The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, August 1, 2002, in Courtroom A of the Calcasieu Parish Courthouse, 1000 Ryan Street, Lake Charles, Louisiana, with The Honorable Enos Derbonne, President, presiding, and the following members present:

President Derbonne called the meeting to order, and the invocation was pronounced by Pastor Wilton Red, Thorn of Grace Fellowship Church, which was followed by the Pledge of Allegiance led by Mr. Collins. The roll was called with the result being as outlined above.
It was moved by Mr. Andrepont, seconded by Mr. Clement and carried unanimously to suspend the rules by a two-thirds majority vote to adopt the following resolution approving an Enterprise Zone Endorsement Application by Citgo Petroleum Corporation for Phase II of the Optimization Project located in Census Tract 32, Block Group 9: (The Police Jury deferred action on this matter on March 21, 2002, at the request of Citgo Petroleum Corporation.)
RESOLUTION
A RESOLUTION stating the Calcasieu Parish Police Jury's endorsement of Citgo Petroleum Corporation to participate in the benefits of the Louisiana Enterprise Zone Program.
WHEREAS, the Louisiana Legislature enacted Louisiana Enterprise Zone Act 901 of 1981, Act 337 of 1982, Act 433 of 1987, Act 1024 of 1992, Act 581 of 1995,
Act 624 of 1997, Act 647 of 1997, and Act 977 of 1999; and
WHEREAS, the Louisiana Enterprise Zone Program offers significant incentives for economic development to some of the most distressed areas in the State; and
WHEREAS, the business is located within Census Tract 32, Block Group 9 which is a designated Enterprise Zone; and
WHEREAS, the Calcasieu Parish Police Jury states this endorsement is in agreement with the Overall Economic Development Plan for the Calcasieu Parish Police Jury; and
WHEREAS, the attached Enterprise Zone map has been marked to show the location of the business being endorsed; and
WHEREAS, in accordance with the Louisiana Enterprise Zone Program requirements, the Calcasieu Parish Police Jury agrees:
2. To assist the Department in evaluating progress made in any Enterprise Zone within its jurisdiction.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular and legal session convened on the 15th day of August, 2002, that Citgo Petroleum Corporation, Enterprise Zone Application #20020054, is endorsed to participate in the Louisiana Enterprise Zone Program.
BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this resolution which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable.
BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed.

President Derbonne advised that a presentation concerning the Calcasieu Parish Police Jury Comprehensive Annual Financial Report for the year ending December 31, 2001, would be received at this time from Mr. Milner. Mr. Milner thanked his staff for the thoroughness and quality of the report, and he thanked the Police Jury for making financially sound decisions which resulted in the good financial condition of the Parish. Mr. Milner pointed out that the recent approval by 75% of the voters to continue collection of the 1 ˝-cent sales tax was an indication of the level of confidence the public had in the financial decisions made by the Police Jury. He then asked Mr. Gus Schram of the parish's auditing firm, Gus Schram and Company, Ltd., to address the Jury relative to the report.
Mr. Schram thanked the staff for their extra efforts in compiling the report this year, pointing out that in addition to the normal difficulties in trying to blend the information from the individual component units, the staff was also trying to implement the new computer system during the same time they were producing the financial report.
Mr. Schram congratulated the Police Jury for having received for the tenth consecutive year the Government Finance Officer's Association's prestigious Certificate of Excellence. He then briefly outlined the various sections of the report, pointing out that the total long-term debt of the Police Jury was approximately $4,500,000 and the total assets were approximately $265,000,000 which he said spoke well of the Parish's financial condition and which laid a solid foundation for the future. Mr. Schram advised that the Parish's total liabilities were approximately $31,000,000.
Mr. Schram further advised that the implementation in the year 2003 of GASB (Governmental Accounting Standards Board) Rule 34 would change the look of future balance sheets and that the biggest concern was the incorporation of accounting related to infrastructure such as roads, works of public improvement, etc. He pointed out that the new computer system and changes in inventorying would help in that regard.
Mr. Schram also advised that the General Fund reflected a slight decrease from prior year revenue totals primarily as a result of a change in the manner in which governmental entities were required to show the value of investments which now had to be reflected at fair market value. He also advised that the total revenues in special revenue funds were almost identical to the year 2000 amounts even though there had been significant decreases in sales tax income and investment income. Mr. Schram stated that one "bright spot" was an almost 5% increase in ad valorem taxes.
Mr. Kleckley asked if the final numbers of the financial impact had been tabulated relative to the recent "ordeal" in the Tax Assessor's Office, to which Mr. Schram answered that said office was not actually part of the Parish's audit, even though they had been included for purposes of the comprehensive report, and that he would check into Mr. Kleckley's question and let him know the answer.
Mr. Clement asked what the 5% increase in ad valorem taxes could be attributed to, and Mr. McMurry stated that a combination of things affected these taxes. He further stated that in a non-reassessment year the increase was normally about 3% and that the increase of 5% might have been due to a new industry coming on the tax rolls or an older industry's tax exemption expiring, or perhaps growth in retail sales with the expansion of the Prien Lake Mall.
Mr. Landry had a question concerning a default of some waterworks district bonds, and Mr. McMurry explained that this was the district in Mossville which had been hit hard financially when Vista Chemical Company bought out a lot of the property surrounding its facility resulting in a loss, a lot of homeowners who had been customers of the district. He further explained that this loss of a huge customer base had hurt an already financially troubled district.
Mr. Milner pointed out that the Mossville waterworks district was doing some restructuring of its bonds so that this might help.
Motion was made by Mr. Breaux, seconded by Mrs. August and carried unanimously to accept the Comprehensive Annual Financial Report for the year ending December 31, 2001, as presented on this date.
At this time Mr. Collins presented a Certificate of Congratulations to Ms. Tena Matthews of Washington-Marion High School for finishing fourth overall in the Hawaii Classics Basketball Tournament, an invitation-only tournament in which 72 high school juniors from around the country participated. Mr. Collins stated that Ms. Matthews had been very active in her community, church, classroom, and basketball, and had led her team in high school to the Sweet 16 Tournament.

Ms. Matthews expressed her appreciation to Mr. Collins, the Police Jury, her supporters, and to all who had made her dream come true.
President Derbonne advised that no action was necessary on applications for liquor and beer permits due to the fact that no applications had been submitted.
Upon motion made by Mr. Andrepont, which was duly seconded by Mrs. August and carried unanimously, the minutes of the Regular Meeting of the Police Jury dated July 18, 2002, were approved, and the reading of same was dispensed with.
President Derbonne advised that action was needed on Zoning Case RZ06-031-02 which was a request by Apostolic Faith Ministries to rezone from A-1 (Agricultural) to C-2 (General Commercial) to allow mini-warehouses (26 units) on Highway 12 in Ward Six, Police Jury District 11. He further advised that the Planning and Zoning Board had met on Tuesday, August 13, 2002, and vote eight (for) and three (against) to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that the proper permits must be obtained; (3) that all drives and parking must be hardsurfaced (concrete or asphalt); and (4) that the use be limited to mini-warehouses.
Motion was made by Mrs. Treme, seconded by Mr. Manuel and carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to Zoning Case RZ06-031-02 and to grant the request to rezone with the stipulations outlined by said Board; whereupon, the following ordinance was adopted:

President Derbonne advised that action was needed on Zoning Case RZ07-032-02 which was a request by Apostolic Faith Ministries to rezone from A-1 (Agricultural) to C-2 (General Commercial) to allow mini-warehouses (26 units) on Foreman Road in Ward Seven, Police Jury District 11. He further advised that the Planning and Zoning Board had met on Tuesday, August 13, 2002, and voted nine (against) and two (for) to recommend that the request be denied due to the residential character of the area. President Derbonne pointed out that should the Police Jury grant the request, the Board recommended the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that the proper permits must be obtained; and (2) that all drives and parking must be hardsurfaced (concrete of asphalt).
Motion was made by Mr. Treme and seconded by Mrs. Griffin to overturn the recommendation of the Planning and Zoning Board with respect to Zoning Case RZ07-032-02 and to grant the request to rezone with the stipulations outlined heretofore. Mrs. Treme stated that she did not understand the reason why the Planning and Zoning Board had voted to recommend approval of the previous zoning request (RZ06-031-02) and had then voted to recommend against this request (RZ07-032-02) since both requests were the same. Mrs. Treme further stated that there were a lot of transient people in the Vinton area who needed this type of storage facility.
Reverend Charles Braneff, 5098 West Fourth Street, DeQuincy, appeared before the Police Jury on behalf of Apostolic Faith Ministries (the applicant) and stated that none of his neighbors opposed the rezoning. Mrs. Treme pointed out that nobody had talked to her in opposition to the request.
Mrs. Griffin asked Mr. Vickers why nine members of the Planning and Zoning Board had voted against the request, and he stated that there was some concern that because the church was a non-profit entity, it might be unfair to a business owner who paid taxes and did not enjoy the tax benefits of a non-profit status. Mr. Vickers stated that with respect to RZ06-031-02, there was existing development along Highway 12 but that he had recommended against RZ07-032-02 because there was no commercial development along Foreman Road. He explained that it was a rural area and not a commercial corridor.
Reverend Braneff stated that there was another gentleman who would like to have his property in this area rezoned commercial and pointed out that a fire station and drainage board office was located in the area, as well as another piece of property which he owned.
Mrs. Treme stated that she had known Reverend Braneff for many years and that he had a wonderful ministry. She further stated that the money that was collected through the mini-warehouse business would go toward his ministry, and she did not feel he should be penalized because his ministry was non-profit.
Mr. Andrepont stated that with all due respect to the taxpaying businesses, it all came down to living in a free enterprise system where one could choose with whom they wished to do business. He further stated that he felt the issue was not about being in competition with someone else but the fact that Reverend Braneff wanted to bring a new business to Calcasieu Parish.
A roll call vote was then taken on the motion on the floor, and the vote thereon was as follows:

President Derbonne advised that due to the fact that the request had been withdrawn, no action was necessary with respect to Zoning Case RZ03-034-02 which was a request by Walter Rutherford or Billie Rutherford Farr to rezone from R-1 (Single Family Residential) to R-2 (Mixed Residential) to allow a single family residential subdivision (houses and manufactured homes) on Corbina Road in Ward Three, Police Jury District 10.

WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Mr. Charles E. Williams to clear and deposit fill to develop a homesite for sale. Approximately 90 cubic yards from an existing knoll (approximately 120' x 60' x 2') will be spread in an adjoining low area 0.453 of an acre in size. An additional 10 cubic yards of earthen material will be hauled in and deposited for the home, and 40 cubic yards for the driveway. The proposed home will be 80' x 30' and the driveway 150' x 10'. A 24" - diameter, 24' - long culvert has been installed in a non-jurisdictional ditch at the entrance to the site. Approximately 0.24 of an acre of wetlands will be impacted by the proposed activities. Proposed work will be conducted at 2228 West Houston River Road, in the City of Sulphur, Section 8, Township 9 South, Range 10 West, in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Mr. Charles E. Williams relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided all necessary permits are obtained from the Parish Division of Planning and Development prior to commencement of the project.
NOW THEREFORE,

An additional 5,066 cubic yards of off-site granular material and sandy/silty clay will be deposited to complete the proposed project backfill. The proposed project would directly impact approximately .22 acres of a tidal wetland. Proposed work will be conducted approximately 600 feet north of the intersection of Maplewood Drive and Maple Fork, in the City of Sulphur, Section 31, Township 9 South, Range 9 West, in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Gravity Drainage District No. Five of Ward Four relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, since the project is located within the city limits of the City of Sulphur.

President Derbonne advised that he had proclaimed the weekend of August 31 - September 2, 2002, as "Creole Nature Trail All American Road" weekend in Calcasieu Parish as outlined in the following proclamation:
PROCLAMATION
WHEREAS, the 180-plus mile Creole Nature Trail is a unique travel experience that appeals to a diverse population of over 200,000 annual visitors; and
WHEREAS, it provides information to knowledge seekers, cultural attractions to aesthetic travelers, two national wildlife refuges and one state wildlife refuge for nature lovers, salt and fresh water resources for recreational advocates, Civil war and archeological dig sites for historians, and miles of marsh, natural beaches, and prairie lands that yield an abundance of wildlife and scenic beauty; and
WHEREAS, the Creole Nature Trail was upgraded by the Federal Highway Administration and designated an "All-American Road" in June of 2002, and is one of only 20 All-American Roads in the country; and
WHEREAS, the trail was among the first 14 to receive a National Scenic Byway designation from the Federal Highway Administration through the National Scenic Byways Program in September 1996, and it remains the only nationally designated byway in Louisiana; and
WHEREAS, a premier national event called See America's Byways is scheduled for the Fall of 2002 to persuade Americans to reconnect with their cultural and environmental roots by traveling the nation's 20 All-American Roads and 75 National Scenic Byways; and
WHEREAS, a Creole Nature Trail "All American Road Weekend" is scheduled during the Labor Day Holiday, August 31 - September 2, 2002, as part of the See America's Byways national campaign.

President Derbonne advised that resolutions had been received from the West Baton Rouge Parish Council and the St. Martin Parish Council commending and thanking all 64 parishes in the State of Louisiana for their support and participation in making the 67th Annual National Association of Counties (NACo) Conference in New Orleans such a huge success, particularly the NACo 2002 "Louisiana Night" held in the Louisiana Superdome on Sunday, July 14, 2002.
Motion was made by Mr. Manuel and seconded by Dr. Mackey that the rules be suspended by a two-thirds majority vote to adopt a resolution approving a Joint Services Agreement between the Police Jury and Jefferson Davis Parish Police Jury whereby the Calcasieu Parish Division of Engineering and Public Works would repair the bridge located on Topsy Road (approximately one and one-half miles east of the Calcasieu Parish line), with the cost not to exceed $7,500.00 to be reimbursed fully by Jefferson Davis Parish.
Mr. Manuel explained that even though the bridge was in Jefferson Davis Parish, it affected residents of Calcasieu Parish whose children were having to get up extremely early in the morning because their school bus had to detour around the bridge.
Mr. Smart stated that the bridge could be repaired in the upcoming week and pointed out that not only would it help those residents to whom Mr. Manuel referred but that it would also help the Parish financially because the detour involved roads (including Bill Rosteet Road and Welcome Road) which were not built for this type of traffic.
Mr. Breaux said he did not understand how the Jefferson Davis Parish Police Jury had money for this project when it had been unable to provide any money to help rebuild the Lorrain bridge (located between Calcasieu and Jefferson Davis parishes).
Mrs. August stated that it was her understanding from the newspaper article concerning this matter that the bridge affected four parishes, and she asked if the other two parishes had been asked to help repair the bridge. Mr. Manuel explained that the residents in these other two parishes could use Highway 171 and Highway 190 to get to their destinations but that the residents in Calcasieu and Jefferson Davis parishes did not have such an option and had to go a significant distance out of their way when the bridge was not traversable.
In answer to a question by President Derbonne, Mr. Manuel stated that this affected approximately 200 school children. Mrs. Griffin stated that she was aware that a lot of Calcasieu Parish students were transported back and forth in this particular area of the Parish, and she expressed her pride in Mr. Manuel and his efforts to help these children.
A vote was taken on the motion on the floor, and said motion carried unanimously; whereupon, the following resolution was adopted:

Mrs. August expressed her concern that at a recent meeting, as a member of the Administering Board of the Office of Community Services, she had approached the Police Jury concerning the need for additional vehicles for the Calcasieu Transit Program and that she had been told afterwards that she should have gone through the OCS Administering Board prior to appearing before the Police Jury for this purpose. Mrs. August stated that following her presentation, she had read in the newspaper that a juror had approached another parish and given their word that Calcasieu Parish would help them with a problem they were facing. She stated that if the jurors were going to follow proper channels, then all of them should be required to do so and that if they were not (going to follow proper channels), then no one should have the right to criticize.
Mrs. August further stated that Mr. Manuel had the prerogative to do things his own way but that if she was criticized for not following the proper channels, then Mr. Manuel should have first consulted the Police Jury prior to making a commitment.
Mrs. Griffin stated that she did not think there should be a clear cut way of doing business but instead, the jurors should be free to do what was best for the people they were elected to represent.
Mr. Collins stated that several months ago he had tried to pass a resolution providing for the City of Lake Charles and the Police Jury to enter into a joint services agreement to help the City repair some streets for the benefit of school children but that he had been unable to get anyone to second the motion. He further stated that if the Police Jury was going to do something, it should help the people in Calcasieu Parish who needed assistance before helping another parish. Mr. Collins stated that he would like to see the Jury work with the City to get funding to repair streets if money was available to help another parish.
Mr. McMurry pointed out that the repair of the bridge on Topsy Road would not cost the Calcasieu Parish Police Jury anything because the cost of equipment and manpower would be fully reimbursed by the Jefferson Davis Parish Police Jury.
Mr. Manuel pointed out that he had made no commitments for the work to be done and that is why he brought the matter to the Police Jury for approval.
Mr. Andrepont asked when the reimbursement would be forthcoming because of the Police Jury's policy of requiring a deadline for repayment, and Mr. Manuel stated that the Jefferson Davis Parish Police Jury would reimburse Calcasieu Parish when the job was complete.
Mr. Smart pointed out that F. Miller and Sons, Inc. would be donating two pilings that were needed to repair the bridge.
Upon motion made by Mr. Manuel, which was duly seconded by Dr. Mackey and carried unanimously, the rules were suspended by a two-thirds majority vote to adopt the following ordinance:

AN ORDINANCE amending Chapter 17, Art. II, Div. 2. Speed Limits, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to modify speed limits on various roads in Ward One of Calcasieu Parish.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, that it does hereby amend Chapter 17, Art. II, Div. 2. Speed Limits, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, as follows:
SECTION 1: Sec.17-64, Twenty-five miles per hour, of the Code of Ordinances is amended:
By Removing the following roads from the provisions of said section:
- Kingrey Road, in Ward 1
SECTION 2: Sec. 17-65, Thirty miles per hour, of the Code of Ordinances is amended:
By Removing the following roads from the provisions of said section:
- Bill Rosteet Road, in Ward 1
- Briarmarsh Road, in Ward 1
SECTION 3: Sec. 17-68, Forty-five miles per hour, of the Code of Ordinances is amended:
By Including the following roads in the provisions of said section:
- Bill Rosteet Road, in Ward 1
- Kingery Road, from Bill Rosteet Road to Ambassador Road, in Ward 1
- Ambassador Road, in Ward 1
BE IT FURTHER ORDAINED that effective immediately, no vehicle shall travel in excess of the maximum speed limits established above.
BE IT FURTHER ORDAINED that appropriate signs shall be posted along the roads set forth above, at reasonable intervals, to warn the operators of vehicles of the speed limits herein imposed.
BE IT FURTHER ORDAINED that anyone violating the provisions of this ordinance, upon conviction, shall be fined as provided in Section 1-9 of the Code of Ordinances of Calcasieu Parish, Louisiana.
BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.
This ordinance was adopted on the 15th day of August, 2002.
