            The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, February 6, 2003, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chuck Kleckley, President, presiding, and the following members present:

 

Mesdames Elizabeth Conway Griffin, Luvertha August, and Sandra J. Treme; and Messrs. Francis Andrepont, Algie Breaux, Brent Clement, Calvin Collins, Mike Danahay, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, and Cornelius “Cornie” Moon

 

Absent: Messrs. Enos Derbonne (ill) and Hal McMillin (out-of-town)


            Also present were Mr. S. Mark McMurry, Parish Administrator, Mr. Bryan Beam, Assistant to the Administrator, Mrs. Coleen Clark, Executive Secretary, Ms. Kathy P. Criglow, Recording Secretary, Mr. Richard Gremillion, Director of the Office of Emergency Preparedness, Mrs. Cheryl Heisser, Director of Human Resources, Mr. Jerry Milner, Director of Finance, Mr. Claude Smart, Parish Engineer, Mr. Allen Smith of the firm of Plauche, Smith and Nieset, Legal Counsel, Mr. Gerry Trahan, Director of Facilities Management, and Mr. Jim Vickers, Director of Planning and Development.

 

            President Kleckley called the meeting to order. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance led by Mr. Andrepont. The roll was called with the result being as outlined above.

 

            President Kleckley welcomed everyone in attendance and asked those who would like to address the Police Jury to fill out a “Request to Appear” form and submit it to the staff. He also asked that all cellular telephones and pagers be turned off or set on a suitable mode so they would not interrupt the meeting.

 

            Mr. Andrepont asked for an update on the physical condition of Mr. Derbonne who had recently undergone heart surgery. Mr. Beam stated that he had spoken with Mr. Derbonne’s brother-in-law earlier on this date and was told that he was doing well, and there was a possibility that he could go home from the hospital by the upcoming weekend.

 

            President Kleckley advised that Mr. Gene Sonnier of the Vinton Harbor and Terminal District would address the Police Jury at this time with reference to ongoing development projects in said district. Mr. Clement explained that he had thought it a good idea to ask Mr. Sonnier to provide feedback to the Jury as to the benefits the Parish had received by virtue of grants from the Riverboat Fund awarded to the Vinton Harbor and Terminal District.

 

            Mr. Sonnier then appeared before the Police Jury on behalf of the Board of Commissioners of said district and stated that one and one-half years ago the Police Jury awarded the district $250,000 for improvements and to replace a building which had been destroyed by fire. He stated that the district had ended up spending $600,000 and almost one year ago had signed a lease with a tenant whose goal was to hire 50 employees within five years. Mr. Sonnier advised that this company, in less than a year, was right at meeting that goal at the present time. He explained that the company did sandblasting and painting for some of the local industries and had a marine division in Texas that they planned to bring into the District to do barge cleaning, blasting, and painting which would generate approximately 60 additional jobs which put the company well ahead of what they had originally planned to do.

 

           Mr. Sonnier also explained that this particular tenant also planned in the future to expand into a dry dock facility for cleaning and painting barges on a 24-hour per day, 365 days per year basis.

 

           Mr. Sonnier stated that the District had recently signed a contract with Dunham Price, and said company planned to be operational by the end of February or the first of March, 2003.

 

            For those who were unfamiliar with the District, Mr. Sonnier explained that it was organized in the late 1950's but had laid dormant for a while before becoming active. He stated that the District’s property was a 320-acre tract situated on the Vinton Drainage Ditch which connected with the Intracoastal Canal.

 

           Mr. Sonnier expressed his appreciation for the grant awarded by the Police Jury to his district, pointing out that it had come in very handy and had been well spent.

 

            Mr. Clement asked Mr. Sonnier to convey his appreciation to all members of the Board of Commissioners for the excellent job they were doing in trying to benefit the Vinton community. Mr. Sonnier admitted that the District did have a good team working together by virtue of the current Board of Commissioners. He stated that while Vinton had experienced some “tough times”, they were coming out of them, and there were some good solid jobs being created at the District that would be around for a long time to come.

 

           Mr. Clement stated that he was glad to hear that the Police Jury had been able to “step up to the plate” and provide some economic development opportunities for the Vinton area.

 

            In answer to a question by Mr. Andrepont, Mr. Sonnier stated that the lease with Dunham Price was a permanent lease, and the operation therefor would be smaller in scale that what said company currently had in the City of Kinder.

 

           President Kleckley thanked Mr. Sonnier for his report.

 

           Motion was made by Dr. Mackey, seconded by Mrs. August and carried unanimously that the following application for a liquor and beer permit be approved:

            Upon motion made by Mr. Andrepont, which was duly seconded by Mrs. August and carried unanimously, payment of all current invoices was approved.

 

            It was moved by Mrs. August, seconded by Dr. Mackey and carried unanimously to approve the minutes of the regular meeting of the Police Jury dated January 2, 2003, and the reading of same was dispensed with.

            Chairman August advised that the purpose of the meeting on this date was to review the proposed agenda for the regular meeting of the Police Jury to be held on February 6, 2003.


            Following review of the items to be considered by the Police Jury on February 6th, it was unanimously recommended that the proposed agenda be accepted.


            Mrs. Griffin requested that all agenda items relating to subdivisions include the Police Jury district number for reference purposes.


            Also, recommendations for appointments to various boards of special service districts were made by members of the Committee.


             There being no further business, Chairman McMillin declared the meeting to be adjourned.

(3)       Recommended that a resolution be adopted accepting Woodland Forest Estates Subdivision Part One located off of North Perkins Ferry Road in Ward One (Section 36, Township 8 South, Range 9 West) of Calcasieu Parish. (Police Jury District 1)

 

(4)       Recommended that a resolution be adopted officially changing the road name of that portion of Nathaniel Drive adjoining Lots 1, 2, 3 and 19 in Vincent Settlement Subdivision, Place II Phase I, to Abigail Lane, in accordance with the request of the property owners who would be affected by this change in road name. (Police Jury District 12)

 

(5)       Recommended that the President of the Police Jury be authorized to execute the necessary documents for donation of right-of-way from Perry Dean Vincent on Cypress Lake Drive in Ward One (Calcasieu Parish Project No. 2003-03).

 

(6)       Recommended that the President of the Police Jury be authorized to execute the necessary documents for donation of right-of-way from Joseph Briggs and Alice Briggs on Cypress Lake Drive in Ward One (Calcasieu Parish Project No. 2003-03).

 

(7)       Recommended that the President of the Police Jury be authorized to execute the necessary documents for donation of right-of-way from Melba Jane VanWinkle on Cypress Lake Drive in Ward One (Calcasieu Parish Project No. 2003-03).

 

(8)       Recommended that a resolution be adopted approving an agreement between the Police Jury and Union Pacific Railroad (UPRR) with reference to construction of the proposed Highway 108 railroad crossing and providing for the closure of the railroad crossings on Racca and Stegall Roads, and further, authorizing the President of the Police Jury, or his designee when appropriate, to execute all documents related thereto.

 

(9)       Recommended that Calcasieu Parish Project No. 2002-02 (Ward 4 – Bowie Drive, Brentwood Drive, Crockett Street, Dave Dugas Road, Dock Board Road, Falco Road, Gross Road, Houston Drive, Miller Avenue, N. Claiborne Street, Old Ferry Road, R. D. Ellender Road, Sandifer Road, Sayles Road, Sim Portie Road, Travis Street, Vincent Road, Fred Istre Road, Claiborne Crossdrain, Pete Manena Road, and Certainteed Plant Road) be accepted as substantially complete.

 

(10)      Recommended that Calcasieu Parish Project No. 2002-03 (Ward 1 – Arnold White Road, Benoit Road, Cheryl Lane, Clyde Road, Gillis Cutoff Road, Kari Lane, Pawnee Drive, Quentin Road, Sam Houston Forest Drive, Watts Road, Chickasaw Drive, Cheyenne Drive, Pilley Lane, Pistol Drive, and Esther Drive; Ward 7 – Fabacher Road, Perry Street, Pickett Road, N. Eddy Street, West Street, and Vinton High School Parking Lot) be accepted as substantially complete.

 

(11)      Recommended that Calcasieu Parish Project No. 2002-04 (Ward 2 – Ward Line Road; Ward 3 – Elliot Road, Greathouse Road, Weaver Road, and West Cal Cam Road) be accepted as substantially complete.

 

(12)      Recommended that the Parish Purchasing Agent be authorized to advertise for one (1) jet vacuum truck, two (2) tandem dump trucks, four (4) one-ton pickup trucks, and three (3) one-half ton pickup trucks for use by the Division of Engineering and Public Works, as well as two (2) 2003 one-half ton pickup trucks and one (1) 2003 van for use by the Mosquito Control Department, all in accordance with the 2003 Annual Budget.

 

(13)      Recommended that the Parish Purchasing Agent be authorized to purchase, utilizing State Contract Purchasing Procedures, four (4) 2003 New Holland TS110 Tractors with four (4) 2003 Tiger Boom and Side Mowers for use by the Division of Engineering and Public Works, all in accordance with the 2003 Annual Budget.

            Motion was made by Mr. Manuel, seconded by Mr. Breaux and carried unanimously that Recommendation No. 1 of the Public Works Committee be approved and that the following resolution be adopted:

RESOLUTION


            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 6th day of February, 2003, that it does hereby authorize the Director of the Parish Division of Planning and Development and the Calcasieu Parish Clerk of Court to file the plat of Vision Center Development located off of Gloria Drive in Ward One in Section 4, Township 9 South, Range 8 West, Calcasieu Parish, Louisiana, in the records of the Calcasieu Parish Clerk of Court, for the sole purpose of meeting the legal recording requirements, bearing File No. 2614830.


            BE IT FURTHER RESOLVED that the recordation of the survey shall not be construed to mean that the Police Jury and/or Parish Planning and Zoning Board or anyone acting on their behalf has accepted and/or approved the streets, roads, drainage system, or any facilities in the subject survey.


            BE IT FURTHER RESOLVED that said streets, roads, and drainage system on the aforementioned plat have not been and are not hereby approved in accordance with parish ordinances and regulations, and are solely private in nature.


            BE IT FURTHER AND FINALLY RESOLVED that a certified copy of this resolution shall be filed in the office of the Calcasieu Parish Clerk of Court and reference shall be made to same on the plat to be recorded.

            It was moved by Dr. Mackey and seconded by Mr. Landry to approve Recommendation Nos. 2 through 13 of the Public Works Committee; however, President Kleckley advised that someone had asked to address the Police Jury with respect to Recommendation No. 8, and Mr. Smart asked that Recommendation No. 11 also be taken up separately. Dr. Mackey then amended his motion, and Mr. Landry who seconded said motion agreed to the amendment, to approve Recommendation Nos. 2, 3, 4, 5, 6, 7, 9, 10, 12, and 13 of the Public Works Committee. A vote taken on the motion as amended carried unanimously; whereupon, said recommendations were approved, and the following resolutions were adopted:

 

RESOLUTION


            WHEREAS, Barry McGee subdivided certain property in Ward Three of Calcasieu Parish, Louisiana, known as Rustic View Estates Subdivision Phase 1B, a subdivision in Section 29, Township 11 South, Range 8 West, Calcasieu Parish, Louisiana; and


            WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana; and


            WHEREAS, said subdivision plat was prepared by George A. Evans, Jr., Registered Land Surveyor No. 4750, and certification was made that the subdivision plat was prepared in accordance with R.S. 33:5051 and all other laws of the State of Louisiana; and

           With reference to Recommendation No. 8 of the Public Works Committee, Mr. Rick Norman, Attorney at Law, 500 Kirby Street, Lake Charles, appeared before the Police Jury at this time on behalf of Mr. Jeffrey Wayne Morrow and Texas Timberjack, Inc. Mr. Norman stated that he had talked with Mr. Smith, Mr. Vickers, and Mr. Andrepont relative to the recommendation of the Public Works Committee and that one of his clients owned ten acres in the vicinity of Racca Road and would be landlocked with the closure of said road. He further advised that Texas Timberjack, Inc. had 205 acres which would have no access if the road was closed. Mr. Norman pointed out that while the people who were directly involved with this matter were aware of the problem, he did not know that everybody was aware of it.

 

            Mr. Andrepont stated he did not feel it was the intention of the Police Jury to impede ingress or egress from Mr. Norman’s clients, and he suggested that the Jury proceed with action recommended by the Public Works Committee in order to not halt the progress which had been made with Union Pacific Railroad Company in the past six months. Mr. Andrepont further suggested that he, Mr. Norman, the staff, and Mr. Danahay try to come to an amicable solution of the problems previously outlined by Mr. Norman.

 

            Motion was then made by Mr. Andrepont and seconded by Dr. Mackey to approve Recommendation No. 8 of the Public Works Committee to adopt a resolution approving an agreement between the Police Jury and Union Pacific Railroad (UPRR) with reference to construction of the proposed Highway 108 railroad crossing and providing for the closure of the railroad crossings on Racca and Stegall Roads, and further, authorizing the President of the Police Jury, or his designee when appropriate, to execute all documents related thereto.

 

            Mr. McMurry stated that he felt the motion on the floor was proper and in good order and pointed out that the motion would not effect an abandonment of these roads but instead would simply authorize an agreement with UPPR which would declare the intent of the Police Jury to commence with the abandonment process which was quite extensive and which involved advertising, a public hearing, etc. Mr. McMurry advised that the adoption of the resolution on the floor would keep the ball rolling on a very long-awaited project while attempts could be made in the meantime to address Mr. Norman’s clients’ concerns.

 

            A vote was then taken on the motion on the floor, and said motion carried unanimously; whereupon, the following resolution was adopted:

            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 6th day of February, 2003, that it does hereby approve an agreement between the Police Jury and Union Pacific Railroad (UPRR) with reference to construction of the proposed Highway 108 railroad crossing and providing for the closure of the railroad crossings on Racca and Stegall Roads.


            BE IT FURTHER RESOLVED that the President of the Police Jury, or his designee, when appropriate, is authorized to execute all documents related thereto.

            With reference to Recommendation No. 11 of the Public Works Committee to accept Calcasieu Parish Project No. 2002-04 (Ward 2 – Ward Line Road; Ward 3 – Elliot Road, Greathouse Road, Weaver Road, and West Cal Cam Road) as substantially complete, Mr. Smart advised that the contractor had assured him that this project would be complete by this date, including Weaver Road, but that was not the case.

 

            Motion was made by Mrs. Treme, seconded by Mrs. August and carried unanimously that action be deferred for thirty days with respect to Recommendation No. 11 of the Public Works Committee as outlined heretofore.

 

           It was moved by Mr. Collins, seconded by Mrs. Griffin and carried unanimously that the recommendations of the Director of the Division of Planning and Development be approved with reference to the Surplus Adjudicated Property Sale conducted on January 28, 2003, on the following cases and that ordinances be adopted with respect to each piece of property:

 

AP03-081-02 (1610 Prater Street, Lake Charles)

The Director of the Division of Planning and Development recommended that the highest offer in the amount of $9,000.00 of Dr. Stephen Ayers be accepted.

 

AP03-013-02 (1614 Iowa Street, Lake Charles)

The Director of the Division of Planning and Development recommended that the highest offer in the amount of $3,900.00 of Mr. Johnny Guillory be accepted.


            As a result of the passage of the motion outlined previously, the following ordinances were adopted:

 

ORDINANCE NO. 4490

 

AN ORDINANCE authorizing the Police Jury to declare the property described as: Lot 7 blk 41 Katrina Moeling Sub <lot $410 imps (50% int in $1020) 4510-balance assessed Doris Frank- S 16 2/3 ft lot 6 blk 41 Katrina Moeling Sub imps R/H (50% in 1020) 510 balance assessed Janice C. Parkerson 21 09 08 1266-41 000602. (AP03-081-02; Tax Assessment No. 991686 & 330051); 1610 Prater Street in Ward Three, Lake Charles, Louisiana, surplus property and to authorize the sale of said lot to Dr. Stephen Ayers, his agent, or assign for the consideration of $9,000.00 (nine thousand dollars) cash, or to the highest offer or who submits an offer with a certified check or money order in the amount of $475.00 ($400 appraisal fee plus $75).


        WHEREAS, the Parish of Calcasieu owns property described as: Lot 7 blk 41 Katrina Moeling Sub <lot $410 imps (50% int in $1020) 4510-balance assessed Doris Frank- S 16 2/3 ft lot 6 blk 41 Katrina Moeling Sub imps R/H (50% in 1020) 510 balance assessed Janice C. Parkerson 21 09 08 1266-41 000602. (AP03-081-02; Tax Assessment No. 991686 & 330051); 1610 Prater Street in Ward Three, said property having been adjudicated to the Parish for unpaid property taxes; and


        WHEREAS, all Members of the Local Services Agreement have recommended that the property be declared surplus and no longer needed for public purposes; and


        WHEREAS, a request has been received by the Division of Planning & Development from Dr. Stephen Ayers, to purchase said property for the consideration of $9,000.00 (nine thousand dollars) cash, at the time of sale; and


        WHEREAS, no written opposition or higher offer has been filed with the Division of Planning & Development Office; and


        WHEREAS, the Calcasieu Parish Police Jury is of the opinion that this property is surplus and no longer needed for public purposes and that it would be in the public interest to convey the above mentioned property to Dr. Stephen Ayers, for the offered consideration.


        NOW, THEREFORE,


        BE IT ORDAINED BY THE POLICE JURY OF THE PARISH OF CALCASIEU, convened in regular session on the 6th day of February, 2003, that it does hereby approve the following criteria for the sale and disposition of adjudicated property:

            Section 2.       Ten days after the final adoption of this ordinance, if no restraining order has been obtained, the President is authorized to execute an act of cash sale in which the Parish of Calcasieu conveys the above described property to Dr. Stephen Ayers, his agent, or assign for and in consideration of $9,000.00 (nine thousand dollars). However, the President shall not execute the act of cash sale until the Adjudicated Property Section of the Division of Planning & Development has certified in writing to the President the following:

 

            (1)        Purchaser has certified in writing to the Adjudicated Property Section of the Division of Planning & Development that purchaser or his agent has examined the mortgage records, conveyance records, probate and civil suit records of the Clerk of Court of Calcasieu Parish and attached to the certification a written list of the names and last known addresses of all owners, mortgagees, and any other person who might have vested or contingent interest in the property, or who has filed a request for notice as provided in LSA-R.S. 47:2261. Said written certification shall contain an indemnification and hold harmless clause by the purchaser in favor of the Parish of Calcasieu, its officers, agents and employees if the purchaser should fail to request notification to an interested party or should incorrectly identify or locate any interested party.

 

            (2)       Purchaser has made written request to the Adjudicated Property Section of the Division of Planning & Development to notify those persons identified above in accordance with LSA-R.S. 33:4720.17 and LSA-R.S. 47:2261 and has paid the Parish the sum of five dollars per notice and/or the sum of thirty dollars per notice by publication requested.

 

            (3)       The Adjudicated Property Section of the Division of Planning & Development has provided purchaser with proof of notice, and purchaser has recorded same in the conveyance records of Calcasieu Parish and has provided the Adjudicated Property Section of the Division of Planning & Development a stamped copy of the recorded proof of notice.

 

            (4)       Purchaser has certified in writing to the Adjudicated Property Section of the Division of Planning & Development that the number of days required by LSA-R.S. 33:4720.17 has elapsed since the above required notice was made or attempted and that the property has not been redeemed by the payment of the taxes owed.

 

            (5)       Purchaser has paid the consideration in cash to the Parish and the cash sale attached has been approved by the Division of Planning & Development.


            Section 3. If purchaser should fail to complete the requirements of Section 2 A) and B) within one hundred twenty (120) days of adoption of this ordinance, the President is authorized to execute an act of cash sale in which the Parish of Calcasieu conveys the above described property to anyone who shall complete the requirements of Section 2. If all of the requirements of Section 2 are not completed within one year from the date this ordinance is adopted, the President’s authority to execute an act of cash sale for this property shall cease, and any and all rights of the purchaser to this property shall terminate.


            Section 4. This act of sale shall be without any warranty or recourse whatsoever (including warranty of title), even for the return or any reduction of the purchase price, but with subrogation to all rights and actions of warranty the Parish of Calcasieu may have, and shall contain such warranty limitations and other provisions as are required by the Parish Attorney. The Parish of Calcasieu shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface rights of the said property.

(AP03-013-02; Tax Assessment No. 586692); 1614 Iowa Street in Ward Three, Lake Charles, Louisiana, surplus property and to authorize the sale of said lot to Mr. Johnny Guillory, his agent, or assign for the consideration of $3,900.00 (three thousand nine hundred dollars) cash, or to the highest offer or who submits an offer with a certified check or money order in the amount of $225.00 ($150 appraisal fee plus $75).


        WHEREAS, the Parish of Calcasieu owns property described as: W 50 ft lots 1,2,3 McMilland Sub of Boggs and Conner Sub of Spence Sub. (AP03-013-02; Tax Assessment No. 586692); 1614 Iowa Street in Ward Three, said property having been adjudicated to the Parish for unpaid property taxes; and


        WHEREAS, all Members of the Local Services Agreement have recommended that the property be declared surplus and no longer needed for public purposes; and


        WHEREAS, a request has been received by the Division of Planning & Development from Mr. Johnny Guillory, to purchase said property for the consideration of $3,900.00 (three thousand nine hundred dollars) cash, at the time of sale; and


        WHEREAS, no written opposition or higher offer has been filed with the Division of Planning & Development Office; and


        WHEREAS, the Calcasieu Parish Police Jury is of the opinion that this property is surplus and no longer needed for public purposes and that it would be in the public interest to convey the above mentioned property to Mr. Johnny Guillory, for the offered consideration.

RESOLUTION


        WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Christopher D. Gustin to mechanically clear and fill an area for a private residence, workshop, and driveway. Approximately 0.75 of one acre of jurisdictional wetlands will be impacted. The project is located in wetlands adjacent to Bayou Choupique, at Latitude 30.20789, Longitude 93.42088, in Section 7, Township 10 South, Range 10 West, in Calcasieu Parish, Louisiana; and


            WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Christopher D. Gustin relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and

 

        WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.


        NOW THEREFORE,


        BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 6th day of February, 2003, that it does hereby indicate no objection to the proposal of Christopher D.             WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Jeffrey Pitre relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and

 

        WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.

            BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, as follows:


            SECTION 1.   Subject to the approval of the State Bond Commission and under the authority conferred by Article 6, Sections 7, 30 and 32 of the 1974 Louisiana Constitution, Chapter 6A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority supplemental thereto, a special election be and the same is hereby called and ordered to be held in the Parish on Saturday, May 3, 2003, between the hours of six (6:00) o’clock A.M. and eight (8:00) o’clock P.M., in compliance with the Louisiana Election Code, and that at the said election there shall be submitted to all registered voters of the Parish qualified and entitled to vote at the said election under the Constitution and Laws of the State of Louisiana and the Constitution and Laws of the United States, the following proposition:


BURTON COLISEUM & AGRICULTURAL SERVICES TAX

 

SUMMARY: Continuation of a 1.5-mill property tax for ten (10) years for the purpose of operating, maintaining, and improving the Burton Coliseum, and for funding other agricultural and community services.

 

PROPOSITION

 

Shall the Calcasieu Parish Police Jury, governing authority of Calcasieu Parish, Louisiana, continue to levy and collect a special tax of one and one-half (1.5) mills, on all property subject to taxation in Calcasieu Parish, Louisiana, for a period of ten (10) years, beginning in 2003, for the purpose of operating, maintaining, and improving the Burton Coliseum, and for funding other agricultural and community services, as determined to be necessary and proper by the Calcasieu Parish Police Jury, and in the event the proposition carries, for authority to levy the maintenance tax provided for herein?


            SECTION 2.   There shall be published in the “Lake Charles American Press”, a daily newspaper of general circulation within the Parish, published in Lake Charles, Louisiana, and being the official journal of the Calcasieu Parish Police Jury, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days prior to the date fixed for the election, notice of said election, which notice shall be substantially in accordance with the Notice of Special Election annexed hereto as “Exhibit A” and incorporated herein by reference, the same as if it were set forth herein in full.


            SECTION 3.    The Calcasieu Parish Police Jury shall meet at its regular meeting place which is the Police Jury meeting room on the first floor of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, on Thursday, the 22nd day of May, 2003, at 5:30 P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the results of said special election.


            SECTION 4.    The polling places set forth in the aforesaid Notice of Special Election, be and the same are hereby designated as the polling places at which to hold said election, and the election officials appointed in accordance with said Notice of Special Election, be and the same are hereby appointed as Commissioners and Commissioners-in-Charge of election, respectively, to serve at the polling places as indicated.


            SECTION 5.    The officers designated to serve as Commissioners and Commissioners-in-Charge, or such substitutes therefor as may be selected and designated in compliance with the Louisiana Election Code, shall hold said special election as herein provided, shall make due returns of said election for the meeting of the Police Jury of the Parish of Calcasieu, State of Louisiana, to be held on the 22nd day of May, 2003, at 5:30 P.M., and the compensation of said officers be and the same is hereby fixed at the sum prescribed by law. All registered voters in the Parish are entitled to vote at said special election. Voting machines shall be used, and assessed valuations shall not be voted.


            SECTION 6.    The Secretary of the Police Jury of the Parish of Calcasieu, State of Louisiana, is hereby empowered, authorized and directed to arrange for the furnishing to said election officers in ample time for the holding of said election the necessary equipment, forms and other election paraphernalia essential to the proper holding of said election.


            SECTION 7.    Certified copies of this resolution shall be forwarded to the Louisiana Secretary of State, the Commissioner of Elections of the State of Louisiana, the Bond Commission of the State of Louisiana, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines in and for the Parish of Calcasieu, State of Louisiana, and the Registrar of Voters in and for said Parish, as notification of the special election herein called in order that each may prepare for said election and perform their respective functions as required by law.


            SECTION 8.    Application be and the same is hereby formally made to the State Bond Commission for consent and authority to hold the aforesaid special election as herein provided, and in the event the aforesaid Proposition carries, for the Commission’s consent and authority to levy and collect, and adopt an ordinance providing for such levy and collection, of the continuation of the maintenance tax as authorized by said Proposition.


            SECTION 9.    A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Police Jury of the Parish of Calcasieu, State of Louisiana, together with a letter requesting the prompt consideration and approval of this application.


            SECTION 10. A certified copy of this resolution, together with other showings required by Section 5 of the Voting Rights Act of 1965 and regulations pertaining thereto shall be submitted to the United States Attorney General for approval in compliance with the Voting Rights Act, should such submission be required.


            SECTION 11. If any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this resolution which can be given effect without the invalid provisions, items, or applications, and to this end, the provisions of this resolution are hereby declared severable.


            SECTION 12. All resolutions, ordinances or parts thereof in conflict herewith are hereby repealed.
