The Police Jury of Calcasieu Parish, Louisiana, met in regular session at 5:30 p.m. on Thursday, October 19, 2000, in the Police Jury Room on the first floor of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with the Honorable Charles S. Mackey, D.D.S., President, presiding, and the following members present:
Mesdames Luvertha August, Elizabeth C. Griffin, and Sandra J. Treme; and Messrs. Mr. Francis Andrepont, Brent Clement, Calvin Collins, Mike Danahay, Enos Derbonne, Chuck Kleckley, Chris Landry, Hal McMillin, Don Manuel, and Cornelius "Cornie" Moon

Also present were Mr. S. President Mackey called the meeting to order, and a moment of silence was observed in memory of the military personnel who were recently killed as a result of the bombing of the U.S.S. Cole, a Navy submarine attacked during re-fueling in Yemen. The invocation was then pronounced by Deacon Wilson Pete of Zion Tabernacle Baptist Church which was followed by the Pledge of Allegiance led by Mrs. Griffin. The roll was called with the result being as outlined above.
Mrs. Treme and Mr. Clement presented a plaque to Mr. Harris Hebert in recognition of 21 ˝ years of service as a member of the Board of Commissioners of the Vinton Harbor and Terminal District. Mr. Hebert thanked the Police Jury for this honor.
The following entities were presented the 2001 Trust Fund Awards from the Calcasieu Parish Road and Drainage Trust Fund Program:
Following the presentation of grants, President Mackey declared a brief recess so that photographs could be taken of representatives of the Trust Fund recipients and jurors.

Motion was made by Mr. Andrepont, seconded by Mrs. August and carried unanimously that the minutes of the Regular Meeting of the Police Jury dated September 21, 2000, be approved, and the reading of same was dispensed with.
President Mackey advised that action was needed on Zoning Case RZ03-027-00 which was a request by D & W Drilling Company, Inc. to rezone from R-2 (Mixed Residential) to I-1 (Light Industrial) to allow parking of equipment for adjacent business (D & W Drilling Co. Inc.) at 3557 Eliza Road in Ward Three, Police Jury District 8. President Mackey further advised that the Planning and Zoning Board had met on Tuesday, October 17, 2000, and voted unanimously to recommend that the request be granted with the following stipulations: (1) that the existing junk items, i.e., broken axle, be removed within 30 days of zoning approval; (2) that the property revert to R-2 and C-1 should D & W Drilling cease to exist or should the company no longer utilize the site; and (3) that development adhere to the site plan on file with the Division of Planning and Development.
Motion was made by Mrs. Griffin, seconded by Mr. Andrepont and carried unanimously to uphold the recommendation of the Planning and Zoning Board with respect to Zoning Case RZ03-027-00 and to grant the request to rezone with the stipulations outlined by said board; whereupon, the following ordinance was adopted:

President Mackey advised that no action was needed on Zoning Case RZ03-029-00 which was a request by Billie J. Rutherford Farr to rezone from R-1 (Single Family Residential) to R-MHP (Manufactured Home Park) to allow expansion of an existing manufactured home park (Rutherford Trailer Park) with 80 additional spaces located at 5905 Corbina Road in Ward Three, Police Jury District 10, due to the fact that the Planning and Zoning Board had met on Tuesday, October 17, 2000, and deferred action on said zoning case for thirty days.
Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Manuel and carried unanimously, the following resolutions were adopted:
RESOLUTION
WHEREAS, notification has been received that application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Calcasieu Parish Gravity Drainage District No. 8 of Ward 1 to excavate material for the construction of a residential drainage ditch and maintenance road. Preliminary determinations have shown that approximately 0.20 of an acre of wetlands will be impacted from the dredging operation. The proposed project will be located within an area approximately 1,256 feet long and 30 feet wide. Approximately 5,000 cubic yards of native topsoil will be excavated for the proposed drainage operation and deposited on an off-site, non-wet area. Said project is located in Section 1, Township 9 South, Range 9 West off of North Perkins Ferry Road from its conjunction with Highway 378, and approximately 6.0 miles northerly from Lake Charles, in Calcasieu Parish; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Calcasieu Parish Gravity Drainage District No. 8 of Ward 1 relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided a development permit is obtained from the Parish Division of Planning and Development prior to commencement of the project.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 19th day of October, 2000, that it does hereby indicate no objection to the proposal of Calcasieu Parish Gravity Drainage District No. 8 of Ward 1 to excavate material for the construction of a residential drainage ditch and maintenance road, provided said work meets with the rules and regulations of the Corps of Engineers and the Louisiana Department of Environmental Quality, and approvals are received from all appropriate state and federal agencies, and further, that a development permit is obtained from the Parish Division of Planning and Development prior to commencement of the project. BE IT FURTHER RESOLVED that the no objection position of the Police Jury in this permit application is based solely on the evaluation of the parish staff of the project's effect on current parish ordinances and provisions.
BE IT FURTHER RESOLVED that a study on the environmental impact of the aforementioned project has not been made due to the lack of expertise of the parish staff to accomplish such a study, and the Police Jury requests that agencies and/or individuals with such expertise make an environmental review of said project and forward their findings to the U.S. Corps of Engineers.

RESOLUTION
WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Nelson Properties to dredge approximately 93,508 cubic yards of material to create a marina basin and connecting channel leading into Bayou Contraband, construct and maintain bulkheads, piers, and boat slips within the marina. Also to deposit dredge materials behind bulkheads and on land adjacent to the marina basin to create higher elevations for the construction of parking lots, roads, a commercial development, and residential town homes. Said project is located within the City of Lake Charles, Louisiana, in Calcasieu Parish; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Nelson Properties relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation Systems; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, since the project is located within the city limits of the City of Lake Charles.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 19th day of October, 2000, that it does hereby indicate no objection to the proposal of Nelson Properties to dredge approximately 93,508 cubic yards of material to create a marina basin and connecting channel leading into Bayou Contraband, construct and maintain bulkheads, piers, and boat slips within the marina. Also to deposit dredge materials behind bulkheads and on land adjacent to the marina basin to create higher elevations for the construction of parking lots, roads, a commercial development, and residential town homes. Said project is located within the City of Lake Charles, Louisiana, in Calcasieu Parish.
BE IT FURTHER RESOLVED that the no objection position of the Police Jury in this permit application is based solely on the evaluation of the parish staff of the project's effect on current parish ordinances and provisions.

RESOLUTION
WHEREAS, notification has been received that application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by PPG Industries, Inc. to construct access roads, levees, a drilling and production pad, and support facilities for an industrial water well and brine pit, located in Section 29, Township 9 South, Range 10 West, within the Sulphur Oil Field near Brimstone, in Calcasieu Parish; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of PPG Industries, Inc. relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided a development permit is obtained from the Parish Division of Planning and Development prior to commencement of the project.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 19th day of October, 2000, that it does hereby indicate no objection to the proposal of PPG Industries, Inc. to construct access roads, levees, a drilling and production pad, and support facilities for an industrial water well and brine pit, provided said work meets with the rules and regulations of the Corps of Engineers and the Louisiana Department of Environmental Quality, and approvals are received from all appropriate state and federal agencies, and further, that a development permit is obtained from the Parish Division of Planning and Development prior to commencement of the project. President Mackey advised that a report would be received at this time from staff relative to efforts toward development of a sewerage ordinance as a result of discussion with various interested groups, as identified by the Police Jury at its regular meeting on September 7, 2000.
Mr. Vickers reported that a meeting with the sewer installers and manufacturers was held on October 11, 2000, and approximately ten representatives attended. Mr. Vickers advised that it was decided that a smaller group consisting of two manufacturers and two installers would work better, and the staff was asked to develop a ballot/selection process to select the four representatives of the industry, with a meeting having been scheduled for October 25, 2000. Mr. Vickers further reported that the Board of Realtors had selected representatives to meet with the staff, and a tentative meeting with them was scheduled for October 24, 2000.
Mr. Vickers advised that the staff had received very good cooperation in this endeavor, and one of the problems that would be faced was that the soil in Calcasieu Parish had too much clay which would make it difficult to get percolation in some areas.
Motion was made by Mrs. Griffin, seconded by Mr. Andrepont and carried unanimously to receive the report given by Mr. Vickers on this date.
Upon motion made by Mr. Manuel, which was duly seconded by Mr. McMillin and carried unanimously, the following resolution was adopted: (The property referred to in the resolution was originally donated to the Parish in February, 1972, for use as a public park and subsequently transferred by donation to Community Center and Playground District No. Four of Ward One for the same use.)

Drew Manuel Training School, and the Southern Belle Estates I and II Homeowners Association, which provides for the transfer, donation, and conveyance of property to said Homeowners Association, described as:
Lot 9 of Block 2 of Southern Belle Estates, a subdivision of the East half of the Southwest Quarter (E 1/2 of SW 1/4), the Northwest Quarter of the Southwest Quarter (NW 1/4 of SW 1/4), the Southwest Quarter of the Northwest Quarter (SW 1/4 of NW 1/4) of Section 20, Township 8 South, Range 8 West, Louisiana Meridian, as per plat recorded in Plat Book 22 at Page 4 and bearing File No. 1212357 in the office of the Clerk of Court of Calcasieu Parish, Louisiana.

WHEREAS, the Code of Federal Regulations, as enacted by the United States Congress, mandates that all structures defined as bridges located on all public roads shall be inspected, rated for safe load capacity, and posted in accordance with the National Bridge Inspection Standards, and that an inventory of these bridges be maintained by each state; and
WHEREAS, the responsibility to inspect, rate, and load post those bridges under the authority of Calcasieu Parish, in accordance with those standards, is delegated by the Louisiana Department of Transportation and Development to Calcasieu Parish.

It was moved by Mr. McMillin, seconded by Mrs. August and carried unanimously that the Parish Administrator be authorized to re-advertise for one 2001 truck-mounted combination jet-vacuum machine, for use by the Division of Engineering and Public Works.
Mrs. Griffin asked that Ms. Ernestine Vallere, a member of Zeta Phi Beta Sorority, be recognized for being in attendance at the meeting on this date in recognition of governmental affairs for the month of October.
Motion was made by Mrs. Treme, seconded by Mrs. August and carried unanimously that the rules be suspended by a two-thirds majority vote to adopt the following resolution:

A RESOLUTION stating the Calcasieu Parish Police Jury's interest in participation in the Louisiana Enterprise Zone Program and designation of the Enterprise Zones and otherwise provide with respect thereto.
WHEREAS, the Louisiana Legislature enacted Louisiana Enterprise Zone Act 901 of 1981, Act 337 of 1982, Act 433 of 1987, Act 1024 of 1992, Act 581 of 1995, Act 624 of 1997, and Act 647 of 1997; and
WHEREAS, the Louisiana Enterprise Zone Program offers significant incentives for economic development; and
WHEREAS, the Louisiana Department of Commerce has designated certain Census Tracts/Block Groups in Calcasieu Parish, Louisiana, as enterprise zone eligible Census Tracts/Block Groups, based on demographic and economic factors; and
WHEREAS, the Calcasieu Parish Police Jury requests that the following alternative Census Tract/Block Group be designated as an enterprise zone in lieu of the original Census Tract/Block Group that qualified:

Mr. Moon asked that Ms. Paige LeBeau, Director of the Calcasieu Parish Library System, be recognized as being in attendance at the meeting on this date and for an excellent presentation which she recently gave at St. Michael's Episcopal Church.
While waiting for 6:00 p.m. and the action scheduled for that time, an informal discussion was held with reference to various items on the agenda on which the Police Jury had already taken action.
The hour being 6:00 p.m., President Mackey advised that a public hearing would be held as a result of notice provided to the owner of the property described below, in accordance with Article II, Chapter Six of the Calcasieu Parish Code of Ordinances, ordering said owner to show cause as to why the structure on said property should not be condemned:
Mr. Wes Crain, Assistant Director of Development, advised that this property was owned by Mr. Harmon Joseph Broussard. He further advised that in 1997 the Parish had received some complaints regarding junk and other code violations and upon investigation, the staff had verified the violations and had sent notices to Mr. Broussard who had met with Mr. Crain regarding the mobile home. Mr. Crain stated that Mr. Broussard had requested that he be allowed to repair the mobile home to allow his daughter to live there, and this request was granted; however, no permit had ever been obtained to repair the structure.
Mr. Crain showed pictures of the property and pointed out that some of the siding had been pulled off of the trailer, and the insulation was exposed. Mr. Crain stated that he thought Mr. Broussard had tried, but the trailer had been in poor condition for quite some time, and the Parish had received constant complaints from individuals in that area. Mr. Crain pointed out that an inspection by Mr. David Hooper, Code Enforcement Officer, had shown that the inside of the mobile home was in good shape, but the exterior was the problem. Mr. Crain also stated that Mr. Broussard had asked that he be given 60 days to make the necessary repairs to the mobile home, and it was the staff's recommendation that his request be granted with a re-evaluation of the situation after the 60 days.
Mr. McMillin, in whose district the property was located, stated that he did not like to tear anybody's house down, but the property had been in deplorable condition for a long time. He pointed out that parish ordinances required 80 feet of road frontage for a dwelling, and Mr. Broussard only had about 59 feet.
Mr. Crain stated that this was a legitimate question, and the staff would have to check the records in the Tax Assessor's office to determine if Mr. Broussard had sold some of his property, because he could not obtain a permit without the necessary footage. Mr. Crain further stated that Mr. Broussard had indicated that he intended to rent the trailer to his brother-in-law.
Mr. Harmon Joseph Broussard (owner of the subject property), 3538 Harmon Broussard Road, Sulphur, appeared before the Police Jury and explained that he had dedicated a right-of-way to the Parish one-fourth of a mile in length which extended to the corner of his property; however, his neighbor across the street did not want the road blacktopped all the way to the end, so the blacktopping did not extend the full length of the right-of-way.
Mr. Broussard spoke of several hardships he had experienced, i.e. divorce, death of a son approximately 15 years ago, his health problems related to diabetes and high blood pressure. He stated that his monthly income was $555, and he worked odd jobs to make money, but there were some days he could not work because of his health problems.
Mr. Broussard stated that he had sold the trailer to his former brother-in-law who had borrowed money to make the repairs, but he had stopped upon receipt of the notice from the Parish of the condemnation hearing. Mr. Broussard reiterated his belief that the right-of-way extended the length of his property and stated that he had always had problems with his neighbor, Mr. Johnson (the complainant), ever since he (Mr. Broussard) had started selling his property which he would not have done had he not needed to.
Mr. Manuel asked how long the trailer had been on the property, and Mr. Broussard stated that he had moved it there in 1991 and had lived in it a while but when he put his house in, he moved the trailer to the side, but it was still on the same property. Mr. Manuel asked if the person who had bought the trailer had the money to make the repairs, and Mr. Broussard's former brother-in-law advised that he did, and it would take him 60 to 90 days to repair it, depending on the weather.
Mr. Andrepont questioned the purpose of bringing up the road frontage issue at this point, since the trailer had been out there for nine years. Mr. Crain explained that the only reason for bringing it up was that Mr. Broussard had the house on the property, and the trailer had never been permitted which would require 80 feet of road frontage for installation of a mechanical sewer system, or 160 feet for two units.
Motion was made by Mrs. Treme and seconded by Mr. Manuel to allow Mr. Broussard 90 days to make the necessary repairs to the mobile home and if not done in 90 days, that the mobile home be condemned.
Mrs. Treme then amended her motion, and Mr. Manuel accepted the amendment to allow the trailer to be permitted under existing conditions since it had been located on the property for as long as it had.
Mr. Ray Johnson, 3541 Harmon Broussard Road, Sulphur, and his wife Martha, appeared before the Police Jury. Mr. Johnson stated that Mr. Broussard's house had been permitted in December of 1997 and that Mr. Broussard had told the Parish at that time that he was going to repair the trailer, yet it had been sitting there for over three years, and it was falling apart. Mr. Johnson stated that Mr. Broussard only had 59 feet of frontage, according to the Tax Assessor's records, and the Engineering Department had indicated that the right-of-way was a private right-of-way and that the Parish's jurisdiction stopped at the end of the blacktop.
Mr. Johnson stated that Mr. Broussard's property was becoming a junk pile directly in his (Mr. Johnson's) front yard, and he distributed photographs of pictures taken from his front door.
Mrs. Johnson stated that one of their main concerns was the continual moving in of structures, none of which were finished, and that because of the subdividing of the property and depletion of road frontage, Mr. Broussard only had 59' of frontage.
Mr. Johnson stated that Mr. Broussard had lived in the house two years but never moved his belongings out of the trailer, and he felt he had been afforded plenty of time.
Mr. McMillin stated that he could see both sides of this issue and could understand Mr. Johnson's desire to keep his property value up, but he also sympathized with Mr. Broussard.
In answer to a question by Mr. Collins, Mr. Hooper stated that the trailer had been left on the property for storage, and the Parish had not pursued that because Mr. Broussard had said he would sell the trailer at a later date. He pointed out that the house had replaced the trailer, and technically the trailer was there illegally. Mr. Hooper also stated that Mr. Broussard had subdivided his property three times and was down to 59 feet of road frontage but before he subdivided, he had enough frontage to allow both structures.
Mr. Crain pointed out that Mr. Broussard had a large tract of land, but what was reduced during the subdividing was the frontage along the road and while he met the land size requirements, he apparently did not meet the frontage requirements.
Mr. Broussard stated that he had 338 feet of frontage remaining based on the easement he had originally signed, and the Parish had not blacktopped the entire length of the road. He also stated that he had intended to get rid of the trailer and then could not fix it because he had gotten sick and had no income.
Mr. McMillin expressed his concern about the precedent the Police Jury might be setting and pointed out that there was more than just one issue involved because of the road frontage question.
Mrs. Treme pointed out that Mr. Broussard could come back before the Police Jury to ask for a zoning variance to allow the mobile home to remain on the property, and the amendment to the motion on the floor was withdrawn.
A roll call vote was then taken on the motion on the floor which was to allow Mr. Broussard 90 days to make the necessary repairs to the mobile home and if not done in 90 days, that the property be condemned, and the result was as follows:

AN ORDINANCE ordering repair of the manufactured home owned by Harmon Joseph Broussard, located at 3538 Harmon Broussard Road, described as S 15 Acres of W ˝ SW NE 2.9.10, Less 9 Acres, in Ward Six of Calcasieu Parish, Louisiana.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 19th day of October, 2000, that:
SECTION 1. The facts as set forth at the meeting of the Police Jury of Calcasieu Parish, Louisiana, on this date, justify an order of this Police Jury, and it is hereby ordered that the manufactured home owned by Harmon Joseph Broussard, located at 3538 Harmon Broussard Road, described as S 15 Acres of W ˝ SW NE 2.9.10, Less 9 Acres, in Ward Six of Calcasieu Parish, be repaired. A development permit shall be obtained by the owner prior to commencement of repairs, and the structure shall be repaired within ninety (90) days of this order. The nature of repairs shall include, but are not limited to:
This order is made this 19th day of October, 2000, and is final unless appealed within five (5) days.
SECTION 2. The owner is hereby ordered to schedule an inspection with the Director of Planning and Development every 30 days from the adoption of this ordinance to determine the progress of the repairs.
SECTION 3. If said building or structure on the premises hereinabove described in the Parish of Calcasieu, Louisiana, is not repaired within ninety (90) days from the date of this order, notice is hereby given that the Director of Parish Planning and Development shall have work commenced on the demolition and removal of said building or structure on the premises hereinabove described, in which case the Police Jury shall not be liable for damages, and the Police Jury shall have a lien and privilege against the property and improvements upon which the building or structure was situated for the cost of demolishing and removing the building or structure, and for the cost of maintaining the property.
SECTION 4. In the event the repairs are not performed in compliance with this order, the Director of Parish Planning and Development is hereby authorized and directed to give notice of said demolition and removal as required by law.
SECTION 5. The Director of Parish Planning and Development is hereby authorized to enter into a contract to accomplish the demolition of the building or structure, if necessary, and to pay the fees of the contractor from appropriate Parish funds, and to pay any and all costs associated with the demolition. Any amounts expended by the Parish of Calcasieu shall be included in the statement of costs in accordance with Chapter 6 of the Code of Ordinances of Calcasieu Parish, Louisiana, and the Parish of Calcasieu shall have a lien and privilege for all costs resulting from the demolition.
SECTION 6. This ordinance shall become effective immediately.

Motion was made by Mr. Kleckley, seconded by Mrs. Treme and carried unanimously to go into executive session to discuss Lawsuit No. 99-6252 (Wall vs. Police Jury). Following the executive session, the Police Jury reconvened in regular session, and motion was made by Mr. Andrepont, seconded by Mrs. August and carried unanimously to approve the report given by legal counsel during the executive session.
There being no further business, President Mackey declared the meeting to be adjourned.
