The Police Jury of Calcasieu Parish, Louisiana, met in regular session at 5:30 p.m. on Thursday, November 15, 2001, in Courtroom A of the Calcasieu Parish Courthouse, 1000 Ryan Street, with the Honorable Elizabeth Conway Griffin, President, presiding and the following members present:
Mesdames Luvertha August and Sandra Treme; and Messrs. Francis Andrepont, Algie Breaux, Brent Clement, Calvin Collins, Mike Danahay, Enos Derbonne, Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, and Cornelius "Cornie" Moon.

President Griffin called the meeting to order, and the invocation was pronounced by Mr. Finers Cryer, Music Minister at First Baptist Church of Westlake, which was followed by the Pledge of Allegiance led by Mr. McMillin. The roll was called with the result being as outlined above.
Mr. Andrepont, as Chairman of the Budget Committee, asked that the item on the agenda pertaining to approval of the Budget Committee Report dated November 15, 2001, be taken up at this time since it was necessary that he leave the meeting early. He stated that an excellent administrative presentation was given by the staff at the Budget Committee meeting earlier on this date and that the proposed budget for FY 2002 was $122.1 million which was an increase of approximately $14 million over last year's budget. He briefly went over the recommendations made by the Budget Committee, and motion was made by Dr. Mackey, seconded by Mr. Derbonne and carried unanimously that the Budget Committee Report dated November 15, 2001, and all recommendations contained therein, be approved as follows:

It was moved by Mrs. August, seconded by Mr. Andrepont and carried unanimously to approve the minutes of the Regular Meeting of the Police Jury dated October 18, 2001, and the reading of same was dispensed with.
President Griffin advised that a report would be received at this time from Mr. McMillin with reference to ongoing activities within his district (District 14) and his liaison affiliations.
Mr. McMillin expressed his appreciation to the staff and their efforts in assisting him. He reported that in working in conjunction with the Mayor of the City of Westlake and the Louisiana Department of Transportation and Development, a right-hand turn lane had been put in going out of Westlake. Mr. McMillin stated that his number one priority was to someday alleviate the traffic problems associated with trains passing through Westlake and while a grade separation was needed, the turn lane had helped.
Mr. McMillin spoke of improvements which had been made at Holbrook Park, of the purchase of a back-up generator and radios for the fire department, of a new water line, hydrants, and valves for the water district, and of a new sprinkler system and sign for the recreation district. He advised that a $1.4 million activity center was currently being built on Sampson Street and that the Managan Center and James Rigmaiden Center were continually being booked for various social functions.
Mr. McMillin stated that he had been working with Mr. Manuel in the Moss Bluff area to have some of the roads hardsurfaced with what was known as a three-shot application. He further stated that he would like the opportunity to work on a new boat launch west of the Calcasieu River, and he felt a good location for one was under the Interstate 10 Bridge. Mr. McMillin also stated that he would like to see a sewerage district formed which would serve the Westlake area.
President Griffin thanked him for his report.
Upon motion made by Dr. Mackey, which was duly seconded by Mr. Breaux and carried unanimously, the following ordinance was adopted: (It was noted that the Planning and Zoning Board had met on Tuesday, November 13, 2001, and voted unanimously to recommend this amendment to the Parish's Zoning Code.)
ORDINANCE NO. 4322
AN ORDINANCE amending Chapter 26 - Zoning, of the Code of Ordinances of the Parish of Calcasieu, Louisiana.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 15th day of November, 2001, that it does hereby amend Chapter 26 - Zoning, of the Code of Ordinances of Calcasieu Parish, Louisiana.
SECTION I. Article III. Administration, Division 1. Decision Making and Administrative Bodies, Section 26-8. Calcasieu Parish planning and zoning board, is amended by changing (d)(1) to read as follows:
BE IT FURTHER ORDAINED that this ordinance shall become effective immediately upon adoption.
BE IT FURTHER ORDAINED that any ordinance or parts of any ordinance in conflict herewith are hereby repealed.
BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

Motion was made by Mr. Andrepont, seconded by Mr. Manuel and carried unanimously that the following resolutions be adopted:
RESOLUTION
WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and an application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Wallace Nichols to clear, grade and deposit fill to develop a 16-home subdivision and one commercial site with associated drainage improvements and utilities. Approximately 65,000 cubic yards of on-site dredged or graded material will be deposited to construct driveways and building pads. Approximately 42.9 acres of forested wetlands will be filled by the proposed project. Said project is located in Section 25, Township 8 South, Range 9 West, at the northwest corner of North Perkins Ferry Road and Coffey Road, in Moss Bluff, in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Wallace Nichols relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided a development permit is obtained from the Parish Division of Planning and Development prior to commencement of the project.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 15th day of November, 2001, that it does hereby indicate no objection to the proposal of Wallace Nichols to clear, grade and deposit fill to develop a 16-home subdivision and one commercial site with associated drainage improvements and utilities. Approximately 65,000 cubic yards of on-site dredged or graded material will be deposited to construct driveways and building pads. BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on Thursday, November 15, 2001, that it does hereby approve the assignment of interest in an oil, gas, and mineral lease dated September 21, 1999, recorded at Entry No. 2481836 in the records of Calcasieu Parish, Louisiana, between the Calcasieu Parish Police Jury and Mayne & Mertz, Inc., from Aspects Resources LLC (successor in interest from Mayne & Mertz, Inc.) to Marks Oil Inc. on property described as follows:

It was moved by Mrs. Treme, seconded by Mr. Manuel and carried unanimously to approve a temporary easement from Drew Estates for the Edgerly-DeQuincy Road Bridge at a cost of $7,500.00 to be paid by the Parish.
Upon motion made by Mr. Clement, which was duly seconded by Mr. Collins and carried unanimously, the Parish Purchasing Agent was authorized to advertise for bids for one 2002 heavy haul truck with winch package for the Road Division, one 2002 100,000 lb. capacity trailer for the Road Division, two 2002 one ton regular cab pickup trucks for the Special Drainage Division, and three new 20' bumper hitch trailers for the Special Drainage Division, as provided for in the 2001 budget.
President Griffin advised that Calcasieu Parish was found to be in full compliance by the Louisiana Department of Transportation and Development for the 2001 annual review related to the Federal Bridge Replacement Program which will assure Calcasieu Parish's continued participation for the year 2002.
Motion was made by Mr. Breaux, seconded by Mrs. August and carried unanimously to suspend the rules by a two-thirds majority vote to adopt the following resolutions:
RESOLUTION
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 15th day of November, 2001, that it does hereby approve the submittal of an application from the Louisiana Community Development Block Grant Program, in the amount of $750,000 for installation of water lines in Waterworks District No. Fourteen of Ward Five (Starks).
BE IT FURTHER RESOLVED that the President of the Police Jury, or her designee, when appropriate, is authorized to execute all documents related thereto.

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 15th day of November, 2001, that it does hereby approve the submittal of an application from the Louisiana Community Development Block Grant Program, in the amount of $600,000 for the rehabilitation of low-to-moderate income housing in the Mallard Junction area.
BE IT FURTHER RESOLVED that the President of the Police Jury, or her designee, when appropriate, is authorized to execute all documents related thereto.

President Griffin declared a fifteen-minute recess prior to the public hearing scheduled for 6:00 p.m. on this date.
Prior to recessing, Mr. Manuel asked for a point of personal privilege to thank everyone, particularly the Public Works Department and the Office of Emergency Preparedness, for their efforts in the search for Miss Mary Jean Thigpen of Moss Bluff, a five-year old who had recently been abducted and murdered.
The hour being 6:00 p.m., President Griffin advised that a public hearing would be held at this time, as advertised in accordance with the law, to receive public comment and input on the Calcasieu Parish Police Jury's plan for reapportionment of Police Jury districts for submittal to the U. S. Department of Justice, and to take appropriate action thereon.
Mr. Milton Bellard, President of the Lake Charles branch of the NAACP (National Association for the Advancement of Colored People), 2916 General Mitchell Street, Lake Charles, appeared before the Police Jury and expressed his appreciation to the administrative staff for having done a "fabulous job" at putting together the reapportionment plan. Mr. Bellard stated that he did have one concern with District 2 as proposed, in that the voter strength in said district was below 60% voting strength by population; however, he had met with the staff and in going over the active registered voter lists, had determined that it was 53.8%. Mr. Bellard further stated that 56% was what he had wanted, and he thought that when they looked at the voting age over 18 (years of age), that goal or better could be reached.
In answer to a question by Mrs. August, Mr. Bellard explained that the proposed plan was drawn using population figures as well as figures pertaining to active registered voters, and in the proposed District 2 that number had been 53.8% which was better than what he had thought it would be. Mr. Bellard further explained that the regional and national offices of the NAACP had analyzed the plan as to voting strength over 18 in a particular district and while those numbers had not yet been run, normally the number of registered voters was less than voting strength in a district. He also stated that he felt confident that the numbers would be close to 56% or better and if so, they were 100% in favor of the plan. Mr. Bellard stated that he did not think the NAACP would have any problem endorsing the plan, and he thought that it would meet the criteria.
President Griffin then asked if Mr. Bellard was saying that he was in agreement with the plan, to which he responded that he felt confident that the numbers would come out the way he wanted and if so, he would have no problem with the plan.
President Griffin then relinquished the Chair to Vice-President Moon. President Griffin asked that if the proposed plan received no opposition from the jurors, would the Department of Justice not review it nor draw up any other proposals to see if the Parish's plan was indeed the best plan for the people of Calcasieu Parish.
Mr. McMurry stated that he thought the Department of Justice would review the plan, and he thought that the level of scrutiny the department would place on the plans submitted to them would rise if there was voiced opposition to a plan. Mr. McMurry explained that the Department of Justice had limited resources and a limited number of employees to look at all of the many plans submitted by municipalities, counties, legislative districts, etc., from across the country, and that he did not think they would spend an inordinate amount of time reviewing a plan that did not have any local opposition to it. Mr. McMurry explained that he did not think that the Department of Justice would ever not look at it, but he just thought the level of review was more superficial in cases where there was no opposition than in cases where there was.
With reference to Mr. Bellard's comments, Mr. McMurry stated that he did not know how those numbers would turn out as far as voting age. He further stated that they had been impressed with the number of registered voters, but if the numbers did not turn out as they expected them to at this point, there might be some opposition to the plan.
President Griffin stated that many of her constituents had some of the same concerns she had previously explained and that even though she personally thought the staff's proposal was a good plan, she did not want to feel uncomfortable later on in thinking that maybe a better plan could have been developed which would have allowed more minority representation. President Griffin advised that 52% did not really mean that they could acquire or be certain of a minority seat even though there would probably end up being three black seats as there currently was.
President Griffin also stated that she had to make sure she was comfortable with the reapportionment plan and that the people whom she represented remained confident in her. She further stated that she would have to oppose the plan so that the Department of Justice would review it to make sure that they had the number of seats on the Police Jury they should have.
Mr. McMurry stated that he did not think there was any "rubber stamp" that the Department of Justice would place on the plan if it was unanimously approved by the Police Jury. He pointed out that development of the plan had been a long process and that ample opportunity for public comment had been afforded as was needed in something of this nature. Mr. McMurry advised that public hearings had been held for the public to voice their positions on the plan.
President Griffin stated that she had talked with Mrs. August and Mr. Collins, and their positions were all the same. She reiterated her statement that it had nothing to do with the staff proposal; it had to do with reassuring the people that she represented that they (the black jurors) had not fallen short and that every step necessary was taken to make sure the black community was represented. President Griffin stated that with the proposed plan developed by the staff, there would be three minority seats, but it was uncertain whether there would be a fourth, and they were hoping that the Department of Justice would help them develop a plan that would guarantee four black juror seats.
Mr. Bellard stated that because of the law, all plans submitted to the Department of Justice were going to be reviewed. He further stated that only those plans that had a lot of opposition would be scrutinized but that all would be reviewed. Mr. Bellard stated that that was why he had sent the proposed plan to the national office of the NAACP and that they had a team working all across the country looking at the numbers. Mr. Bellard further stated that with 54% registered voters, he was quite sure it would turn out to be more than 56% potential registered voters because normally the minority community had a higher voting age than the non-white community.
President Griffin pointed out that she worked for thousands of people and that she was doing what they wanted her to do which she said was her job. She then reassumed the Chair.
Mrs. August asked the opinion of legal counsel as to whether or not having some opposition on record would result in more scrutiny of the proposed plan, to which Mr. David Vaughn stated that he believed the earlier comments made by Mr. McMurry were correct. He further stated that the Department of Justice was legally obliged to review the plan but that they may give it a little further scrutiny depending on the level of opposition that was raised. Mr. Vaughn advised that he could not tell the jurors what level of scrutiny would occur except that the Department of Justice would read the record, note the nature of the opposition, and base their scrutiny on that. Mr. Vaughn concluded his comments by saying that he thought the Justice Department would look at the proposed plan, one way or the other, and they would approve or disapprove of it based on their own evaluation.
Mrs. August stated she had no problems with the staff and the reapportionment plan they had come up with and that the staff had done an excellent job but that she too had received telephone calls. She further stated that if it was a matter of getting the Department of Justice to verify that the proposed plan was the best plan by her opposing it, she would be willing to do that. Mrs. August stated that she would second President Griffin's motion, if indeed it had been a motion, when she spoke earlier after relinquishing the Chair to Vice-President Moon. Mrs. August pointed out that she was in no way going against the work that the staff had done but that this was an effort to ensure one way or the other that the plan was the best plan so that she could tell her constituents that the Department of Justice had determined it to be the best possible plan.
President Griffin did not acknowledge having made her comments into the form of a motion but did reiterate that she worked for a lot of people and that what she was doing on this date was what they wanted her to do. She further stated that she needed them to know that she had listened to and considered what they had said to her.
Mr. Kleckley pointed out that the jurors had reviewed a lot of numbers during the past month between census figures, population changes, the annual budget, etc. He asked Mr. McMurry to refresh his memory with respect to the percentage of minority population of Calcasieu Parish.
Mr. McMurry advised that according to the 2000 census, the black population was 44,025 which represented 23.9% of the total population. He further advised that three black seats on the Police Jury would equal 20% of the total number of seats, and four seats would equal 26.7%; therefore, the actual percentage of black population was between three and four seats. Mr. McMurry pointed out that there of course could not be 3 ½ black jurors, and the staff felt that the crafting of four districts with a minority majority was what the Department of Justice would have them do and would comply with the spirit of what they would have wanted.
Motion was made by Dr. Mackey and seconded by Mr. Manuel that the proposed reapportionment of Police Jury districts as proposed by the staff be approved and forwarded to the Department of Justice. A roll call vote was taken on the motion, and the result thereof was as follows:

ORDINANCE NO. 4324
AN ORDINANCE creating a 15-member district plan for reapportionment of the Calcasieu Parish Police Jury and providing for the division of certain precincts into two or more precincts by a visible feature for the purpose of creation of said reapportionment plan in accordance with Louisiana Revised Statute 18:532.1.
WHEREAS, on September 6, 2001, the Calcasieu Parish Police Jury declared the need for a new apportionment plan due to the fact that the 2000 decennial census indicated a number of population shifts within the Parish which caused substantial variation in representation of the current Police Juror Single Member Districts; and
WHEREAS, on October 18, 2001, the proposed reapportionment plan was formally presented to the Calcasieu Parish Police Jury, and the Police Jury approved a schedule for a public comment period, public hearings, and adoption of the plan; and
WHEREAS, in accordance with its responsibility as the governing authority of Calcasieu Parish, Louisiana, the Police Jury held an open session for public comment and input on the proposed plan and process on November 6, 2001, after two public notices were published in the official journal; and
WHEREAS, a public hearing was held at the regular meeting of the Police Jury on November 15, 2001, for consideration of comments received during the comment period, to receive additional public input, and for consideration of final approval of the reapportionment plan; and
WHEREAS, two public notices were published in the official journal giving notice of the aforementioned public hearing date and time; and
WHEREAS, at the public hearing on November 15, 2001, comments were entered by both the public and the police jurors; however, no additional proposals were submitted for consideration by the Police Jury.
NOW, THEREFORE,
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 15th day of November, 2001, that:
SECTION 1. In accordance with data provided by the Bureau of the Census in the 2000 decennial census, the need for the Calcasieu Parish Police Jury to reapportion its election districts is hereby reconfirmed.

SECTION 4. Maps outlining the 15 single-member police juror districts for reapportionment for the Calcasieu Parish Police Jury and all of the precincts in Calcasieu Parish, Louisiana, including the above listed precinct divisions, are hereby attached hereto and made a part hereof as Exhibit "B".
SECTION 5. Any ordinances, or parts thereof, held to be in conflict with this ordinance are hereby repealed.
SECTION 6. This ordinance shall become effective at the end of the term of the incumbent police jurors, in accordance with Louisiana Revised Statute 33:1411.
