26-15 (b), of the Code of Ordinances of Calcasieu Parish, Louisiana, to provide for a revised Master Private Road List adopted on May 1, 2003, as follows:


            SECTION 1.         Section 23-8. Administration and violation, is amended as follows:

 

            (c)       Variance on Private Road. No application for variance request shall be processed by the commission staff for authorization of a development permit on a private road other than those shown on Calcasieu Parish’s Master Private Road List officially adopted by the Police Jury on June 20, 2002, and revised on May 1, 2003, a copy of which is attached hereto and made a part hereof, and which is also hereby incorporated in the Code of Ordinances of Calcasieu Parish, Louisiana, as Exhibit A in the Appendix Chapter. Procedures for applying for development permits without public road frontage requirements.

 

        SECTION 2.         Section 26-15. Procedures for applying for development permits without public road frontage requirements, is amended as follows:

 

            (b)       No application for variance request shall be processed by the Division of Planning and Development for authorization of a development permit on a private road other than those shown on Calcasieu Parish’s Master Private Road List officially adopted by the Police Jury on June 20, 2002, and revised on May 1, 2003, a copy of which is attached hereto and made a part hereof, and which is also hereby incorporated in the Code of Ordinances of Calcasieu Parish, Louisiana, as Exhibit A in the Appendix Chapter.


            BE IT FURTHER ORDAINED that this ordinance shall become effective immediately upon adoption.


            BE IT FURTHER ORDAINED that any ordinance or parts of any ordinance in conflict herewith are hereby repealed.


            BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.
