The Police Jury of Calcasieu Parish, Louisiana, met in regular session at 5:30 p.m. on Thursday, May 17, 2001, in the Police Jury Room on the first floor of the Parish Government Building, 1015 Pithon Street, with the Honorable Elizabeth Conway Griffin, President, presiding, and the following members present:
Mesdames Luvertha August and Sandra Treme; and Messrs. Francis Andrepont, Algie Breaux, Brent Clement, Calvin Collins, Mike Danahay, Enos Derbonne,
Chuck Kleckley, Chris Landry, Charles S. Mackey, D.D.S., Don Manuel, Hal McMillin, and Cornelius "Cornie" Moon.

President Griffin called the meeting to order, and the invocation was pronounced by Reverend Sam Tolbert, Lake Charles City Councilman, which was followed by the Pledge of Allegiance led by Mr. Collins. The roll was called with the result being as outlined above.
President Griffin advised that Mr. Richard Donahoe, Director of the Southwest Louisiana Criminalistics Laboratory, was present at the meeting on this date with reference to approval of an amendment to said agency's Fiscal Year 2000-2001 budget and the approval of its proposed budget for Fiscal Year 2001-2002.
President Griffin asked if anyone had questions concerning the amendment and budget. Hearing none, and in accordance with the staff's recommendation, motion was made by Mr. Andrepont, seconded by Mr. McMillin and carried unanimously that the amendment to the 2000-2001 budget of the Southwest Louisiana Criminalistics Laboratory, and said agency's proposed budget for Fiscal Year 2001-2002, be approved as presented on this date.
It was moved by Mr. Andrepont, seconded by Mr. Breaux and carried unanimously that the following applications for liquor and beer permits be approved:

President Griffin advised that action was needed on Zoning Case RZ08-015-01 which was a request by Southernwoods Estates, L.L.C., to rezone from I-1 (Light Industrial) to A-1 (Agricultural) to allow a residential subdivision (Southernwoods Estates) at Highway 397 and McCown Road in Ward Eight, Police Jury District 10. She further advised that the Planning and Zoning Board had met on Tuesday, May 15, 2001, and voted unanimously to recommend that the request be granted. (It was noted that the staff's recommendation had been to deny the request due to residential encroachment in an industrial area.)
Motion was made by Mr. Breaux, seconded by Mrs. August and carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to Zoning Case RZ08-015-01 and to grant the request to rezone; whereupon, the following ordinance was adopted:

President Griffin advised that action was needed on Zoning Case RZ03-017-01 which was a request by Michael Thibodeaux to rezone from R-2 (Mixed Residential) to C-2 (General Commercial) to allow a trenching business on Arabie Road in Ward Three, Police Jury District 9. She further advised that the Planning and Zoning Board had met on Tuesday, May 15, 2001, and voted six (against) and five (for) to recommend that the request be denied. (It was noted that the staff's recommendation had been to grant the request with the following stipulations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that a six-foot (6') wooden fence be installed along the west property line after thirty days of completion of the building; (3) that all drives and parking areas be hardsurfaced (concrete or asphalt) within six months; and (4) that the use be limited to a trenching service only.)
It was moved by Mr. Derbonne, seconded by Mr. Manuel and carried unanimously that the recommendation of the Planning and Zoning Board be upheld with respect to Zoning Case RZ03-17-01 and that the request to rezone be denied.
Ms. Kitty Richard, Arabie Lane, Lake Charles, appeared before the Police Jury and stated that her neighborhood was a middle class neighborhood with homes in the price range of $40,000 to $50,000, and most residents were retired, yet Mr. Thibodeaux wanted to put a metal building in this residential area.
Mr. Andrepont called for a point of order, stating that Ms. Richard was in favor of the motion on the floor.
President Griffin allowed Ms. Richard to continue, and she (Ms. Richard) stated that one of the reasons she disagreed with allowing Mr. Thibodeaux to put in the metal building was that he was aware of how the property was currently zoned, and while the property fronting Gulf Highway was commercial, Arabie Road (leading off of Gulf Highway) was not. She further stated that she did not mind the building but wanted it put somewhere else.
A vote was taken on the motion on the floor, and said motion carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to Zoning Case RZ03-017-01 and to deny the request to rezone.
President Griffin advised that action was needed on Zoning Case RZ03-016-01 which was a request by Curray Corporation to rezone from R-2 (Mixed Residential) to C-2 (General Commercial) to allow commercial development at 4124 Thornton Street in Ward Three, Police Jury District 2. She further advised that the Planning and Zoning Board had met on Tuesday, May 15, 2001, and had voted unanimously to recommend that the request be granted with the following staff recommendations: (1) that the development adhere to the site plan on file with the Division of Planning and Development; (2) that all storage and equipment must be stored within confines of the building; and (3) that the rezoning was for Lots 16 and 17 only.
Motion was made by Mr. Andrepont, seconded by Dr. Mackey and carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to Zoning Case RZ03-016-01 and to grant the request to rezone; whereupon, the following ordinance was adopted:

Upon motion made by Mr. Andrepont, which was duly seconded by Mrs. Treme and carried unanimously, the following resolution was adopted:
RESOLUTION
WHEREAS, notification has been received that an application for an after-the-fact Department of the Army Permit has been made to the U.S. Corps of Engineers, and application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Palermo Properties, L.L.C. to clear, grade and fill an area, to construct a public truck stop and casino. Preliminary determinations have shown that approximately 2.7 acres of jurisdictional wetlands will be impacted from the final development. The proposed project is located within an area about 635 feet long and 236 feet wide, adjacent to Beglis Parkway. Approximately 7,400 cubic yards of on-site graded earthen material and 9,800 cubic yards of hauled-in clay and aggregate will be deposited as fill for the proposed development. Said project is located in Calcasieu Parish, Section 11, Township 10 S, Range 10 W, approximately 7.0 miles easterly from Lake Charles, Louisiana, off of Beglis Parkway; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Palermo Properties, L.L.C. relative to its compliance with
current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as
well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit
application based on parish ordinances and provisions, provided a development permit is obtained from the Parish Division of Planning and Development prior
to commencement of the project.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 17th day of May, 2001, that it
does hereby indicate no objection to the proposal of Palermo Properties, L.L.C. to clear, grade and fill an area, to construct a public truck stop and casino.

parish staff to accomplish such a study, and the Police Jury requests that agencies and/or individuals with such expertise make an environmental review of said
project and forward their findings to the U.S. Corps of Engineers.

It was moved by Mr. Andrepont, seconded by Mrs. August and carried unanimously to authorize the Parish Engineer to proceed with the appraisal process for acquisition of right-of-way for the Walker Road Extension Project, from Thompson Road to Louisiana Highway 27.
Upon motion made by Mrs. August, which was duly seconded by Mrs. Treme and carried unanimously, the following resolutions were adopted:

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 17th day of May, 2001, that it
does hereby approve an agreement between the Calcasieu Parish Police Jury Transit System (Office of Community Services) and the Calcasieu Workforce
Center to provide transportation services to eligible participants of the Calcasieu Workforce Center actively participating in programs provided by the Calcasieu
Workforce Center.
BE IT FURTHER RESOLVED that the President of the Police Jury is authorized to execute all documents related thereto.

It was moved by Mrs. Treme, seconded by Mr. McMillin and carried unanimously to suspend the rules by a two-thirds majority vote to receive a report from the Parish Engineer as to whether or not the existing 25-mph speed limit on Grape Street in Pine Acres Subdivision in Ward Six should be increased. (This item had been on the agenda of the Police Jury's Regular Meeting on May 3, 2001, but the Parish Engineer had requested more time for the staff to conduct a traffic study of this street and others in the subdivision with a report to be made at a later date.)
In accordance with the staff's report and recommendation, motion was made by Mrs. Treme, seconded by Mr. McMillin and carried unanimously that the rules be suspended by a two-thirds majority vote to adopt the following ordinance:

BE IT FURTHER ORDAINED that anyone violating the provisions of this ordinance, upon conviction, shall be fined as provided in Section 1-9 of the Code
of Ordinances of Calcasieu Parish, Louisiana.
BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or
amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

WHEREAS, emergency medical services is a vital public service; and
WHEREAS, the members of emergency medical services teams are ready to provide lifesaving care to those in need 24 hours a day, seven days a week; and
WHEREAS, access to quality emergency care dramatically improves the survival and recovery rate of those who experience sudden illness or injury; and
WHEREAS, emergency medical services providers have traditionally served as the safety net of America's health care system; and
WHEREAS, emergency medical services teams consist of emergency physicians, emergency nurses, emergency medical technicians, paramedics, firefighters,
educators, administrators, and other; and
WHEREAS, approximately two-thirds of all emergency medical services providers are volunteers; and
WHEREAS, the members of emergency medical services teams, whether career or volunteer, engage in thousands of hours of specialized training and
continuing education to enhance their lifesaving skills; and
WHEREAS, Americans benefit daily from the knowledge and skills of these highly trained individuals; and
WHEREAS, it is appropriate to recognize the value and the accomplishments of emergency medical services providers by designating Emergency Medical
Services Week; and
WHEREAS, injury prevention and appropriate use of the EMS system will help reduce national health care costs.
NOW, THEREFORE,

the week of May 20 - 26, 2001, is hereby proclaimed
Emergency Medical Services Week
in the Parish of Calcasieu, State of Louisiana, and all citizens are urged to observe this week with appropriate ceremonies and activities.
* * * * * * * * * * * * There being no other items of business, Mr. McMurry stated that Mr. Smith had asked that the Police Jury go into executive session prior to action scheduled for 6:00 p.m. to discuss Lawsuit No. 2000-004367 (Arabie vs. CPPJ).
Motion was made by Mr. Andrepont, seconded by Mrs. August and carried unanimously to suspend the rules by a two-thirds majority vote to go into executive session to discuss Lawsuit No. 2000-004367 (Arabie vs. CPPJ).
Prior to going into executive session, President Griffin thanked Mr. Moon for having recently organized an informational training session which was conducted by former McNeese State University Professor Bill Casey on parliamentary procedures and Robert's Rules of Order.
Mr. Manuel invited everyone to attend a function at the VFW on Highway 171 in Moss Bluff on May 30, 2001, at 10:00 a.m. in honor of the veterans of World War II.
President Griffin asked Ms. Sandy Mason, Director of the Office of Community Services, to update the members of the Police Jury on a leadership training seminar being conducted by her office. Ms. Mason gave a brief update, with particular emphasis on inviting the jurors to participate in the mock Police Jury meeting which would be held on Saturday, May 19, 2001.
Mr. McMillin recognized Mr. Warren Hicks, member of the Board of Commissioners of Waterworks District No. Four of Ward Four, as being present at the meeting on this date.
President Griffin recognized Mr. Jason Savant of Med Express Ambulance as being present at the meeting on this date.
In accordance with action previously taken, the Police Jury then went into executive session. Following the executive session, motion was made by Mr. Andrepont, seconded by Mr. Breaux and carried unanimously that the rules be suspended by a two-thirds majority vote to approve the report given by legal counsel during said executive session.
The hour being 6:00 p.m., President Griffin advised that a public hearing would be held at this time, as a result of notice provided to the owner of property described below, in accordance with Article II-Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, ordering said owners to show cause as to why the structure on said property should not be condemned:

Lake Street, Lake Charles, Louisiana, 70605, TA# 89184 (Police Jury District 9) (On April 5, 2001, the Police Jury deferred action on this condemnation until
the Regular Meeting on May 17, 2001.)
President Griffin asked if there was anyone present in the audience to discuss or make comments relative to this proposed condemnation. Hearing no comments, and in accordance with the staff's recommendation, motion was made by Mr. Andrepont, seconded by Mr. Breaux and carried unanimously that the following ordinance be adopted:
ORDINANCE NO. 4269
AN ORDINANCE ordering demolition of the house on property located at 1407 W. Lincoln Road, and described as: Com at NE Cor of NE NW 13.11.9, W
along N line of said Sec 417.4 ft, S 417.4 ft etc., Subj to road R/W along N line of said property; Ward Three, Calcasieu Parish, Louisiana, and owned by
Cardone-Gregory LLC.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 17th day of May, 2001, that:
SECTION 1. The facts as set forth at the meeting of the Police Jury of Calcasieu Parish, Louisiana, on this date, justify an order of this Police Jury, and it is
hereby ordered that the house on property located at 1407 W. Lincoln Road, and described as: Com at NE Cor of NE NW 13.11.9, W along N line of said Sec
417.4 ft, S 417.4 ft etc., Subj to road R/W along N line of said property; Ward Three, Calcasieu Parish, Louisiana, and owned by Cardone-Gregory LLC, be
demolished and removed within thirty (30) days from the date of this ordinance. This order requires that all development permits be secured for demolition and
all debris be removed from the premises. This order is made this 17th day of May, 2001, and is final unless appealed within five (5) days.
SECTION 2. If the house on the premises hereinabove described in the Parish of Calcasieu, Louisiana, is not demolished and removed within thirty (30) days
from the date of this order, notice is hereby given that the Director of Parish Planning and Development shall have work commenced on the demolition and
removal of said house, in which case the Police Jury shall not be liable for damages and shall have a lien and privilege against the property upon which the
house was situated for the cost of demolishing and removing said house, and for the cost of maintaining the property.
SECTION 3. The Director of Parish Planning and Development is hereby authorized and directed to give notice of said demolition and removal as required by law.
SECTION 4. The Director of Parish Planning and Development is hereby authorized to enter into a contract to accomplish the demolition of the house, if
necessary, and to pay the fees of the contractor from appropriate Parish funds, and to pay any and all costs associated with the demolition. Any amounts
expended by the Parish of Calcasieu shall be included in the statement of costs in accordance with Chapter 6 of the Code of Ordinances of Calcasieu Parish,
Louisiana, and the Parish of Calcasieu shall have a lien and privilege for all costs resulting from the demolition.
SECTION 5. This ordinance shall become effective immediately.
