The Police Jury of Calcasieu Parish, Louisiana, met in Regular Session at 5:30 p.m. on Thursday, March 21, 2002, in Courtroom A of the Calcasieu Parish Courthouse, 1000 Ryan Street, Lake Charles, Louisiana, with The Honorable Enos Derbonne, President, presiding, and the following members present:

Mesdames Luvertha August, Elizabeth Conway Griffin, and Sandra J. Treme; and Messrs. Francis Andrepont, Brent Clement, Calvin Collins, Mike Danahay, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, and Cornelius "Cornie" Moon

Also present were Mr. S. Mark McMurry, Parish Administrator, Mr. Bryan Beam, Assistant to the Administrator, Mrs. Coleen Clark, Executive Secretary, Ms. Kathy P. Criglow, Recording Secretary, Mr. Richard Gremillion, Director of Emergency Preparedness, Claude Smart, Parish Engineer, Mr. Allen Smith, Legal Counsel, Mr. Gerry Trahan, Director of Facilities Management, and Mr. Jim Vickers, Director of Planning and Development.

President Derbonne called the meeting to order, and the invocation was pronounced by Mr. Landry which was followed by the Pledge of Allegiance. The roll was called with the result being as outlined above.

President Derbonne advised that no action was needed on applications for liquor and beer permits due to the fact that no applications had been submitted.

Upon motion made by Mr. Andrepont which was duly seconded by Mrs. August and carried unanimously, the minutes of the Regular Meeting of the Police Jury dated February 19, 2002, were approved, and the reading of same was dispensed with.

State Senator Willie Mount and State Representatives Dan Morrish and Vic Stelly appeared before the Police Jury at this time to present the following 2001-2002 Rural Development Grant Awards: Ward Four Fire Protection District No. Three - $10,000 for fire equipment; Ward Six Fire Protection District No. One - $10,000 for storage compartments/pumper trucks; Waterworks District No. One of Ward One - $20,000 for water system improvements; and Waterworks District No. Five of Wards Three and Eight - $10,000 for water system improvements.

Accepting the awards on behalf of the districts were Mr. Lester Goss of Ward Four Fire Protection District No. Three, Mr. Haskell Nixon of Waterworks District No. One of Ward One, Mr. Jimmy Pearson and Mr. Tim Gilland of Ward Six Fire Protection District No. One.

Mr. Randy Fuerst appeared before the Police Jury with reference to his candidacy for Family Court Judge. He stated that he had practiced law in Calcasieu Parish for the past 21 years and for 27 years in the State of Louisiana, with focus almost exclusively on family court cases for the past 15 years. Mr. Fuerst stated that he had participated in many programs involving administration of family courts and became interested and involved in family court cases because he saw the plight of children who were caught in the middle of divorce.

Mr. Fuerst stated that he had served as Chairman of the Family Court Committee of the Louisiana Bar Association for the past two years, the purpose of which was to seek funding and to create a model for family court in the State. He further stated that the Committee had been successful in its efforts, and he hoped to implement the model in Calcasieu Parish.

Mr. Fuerst outlined the key essentials of his campaign platform and afterward thanked the jurors for their time and consideration of his candidacy.

President Derbonne advised that action was needed on Zoning Case RZ08-010-02 which was a request by Raymond and Bonnie Harris to rezone from C-1 (Light Commercial) to C-2 (General Commercial) to allow horse trailer sales on Highway 397 in Ward Eight, Police Jury District 10. He further advised that the Planning and Zoning Board had met on Tuesday, March 19, 2002, and voted unanimously that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that the use be limited to horse trailers and equine equipment sales only; (3) that proper permits must be obtained within thirty (30) days of zoning approval; (4) that State Fire Marshal approval must be obtained; and (5) that an occupational license must be obtained within thirty (30) days of zoning approval.

Mr. Raymond Harris, the applicant for the rezoning request, appeared before the Police Jury and stated that he would prefer that Stipulation No. Two as listed heretofore be amended to reflect "trailers" instead of "horse trailers". Mr. Vickers stated that he had no objection to this change, and Mr. Smith stated that it was his interpretation that the Planning and Zoning Board had limited the use to the sale of trailers and other equine equipment.

Motion was made by Mr. Manuel, seconded by Mrs. Treme and carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to RZ08-010-02 and to grant the request to rezone with the stipulations outlined by said Board and with Stipulation No. Two being amended to read "that the use be limited to trailer and other equine equipment sales only"; whereupon, the following ordinance was adopted:

AN ORDINANCE amending Chapter 26 - Zoning, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, classifying the area: A request by Raymond and Bonnie Harris to rezone from C-1 (Light Commercial) to C-2 (General Commercial) to allow trailer and other equine equipment sales on the property described as: Lot 1 Highland Heights Pt. A Lot 1 imp/92 CI Hayes Western Store on Lot 1.

BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 21st day of March, 2002, that Chapter 26 - Zoning, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, and the Comprehensive Zoning Map for Calcasieu Parish, Louisiana, be and they are hereby amended insofar as said ordinance and map pertain to the following property in Ward Eight of this parish:

President Derbonne advised that action was needed on Zoning Case RZ03-009-02 which was a request by Richard Dignam to amend Ordinance No. 3724 to provide for a change in Stipulation No. Four to allow a manufactured home on West Gauthier Road in Ward Three, Police Jury District 9. He further advised that the Planning and Zoning Board had met on Tuesday, March 19, 2002, and voted 6 (against) to 4 (for) to recommend that the request be denied, and further, that the manufactured home be removed from the property within sixty (60) days from the zoning hearing and that Ordinance No. 3724 be rescinded to revert zoning to R-1 (Single Family Residential) since the property was never developed for a horticultural nursery.

President Derbonne also advised that should the Police Jury grant the request, the Board recommended the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that the manufactured home be for the son only, not to exceed two years, and should the son move out prior to the two-year term limit, the manufactured home must be moved off the property immediately; and (3) that proper permits must be obtained within five (5) days of zoning approval.

(It was noted that on November 15, 1995, the Police Jury granted the petitioner's request to rezone from R-1 (Single Family Residential) to A-1 (Agricultural) to allow a horticultural nursery with the following stipulations: (1) that a hedge line must be provided along the east and west property lines; (2) landscaping must be planted along the north property line, excluding driveway entrance; (3) all equipment must be stored within the confines of the building; and (4) zoning use shall be restricted to a horticultural nursery and no mobile homes.)

Motion was made by Dr. Mackey, seconded by Mr. Landry and carried unanimously that the recommendation of the Planning and Zoning Board be upheld with reference to Zoning Case RZ03-009-02 and that the request be denied, that the manufactured home be moved off the property within sixty (60) days from the zoning hearing, and that Ordinance No. 3724 be rescinded since the property was never developed for a horticultural nursery; whereupon, the following ordinance was adopted:

ORDINANCE NO. 4358

AN ORDINANCE repealing Ordinance No. 3724, adopted by the Police Jury onNovember 15, 1995, which rezoned the following property in Ward Three, and owned by Richard Dignam, in Zoning Case RZ03-057-95 from R-1 (Single Family Residential) to A-1 (Agricultural): Com 1600 feet W of the NE cor of the NW/4 of S3, T11S, R9W; thence S 1320 feet more or less; Thence W 400 feet; thence N 1320 feet; Thence E 400 feet to the POC.

BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 21st day of March, 2002, that Ordinance No. 3724, adopted by the Police Jury on November 16, 1995, is hereby repealed and declared to be null and void and of no effect.

BE IT FURTHER ORDAINED that the following described property is hereby classified as R-1 (Single Family Residential):Com 1600 feet W of the NE cor of the NW/4 of S3, T11S, R9W; thence S 1320 feet more or less; Thence W 400 feet; thence N 1320 feet; Thence E 400 feet to the POC.

BE IT FURTHER ORDAINED that Chapter 26 - Zoning, of the Code of Ordinances, and the Comprehensive Zoning Map for Calcasieu Parish, Louisiana, are hereby amended to reflect the R-1 (Single Family Residential) zoning classification referred to above.

BE IT FURTHER ORDAINED that this ordinance shall become effective immediately upon its adoption.

BE IT FURTHER ORDAINED that any ordinance or parts of any ordinance in conflict herewith are hereby repealed.

President Derbonne advised that action was needed on Zoning Case RZ03-013-02 which was a request by Charles H. Precht, Jr. to rezone from R-1 (Single Family Residential) to C-2 (General Commercial) to allow commercial development (Dollar General Store) on Highway 14 in Ward Three, Police Jury District 10. He further advised that the Planning and Zoning Board had met on Tuesday, March 19, 2002, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that all parking and drives be hardsurfaced (asphalt or concrete); (3) that the use be limited to a retail store only; (4) that proper permits must be obtained; (5) that an occupational license must be obtained from the Division of Planning and Development; and (6) that the dumpster(s) be placed in a six (6) foot fenced in containment area.

Motion was made by Mr. Clement, seconded by Mrs. August and carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to Zoning Case RZ03-013-02 and to grant the request to rezone with the stipulations outlined by said Board; whereupon, the following ordinance was adopted:

President Derbonne advised that action was needed on Zoning Case RZ04-011-02 which was a request by RD Leasing Company, Inc. to rezone from A-1 (Agricultural) to C-2 (General Commercial) to allow retail establishment (Family Dollar Store) on Highway 27 in Ward Four, Police Jury District 12. He further advised that the Planning and Zoning Board had met on Tuesday, March 19, 2002, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the use is limited to a "Family Dollar Store" only on the north 130', however, the south 250' is limited to retail establishments only unless otherwise approved by the Director of Planning and Development; (2) that the development adhere to the site plan on file with the Division of Planning and Development; and (3) that all drives and parking be hardsurfaced (concrete or asphalt).

It was moved by Dr. Mackey, seconded by Mr. Clement and carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to Zoning Case RZ04-011-02 and to grant the request to rezone with the stipulations outlined by said Board; whereupon, the following ordinance was adopted:

Upon motion made by Mr. Manuel, which was duly seconded by Mrs. Griffin and carried unanimously, the following ordinance was adopted:

ORDINANCE NO. 4357

AN ORDINANCE amending Chapter 6 - Buildings, and Chapter 26 - Zoning, of the Code of Ordinances of the Parish of Calcasieu, Louisiana.

BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 21st day of March, 2002, that it does hereby amend Chapter 6 - Buildings, and Chapter 26 - Zoning, of the Code of Ordinances of Calcasieu Parish, Louisiana, as follows:

SECTION I. Chapter 6, Article IV, Sec. 6-93. Location of off-premises signs (c) is amended in its entirety to read as follows:

The Planning and Zoning Board may permit zoning exceptions for off-premise outdoor advertising signs in R-1 (Single Family Residential), R-2 (Mixed Residential), R-M (Multi-Family Residential) and R-MHP (Manufactured Home Park) for churches, schools, low intensive recreational uses, museums and other similar type uses permitted in the aforementioned zones. Off-premise signs for these type uses shall not exceed thirty-two (32) square feet in size.

SECTION II. Chapter 6, Article IV, Sec. 6-93. Location of off-premises signs (c) is hereby renumbered as Chapter 6, Article IV, Sec. 6-93. Location of off-premises signs (d).

SECTION III. Chapter 26 - Zoning, is amended by changing the word "site" to read "premise" throughout the entire chapter.

SECTION IV. Chapter 26, Article IV, Sec. 26-28. Minimum requirements, Chart A, Schedule of Zoning District Regulations, Zoning District: A-1 (AGRICULTURAL), Permitted Uses is amended in its entirety to read as follows:

Permitted Uses -Animal hospitals; boat houses and docks; cemeteries; churches; clubs; coastal zone sites; community homes; duplexes; farms and farm-related buildings; gardens; helistops; home occupations; kennels; low-intensive recreational facilities; modular homes; nurseries (horticultural); oil and gas exploration; oil and gas pump transfer stations; ponds; private airstrips; private schools (excluding trade and business); public uses; the sale of products grown on premises; single-family detached dwellings; single unit manufactured homes; stables; temporary building used in connection with construction for a period of six (6) months; and wildlife reservations.

SECTION V. Chapter 26, Article IV, Sec. 26-28. Minimum requirements, Chart A, Schedule of Zoning District Regulations, Zoning District: A-1 (AGRICULTURAL), Permitted as Exceptions by Planning and Zoning Board is amended in its entirety to read as follows:

Permitted as Exceptions by Planning and Zoning Board -Airports; bed and breakfast establishments; borrowpits; communication towers; fourplexes; institutions; off-premise signs; outdoor shooting ranges; railroads; solid waste sites, excluding sanitary landfills; tri-plexes; and uses permitted in a C-1 (Light Commercial) zoning district.

SECTION VI. Chapter 26, Article VI, Sec. 26-28. Minimum requirements, Zoning District: C-2 (GENERAL COMMERCIAL), Permitted Uses is amended in its entirety to read as follows:

Permitted Uses -Same as C-1, plus, auditoriums and convention centers; auto/truck sales, service, and rental; boat sales and service (wholesale and retail); business schools; car washes; community-based recycling facilities; farm equipment sales, service, and rental; farmers market; gasoline stations; hotels and motels; institutions; intensive recreational facilities; janitorial service; (wholesale and retail); laundries and linen services; light manufacturing; lounges, mini warehouses; neighborhood shopping; offices; retail and wholesale uses; off-premise signs; parking garages and lots; passenger terminals; ponds; printing and engraving; radio and television studios; recreational vehicle and/or manufactured home sale, service, and rental; residential appliance sales and service; retail manufacturing; restaurants (alcoholic beverages consumed on premises); theaters; and truck stops.

SECTION VII. Chapter 26, Article VI, Sec. 26-34. Fees (c) is amended in its entirety to read as follows:

Each application to petition for zoning exception or rezoning for off-premise signs that are 32 square feet or less shall be accompanied by a fee of twenty-five dollars ($25.00).

SECTION VIII. Chapter 26, Article VI, Sec. 26-34. Fees (c), (d), and (e) are renumbered as Chapter 26, Article VI, Sec. 26-34. Fees (d), (e), and (f).

BE IT FURTHER ORDAINED that this ordinance shall become effective immediately upon adoption.

BE IT FURTHER ORDAINED that any ordinance or parts of any ordinance in conflict herewith are hereby repealed.

BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

Upon motion made by Dr. Mackey, which was duly seconded by Mrs. Griffin and carried unanimously, the following resolutions were adopted:

RESOLUTION

WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Mr. Arnold Natali to clear, grub, excavate, and grade a 20.7 acre tract, of 7.8 acres of bottomland hardwood wetlands will be directly impacted. Approximately 9,680 cubic yards of on-site dredge earthen material in addition to 38,720 yards of hauled-in earthen material and aggregate fill will be deposited on-site to prepare surface conditions to facilitate the construction of a residential subdivision. Said project is located in Lake Charles, Louisiana, in Calcasieu Parish, Section 13, Township 10 South, Range 9 West; and

WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Mr. Arnold Natali relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and

Motion was made by Mrs. Griffin, seconded by Mrs. Treme and carried unanimously to adopt a resolution approving a format of a Hold Harmless Agreement between the Police Jury and the Lorrain Bridge Association with reference to the association holding multiple fundraisers at Lorrain Park, and further, authorizing the President of the Police Jury, or his designee when appropriate, to execute a Hold Harmless Agreement for each event and all documents related thereto.

Mrs. Lisa Broussard Louviere, 6601 Ursan Drive, Sulphur, appeared before the Police Jury and advised that there were some minor amendments to the draft of the Hold Harmless Agreement insofar as the time of the events, etc. She further advised that the first fundraiser was scheduled for April 27, 2002, and/or April 28, 2002, depending on the weather, and that she mainly was in attendance to answer any questions the jurors might have.

Mr. McMillin invited the jurors and their families to participate in the fundraisers at Lorrain Park and said that it was a tremendous effort and good opportunity to raise money for Lorrain Bridge.

A vote was then taken on the motion on the floor, and said motion carried unanimously; whereupon, the following resolution was adopted:

With reference to the foregoing resolution, Mr. Moon complimented Mr. Smart on the excellent job he had done in getting the grant for the sidewalk projects which would result in an additional 3900' of sidewalks to increase safety for the children in this particular area. It was moved by Dr. Mackey, seconded by Mr. Manuel and carried unanimously to authorize the Parish Administrator to advertise for bids for Calcasieu Parish Project No. 2002-04 (Ward Two - Ward Line Road, Ward Three - Weaver Road, Elliot Road, West Cal-Cam Line Road, and Greathouse Road).

Motion was made by Mrs. August, seconded by Dr. Mackey and carried unanimously that in accordance with the request of the Office of Community Services (OCS), the OCS's newly-revised Affirmative Action and Diversity Plan for Fiscal Year 2002-2004 be approved, and further, that the recommendation of the OCS Administering Board be approved with reference to appointing Mrs. Theresa Richard to serve on the newly-restructured Board of Directors of the Acadiana Legal Services Corporation to fill OCS's designated seat on said Board.

WHEREAS, barriers that diminish the rights and limit the options of any citizen will ultimately diminish the rights and limit the options of all.

WHEREAS, Louisiana's retired teachers have rendered valuable service in diverse leadership roles in their communities and institutions throughout their careers and continue to render such services as retirees; and

WHEREAS, Louisiana's retired teachers represent the profession, which is given the basic responsibility for launching the careers of state and national leaders, and for laying the foundation for the welfare of all members of our society; and

WHEREAS, Louisiana's retired teachers have toiled ceaselessly to improve the quality of life in the state and nation, too often in less than adequate circumstances and for less than adequate pay; and

WHEREAS, Louisiana's retired teachers represent a tremendous pool of experience and training which remains dedicated to the betterment of society everywhere; and

WHEREAS, Louisiana's retired teachers represent a loyal, patriotic, and concerned citizenry which provides dedicated and dependable support to the leaders in our communities, state, and nation.

NOW, THEREFORE, I, Enos Derbonne, President of the Calcasieu Parish Police Jury, do hereby proclaim March 21, 2002, as

Retired Teachers Day

in Calcasieu Parish, Louisiana, and urge all citizens to join with the Police Jury in honoring Louisiana's retired teachers and their contributions to the betterment of our society.

It was moved by Mrs. August, seconded by Mr. Andrepont and carried unanimously to go into executive session to discuss Lawsuit No. 2000-005275 (Ferguson vs. Police Jury). Following the executive session, the Police Jury reconvened in regular session and motion was made by Mrs. August, seconded by Mr. Andrepont and carried unanimously to approve the report given by legal counsel during the executive session.

There being no further business, motion was made by Mr. Moon, seconded by Mr. Danahay and carried unanimously that the meeting be adjourned.
