The Police Jury of Calcasieu Parish, Louisiana, met in regular session at 5:30 p.m. on Thursday, June 1, 2000, in the Police Jury Room on the first floor of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with the Honorable Charles S. Mackey, D.D.S., President, presiding, and the following members present:

Mesdames Luvertha August, and Sandra J. Treme; and Messrs. Francis Andrepont, Algie Breaux, Brent Clement, Calvin Collins, Mike Danahay, Enos Derbonne, Chuck Kleckley, Chris Landry, Hal McMillin, and Don Manuel

President Mackey called the meeting to order, and the invocation was pronounced by Dr. Whitney Harris, Executive Director of Human Resources and Social Equities at McNeese State University, which was followed by the Pledge of Allegiance led by Mr. Derbonne. The roll was called with the result being as outlined above.

Mr. Breaux presented a Certificate of Appreciation to Mr. A. J. Holland who had recently been recognized by the Council on Aging, Inc. on Senior Day in April for his outstanding service and dedication to his community. Mr. Holland thanked everyone for recognizing him with this award.

President Mackey, Mrs. August, and Mr. Collins presented a grant in the amount of $5,000.00 to the North Lake Charles Economic Development District. Mr. Albert Miller, Vice President of the District, thanked the Police Jury for its support and stated that for the first time, there was an opportunity to put together economic development plans for a historically disadvantaged area of the Parish, and this would require a lot of hard work.

Mr. Scott Thorn, 422 Moss Street, Lake Charles, appeared before the Police Jury and extended an invitation to join him and other members of the Captain James Wesley Bryan Post of the Sons of the Confederate Veterans on Saturday, June 3, 2000, for recognition of the last Confederate Memorial Day in the 20th Century. He stated that 1222 veterans would be remembered and honored, some of whom were former members of the Calcasieu Parish Police Jury.

With respect to the issue of the disposal of incinerator ash which the Police Jury had discussed and had adopted a resolution at its regular meeting on May 4, 2000, in opposition to it being disposed of at the Chemical Waste Management, Inc. (CWMI) facility in Carlyss, Mr. Clement advised that he had spoken the day before the meeting on this date to CWMI personnel and was assured that the ash would not be disposed of in Carlyss. He expressed his appreciation to the members of the Calcasieu Legislative Delegation and to CWMI's local management for their assistance in this matter.

Motion was made by Mr. Clement, seconded by Mrs. August and carried unanimously that issuance of the following application for a Type C permit be ratified and that the following application for a liquor and beer permit be approved:

Chairman Griffin advised that proposals had been advertised for receipt on May 24, 2000, by the Parish Purchasing Agent, and the proposal of the "Lake Charles American Press" was received after the deadline set forth in the advertisement.

Recommendation was made by the Agenda Committee to waive the deadline requirement, since the Police Jury was not legally required to solicit bids for the official journal, and the following proposals were then opened and read:

Following opening of the proposals, the Agenda Committee recommended that the low proposal of the "Lake Charles American Press" be accepted in the amount of $3.50 per square of 100 words or $3.00 per square if submitted on computer disk.

Chairman Griffin advised that the purpose of the meeting on this date was to review the proposed agenda for the regular meeting of the Police Jury to be held on June 1, 2000.

Following review of the items to be considered by the Police Jury on May 4th, it was unanimously recommended that the proposed agenda be accepted with the following addition:

Consideration of adopting a resolution in support of the efforts of Sulphur Parks and Recreation (SPAR), Sulphur High School, the Greater Sulphur/Lake Charles area and all of Calcasieu Parish in hosting the State High School Girls Softball Tournament for the years 2001 and 2002, and more particularly, to support this Southwest Louisiana endeavor.

Also, recommendations for appointments to various boards of special service districts were made by members of the Committee.

There being no further business, Chairman Griffin declared the meeting to be adjourned.

A meeting of the Public Works Committee was held on Thursday, May 25, 2000, in the Police Jury Meeting Room in the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with Mr. Algie Breaux, Chairman, presiding, and the following members present:

Said Committee:

(1) Recommended that the appearance of Mr. Denver Lowe in reference to a complaint about the noise ordinance as it relates to Granger's Restaurant on Highway 3059 be deleted from the agenda due to the fact that Mr. Lowe was not present at the meeting.

(2) Recommended that a resolution be adopted accepting Tallow Woods Subdivision located off of Boudoin Road in Section 14, Township 10 South, Range 10 West in Ward Four.

(3) Recommended that a resolution be adopted accepting C Wait Estates, Phase Two and Phase Three, off of Packing House Road in Section 27, Township 9 South, Range 7 West in Ward Eight.

(4) Received report from the Parish Engineer with reference to adding the installation of culverts on Goodman Road in Ward Three to the 2000-2002 Capital Improvement Program and recommended that this work be included in said program at a cost of approximately $125,000.

(5) Recommended that existing ordinances be amended and/or ordinances be adopted regulating speed limits on the following roads:

(6) Recommended that the President of the Police Jury be authorized to execute the necessary documents for acquisition of right-of-way from Kenneth Paul Lyons, Helen Jean Lyons, and Elder Marie Lyons on WPA Road in Wards Four and Seven (Calcasieu Parish Project No. 2000-03), in accordance with criteria established by the Police Jury and recommendation of the Parish Engineer.

(7) Recommended that an ordinance be adopted authorizing the issuance of paving certificates to the contractor for the unpaid balance of Calcasieu Parish Project No. 1999-11 (Front Foot Assessment Project).

(8) Recommended that the Parish Administrator be authorized to advertise for bids for Calcasieu Parish Project No. 2000-12 (Special Drainage Project in Ward One - Belle Avenue, Phil's Lane, Rhett Drive, Tara Avenue, Ashley Drive, Atlanta Drive, Hampton Drive, Melanie Avenue, Bonnie Blue Avenue, Northern Drive, Beau Avenue, Scarlett Drive, Joshua Lane, and Southern Drive).

(9) Recommended that Calcasieu Parish Project No. 2000-01 (Ward Two - Alta Road, Cemetery Road and Fruge Road; Ward Three - Corbina Road and East Gauthier Road; and Ward Eight - Bobolink Circle, Boys Village Road, Chickadee Circle, Clarence Corbello Road, Corbello Road, Finch Circle, Flicker Circle, Oriole Circle, Sandpiper Circle, and White Oak Drive) be accepted as substantially complete.

There being no further business, Chairman Breaux declared the meeting to be adjourned.

Motion was made by Mrs. Treme, seconded by Mr. Breaux and carried unanimously that Recommendation No. 1 of the Public Works Committee as outlined heretofore be approved.

With respect to said recommendation, Mr. Andrepont pointed out that while he did not have a problem when appropriate in listening to persons who appeared before the Police Jury with a complaint, the Police Jury was a policymaking body and did not enforce laws that they adopted. He further pointed out that enforcement was law enforcement's responsibility, and if there was a problem with the noise ordinance, it was the responsibility of the appropriate law enforcement agency to make recommendations to the Police Jury concerning same.

Motion was made by Mr. Andrepont and seconded by Mrs. August that persons with these types of complaints be discouraged from appearing before the Police Jury in circumstances when the Police Jury was not in a position to do anything about their complaints, and further, if the Sheriff's Department or appropriate law enforcement agency could provide no relief, then those persons would then be allowed to appear before the Police Jury.

Mr. Breaux suggested that persons with complaints contact the staff after contacting law enforcement and prior to appearing before the Police Jury. Ms. Mailhes explained that Mr. Lowe had done that, and the staff had measured the distance between his residence and Granger's Restaurant, as per the requirements of the Parish noise ordinance, and had determined that he did not live within 200' of the restaurant and was, therefore, not covered by said ordinance.

Mr. Vickers stated that Mr. Lowe had initially contacted the Sheriff's Department, and he was told that his property was outside the limits of the ordinance; then Mr. Lowe contacted the staff, and the distance was measured. Mr. Vickers also stated that the staff had gone even further and had notified the owner of Granger's Restaurant and asked them to lower the volume of the music, but Mr. Lowe still complained. He stated that the staff met personally with the restaurant owners, and Mr. Collins had been out to the location as well. Mr. Vickers advised that the reason Mr. Lowe had not appeared at the Public Works Committee meeting, after having made the request to do so, was because he did not want the owners of the restaurant to be present when the matter was discussed, and Mr. Lowe was told that was not the way the Parish conducted its business. Mr. Vickers emphasized the fact that the staff did try to administratively resolve the problem, but Mr. Lowe felt the only way to get his point across was to appear before the Police Jury.

Mr. Clement questioned how persons with complaints could be discouraged from appearing before the Police Jury, and Mr. McMurry stated that it would help to have formal action of the Police Jury in this regard although the staff did automatically attempt to discourage them if they had not gone through the proper procedures to resolve their complaint.

A vote on the motion on the floor carried unanimously.

It was moved by Mrs. Treme, seconded by Mr. McMillin and carried unanimously to approve Recommendation Nos. 2, 3, 4, 5, 6, 7, 8 and 9 of the Public Works Committee as outlined heretofore; whereupon, the following resolutions and ordinances be adopted:

RESOLUTION

WHEREAS, Dalton Langford subdivided certain property in Ward Four of Calcasieu Parish, Louisiana, known as Tallow Woods Subdivision, a subdivision in Section 14, Township 10 South, Range 10 West, Calcasieu Parish, Louisiana, and

WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, and

WHEREAS, said subdivision plat was prepared by K. Carl Johnson, Registered Land Surveyor No. 4866, and certification was made that the subdivision plat was prepared in accordance with R.S. 33:5051 and all other laws of the State of Louisiana, and

ORDINANCE NO. 4199

AN ORDINANCE amending Chapter 17, Art. II, Div. 2. Speed Limits, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to establish speed limits on Rip Henagan Road in Ward Six and on Harrington Road in Ward Two in Calcasieu Parish.

BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, that it does hereby amend Chapter 17, Art. II, Div. 2. Speed Limits, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to establish speed limits on the following roads in Calcasieu Parish:

SECTION 1. Sec. 17-64, Twenty five miles per hour, of the Code of Ordinances is amended by including the following road in the provisions of said section:

Rip Henagan Road in Ward Six

SECTION 2. Sec. 17-67, Forty miles per hour, of the Code of Ordinances is amended byincluding the following road in the provisions of said section:

Harrington Road in Ward Two

BE IT FURTHER ORDAINED that effective immediately, no vehicle shall travel in excess of the maximum speed limits established above.

BE IT FURTHER ORDAINED that appropriate signs shall be posted along the roads set forth above, at reasonable intervals, to warn the operators of vehicles of the speed limits herein imposed.

BE IT FURTHER ORDAINED that anyone violating the provisions of this ordinance, upon conviction, shall be fined as provided in Section 1-9 of the Code of Ordinances of Calcasieu Parish, Louisiana.

BE IT FURTHER ORDAINED that the provisions of this ordinance shall be included and incorporated in the Code of Ordinances as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.

This ordinance was adopted on the 1st day of June, 2000.

AN ORDINANCE, authorizing and providing for the issuance, execution, negotiation, and delivery of ten (10) negotiable interest bearing paving certificates of the Parish of Calcasieu, State of Louisiana, in the amount of Seventy Nine Thousand Seven Hundred and Four and 73/100 ($79,704.73) Dollars, prescribing the form thereof, designating the date, denomination, time and place of payment, and providing for the payment thereof in principal and interest for the purpose of paying in part for the paving of certain streets or portions of certain streets within the Parish of Calcasieu, State of Louisiana, said streets being described in detail on Exhibit "A" which is attached hereto and made a part hereof.

WHEREAS, the Police Jury of the Parish of Calcasieu, State of Louisiana, the governing authority of said Parish, in strict compliance with Louisiana Revised Statutes 33:3689.1 - 33:3689.17 and all other laws on the same subject matter, adopted on the 19th day of April, 2000, Local or Special Assessment Ordinance No. 112, which ordinance was duly published and recorded in the manner provided for by law, said ordinance levying local or special assessments in the total amount of One Hundred and Five Thousand One Hundred Fifty Eight and 52/100 ($105,158.52) Dollars to cover the cost of constructing street paving improvements along certain streets or portions of certain streets within the Parish of Calcasieu, State of Louisiana, said streets being described in detail on Exhibit "A"which is attached hereto and made a part hereof.

WHEREAS, of the amount so levied by said Local or Special Assessment Ordinance No. 112 aggregating One Hundred and Five Thousand One Hundred Fifty Eight and 52/100 ($105,158.52) Dollars, there has been cash or adjustments received in the amount of Twenty Five Thousand Four Hundred Fifty Three and 79/100 ($25,453.79) Dollars, leaving a balance of Seventy Nine Thousand Seven Hundred and Four and 73/100 ($79,704.73) Dollars to be paid in installments or deferred payments.

WHEREAS, under the provisions of Louisiana Revised Statutes 33:3689.1 - 33:3689.17 and all other laws pertaining to the same subject matter, the amount of installments or deferred payments shall be represented by the issuance and delivery to the Contractor, or his designee, of negotiable interest bearing paving certificates, as provided for in said Act and by prior action of this Police Jury.

NOW THEREFORE,

SECTION 1: BE IT ORDAINED BY THE POLICE JURY OF THE PARISH OF CALCASIEU, STATE OF LOUISIANA, acting as the governing authority of said Parish, in regular session convened, that all proceedings had by the Police Jury with respect to Local or Special Assessment Ordinance No. 112 of the Parish of Calcasieu, Louisiana, for the year 2000, referred to in the preamble hereto, have been examined, investigated, and are hereby determined to be regular and legal; that the amounts so assessed in the sum of One Hundred and Five Thousand One Hundred Fifty Eight and 52/100 ($105,158.52) Dollars have been found and determined and are hereby certified to be correct and in conformity with the provisions of law; and that the said Local or Special Assessment Ordinance No. 112 has been duly published and duly filed for record in the Mortgage Records of the Parish of Calcasieu, Louisiana, and has been duly recorded in said Mortgage Records.

SECTION 2: BE IT FURTHER ORDAINED, ETC., that in compliance with and under and by virtue of the authority of Article VI, Section 36, of the Constitution of the State of Louisiana, for the year 1974, and Louisiana Revised Statutes 33:3689.1 - 33:3689.17, and all other laws on the same subject matter, there be and there is hereby authorized and directed the issuance of negotiable interest bearing paving certificates of the Parish of Calcasieu, State of Louisiana, in the principal sum of Seventy Nine Thousand Seven Hundred Four and 73/100 ($79,704.73) Dollars to represent the installments or deferred payments to cover the unpaid cost for constructing street paving improvements along those portions of those streets within the limits of Calcasieu Parish, Louisiana, set out in Local or Special Assessment Ordinance No. 112 of the Parish of Calcasieu, Louisiana, for the year 2000, adopted on the 19th day of April, 2000, and hereinabove referred to. Said paving certificates shall be dated the 15th day of June, 2000, shall bear interest at the rate of five and one-quarter percent (5.25%) per annum, from said date until paid, said interest to be payable annually on the 15th day of June each year, commencing June 15, 2001.

Said Paving Certificates are to be numbered One (1) to Ten (10), both inclusive; Certificate Nos. 1, 2, 3, 4, 5, 6, 7, 8, and 9 to be in the denomination of Seven Thousand Nine Hundred and Seventy and 48/100 ($7,970.48) Dollars each; and Certificate No. 10 to be in the denomination of Seven Thousand Nine Hundred Seventy and 41/100 ($7,970.41) Dollars, said Paving Certificates to mature annually and become due and payable as follows, to-wit:

SECTION 3: BE IT FURTHER ORDAINED, ETC., that interest on the Paving Certificates shall commence on June 15, 2000, and shall be payable on June 15, 2001, and annually thereafter on June 15th of each year. Principal and interest on the Paving Certificates are payable to the persons in whose names the Certificates are registered at the close of business on the May 31st immediately preceding such principal or interest payment date.

This Paving Certificate of Indebtedness is one of an issue of ten (10) certificates, aggregating in principal the sum of Seventy Nine Thousand Seven Hundred Four and 73/100 ($79,704.73) Dollars, bearing interest at the rate of five and one-quarter percent (5.25%) per annum, from June 15, 2000, until paid, issued by the Parish of Calcasieu, State of Louisiana, to represent the installments or deferred payments to cover the unpaid cost of the construction of street paving with improvements, without sidewalks on those streets within the corporate limits of the Parish of Calcasieu and outside of municipal corporations, as set out in Local or Special Assessment Ordinance No. 112 of the Parish of Calcasieu, State of Louisiana, for the year 2000, adopted on April 19, 2000, and by Ordinance No. 4200 of the Parish of Calcasieu, State of Louisiana, for the year 2000, adopted on June 1, 2000, by the governing authority of said Parish, under and by virtue of Article VI, Section 36, of the Constitution of the State of Louisiana, for the year 1974, and Louisiana Revised Statutes 33:3689.1 - 33:3689.17 and all other laws on the same subject matter, and pursuant to proceedings regularly and legally taken by the governing authority of said Parish of Calcasieu, State of Louisiana.

This Certificate, and the issue of which it forms a part, is secured by and payable in principal and interest by the irrevocable pledge and dedication of the funds to be derived from the collection of the unpaid local or special assessments levied by Local or Special Assessment Ordinance No. 112 adopted April 19, 2000, and Ordinance No. 4200 adopted June 1, 2000, hereinabove referred to, said assessments having been levied on the real property abutting the portions of those streets set out in said Ordinance, which have been improved by the construction of street paving improvements thereon, and which local or special assessments are payable in annual installments or deferred payments as provided for by law.

Said funds, when collected, shall be deposited in a separate account known as "Amortization Fund for Paving Certificates of Indebtedness of the Parish of Calcasieu, Louisiana, Series 1999-11, dated June 15, 2000", and said funds so deposited shall be used for no purpose other than to pay principal of and the interest on this Certificate and the issue of which it forms a part on its respective maturity dates. The Parish of Calcasieu, State of Louisiana, obligates itself and is bound under the terms and provisions of law to properly allocate the funds so collected as hereinabove set out.

This Paving Certificate and all of the Paving Certificates of this issue may be called for redemption by the Parish of Calcasieu, State of Louisiana, on June 15th of any year or after June 15, 2001, at a price of $1.0525 on the dollar of the face value thereof and accrued interest to the call date, provided that said Paving Certificates are called from each maturity outstanding at the time in the event less than all outstanding certificates are called, and provided further that official notice of such call shall have been given in writing by registered mail to the registered owners of said Paving Certificates and the Paying Agent/Registrar not less than thirty (30) days prior to the call date.

The Parish shall cause to be kept at the Office of the Paying Agent/Registrar a register (the "Certificate Register") in which registration of the Certificates and of transfers of the Certificates shall be made as provided herein. This Certificate may be transferred, registered and assigned only on the Certificate Register of the Paying Agent/Registrar, and such registration shall be at the expense of the Parish. This Certificate may be assigned by the execution of the assignment form hereon or by other instrument of transfer and assignment acceptable to the Paying Agent/Registrar. A new Certificate or Certificates will be delivered by the Paying Agent/Registrar to the last assignee (the new registered owner) in exchange for the transferred and assigned Certificate within three (3) days after receipt of the Certificate to be transferred in proper form. Such new Certificate or Certificates shall issue in the name of the transferee a new registered Paving Certificate of the same aggregate principal amount and maturity as the surrendered Paving Certificate. Neither the Parish nor the Paying Agent/Registrar shall be required to issue, register, transfer or exchange any Certificate during a period beginning at the opening of business on the 15th day next preceding an interest payment date and ending at the close of business on the interest payment date; except, however, that in the event any Certificates are called for redemption prior to maturity, neither the Parish nor the Paying Agent/Registrar shall be required to issue, register, transfer or exchange any such Certificate to be so redeemed during a period beginning at the opening of business fifteen (15) days before the date of the mailing of a notice of redemption of such Certificates and ending on the date of such redemption.

The Parish of Calcasieu, State of Louisiana, and the Paying Agent/Registrar may deem and treat the person in whose name this Certificate shall be registered upon the Certificate Register of said Parish as the absolute owner of this Certificate, whether this Certificate shall be overdue or not, for the purpose of receiving payment of, or on account of, the principal and interest on this Certificate and for all other purposes, and all such payments so made to any such registered owner or upon his order shall be valid and effectual to satisfy and discharge the liability upon this Certificate to the extent of the sum or sums so paid, and neither the Parish of Calcasieu, State of Louisiana, nor the said Paying Agent/Registrar shall be affected by any notice to the contrary.

It is certified that this Certificate is authorized by and is issued in conformity with the requirements of the Constitution and Statutes of the State of Louisiana. It is hereby further certified and recited by the Parish that all acts, conditions and things necessary to be done, precedent to and in the issuance of this Certificate or the issue of which this Certificate forms a part in order to make them the legal, valid, and binding obligations of the Parish in accordance with their terms, have been done, have happened, and have been performed in regular and due form as required by law, that the local or special assessments have been duly levied, and that the issue of such Certificates does not exceed the principal amount of the unpaid installments or deferred payments or exceed or violate any constitutional, statutory, or other limitation upon the amount of the bonded indebtedness prescribed by law for the Parish and that the Parish shall pay the difference, if any, in interest being collected from said unpaid installments and the interest rate on the Certificates.

SECTION 6: BE IT FURTHER ORDAINED, ETC., that the Paving Certificates herein authorized shall be signed by the President of the Police Jury and the Parish Secretary of the Parish of Calcasieu, Louisiana (the signature of either the President or the Secretary being authorized to be a facsimile of their signatures), and authenticated by the Paying Agent/Registrar, for, on behalf of, in the name of and under the corporate seal of said Parish of Calcasieu, State of Louisiana.

SECTION 7: BE IT FURTHER ORDAINED, ETC., that this Police Jury, having examined and determined the regularity of all proceedings had in connection with the issuance of the Paving Certificates herein authorized, and having examined and verified the correctness thereof, each of the said Paving Certificates shall contain the following recital, to-wit:

"It is certified that this Paving Certificate is authorized by and is issued in conformity with the requirements of the Constitution and Statutes of the State of Louisiana."

SECTION 8: BE IT FURTHER ORDAINED, ETC., that the Paying Agent/Registrar is hereby authorized to sign the Certificate of Registration on each Paving Certificate for which payment has been received or a transfer requested. No Paving Certificate shall be valid unless so authenticated by said Paying Agent/Registrar. Such certificate of the Paying Agent/Registrar upon any Paving Certificate executed on behalf of Calcasieu Parish shall be conclusive evidence that the Paving Certificate so authenticated has been duly authenticated and delivered under this ordinance and that the registered owner thereof is entitled to the benefits of this ordinance.

SECTION 9: BE IT FURTHER ORDAINED, ETC., that Paving Certificates, upon surrender thereof at the principal office of the Paying Agent/Registrar with a written instrument of transfer satisfactory to the Paying Agent/Registrar, duly executed by the registered owner or his duly authorized attorney, may at the option of the registered owner thereof, and upon payment by such registered owner of any charges which the Paying Agent/Registrar may make as provided in Section 11 be exchanged for an equal aggregate principal amount of registered Paving Certificates of the same maturity in any other authorized denominations.

SECTION 10: BE IT FURTHER ORDAINED, ETC., that Paving Certificates shall be transferable only upon the books of Calcasieu Parish which shall be kept for that purpose at the principal office of the Paying Agent/Registrar by the registered owner thereof in person or by his attorney duly authorized in writing, upon surrender thereof, together with a written instrument of transfer satisfactory to the Paying Agent/Registrar duly executed by the registered owner or his duly authorized attorney. Upon the transfer of any such Paving Certificate, the Paying Agent/Registrar shall issue in the name of the transferee a new registered Paving Certificate or Paving Certificates of the same aggregate principal amount and maturity as the surrendered Paving Certificate.

Calcasieu Parish and the Paying Agent/Registrar may deem and treat the person in whose name any Paving Certificate shall be registered upon the Paving Certificate Register of Calcasieu Parish as the absolute owner of such Paving Certificate, whether such Paving Certificate shall be overdue or not, for the purpose of receiving payment of, or on account of, the principal of and interest on such Paving Certificate and for all other purposes, and all such payments so made to any such registered owner or upon his order shall be valid and effectual to satisfy and discharge the liability upon such Paving Certificate to the extent of the sum or sums so paid, and neither Calcasieu Parish nor the Paying Agent/Registrar shall be affected by any notice to the contrary.

SECTION 11: BE IT FURTHER ORDAINED, ETC., that in all cases in which the privilege of exchanging or transferring Paving Certificates is exercised, Calcasieu Parish shall execute and the Paying Agent/Registrar shall authenticate and deliver Paving Certificates in accordance with the provisions of this ordinance. All Paving Certificates surrendered in any such exchanges or transfers shall forthwith be cancelled by the Paying Agent/Registrar. For every such exchange or transfer of Paving Certificates, Calcasieu Parish or the Paying Agent/Registrar may make a charge sufficient to reimburse it for any tax, fee or other governmental charge required to be paid with respect to such exchange or transfer. A holder of a Paving Certificate may also be required to pay a fee for each new Paving Certificate issued on any such exchange or transfer to reimburse Calcasieu Parish for administrative expenses. Neither Calcasieu Parish nor the Paving Officer, or agent designated by the Parish Administrator, shall be required (a) to transfer or exchange Paving Certificates for a period of fifteen (15) days next preceding an interest payment date on the Paving Certificates or the date on which Paving Certificates are selected to be redeemed or thereafter until after the first mailing of any notice of redemption; or (b) to transfer or exchange any Paving Certificates called for redemption.

SECTION 12: BE IT FURTHER ORDAINED, ETC., that the Paving Certificates herein authorized shall be secured and payable solely in principal and interest from the funds to be derived from the collection of the unpaid local or special assessments levied by Local or Special Assessment Ordinance No. 112 adopted on April 19, 2000, on each lot or parcel of real estate abutting on the streets improved, which funds derived from the collection of the said unpaid local or special assessments together with any interest thereon, shall be and they are irrevocably pledged and dedicated to the principal of and the interest on said Paving Certificates and shall be set aside in a separate and special fund to be known as "Amortization Fund for Paving Certificates dated June 15, 2000", and shall not be drawn upon for any purpose other than to pay said principal and interest.

SECTION 13: BE IT FURTHER ORDAINED, ETC., that the Police Jury of the Parish of Calcasieu, State of Louisiana, acting as the governing authority of said Parish, does hereby obligate itself and is bound under the terms, provisions, and conditions of law to properly collect the said installments or deferred payments, together with the interest thereon, when due and collectible, said installments and deferred payments representing the unpaid cost of the construction of street paving along the said streets hereinabove set out, and having been levied by Local or Special Assessment Ordinance No. 112. In the event of default in the payment of said local or special assessments, said governing authority shall proceed to collect said default or defaults in the manner provided for by law.

SECTION 14: BE IT FURTHER ORDAINED, ETC., that the President and Secretary of the Police Jury of the Parish of Calcasieu, Louisiana, be and they are hereby empowered, authorized and directed to have the said Paving Certificates printed, to execute the same as hereinabove provided, and to deliver said Certificates to the Contractor, or his designee, in partial payment of the contractual obligation of the Parish covering said improvements.

SECTION 15: BE IT FURTHER ORDAINED, ETC., that this Paving Certificate and all of the Paving Certificates of this issue may be called for redemption by the Parish of Calcasieu, State of Louisiana, on June 15th of any year on or after June 15, 2001, at a price of $1.0525 on the dollar of the face value thereof and accrued interest to the call date, provided that said Paving Certificates are called by lot and that insofar as practicable an equal amount of said Paving Certificates are called from each maturity outstanding at the time in the event less than all outstanding certificates are called, and provided further that official notice of such call shall have been given in writing by registered mail to the registered owners of said Paving Certificates and to the Paying Agent/Registrar not less than thirty (30) days prior to the call date.

SECTION 16: BE IT FURTHER ORDAINED, ETC., that the President and the Secretary of the Police Jury of the Parish of Calcasieu, State of Louisiana, be and they are hereby empowered, authorized and directed to issue and deliver vouchers drawn against the funds derived from the assessments paid in cash in accordance with and in the respective amounts set out in the report of the Parish Engineer and accepted by the Police Jury of the Parish of Calcasieu, State of Louisiana, in full payment of all costs incurred in connection with the issuance and delivery of the Paving Certificates herein authorized.

SECTION 17: BE IT FURTHER ORDAINED, ETC., that a copy of this ordinance shall be published immediately after its adoption in one issue of the official journal of the Parish of Calcasieu. If the validity of the issuance of the Paving Certificates authorized herein is not raised within thirty (30) days from the date of such publication, the authority to issue said certificates, the legality thereof and of the local or special assessments necessary to pay the same, shall be conclusively presumed, and no court shall thereafter have authority to inquire into such matters.

President Mackey advised that a presentation would be given at this time by Ms. Laura Lanza, Director of the Parish's Animal Control Department, with regard to the possible development of a dog park at the site of the Calcasieu Animal Control facility.

Ms. Lanza stated that her proposal would be to use part of the land at the very front of the new animal control facility to address suggestions made to her for the past 15 to 20 years by citizens and dog enthusiasts relative to a need for a safe and specialized park for dogs and their owners to exercise and socialize. Ms. Lanza stated that dog parks were a fast growing form of recreation especially because of limited access to public parks. She further stated that in addition to grants from the Association for Prevention of Cruelty to Animals, and Pets Mart, the Animal Concern and Education Corps had agreed to donate approximately $8-12,000 for the dog park, on top of the $55,000 already donated for the Adoption Garden at the Animal Control Facility.

Mr. McMillin asked about signage for the Animal Control Facility, and Ms. Lanza stated that while some of the citizens had asked for a larger sign out front, the public was finding its way to the facility. Mr. McMurry stated that the staff was looking at some different designs for signage of various parish installations and was in the process of trying to decide on the best design.

Motion was made by Mr. Andrepont, seconded by Mrs. Treme and carried unanimously that the development of a dog park at the site of the Calcasieu Animal Control Facility be approved and that the staff be authorized to solicit bids for fencing of the park.

Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Breaux and carried unanimously, the following resolutions were adopted:

RESOLUTION

WHEREAS, notification has been received that application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Calcasieu Parish Gravity Drainage District No. Five of Ward Four to fill an existing ditch and install a 60-inch reinforced concrete pipe to improve drainage and safety and to reduce erosion and maintenance in a portion of the Sumpter Ditch Drainage Channel east of Saunier Street in Sulphur, Louisiana, which is located within Section 3, Township 10 South, Range 10 West of Calcasieu Parish, Louisiana; and

WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Gravity Drainage District No. Five of Ward Four relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and

WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided a development permit is obtained from the Parish Division of Planning and Development prior to commencement of the project.

NOW THEREFORE,

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 1st day of June, 2000, that it does hereby indicate no objection to the proposal of Calcasieu Parish Gravity Drainage District No. Five of Ward Four to fill an existing ditch and install a 60-inch reinforced concrete pipe to improve drainage and safety and to reduce erosion and maintenance in a portion of the Sumpter Ditch Drainage Channel east of Saunier Street in Sulphur, Louisiana, which is located within Section 3, Township 10 South, Range 10 West of Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers and the Louisiana Department of Environmental Quality, and approvals are received from all appropriate state and federal agencies, and further, that a development permit is obtained from the Parish Division of Planning and Development prior to commencement of the project.

BE IT FURTHER RESOLVED that the no objection position of the Police Jury in this permit application is based solely on the evaluation of the parish staff of the project's effect on current parish ordinances and provisions.

BE IT FURTHER RESOLVED that a study on the environmental impact of the aforementioned project has not been made due to the lack of expertise of the parish staff to accomplish such a study, and the Police Jury requests that agencies and/or individuals with such expertise make an environmental review of said project and forward their findings to the U.S. Corps of Engineers.

WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of the City of DeQuincy relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation System; and

WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions, provided a development permit is obtained from the Parish Division of Planning and Development prior to commencement of the project.

NOW THEREFORE,

It was moved by Mr. Andrepont, seconded by Mr. Clement and carried unanimously that the Director of Planning and Development be authorized to notify the following property owners, in accordance with Article II of Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to show cause at a public hearing on June 22, 2000, or the first regular Police Jury meeting thereafter, as to why the structures on the properties as stipulated should not be condemned:

President Mackey advised that a report would be received at this time from the Parish Administrator on the status of activities of the Calcasieu Estuary Community Task Force. Mr. McMurry advised that said Task Force had met twice thus far, once in January and once in March of 2000. He further advised that EPA had just received the last package of sampling data from the laboratory in Houston, Texas, and was in the process of validating the samples with a report on same anticipated by the end of June. Mr. McMurry pointed out that one of the questions raised by the legislators was the reasoning behind releasing raw data to the public which had not been assessed or interpreted, and EPA had said that their rules and regulations require release of the data; therefore, a sub-committee of the Task Force had been appointed to meet with EPA to work out a mechanism for dissemination of same.

Mr. McMurry stated that the next step, after release of the data, was to hold a meeting of the Task Force in early to mid-July which would be geared toward a training session of the Task Force members on the whole issue of risk assessment which was one of the most important facets of the study, because sometimes the risks of complete cleanup were greater than managing the contamination that existed, and the Task Force members wanted someone from a scientific point of view to teach them as laymen what the whole process of risk assessment was all about and what purpose it served.

Mr. McMurry further advised that in August, the EPA expected to have a document dealing with project formulation, sampling and analysis for Phase II, which would begin in late Summer or Fall with the objective being to try to fill in the gaps between complete final analysis of the Calcasieu Estuary and its contamination, as well as corrective action needed.

Mr. McMurry closed by saying that he felt a report to the Police Jury on the activities of the Task Force was needed at this time, because nothing had been reported in the media recently about it, and he assured the jurors that the Task Force had not "died on the vine," but the gathering of data had been a slow process.

Motion was made by Mr. Andrepont, seconded by Mrs. August and carried unanimously that the report given by Mr. McMurry as outlined heretofore be received.

Upon motion made by Mr. Manuel, which was duly seconded by Mr. Andrepont and carried unanimously, the following resolution was adopted:

RESOLUTION

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 1st day of June, 2000, that it does hereby approve an Amendment No. One to the Original Lease between the Police Jury and the State of Louisiana, Department of Health and Hospitals, which will change the effective date of the lease to coincide with actual occupancy date with reference to space leased by said agency for the Regional Laboratory.

BE IT FURTHER RESOLVED that the President of the Police Jury is authorized to execute all documents related thereto.

(It was noted that the updated agreements were proposed to replace original contracts due to the dissolution of the original joint venture of the firms and assignment agreements entered into by said firms providing for the reassignment of existing projects.)

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 1st day of June, 2000, that it does hereby approve and ratify the authority of the President of the Police Jury to execute a Memorandum of Understanding (MOU) between the Workforce Investment Board (WIB) and the required One Stop Partners, in accordance with requirements of the Workforce Investment Act (WIA), as well as the JTPA Subrecipient Close-Out Plan, and the WIB Plan as previously submitted.

Upon motion made by Mr. Manuel, which was duly seconded by Mr. McMillin and carried unanimously, the Parish's Administrative Liaison Group was authorized to establish and implement appropriate automobile and insurance allowance provisions, in lieu of required utilization of a parish-owned vehicle, in accordance with terms of the administrative employment agreement.

It was moved by Mr. Andrepont, seconded by Mr. Derbonne and carried unanimously to authorize the Parish Administrator to delegate authority, as necessary and appropriate, for the official certifying of copies of parish records and documents.

Motion was made by Mr. Breaux, seconded by Mr. McMillin and carried unanimously that the following resolution be adopted:

RESOLUTION

WHEREAS, the Louisiana Department of Wildlife and Fisheries has announced that under budget recommendations of the State Administration for the state's new fiscal year which begins July 1, it may have a budget shortfall of several million dollars; and

WHEREAS, in order to accommodate this shortfall, the Department may have to seriously curtail operations and lay off numerous employees; and

WHEREAS, among other things, the Department may have to close a number of wildlife management areas including the Alexander State Forest, Attakapas, Big Colewa Bayou, Big Lake, Bodcau, Dewey Wills, Elbow Slough, Fort Polk, Grassy Lake, Hutchinson Creek, Joyce, Manchac, Peason Ridge, Sabine Island, Sandy Hollow, Soda Lake, and Spring Bayou; and

WHEREAS, the Department has announced plans to ask the Louisiana Wildlife and Fisheries Commission to shorten hunting seasons on the remaining wildlife areas, and to open others to "lottery hunts" only; and

WHEREAS, these plans would drastically affect a substantial segment of the Louisiana population, depriving them of a major recreational activity and causing serious economic harm to many hundreds and even thousands of Louisiana citizens; and

WHEREAS, these actions would also cause irreparable harm to Louisiana's reputation as a "Sportsman's Paradise."

NOW, THEREFORE,

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 1st day of June, 2000, that it does hereby go on record as urging the Louisiana Department of Wildlife and Fisheries, Governor Mike Foster, and the Louisiana Legislature to work toward a resolution of the funding problems of the Department which would permit that agency to carry out its mission without having to close wildlife management areas, or curtail the many hunting and fishing opportunities available to the citizens of this state.

BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the Department, to the Governor, and to the members of the Legislature so that they might be made aware of the position of this body on this most important matter.

With respect to the foregoing resolution, Mr. Breaux stressed the importance of maintaining current levels of operation of the Louisiana Department of Wildlife and Fisheries. Mr. McMillin agreed, adding that there was a safety factor involved also, and that the Calcasieu legislative delegation was working hard to solve the problems in order to make sure the local office remained open.

WHEREAS, Sandy Treme is currently serving her third term on the Calcasieu Parish Police Jury representing District 11; and

WHEREAS, Mrs. Treme served as President of the Police Jury in 1998 and as Vice-President in 1994; and

WHEREAS, Mrs. Treme is a member of various Police Jury committees and serves as the Police Jury's liaison to the Town of Vinton, City of DeQuincy, Calcasieu Parish Library Board, Calcasieu Parish Public Trust Authority, Vinton Harbor and Terminal District, West Calcasieu Community Center Authority, and the Southwest Louisiana Convention & Visitors Bureau; and

WHEREAS, Mrs. Treme also serves as Chairman of the Parks, Recreation and Tourism Committee of the Louisiana Police Jury Association, as well as a member of NACo's Environment, Energy and Land Use Steering Committee; and

WHEREAS, Mrs. Treme has earned the respect and admiration of her fellow parish officials throughout Louisiana for her leadership and judgment, and she has served with excellence and honor for the betterment of Calcasieu Parish and the State of Louisiana as a whole; and

WHEREAS, during her service as a parish official, Mrs. Treme has been very involved in the Police Jury Association of Louisiana and offers to the Executive Board of said organization her experience from a parish point of view, as well as knowledge of statewide parish needs; and

WHEREAS, Mrs. Treme has expressed her willingness and desire to serve as Region Seven Representative on the Executive Board of the Police Jury Association of Louisiana.

NOW, THEREFORE, BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 1st day of June, 2000, that it does hereby endorse Sandy Treme in her candidacy for the office of Region Seven Representative on the Executive Board of the Police Jury Association of Louisiana.

With reference to the foregoing resolution, Mr. Landry advised that this position on the Executive Board of the Louisiana Police Jury Association was a very important one, and the jurors would not want to lose Calcasieu Parish's seat as Region 7 Representative on said Board. Mr. Landry urged the jurors to make telephone calls in support of Mrs. Treme's candidacy.

Mr. Breaux pointed out that the ballot recently sent out by the Executive Board should have listed the candidates in alphabetical order, and Mr. McMurry stated that the ballot would not change, since it had already been mailed.

Mrs. Treme thanked the jurors for their support and advised that she was working very hard to secure the position on behalf of Calcasieu Parish by attending various police jury meetings throughout Region 7 and by talking to most, if not all, police jurors from these parishes.

(It was noted that proposals were advertised for receipt on May 24, 2000, by the Parish Purchasing Agent, and the proposal of the "Lake Charles American Press" was received after the deadline set forth in the advertisement. Recommendation was then made by the Agenda Committee on May 25th to waive the deadline requirement, since the Police Jury was not legally required to solicit bids for the official journal, and the following proposals were opened and read: "News Leader, Inc." - $4.00 per square of 100 words or $3.50 per square of 100 words if submitted on computer disk; and "Lake Charles American Press" - $3.50 per square of 100 words or $3.00 per square of 100 words if submitted on computer disk. Following opening of the proposals at the Agenda Committee meeting, said Committee recommended that the low proposal of the "Lake Charles American Press" be accepted in the amount of $3.50 per square of 100 words or $3.00 per square if submitted on computer disk.)

Upon motion made by Mr. Andrepont, which was duly seconded by Mr. Clement and carried unanimously the Parish Purchasing Agent was authorized to advertise for hot mix asphalt, with unit prices effective for a period of six months.

Motion was made by Mr. Andrepont, seconded by Mr. Danahay and carried unanimously that the following resolution be adopted:

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 1st day of June, 2000, that it does hereby wholeheartedly support the efforts of Sulphur Parks and Recreation (SPAR), Sulphur High School, the Greater Sulphur/Lake Charles Area, and all of Calcasieu Parish, in hosting the State High School Girls Softball Tournament for the years 2001 and 2002, and more particularly, to support this Southwest Louisiana endeavor.

With regard to the foregoing resolution, Mr. Andrepont stated that he felt more was needed than a resolution and that perhaps a group should go to Lafayette to lobby in favor of having the tournament in Sulphur. He also stated that there was no reason in the world for not having it in Sulphur, because that facility was better than so many others.

Mr. Danahay agreed, stating that he also felt a delegation should go to Lafayette to lobby for the tournament. He added that the reasons given in the past for always having it in Alexandria revolved around said city being more centrally located for the benefit of the participating teams.

Mr. Manuel stated that he would be willing to help lobby, and Mrs. August suggested sending videos of the Sulphur facility or bringing the decision makers for the tournament to the facility to show them what was available.

President Mackey advised that the following terms would expire in July of 2000:

Motion was made by Mr. Andrepont, seconded by Mr. Danahay and carried unanimously to suspend the rules by a two-thirds majority vote to hear a report from Mr. Derbonne, Chairman of the General Insurance Committee, relative to a meeting of said Committee which was held prior to the Regular Meeting on this date.

Mr. Derbonne explained the action taken by said Committee, and following a brief discussion, motion was made by Mrs. Treme, seconded by Mr. Clement and carried unanimously to suspend the rules by a two-thirds majority vote to approve the Gene
