The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, January 16, 2003, in the Police Jury Meeting Room of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with The Honorable Chuck Kleckley, President, presiding, and the following members present:

President Kleckley called the meeting to order and asked everyone to remember in their prayers Mrs. Treme’s father, Mr. Horace Lynn Jones, who was facing some health issues. The invocation was pronounced by Mrs. Griffin which was followed by the Pledge of Allegiance led by Mr. Clement. The roll was called with the result being as outlined above.
Motion was made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously that the following applications for liquor and beer permits be approved:

Upon motion made by Dr. Mackey, which was duly seconded by Mr. Collins and carried unanimously, the minutes of the Regular Meeting of the Police Jury dated December 19, 2002, were approved, and the reading of same was dispensed with.
President Kleckley advised that action was needed on Zoning Case RZ02-001-003 which was a request by Jerry and Deloras Campbell to rezone from C-1 (Light Commercial) to R-2 (Mixed Residential) to allow residential development at North Railroad Avenue and Fourth Street in Ward Two, Police Jury District 10. He further advised that the Planning and Zoning Board had met on Tuesday, January 14, 2003, and voted 9 (for) and 1 (against) to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that the proper permits must be obtained within five days of zoning approval; and (3) that the manufactured home must be skirted prior to utilities being connected.
It was moved by Mr. Breaux, seconded by Mr. Collins and carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to Zoning Case RZ02-001-003 and to grant the request to rezone with the stipulations outlined by said Board; whereupon, the following ordinance was adopted:

AN ORDINANCE amending Chapter 26 - Zoning, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, classifying the area: A request by Jerry and Deloras Campbell to rezone from C-1 (Light Commercial) to R-2 (Mixed Residential) to allow residential development on the property described as: Lots 4, 5, 6, 10, 11, and 12 of Block 9, Bell City, Louisiana, including all improvements situated thereon.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 16th day of January, 2003, that Chapter 26 - Zoning, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, and the Comprehensive Zoning Map for Calcasieu Parish, Louisiana, be and they are hereby amended insofar as said ordinance and map pertain to the following property in Ward Two of this parish:

President Kleckley advised that action was needed on Zoning Case RZ03-002-03 which was a request by Bernice Gauthier to rezone from R-2 (Mixed Residential) to C-2 (General Commercial) to allow a lounge at 4015 East Broad Street in Ward Three, Police Jury District 2. He further advised that the Planning and Zoning Board had met on Tuesday, January 14, 2003, and voted unanimously to recommend that the request be denied. President Kleckley pointed out that should the Police Jury grant the request, the staff recommended the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) a parish occupational license must be obtained; (3) adhere to the Parish Noise Ordinance; (4) install a six-foot (6') wood privacy fence along the north and west property lines upon completion of the building; (5) install adequate insulation in the building to prevent loud noise from unnecessarily interfering with the comfort of nearby residents; and (6) all parking and driveways must be hardsurfaced (asphalt or concrete).
Motion was made by Dr. Mackey, seconded by Mr. Manuel, and carried unanimously that the recommendation of the Planning and Zoning Board be upheld with respect to Zoning Case RZ03-002-03 and that the request to rezone be denied.
Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Collins and carried unanimously, the following resolution was adopted:
RESOLUTION
WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Mayne & Mertz, Inc. to construct a ring levee to prepare a well site to drill and produce the Northwest Vinton Field - Richard Well No. 1. The proposed ring levee will measure 300 feet by 300 feet and will require the discharge of approximately 267 cubic yards of material into jurisdictional wetlands. The levee will measure 2 feet high by 5 feet wide with a 1-foot-wide crown and a 1:1 side slope configuration. All material used to construct the levee will be excavated from within the levee perimeter. A total of 2.1 acres of wetland habitat will be impacted as a result of the proposed activity. The site will be accessed by means of an existing limestone access road. If productive, the site will be restored to the minimum area necessary for production activities. Within 120 days of cessation of drilling activities, the well site will be degraded, and the site will be restored to pre-construction contours. To compensate for impacts to the wetland habitat, the applicant will purchase 2.1 acre-credits from an appropriate wetland mitigation bank. The project site is located in wetlands, adjacent to Gum Gully, northeast of Toomey in Section 25, Township 10 South, Range 13 West, in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Mayne & Mertz, Inc. relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 16th day of January, 2003, that it does hereby indicate no objection to the proposal of to construct a ring levee to prepare a well site to drill and produce the Northwest Vinton Field - Richard Well No. 1. BE IT FURTHER RESOLVED that the no objection position of the Police Jury in this permit application is based solely on the evaluation of the parish staff of the project’s effect on current parish ordinances and provisions.
BE IT FURTHER RESOLVED that a study on the environmental impact of the aforementioned project has not been made due to the lack of expertise of the parish staff to accomplish such a study, and the Police Jury requests that agencies and/or individuals with such expertise make an environmental review of said project and forward their findings to the U.S. Corps of Engineers.

It was moved by Dr. Mackey, seconded by Mrs. Griffin and carried unanimously, to approve a Revised Coastal Use Permit application for Mr. Lester Langley to develop property located at the end of Lake Breeze Road in Ward Three with reference to the placement of additional fill to raise the house pads and widen by ten additional feet for residential subdivision development. (On May 6, 1999, the Police Jury granted approval for this development, however, these additional modifications were requested by Mr. Langley.)
Motion was made by Mr. Manuel, seconded by Mrs. Griffin and carried unanimously that the Director of Planning and Development be authorized to notify the following property owners in accordance with Article II of Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to show cause at a public hearing on March 6, 2003, or the first regular Police Jury meeting thereafter, as to why the structures on the properties as stipulated should not be condemned:

Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Breaux and carried unanimously, the following ordinance was adopted to amend the Calcasieu Parish Code of Ordinances, Chapter 15-Licenses and Miscellaneous Business Regulations, to correctly outline various cross references contained within said Chapter:
ORDINANCE NO. 4488
AN ORDINANCE amending Chapter 15 – Licenses and Miscellaneous Business Regulations, Article V. Private Ambulances, of the Code of Ordinances of the Parish of Calcasieu, Louisiana.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 16th day of January, 2003, that it does hereby amend Chapter 15 – Licenses and Miscellaneous Business Regulations, Article V. Private Ambulances, of the Code of Ordinances of Calcasieu Parish, Louisiana, to correctly outline various cross references contained within the following sections below:
SECTION 1. Sec. 15-142. Implementation of an Exclusive Franchise Agreement, Paragraph (b), is amended in its entirety to read as follows:
(b) Upon execution of the exclusive franchise agreement, any other entities or persons conducting operation of an ambulance as defined herein within the Parish, with the exception of the Good Samaritan provision under LSA— R.S. 40:1235 and Sec. 15-155 of this ordinance, shall be in violation of this ordinance.
SECTION 2. Sec.15-143. Availability of services required, Paragraph (2), is amended in its entirety to read as follows:
(2) Air ambulance service by rotor wing helicopter, based in the Parish, and staffed twenty-four (24) hours each day, seven (7) days a week. The air ambulance service shall include full-time access to a rotor wing helicopter medically configured in accordance with state regulations which is capable of providing for the transportation of patients at the direction of a physician, a medical facility or an emergency responder. Notwithstanding other provisions of this ordinance, the selected provider of ambulance service shall be the provider of air ambulance service for the area in which West Cal-Cam EMS is the primary responder in accordance with Section 15-155. Any air ambulance utilized for such purposes shall be licensed by the State of Louisiana. Revocation of such license by the State of Louisiana shall be considered a violation of this ordinance.
SECTION 3. Sec.15-143. Availability of services required, Paragraph (4), is amended in its entirety to read as follows:
(4) Proof of the establishment and maintenance of a bonafide office in the Parish from which the service is offered, and availability to serve all areas of the Parish subject to Sec. 15-155 of this ordinance.
SECTION 4. Sec. 15-151. Inspection of ambulances, is amended in its entirety to read as follows:
The Office of Emergency Preparedness shall inspect ambulances for adherence to operational and equipment requirements in accordance with Section 15-146 of this ordinance. The OEP shall inspect each ambulance annually for compliance in these areas, and randomly at its discretion. Inspections will be conducted in a manner so as not to interfere with patient care.
SECTION 5. Sec. 15-155. West Calcasieu-Cameron Hospital Service District, Paragraph (b), is amended in its entirety to read as follows:
(b) West Cal-Cam EMS shall be subject to all requirements of this ordinance, with the following exceptions:
Sec. 15-144 (1): Performance bond requirements
Sec. 15-144 (2): Accreditation by CAAS
Sec. 15-143 (2): Availability of air ambulance service
BE IT FURTHER ORDAINED that this ordinance shall become effective immediately upon adoption.
BE IT FURTHER ORDAINED that any ordinance or parts of any ordinance in conflict herewith are hereby repealed.
BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

It was moved by Mr. Collins and seconded by Mr. McMillin to adopt a resolution approving an amendment to the Joint Services Agreement between the Police Jury and the Calcasieu Parish Sheriff’s Office for the use of inmate labor for litter abatement to reflect the revised budget for this program beginning January 1, 2003, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.
Mr. Clement asked what the revised budget entailed, and Mr. Beam responded that it involved an increase of $12,000 (from $48,000 to $60,000) due to an increase in costs for the Sheriff to provide security for the inmates on the litter crews.
A vote was taken on the motion on the floor, and said motion carried unanimously; whereupon, the following resolution was adopted:

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 16th day of January, 2003, that it does hereby approve an amendment to the Joint Services Agreement between the Police Jury and the Calcasieu Parish Sheriff’s Office, for the use of inmate labor for litter abatement, to reflect the revised budget for this program beginning January 1, 2003.
BE IT FURTHER RESOLVED that the President of the Police Jury, or his designee, when appropriate, is authorized to execute all documents related thereto.

Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Manuel and carried unanimously, the President of the Police Jury was authorized to execute the necessary documents for acquisition of right-of-way from HFB Properties, LLC, Donald Wayne Meadows, Jr., and Anita Faye Arceneaux-Meadows on Nelson Road in Ward Three (Calcasieu Parish Project No. 1999-07).
It was moved by Mr. Manuel and seconded by Mr. Collins to authorize the Parish Purchasing Agent to advertise for bids for the purchase of two (2) 2003 one-half ton extended cab and chassis pickup trucks and one (1) 2003 three-quarter ton extended cab pickup truck to be used by the Division of Engineering and Public Works (Animal Control Department).
Mr. Smart asked that the motion be amended to authorize advertisement for bids for the purchase of two (2) 2003, one-half ton regular cab and chassis pickup trucks [instead of two (2) one-half ton extended cab and chassis pickup trucks] and one (1) 2003 three-quarter ton extended cab pickup truck for use by the Division of Engineering and Public Works (Animal Control Department).
Mr. Breaux stated that when the current Police Jury was seated, one of the jurors had asked how many vehicles the Parish had, not counting equipment. Mr. Andrepont pointed out that Mr. David Abshire, former police juror, had asked for that information. Mr. Breaux asked Mr. Smart if he could compile this information for him, and Mr. Smart responded that he could compile the information on vehicles under his supervision. Mr. McMurry stated that he could supply the rest of the information but that the majority would be under the Division of Engineering and Public Works.
Mr. Manuel amended his motion, and Mr. Collins accepted said amendment, to authorize the Parish Purchasing Agent to advertise for bids for the purchase of two (2) 2003, one-half ton regular cab and chassis pickup trucks, and one (1) 2003 three-quarter ton extended cab pickup truck, to be used by the Division of Engineering and Public Works (Animal Control Department). A vote taken on the motion carried unanimously.
President Kleckley advised that the Consulting Service Agreement between the Police Jury and Lake Charles Memorial Hospital for the Employee Assistance Program had been assigned to the Institute of Neuropsychiatry, in accordance with the provisions of said Agreement.
Motion was made by Mr. Andrepont, seconded by Mrs. August and carried unanimously to go into executive session to discuss Claim No. 270A201674 (Miller vs. Police Jury). Following the executive session, the Police Jury reconvened in regular session, and motion was made by Mr. Andrepont, seconded by Mrs. Treme and carried unanimously to approve the report given by legal counsel during the executive session.
The hour being 6:00 p.m., President Kleckley advised that a public hearing would be held at this time, in accordance with Article II-Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, requesting authorization to condemn immediately the following described structure due to the structure being in danger of collapse and constituting a menace to public safety:

Mr. Wes Crain, Assistant Director of Planning and Development, showed photographs of the structure in question, pointing out that there were small children who lived in this neighborhood, and stated that the letter which had been mailed to the owner notifying him of the condemnation hearing had been returned as unclaimed.
President Kleckley asked if there was anyone present in the audience to address the Police Jury with respect to this proposed condemnation and hearing no comments, motion was made by Mr. Andrepont, seconded by Mr. Manuel and carried unanimously that the structure be condemned and removed immediately; whereupon, the following ordinance was adopted:
ORDINANCE NO. 4489
AN ORDINANCE ordering immediate demolition of one burned manufactured home with addition on property located at 2417 Stingray Drive (Lot 176, Country Pines North Subdivision, Part 7, (Tax Assessment No. 01320943)), South Lake Charles area of Ward 3, Calcasieu Parish, Louisiana, and owned by Tony Ray Bragg.

The facts as set forth at the meeting of the Police Jury of Calcasieu Parish, Louisiana, on this date, justify an order of this Police Jury, to exercise its right under the Calcasieu Parish Code of Ordinances, Chapter 6, Article II, Section 6-18 (d), to condemn the following described property wherein the notice requirements to the owner shall not apply when any building, dwelling or structure, or any part thereof, are in imminent danger of collapse, and constitute a menace to public safety; therefore, it is hereby ordered that the burned manufactured home with addition on property located at 2417 Stingray Drive (Lot 176, Country Pines North Subdivision, Part 7, (Tax Assessment No. 01320943)), South Lake Charles area of Ward 3, Calcasieu Parish, Louisiana, and owned by Tony Ray Bragg, be demolished and removed immediately. This order requires that all development permits be secured for demolition and all debris be removed from the premises. This order is made this 16th day of January, 2003, and is final unless appealed within five (5) days.
SECTION 2. If the burned manufactured home with addition on the premises hereinabove described in the Parish of Calcasieu, Louisiana, is not demolished and removed immediately, notice is hereby given that the Director of Parish Planning and Development shall have work commenced on the demolition and removal of said burned manufactured home with addition, in which case the Police Jury shall not be liable for damages and shall have a lien and privilege against the property upon which the burned manufactured home with addition was situated for the cost of demolishing and removing said burned manufactured home with addition, and for the cost of maintaining the property.
SECTION 3. The Director of Parish Planning and Development is hereby authorized and directed to give notice of said demolition and removal as required by law.
SECTION 4. The Director of Parish Planning and Development is hereby authorized to enter into a contract to accomplish the demolition of the burned manufactured home with addition, if necessary, and to pay the fees of the contractor from appropriate Parish funds, and to pay any and all costs associated with the demolition. Any amounts expended by the Parish of Calcasieu shall be included in the statement of costs in accordance with Chapter 6 of the Code of Ordinances of Calcasieu Parish, Louisiana, and the Parish of Calcasieu shall have a lien and privilege for all costs resulting from the demolition.
SECTION 5. This ordinance shall become effective immediately.
