The Police Jury of Calcasieu Parish, Louisiana, met in regular session at 5:30 p.m. on Thursday, January 3, 2002, in Courtroom A of the Calcasieu Parish Courthouse, 1000 Ryan Street, Lake Charles, Louisiana, with The Honorable Elizabeth Conway Griffin, President, presiding, and the following members present:

Mesdames Luvertha August and Sandra J. Treme; and Messrs. Francis Andrepont, Algie Breaux, Brent Clement, Calvin Collins, Mike Danahay, Enos Derbonne, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, and Cornelius "Cornie" Moon

Also present were Mr. S. President Griffin called the meeting to order, and the invocation was pronounced by Mr. Collins which was followed by the Pledge of Allegiance led by Mr. Collins. The roll was called with the result being as outlined above.

2001 - The Year In Review

 

I would like to take a few minutes before the installation of the new President and Vice-President of the jury to comment on the year just past, highlighting some of our accomplishments over the past twelve months.

At the halfway mark of this Police Jury's term, it is clear when looking back that we have achieved a great deal. This is possible only with the cooperation of the members of this body. I thank all of you for your support during my term as President.

To highlight some accomplishments in 2001, I will begin by mentioning:

•Our Road and Drainage Trust Fund, which completed its eighth year, and has produced $34.2 million of capital improvements throughout our parish using only $8.5 million of Police Jury funds - a great return on investment. This program, developed with no new taxes, is the only one of its kind in Louisiana.

It is evident that in 2001 the Police Jury made great strides in enhancing services to the citizens of Calcasieu Parish, especially in the area of facility expansions and improvements. Serving in this office has made me realize even more the vast array of services the Police Jury provides, both outside and within municipalities.

I give thanks to each of my colleagues and our staff for completing a successful year. Serving as your President has been a pleasure and a privilege. I thank you for the confidence that you placed in me, and I sincerely hope that I have fulfilled this role in a manner that brings honor to this public body.

President Griffin then opened the floor for nominations for President of the Police Jury for the ensuing year. Mr. Kleckley nominated Mr. Derbonne and stated that he had been a successful businessman in the Parish for many years, was a man of great character, intellect and wisdom, and could provide the kind of leadership for the many challenges the Police Jury would face in the year 2002. The nomination was seconded by Mr. Andrepont, and Mr. Derbonne was elected by acclamation.

Newly-elected President Derbonne assumed the chair and opened the floor for nominations for Vice-President of the Police Jury for the ensuing year. Mr. Clement nominated Mr. McMillin, the nomination was seconded by Mr. Manuel, and Mr. McMillin was elected by acclamation.

President Derbonne thanked his colleagues for their confidence in voting for him. He then presented an engraved plaque to outgoing-President Griffin and thanked her, on behalf of the entire Jury, for her leadership during the past year. President Derbonne pointed out that Mrs. Griffin was the first African-American woman to be elected as President of the Police Jury. He stated that the past year had been a difficult one for the entire nation, which had also affected the Parish, but that a lot had been accomplished during Mrs. Griffin's leadership.

Mrs. Griffin thanked President Derbonne for his kind words and then presented an engraved plaque to outgoing Vice-President Moon. She expressed her appreciation for those times during which Mr. Moon had stepped in and represented the Police Jury when she had been unavailable, as well as her appreciation for his kind and encouraging assistance throughout the year. Mr. Moon thanked her for her remarks and stated that it had been a pleasure to serve as Vice-President.

A brief report was given at this time by Mr. Calvin Collins, District 2, with reference to the following ongoing activities within his district and his liaison affiliations: installation of water lines in Waterworks District No. Five of Ward Three to serve approximately 2,041 customers, improvements at Mallard Junction Park, ten new volunteers with Ward Eight Fire Protection District No. Two which responded to 300 emergencies in the year 2001, pending completion of LeBleu Elementary School on July 1, 2002, a flood control system for Antoine Gully to provide flood protection for residences and commercial establishments, the handling of 1200 Animal Control requests in 2001, the completion of a new pavilion at White Oak Park, consideration of building a new school for Combre Elementary and new gym at Roy D. Molo Middle School, construction of a new Wal-Mart Supercenter, and consideration of grants for people to repair and rebuild their homes.

Mr. Collins thanked his fellow jurors and staff and said that being a juror was not about one's district but what they had been elected for as God's servants - to serve the people.

Motion was made by Mr. Manuel, seconded by Mrs. August and carried unanimously that payment of all current invoices be approved.

It was moved by Mrs. August, seconded by Mr. Andrepont and carried unanimously to approve the minutes of the Regular Meeting of the Police Jury dated December 6, 2001, and the reading of same was dispensed with.

President Derbonne advised that action was needed on SV03-012-01 which was a request by John and Myrna Babineaux for a subdivision variance to allow residential development without public road frontage on Arsene LeBleu Road in Ward Three, Police Jury District 9. He further advised that the Planning and Zoning Board had met on Tuesday, December 18, 2001, and recommended that its action on this request be considered at the Police Jury's Regular Meeting on this date. President Derbonne also advised that the Planning and Zoning Board voted unanimously to recommend that the request be denied but should the Police Jury grant the request, the Board recommended the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that a maintenance agreement be filed with the Clerk of Court's Office; (3) that multi-address sign must be posted at the intersection of Arsene LeBleu Road and Babineaux Lane within thirty (30) days of approval.

President Derbonne asked if there was anyone present in the audience to discuss this matter and hearing no comments, motion was made by Mr. Manuel, seconded by Dr. Mackey and carried unanimously that the recommendation of the Planning and Zoning Board be upheld with respect to SV03-012-01 and that the request for a subdivision variance be denied.

Upon motion made by Mrs. Griffin, which was duly seconded by Mr. McMillin and carried unanimously, the Director of Planning and Development was authorized to notify the following property owners in accordance with Article II of Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to show cause at a public hearing on February 20, 2002, or the first regular Police Jury meeting thereafter, as to why the structures on the properties as stipulated should not be condemned:

It was moved by Mrs. Griffin, seconded by Mrs. August and carried unanimously to approve the request of the Office of Community Services and to authorize the Parish Purchasing Agent to issue a request for proposals for the procurement of a Transit Demand Responsive Scheduling and Reporting software which had the mapping capability to efficiently dispatch, record, file, track and bill the multiple funding sources for services provided either under specialized contracts or federally funded initiatives.

It was also moved by Mrs. Griffin, seconded by Mrs. August and carried unanimously to adopt the following resolutions in accordance with the request of the Office of Community Services:

RESOLUTION

WHEREAS, the Secretary of Transportation and Development is authorized to make grants for mass transportation projects;

WHEREAS, it is required by the Louisiana Department of Transportation and Development in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and

WHEREAS, it is the goal of the Applicant that minority business enterprise be utilized to the fullest extent possible in connection with this project, and that definitive procedures shall be established and administered to ensure that minority businesses shall have the maximum feasible opportunity to compete for contracts when procuring construction contracts, supplies, equipment or consultant and other services.

NOW, THEREFORE,

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 3rd day of January, 2002, that it does hereby approve the submittal of this resolution authorizing the filing of an application with the Louisiana Department of Transportation and Development for a grant under 49 CFR 5311, Non-Urbanized Area Formula Program and/or 49 CFR 5309, Discretionary Capital Program.

BE IT FURTHER RESOLVED that the President, or his designee, is authorized to execute and file an application on behalf of the Calcasieu Parish Police Jury Public Transit System with the Louisiana Department of Transportation and Development to aid in the financing of operating and/or capital assistance projects pursuant to the Rural Public Transit Program, 49 CFR 5311 and/or the Discretionary Capital Program, 49 CFR 5309.

BE IT FURTHER RESOLVED that the President, or his designee, is authorized to execute and file with such applications an assurance or any other document required by the Louisiana Department of Transportation and Development effectuating the purposes of Title VI of the Civil Rights Act of 1964, as amended.

BE IT FURTHER RESOLVED that the President, or his designee, is authorized to furnish such additional information as the Louisiana Department of Transportation and Development may require in connection with the application or the project;

BE IT FURTHER RESOLVED that the President, or his designee, is authorized to set forth and execute affirmative minority business policies in connection with the project's procurement needs.

BE IT FURTHER RESOLVED that the President, or his designee, is authorized to execute grant contract agreements on behalf of Calcasieu Parish Police Jury Public Transit System with the Louisiana Department of Transportation and Development for aid in the financing of the operating or capital assistance projects.

BE IT FURTHER, AND FINALLY RESOLVED that this resolution is applicable for a period of one year unless revoked by the governing body and copy of such revocation shall be furnished to the DOTD.

RESOLUTION

WHEREAS, the Calcasieu Parish Police Jury Public Transit System, hereinafter referred to as the "Applicant", has requested assistance from the Louisiana Department of Transportation and Development for the purpose of capital assistance; and

WHEREAS, this project is considered to be important and necessary to public transportation in Lake Charles, Louisiana and the Parish of Calcasieu; and

WHEREAS, the Applicant has the legal, fiscal, and managerial capacity to carry out the project.


NOW, THEREFORE,


BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 3rd day of January, 2002, that it does hereby approve the submittal of this resolution authorizing the filing of an application with the Louisiana Department of Transportation and Development for 5310 Elderly Grants Program for Elderly and Disabled Persons With Disabilities.


BE IT FURTHER RESOLVED that the Applicant requests funding for the project from the Louisiana Department of Transportation and Development.


BE IT FURTHER RESOLVED that the Applicant, while making application to or receiving grants from the Federal Transit Administration, will comply with the Federal Statutes, regulations, executive orders and administrative requirements as listed in Appendix 1 (copied from UMTA Circular 9100.1B) of the 2002 Application Procedures Manual.


BE IT FURTHER RESOLVED that the Applicant has or will make available the required non-federal funds to meet local share requirements.

BE IT FURTHER RESOLVED that the President of the Police Jury, or his designee, is empowered to sign a contract on behalf of the Applicant.

BE IT FURTHER RESOLVED that the above named official or designee may sign on behalf of the Applicant any assurance, certification, or other documentation that may be required as a part of the application submitted.

BE IT FURTHER, AND FINALLY RESOLVED that this resolution is applicable for a period of one year unless revoked by the Calcasieu Parish Police Jury and copy of such revocation shall be furnished to the Louisiana Department of Transportation and Development.

RESOLUTION

WHEREAS, it is required by the Louisiana Department of Transportation and Development in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and

WHEREAS, it is the goal of the Applicant that minority business enterprise be utilized to the fullest extent possible in connection with the project, and that definitive procedures shall be established and administered to ensure that minority businesses shall have the maximum feasible opportunity to compete for contracts when procuring construction contracts, supplies, equipment, or consultant and other services.

NOW, THEREFORE,

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 3rd day of January, 2002, that it does hereby approve the submittal of this resolution authorizing the filing of an application with the Louisiana Department of Transportation and Development for the Transit Job Access and Reverse Commute Program Section 3037 Transportation Equity Act for the 21st Century (TEA-21).

BE IT FURTHER RESOLVED that the President of the Police Jury, or his designee, is authorized to execute and file an application on behalf of Calcasieu Parish Public Transit System with the Louisiana Department of Transportation and Development, to aid in the financing of operating and or capital assistance projects pursuant to the Job Access and Reverse Commute Program Section 3037 of TEA-21 Grant Program.

BE IT FURTHER RESOLVED that the President of the Police Jury, or his designee, is authorized to execute and file with such applications an assurance or any other document required by the Louisiana Department of Transportation and Development effectuating the purposes of Title VI of the Civil Rights Act of 1964.

BE IT FURTHER RESOLVED that the Executive Director of the Calcasieu Parish Office of Community Services is authorized to execute and furnish such additional information as the Louisiana Department of Transportation and Development may require in connection with the application or the project.

BE IT FURTHER RESOLVED that the Executive Director of the Calcasieu Parish Office of Community Services is authorized to develop for consideration by the Police Jury affirmative minority business policies in connection with the project's procurement needs.

BE IT FURTHER RESOLVED that the President of the Police Jury, or his designee, is authorized to execute grant contract agreements on behalf of Calcasieu Parish Police Jury Public Transit System with the Louisiana Department of Transportation and Development for aid in the financing of the operating or capital assistance projects.

BE IT FURTHER, AND FINALLY RESOLVED that this resolution is applicable for a period of one year unless revoked by the governing body and copy of such revocation shall be furnished to the DOTD.

Upon motion made by Mr. Clement, which was duly seconded by Mrs. Griffin and carried unanimously, the following resolution was adopted:

RESOLUTION

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 3rd day of January, 2002, that it does hereby approve an interim lease on a month-to-month basis for office space for the Parish Title I WIA Program staff at 1028 Enterprise Boulevard, with Calderera Properties, Inc., in conjunction with the State Department of Labor Offices as part of the One-Stop Service Operation.

BE IT FURTHER RESOLVED that the President of the Police Jury, or his designee, when appropriate, is authorized to execute all documents related thereto.

 Motion was made by Mr. Clement, seconded by Mr. McMillin and carried unanimously, that the President of the Police Jury be authorized to execute the necessary documents for acquisition of right-of-way from Margaret Helen Vincent Perry and Lewis Roy Vincent and Perry Vaughn Strickland and Marsha Katherine Strickland on Walker Road in Ward Four.

It was moved by Mr. Clement, seconded by Mrs. Griffin and carried unanimously to authorize the President of the Police Jury to execute the necessary documents for acquisition of a Temporary Construction Servitude Agreement from Margaret Helen Vincent Perry and Lewis Roy Vincent on Walker Road in Ward Four.

Upon motion made by Mr. Clement, which was duly seconded by Mrs. August and carried unanimously, the Parish Purchasing Agent was authorized to advertise for bids for the purchase of the following vehicles and equipment for use by the Division of Engineering and Public Works: (1) two 2002 hydraulic excavators with telescopic booms for use by the Road Division; (2) one (1) 2002 regular cab, dual rear wheel pickup truck with installed herbicide spray system for use by the Vegetation Department; (3) one (1) 2002 one-half ton extended cab pickup truck for use by the Road Division; (4) one (1) 2002 one-half ton extended cab pickup truck for use by the Parks Department; and (5) one (1) 2002, one-half ton extended cab pickup truck for use by the Inspection Department.

Mrs. Griffin asked how many vehicles were purchased by the Parish per year, to which Mr. Smart responded that he could find out that information and get back with her. He asked if she was referring to vehicles for use by the Public Works Department or the whole Parish, to which Mrs. Griffin stated that it seemed to her that a vehicle was purchased at every meeting of the Police Jury, but that she was primarily interested in the Public Works Department.

Mr. Landry stated that he received a lot of remarks about some of the Parish vehicles, and he had even seen some four-wheel drive vehicles belonging to the Parish. He further stated that he felt sure the staff made certain that in each case the vehicle fit the job that was to be done with it.

Mr. Smart advised that in the past the foremen decided what kind of equipment was needed but in the last few years, the Parish had a fleet manager who was in charge of drawing up applicable specifications, and that a lot of the "niceties" that had been put in over the years had been removed.

Upon motion made by Mrs. Griffin, which was duly seconded by Mr. Collins and carried unanimously, Calcasieu Parish Project No. 2001-05 [South Thompson Road Bridge (Structure No. 80506012), South Thompson Road Bridge (Structure No. P1030132930071) and Fruge Road Bridge (Structure No. P1030040930281) was accepted as substantially complete.

Motion was made by Mr. Clement, seconded by Mrs. Griffin and carried unanimously that Mr. S. Mark McMurry be reappointed as ex-officio Parish Treasurer in accordance with LSA--R.S. 33:1651.

It was moved by Mrs. Treme, seconded by Mr. Andrepont and carried unanimously to defer action for thirty days on the expiration of the term of Mr. Jerry Wise as a member of the Board of Control of the Calcasieu Parish Public Library System.

With reference to the foregoing, Mr. Andrepont explained that Mrs. Treme, as liaison to the Library Board, had agreed to replace Mr. Wise with a representative of Sulphur, Ms. Llabetta Young, but it was his understanding that Mr. Wise wished to continue to serve on the Board until such time as the process of selecting a new director for the library system was completed.

Mrs. Griffin stated that it was her desire that one of the four Police Jury representatives on the Library Board be a minority. She pointed out that only one of the nine total members was black and that since a lot of the problems faced by the board were racial issues, she felt that at least one of the Police Jury's four appointments should be a minority.

Mrs. Treme stated that the appointment under consideration was normally a representative of the area west of the Calcasieu River, and Mrs. Griffin stated that she was referring to any future vacancies on the board.

Mr. Andrepont stated that he appreciated Mrs. Griffin's comments, but the reason he had asked for a representative of Sulphur to be placed on the Board was because Ward Four was a heavy contributor to the library system, yet there was no appointment from Ward Four, and since Sulphur had the majority of the population in Ward Four, he felt a representative should come from west Calcasieu.

Mrs. Griffin stated that she was not talking about the current appointment, she was talking about the Police Jury having four appointments on the board and not one of them was black.

The hour being 6:00 p.m., President Derbonne advised that a public hearing would be held, as advertised in accordance with law, to receive public comment and input on the Calcasieu Parish Police Jury's revised plan for reapportionment of Police Jury Districts for submittal to the U. S. Department of Justice.

Mr. McMurry pointed out that at the regular meeting on December 20, 2001, the Police Jury had preliminarily approved a revised reapportionment plan, as well as a time line of events which called for a public comment period from December 21, 2001, to the current date. He advised that advertisements were run in the Lake Charles American Press asking for public comments relative to the revised plan, and none had been received.

Mr. McMurry further advised that it would be appropriate to open the floor for any public comments on this date and then to take action on the plan so that the staff could follow through with submitting it to the Department of Justice and various State offices.

President Derbonne asked if there was anyone present in the audience to offer any comments regarding the reapportionment plan, and no comments were received.

Mr. Kleckley stated that he would stand by the comments he made at the regular meeting on December 20, 2001, but he saw no need to vote against the revised plan at this time since doing so would serve no purpose at all, and he felt it needed to move forward.

Mrs. Griffin stated that she appreciated Mr. Kleckley's statement and also appreciated the full Police Jury for understanding the importance of what the black jurors had done. She further stated that she would like to thank everyone for seeing that this had come to pass.

Motion was made by Mrs. Griffin, seconded by Mr. Andrepont and carried unanimously that the revised reapportionment plan be approved and submitted to the U. S. Department of Justice; whereupon, the following ordinance was adopted:

ORDINANCE NO. 4331

AN ORDINANCE creating a revised 15-member district plan for reapportionment of the Calcasieu Parish Police Jury and providing for the division of certain precincts into two or more precincts by a visible feature for the purpose of creation of said reapportionment plan in accordance with Louisiana Revised Statute 18:532.1.

WHEREAS, on September 6, 2001, the Calcasieu Parish Police Jury declared the need for a new apportionment plan due to the fact that the 2000 decennial census indicated a number of population shifts within the Parish which caused substantial variation in representation of the current Police Juror Single Member Districts; and

WHEREAS, on October 18, 2001, the proposed reapportionment plan was formally presented to the Calcasieu Parish Police Jury, and the Police Jury approved a schedule for a public comment period, public hearings, and adoption of the plan; and

WHEREAS, in accordance with its responsibility as the governing authority of Calcasieu Parish, Louisiana, the Police Jury held an open session for public comment and input on the proposed plan and process on November 6, 2001, after two public notices were published in the official journal; and

WHEREAS, a public hearing was held at the regular meeting of the Police Jury on November 15, 2001, for consideration of comments received during the comment period, to receive additional public input, and for consideration of final approval of the reapportionment plan; and

WHEREAS, two public notices were published in the official journal giving notice of the aforementioned public hearing date and time; and

WHEREAS, at the public hearing on November 15, 2001, comments were entered by both the public and the police jurors; however, no additional proposals were submitted for consideration by the Police Jury, and the proposed plan was officially adopted by the Police Jury; and


WHEREAS, at its regular meeting on December 6, 2001, Mr. Cedric Floyd of Data Center in Kenner, Louisiana, appeared before the Police Jury regarding an alternative reapportionment plan he was proposing in lieu of the plan approved by the Police Jury on November 15, 2001, and action on the alternative to the reapportionment plan as presented by Mr. Floyd was deferred by the Police Jury until its next regular meeting on December 20, 2001; and


WHEREAS, on December 20, 2001, the Police Jury took official action to preliminarily approve a revised reapportionment plan, as well as a schedule for a public comment period, public hearing, and adoption of the plan; and

WHEREAS, public notice was appropriately given in the official journal of the Parish relative to the public comment period and the public hearing referenced in the foregoing paragraph and relative to the availability of the revised reapportionment plan for public inspection; and

WHEREAS, during the comment period and at the public hearing on January 3, 2002, no comments were received from the public, no additional proposals were submitted for consideration by the Police Jury, and the revised reapportionment plan was officially adopted by the Police Jury.


NOW, THEREFORE,


BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 3rd day of January, 2002, that:


SECTION 1. Ordinance No. 4324 which was originally adopted by the Police Jury on November 15, 2001, and which created a 15-member district plan for reapportionment is hereby repealed in its entirety.


SECTION 2. In accordance with data provided by the Bureau of the Census in the 2000 decennial census, the need for the Calcasieu Parish Police Jury to reapportion its election districts is hereby reconfirmed.


SECTION 3. There is hereby created a 15-member district plan for reapportionment of the Calcasieu Parish Police Jury in accordance with the 2000 decennial census to provide for Single Member Police Juror Districts consisting of precincts shown on Exhibit "1-A" which is attached hereto and hereby made a part of this ordinance.

SECTION 3. In accordance with Louisiana Revised Statute 18:532.1, the following precincts are hereby divided by the Census Tracts and Census Blocks so reflected and the legal descriptions so depicted, and shall bear the precinct numbers stipulated, for the purpose of effective reapportionment:

THENCE northerly along the centerline of Leger Road to its intersection with the centerline of the Missouri Pacific Railroad,

THENCE west along the centerline of the Missouri Pacific Railroad to its intersection with the centerline of Manchester Road,

THENCE south along the centerline of Manchester Road to its intersection with the centerline of Farm Road,

THENCE west along the centerline of Farm Road to its intersection with the centerline of La. Hwy 397,

THENCE north along the centerline of La. Hwy. 397 to its intersection with the centerline McCown Road, being the point of beginning.

SECTION 4. A map outlining the 15 single-member police juror districts for reapportionment for the Calcasieu Parish Police Jury and all of the precincts in Calcasieu Parish, Louisiana, including the above listed precinct divisions, is hereby attached hereto, made a part hereof, and labeled as "Map 1".

SECTION 5. Any ordinances, or parts thereof, held to be in conflict with this ordinance are hereby repealed.

SECTION 6. This ordinance shall become effective at the end of the term of the incumbent police jurors, in accordance with Louisiana Revised Statute 33:1411.

Motion was made by Mrs. Treme, seconded by Mr. Andrepont and carried unanimously to defer action on expiration of the term of Mr. Chad Thielen as a member of the Board of Control of the Calcasieu Parish Public Library System until such time as notification is received from the City of Lake Charles relative to this expiration, since Mr. Thielen was a representative of the City of Lake Charles.
