The Police Jury of Calcasieu Parish, Louisiana, met in regular session at 5:30 p.m. on Thursday, July 19, 2001, in Courtroom A of the Calcasieu Parish Courthouse, 1000 Ryan Street, with the Honorable Elizabeth Conway Griffin, President, presiding, and the following members present:
Mesdames Luvertha August and Sandra Treme; and Messrs. Francis Andrepont, Algie Breaux, Brent Clement, Calvin Collins, Mike Danahay, Enos Derbonne,
Chris Landry, Hal McMillin, Cornelius "Cornie" Moon, Charles S. Mackey, D.D.S., and Don Manuel.

President Griffin called the meeting to order, and the invocation was pronounced by Dr. Eddie Simmons, Pastor of Sale Street Baptist Church in Lake Charles, which was followed by the Pledge of Allegiance led by Dr. Mackey. The roll was called with the result being as outlined above.
President Griffin advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for an oil, gas, and mineral lease on certain roads in Sections 22, 26, 27, 28, 33 and 34, Township 10 South, Range 8 West, in Ward One of Calcasieu Parish.
Mr. McMurry then proceeded to open the only bid received of Mayne and Mertz, Inc. and publicly read the details of said bid which are incorporated in the resolution set forth below which was adopted upon motion made by Mr. Andrepont, duly seconded by Mr. McMillin and carried unanimously:

does hereby accept the bid of Mayne & Mertz, Inc. for a mineral lease on the following described property, to-wit:

Tract Nos. 1-6 combined total 23.79 acres, more or less.
for a three-year lease with a cash bonus of Five Thousand Nine Hundred Forty Seven and 50/100 Dollars ($5,947.50) and an annual rental of Two Thousand Nine Hundred Seventy Three and 75/100 Dollars ($2,973.75), and with the Calcasieu Parish Police Jury to receive 25% of all oil produced and saved or utilized, 25% of all gas produced and saved or utilized, 25% of all sulphur produced and saved, and 25% of all other liquid or gaseous hydrocarbon minerals produced and saved.
BE IT FURTHER RESOLVED that the President of the Police Jury is authorized to execute all documents related thereto.

Mr. McMillin asked that the presentation of a plaque to Mr. Zeke Dixon who recently was recognized by the "Lake Charles American Press" as an Outstanding Athlete of the Year be postponed due to the fact that Mr. Dixon was in Baton Rouge playing in a high school all star game on this date.
At the request of Mr. Milner, Mr. Gus Schram of the firm of Gus Schram and Company, Ltd. (the Parish's auditing firm) presented the Police Jury's Comprehensive Annual Financial Report for the year ending December 31, 2000.
Mr. Schram thanked the staff for meeting the June 30th deadline in compiling all of the financial information, particularly from all of the Police Jury's component units, which was difficult because of the extensiveness of the report. He pointed out that once all of the information was gathered, there was a short window of about six to eight weeks during which all of the information had to be combined and submitted to the Legislative Auditor by June 30th.
Mr. Schram stated that it was always a pleasure to work with the administration and staff, and this year's effort had been one of the smoothest his firm had ever been associated with. He congratulated everyone on last year's report and receipt of the Excellence in Financial Reporting from the Governmental Finance Officers Association for the ninth consecutive year and stated that he fully expected that this year's report would be eligible for the award as well.
Mr. Schram then gave a brief overview of the report, pointing out that the overall position of the Parish was very sound and among the "upper crust" of all the parishes in the State as far as financial soundness. He pointed out that as of December 31, 2000, the Parish's long-term debt was under $26 million as compared to assets of $250 million. Mr. Schram also pointed out that expenditures had increased approximately 3.8%, ad valorem taxes had increased by 3.7%, and sales tax revenues by 5.3%, but in the event there might be a point in time when revenues decreased, there was a healthy reserve to accommodate such a decrease.
There being no questions from the jurors, motion was made by Mr. Andrepont, seconded by Mr. Moon and carried unanimously that the Calcasieu Parish Police Jury Comprehensive Annual Financial Report for the year ending December 31, 2000, be received.
President Griffin advised that no action was needed on applications for liquor and beer permits due to the fact that no applications had been submitted.
Motion was made by Mr. Andrepont, seconded by Mr. Moon and carried unanimously to approve the minutes of the Regular Meeting of the Police Jury dated June 21, 2001.
A report was given by Mr. Moon, Police Juror-District Six, with reference to on-going activities within his Police Jury district and liaison affiliations. Mr. Moon gave a synopsis of recent drainage, public works, housing, and animal control issues which had been successfully resolved. He stated that he served on the Special Service Districts Review Committee which was currently reviewing various matters.
Mr. Moon advised that the economic development study team on which he served consisted of representatives from the Parish, the City of Lake Charles, and the Port of Lake Charles and had recently discussed such issues as the Weingarten/Target litigation, the proposed Port access road, I-210/Prien Lake Road exit ramp, and joint funding for paving Nelson Road from Country Club to Gauthier Road (Police Jury - $4.5 million, City of Lake Charles - $1 million, Port of Lake Charles - $1 million, and Lake Charles Memorial Hospital - $300,000), as well as the much-needed overlay of Gulf Highway from the end of the existing improvements to the Lake Charles Regional Airport.
Mr. Moon further advised that with regard to his liaison affiliations with the Calcasieu Parish Office of Emergency Preparedness and the Communications and Emergency Response Committee, there was a need to review the current public safety two-way radio system to be assured that the Parish had dependable, clear, uninterrupted communications during times of emergency. He pointed out that the Sheriff's office had purchased a new system separate from the one which the Lake Charles Police Department was using, and the Parish needed to make certain it remained compatible in light of the fact that the Parish's system was about 14 years old and used the same band as pagers and cell phones, the use of which had increased. Mr. Moon also pointed out the need to take a look at having global positioning system devices for emergency vehicles which would fix the location of all operational vehicles and lessen the response time whether it would be law enforcement, fire protection, or ambulance service.
Mr. Moon thanked the members of the Police Jury for their support of his request for a resolution asking the Louisiana Department of Transportation and Development to install a planting strip between the sidewalk and the curb on Nelson Road for the safety of children walking to and from Prien Lake Elementary School, as well as the Lake Charles City Council's agreement to maintain the planting strip. He closed by saying that he had asked the Engineering Department to look at the feasibility of a pilot project to install sidewalks within two blocks of a school where students must walk down busy streets and had faxed Senator Landrieu's office asking for a search for grant money for such a project.
President Griffin thanked Mr. Moon for his report and stated that it was helpful for the jurors to learn more about what was going on in each other's districts.
President Griffin advised that action was needed on Zoning Case RZ03-023-01 which was a request by Levorel J. Moreau to rezone from A-1 (Agricultural) to C-2 (General Commercial) to allow a trenching business on Bennett Road in Ward Three, Police Jury District 9. She further advised that the Planning and Zoning Board had met on Tuesday, July 17, 2001, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that a 6' wooden fence be installed along the east property line after 30 days of completion of the building; (3) that all drives and parking areas be hardsurfaced (concrete or asphalt) within six months; and (4) that the use be limited to a trenching service only.
It was moved by Mr. Andrepont, seconded by Dr. Mackey and carried unanimously that the recommendation of the Planning and Zoning Board be upheld with respect to Zoning Case RZ03-023-01 and that the request be granted with the stipulations outlined by the Planning and Zoning Board; whereupon, the following ordinance was adopted:

She further advised that the Planning and Zoning Board had met on Tuesday, July 17, 2001, and voted 6-3 to recommend that the request be granted with the following stipulations: (1) that the use is limited to a salvage yard only; (2) should the business cease, the I-2 (Heavy Industrial) zoning classification is non-transferable and the property would automatically revert to R-2 (Mixed Residential); (3) that a Parish occupational license be obtained within five days of zoning approval; (4) existing building must have appropriate siding installed around the entire building within sixty days of zoning approval; (5) petitioner must provide documentation on an approved sewage system within fifteen days of zoning approval; (6) existing fence must be repaired within thirty days of zoning approval; (7) a six-foot privacy fence must be installed along east property line (south of driveway) to provide a screening within thirty days of zoning approval; and (8) all vehicles must be stored behind the fence.

President Griffin advised that action was needed on Zoning Case RZ04-025-01 which was a request by Twins R Us to amend Ordinance 4188 (Stipulation No. 2) to read as follows: that the development must adhere to the revised site plan dated June 25, 2001, on file with the Division of Planning and Development (Beglis Parkway in Ward Four, Police Jury District 12). She further advised that the Planning and Zoning Board had met on Tuesday, July 17, 2001, and voted unanimously to recommend that the request be granted. [On April 19, 2000, the Police Jury approved the request of Stephen and Diana Khoury to rezone R-1 (Single Family Residential) to C-2 (General Commercial) to allow a truck stop with five stipulations. AN ORDINANCE amending Ordinance No. 4188, adopted by the Police Jury on April 19, 2000, (Zoning Case RZ04-015-00), to amend Stipulation No. 2.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 19th day of July, 2001, that
Ordinance No. 4188, adopted by the Police Jury on April 19, 2000, (Zoning Case RZ04-015-00), is hereby amended to provide for the amendment to
Stipulation 2) that the development must adhere to the revised site plan dated June 25, 2001, on file with the Division of Planning and Development, on the
following property:
Beginning at a point on the E ROW line of Beglis Parkway (formerly Arizona Street) said point being 293.04 feet E and N 4 degs 36' 34" E 333.44 feet from
the SW cor of the NW/4 of NE/4 of Section 11, Township 10S, Range 10W, Calcasieu Parish, Louisiana; th N 4 degs 36' 34" E 333.44 feet along the E ROW

BE IT FURTHER ORDAINED that the above described property is hereby classified and ratified as C-2 (General Commercial).
BE IT FURTHER ORDAINED that this ordinance shall become effective immediately upon its adoption.
BE IT FURTHER ORDAINED that any ordinance or parts of any ordinance in conflict herewith are hereby repealed.

President Griffin advised that no action was needed on Zoning Study ST08-002-01 which was a study to examine the feasibility of rezoning parcels located on P. E. Daigle Road in Ward Eight, Police Jury District 10, due to the fact that the Planning and Zoning Board had met on Tuesday, July17, 2001, and voted unanimously to recommend that the request be withdrawn at the request of the residents.
In accordance with the staff's recommendation, motion was made by Dr. Mackey, seconded by Mr. Breaux and carried unanimously to defer action until the Regular Meeting of the Police Jury on August 2, 2001, relative to adopting a resolution indicating objection/no objection to the following proposed project in Calcasieu Parish, Louisiana, due to the fact that the Office of Planning and Development was currently waiting on a letter from Gravity Drainage District No. Five of Ward Four pertaining to said proposed project:
Proposal of Palermo Properties to deposit fill for the closure of existing drainage ditches as part of the construction of a 22-lot subdivision. Preliminary determinations have shown that the proposed ditch closures will impact approximately 2.00 acres of jurisdictional wetlands along the existing drainage ditches. The proposed activity will be located within an area approximately 3,100 feet long and 30 feet wide, and the fill operation will include the deposition of approximately 1,400 cubic yards of earthen material to be placed within the existing drainage ditches. Said project is located in Sections 34 and 35, Township 10 South, Range 11 West, adjacent to Louisiana Highway 108, near Sulphur.

With reference to the foregoing resolution and in answer to a question by Mr. Clement, Mr. Smart advised that this was a federal program administered by the Louisiana Department of Transportation and Development, and the Police Jury had to submit this annual certification in order to partake of the funding.
It was moved by Mr. Andrepont, seconded by Dr. Mackey and carried unanimously that the following resolution be adopted:
RESOLUTION
A RESOLUTION providing for the employment of general counsel for the Calcasieu Parish Police Jury;
WHEREAS, the Calcasieu Parish Police Jury is desirous of employing general counsel pursuant to the authority granted by LSA-R.S. 42:261 (g) as amended
by the Legislature during its regular session to provide legal counsel in general legal matters affecting the Police Jury and its employees, including court
appearances as necessary.
NOW, THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 19th day of July, 2001, that it
does hereby authorize employment of the firm of Plauche, Smith & Nieset, a Professional Law Corporation, as general counsel for the Calcasieu Parish Police
Jury in legal matters affecting it, its members and employees, and, as necessary and appropriate, to provide defense of claims and lawsuits made against the
Calcasieu Parish Police Jury.
BE IT FURTHER RESOLVED that employment of such general counsel is specifically authorized under LSA-R.S. 42:261 (g) as amended by House Bill
No. 562 passed by the Legislature at its regular session, 2001, and signed by Governor J. Murphy Foster.
BE IT FURTHER RESOLVED that the Parish Administrator is hereby authorized to execute into an employment contract between the Calcasieu Parish
Police Jury and the firm of Plauche, Smith & Nieset, a Professional Law Corporation, which agreement shall be for the period of one year commencing January
1, 2001, and ending December 31, 2001, which said contract shall automatically be renewed from year to year unless either party thereto terminates said
agreement by notifying the other party in writing, by United States Mail, before December 1 of any year, for annual compensation not exceeding a total of
$100,000 exclusive of reimbursed costs.
BE IT FURTHER RESOLVED that this Resolution shall be spread upon the minutes of the Police Jury and published in the official journal in accordance
with LSA-R.S. 42:263.

District for a period of ten (10) years beginning January 1, 2001, for the purpose of acquiring, constructing, maintaining, and operating fire protection facilities,
equipment, and paying salaries and fees of firemen, for fire protection within the District; and making application to the State Bond Commission and United
States Attorney General in connection therewith.
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, serving as the Board of Commissioners of Ward Four Fire
Protection District No. Four (the "District"), as follows:
SECTION 1. Subject to the approval of the State Bond Commission and under the authority conferred by Article 6, Sections 7, 30 and 32 of the 1974
Louisiana Constitution, Chapter 6A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority
supplemental thereto, a special election be and the same is hereby called and ordered to be held in the District on Saturday, October 20, 2001, between the hours

SECTION 2. There shall be published in the "Lake Charles American Press", a daily newspaper of general circulation within the District, published in Lake
Charles, Louisiana, and being the official journal of the Calcasieu Parish Police Jury, serving as the Board of Commissioners of Ward Four Fire Protection
District No. Four, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days
prior to the date fixed for the election, notice of said election, which notice shall be substantially in accordance with the Notice of Special Election annexed
hereto as "Exhibit A" and incorporated herein by reference, the same as if it were set forth herein in full.
SECTION 3. The Calcasieu Parish Police Jury, serving as the Board of Commissioners of Ward Four Fire Protection District No. Four, shall meet at its
temporary meeting place which is Courtroom A of the Calcasieu Parish Courthouse, 1000 Ryan Street, Lake Charles, Louisiana, on Thursday, the 1st day of
November, 2001, at 5:30 P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the results of said
special election.
SECTION 4. The polling places set forth in the aforesaid Notice of Special Election, be and the same are hereby designated as the polling places at which to
hold said election, and the election officials appointed in accordance with said Notice of Special Election, be and the same are hereby appointed as
Commissioners and Commissioners-in-Charge of election, respectively, to serve at the polling places as indicated.
SECTION 5. The officers designated to serve as Commissioners and Commissioners-in-Charge, or such substitutes therefor as may be selected and designated
in compliance with the Louisiana Election Code, shall hold said special election as herein provided, shall make due returns of said election for the meeting of
the Police Jury of the Parish of Calcasieu, State of Louisiana, to be held on the 1st day of November, 2001, at 5:30 P.M., and the compensation of said officers
be and the same is hereby fixed at the sum prescribed by law. All registered voters in the District are entitled to vote at said special election. Voting machines
shall be used, and assessed valuations shall not be voted.
SECTION 6. The Secretary of the Police Jury of the Parish of Calcasieu, State of Louisiana, is hereby empowered, authorized and directed to arrange for the
furnishing to said election officers in ample time for the holding of said election the necessary equipment, forms and other election paraphernalia essential to the
proper holding of said election.
SECTION 7. Certified copies of this resolution shall be forwarded to the Louisiana Secretary of State, the Commissioner of Elections of the State of
Louisiana, the Bond Commission of the State of Louisiana, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines in and for the Parish of
Calcasieu, State of Louisiana, and the Registrar of Voters in and for said Parish, as notification of the special election herein called in order that each may
prepare for said election and perform their respective functions as required by law.
SECTION 8. Application be and the same is hereby formally made to the State Bond Commission for consent and authority to hold the aforesaid special
election as herein provided, and in the event the aforesaid Proposition carries, for the Commission's consent and authority to levy and collect, and adopt an
ordinance providing for such levy and collection, of the continuation of the maintenance tax as authorized by said Proposition.
SECTION 9. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Police Jury of the Parish of Calcasieu,
State of Louisiana, together with a letter requesting the prompt consideration and approval of this application.
SECTION 10. A certified copy of this resolution, together with other showings required by Section 5 of the Voting Rights Act of 1965 and regulations
pertaining thereto shall be submitted to the United States Attorney General for approval in compliance with the Voting Rights Act, should such submission be required.
SECTION 11. If any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or
applications of this resolution which can be given effect without the invalid provisions, items, or applications, and to this end, the provisions of this resolution
are hereby declared severable.
SECTION 12. All resolutions, ordinances or parts thereof in conflict herewith are hereby repealed.

does hereby approve an Addendum to the existing Services Agreement between the Calcasieu Public Transit System and the Calcasieu Voluntary Council on
Aging (CCOA) wherein the CCOA will pay a regular and consistent monthly fee of $5,666.66 per month to the Calcasieu Public Transit System to purchase
transit rides for those seniors 60 and older who have been certified by the CCOA for their participation in the Title II-B Supportive and Assisted Services
(medical, medically-related, and grocery shopping), as provided by the CCOA.
BE IT FURTHER RESOLVED that the President of the Police Jury, or her designee, when appropriate, is authorized to execute all documents related thereto.

BE IT FURTHER RESOLVED that the above-named appointee shall be administered the oath of office within thirty days following receipt of this resolution.

It was moved by Mr. McMillin, seconded by Mr. Manuel and carried unanimously that the rules be suspended by a two-thirds majority vote to adopt the following Resolution in Memoriam:
RESOLUTION IN MEMORIAM
WHEREAS, Almighty God in His Infinite Wisdom has seen fit to take by death Mr. Jerry J. Johnson who served his community, Parish, and nation for many
years through various civic, governmental, and military endeavors; and
WHEREAS, Mr. Johnson, a lifelong resident of Calcasieu Parish, was a McNeese State University graduate and a Vietnam veteran and was active in many
business and civic organizations; and
WHEREAS, Mr. Johnson was appointed as a member of the Calcasieu Parish Police Jury on January 28, 1999, and served as the local government
representative of Ward One until January 9, 2000, during which time he served with excellence and honor for the betterment of his community and Calcasieu
Parish; and
WHEREAS, Mr. Johnson will long be remembered for his untiring efforts, and accomplished and dedicated service; and
WHEREAS, in his passing, the Parish of Calcasieu feels the loss of an outstanding public-spirited citizen and friend, and he will be sorely missed.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 19th day of July, 2001, that it
does hereby express sincere and heartfelt regret in the passing of Mr. Jerry J. Johnson.
BE IT FURTHER RESOLVED that this memorial shall be spread upon the minutes and placed in the archives of the Calcasieu Parish Police Jury.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be forwarded to the family of Mr. Jerry J. Johnson in heartfelt sympathy and
condolences.

Calcasieu Parish Police Jury

Motion was made by Mr. Andrepont, seconded by Mr. Collins and carried unanimously that the rules be suspended by a two-thirds majority vote to approve a Joint Services Agreement between the Police Jury and Ward Two Fire Protection District No. One providing for the installation of a dry fire hydrant on the Government Ditch by the Division of Engineering and Public Works with reimbursement for time and fuel, estimated at approximately $898.05, to be made by the Fire District, and the Fire District to be responsible for the purchase of all materials.
There being no further business, motion was made by Mr. Moon, seconded by Mr. Danahay and carried unanimously that the meeting be adjourned.
