The Police Jury of Calcasieu Parish, Louisiana, met in regular session at 5:30 p.m. on Thursday, February 17, 2000, in the Police Jury Room on the first floor of the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, with the Honorable Charles S. Mackey, D.D.S., President, presiding, and the following members present:
Mesdames Luvertha August, Elizabeth C. Griffin, and Sandra J. Treme; and Messrs. Francis Andrepont, Algie Breaux, Brent Clement, Calvin Collins, Mike Danahay, Enos Derbonne, Chuck Kleckley, Chris Landry, Hal McMillin, Don Manuel, and Cornelius "Cornie" Moon

Also present were Mr. S. Mark McMurry, Administrator and Ex-Officio Secretary/Treasurer; Ms. Gernine Mailhes, Assistant District Attorney; Ms. Kathy Criglow, Recording Secretary; Mrs. Coleen Clark, Executive Secretary; Mr. Claude Smart, Parish Engineer; Mr. Jerry Milner, Director of Finance; Mr. Jim Vickers, Director of Planning and Development; Mr. Bryan Beam, Assistant to the Administrator; Mr. Richard Gremillion, Director of Emergency Preparedness; and Mr. Gerry Trahan, Director of Facilities Management.
President Mackey called the meeting to order, and the invocation was pronounced by Pastor Karl Fuselier, Immaculate Heart of Mary Catholic Church, which was followed by the Pledge of Allegiance led by Mr. Collins. The roll was called with the result being as outlined above.
Motion was made by Mr. Andrepont, seconded by Mrs. August and carried unanimously that the minutes of the regular meeting of the Police Jury dated January 20, 2000, be approved and that the reading of same be dispensed with.
President Mackey advised that no action was needed on applications for liquor and beer permits due to the fact that no applications had been submitted.
President Mackey advised that bids would be received and opened at this time, as advertised in accordance with law for action to be taken at 5:30 p.m., for Calcasieu Parish Project No. 2000-01 (Hardsurfacing, overlaying, and drainage improvements of various roads). Mr. McMurry then proceeded to open the following bids:
Motion was made by Mr. Andrepont, seconded by Mrs. Treme and carried unanimously that the bids as listed above be referred to the Parish Engineer for final tabulation with further action to be taken later in the meeting on this date.
President Mackey recognized Ms. Ann Knapp, candidate for Mayor of the City of Lake Charles, as being present at the meeting, and she briefly addressed the Police Jury relative to the accomplishments made by the Parish and City working together, e.g. postal service unit in North Lake Charles, and the Joint Services Agreement with Recreation District No. One of Ward Three. Ms. Knapp stated that she looked forward to doing things for the betterment of the community should the voters honor her by electing her Mayor on March 14, 2000.
President Mackey advised that action was needed on Zoning Case RZ06-007-00, which was a request by Benny and Wanda Jarrell to rezone from C-1 (Light Commercial) to A-1 (Agricultural) to allow residential development (manufactured home) at the Northwest Corner of Highway 27 North and Peggy Lane in Ward Six, Police Jury District 13. He further advised that The Planning and Zoning Board had voted unanimously to recommend that the request be granted.
Motion was made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously that the recommendation of the Planning and Zoning Board be upheld with respect to Zoning Case RZ06-007-00 and that the request to rezone be granted; whereupon, the following ordinance was adopted:

Spooner to rezone from C-1 (Light Commercial) and I-1 (Light Industrial) to R-2 (Mixed Residential) to allow residential development at the corner of N. Perkins Ferry Road and Spooner Lane in Ward One, Police Jury District 14. He further advised that the Planning and Zoning Board had voted 10-1 to recommend that the request be granted with the following stipulations: 1) that the development be limited to the site plan on file with the Division of Planning and Development; and 2) that driveway access be limited to Spooner Lane.
It was moved by Mr. McMillin, seconded by Mrs. Griffin and carried unanimously that the recommendation of the Planning and Zoning Board be upheld with respect to Zoning Case RZ01-005-00 and that the request to rezone be granted with the stipulations outlined by the Planning and Zoning Board; whereupon, the following ordinance was adopted:

President Mackey advised that action was needed on Zoning Case RZ03-009-00, which was a request by the Lake Charles Regional Airport to rezone from I-1 (Light Industrial) to I-2 (Heavy Industrial) to allow a ready mix concrete facility on Lincoln Road in Ward Three, Police Jury District 9. He further advised that the Planning and Zoning Board had voted unanimously to recommend that the request be granted with the following stipulations: 1) that access be limited to Lincoln Road; 2) that all drives and parking areas be hardsurfaced; 3) that the site be fenced with a six-foot chain link material; 4) that the east property line be landscaped in accordance with a plan subject to approval by the Division of Planning and Development; 5) that the use be limited to a ready mix concrete facility; and 6) that the lessee will take the necessary steps to maintain dust control and prevent spillage from occurring on any public road.
Upon motion made by Mr. Derbonne, which was duly seconded by Mrs. Griffin and carried unanimously, the recommendation of the Planning and Zoning Board was upheld with respect to Zoning Case RZ03-009-00, and the request to rezone was granted with the stipulations outlined by the Planning and Zoning Board; whereupon, the following ordinance was adopted:

WHEREAS, Dr. John Gregory subdivided certain property in Ward Four of Calcasieu Parish, Louisiana, known as Audubon Acres Part Two, a subdivision in Section 23, Township 9 South, Range 10 West, Calcasieu Parish, Louisiana, and
WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana, and
WHEREAS, said subdivision plat was prepared by Mr. George F. Webb, Registered Land Surveyor No. 3870, and certification was made that the subdivision plat was prepared in accordance with R.S. 33:5051 and all other laws of the State of Louisiana, and

WHEREAS, Sammy Holtzman subdivided certain property in Ward Three of Calcasieu Parish, Louisiana, known as Buccaneer Acres Subdivision, Part Two, a subdivision in Section 34, Township10 South, Range 9 West, Calcasieu Parish, Louisiana; and
WHEREAS, said subdivision was submitted to the Calcasieu Parish Planning and Zoning Board and the Calcasieu Parish Police Jury for acceptance in accordance with the terms and conditions of Chapter 23 - Subdivisions, of the Code of Ordinances of the Parish of Calcasieu, Louisiana; and

Upon motion made by Mr. Derbonne, which was duly seconded by Mrs. August and carried unanimously, the following ordinance was adopted:
ORDINANCE NO. 4169
AN ORDINANCE amending Ordinance No. 4040, adopted by the Police Jury on November 19, 1998, (Zoning Case RZ03-049-98), to provide for the deletion of Stipulation No. One, which required that access to the rezoned site be limited to Lincoln Road.
BE IT ORDAINED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 17th day of February, 2000, that Ordinance No. 4040, adopted by the Police Jury on November 19, 1998, (Zoning Case RZ03-049-98), is amended to provide for the deletion of Stipulation No. One which required that access to the rezoned site be limited to Lincoln Road of the following described property:
Commencing at a point which is 75.0 feet E and 75.0 feet N of the SW corner of the NW/4 of the NE/4 of S18, T11S, R8W; thence N 00 degrees 33 minutes 00 seconds W, 285.0 feet; thence S 88 degrees 43 minutes 00 seconds E, 655.7 feet; thence southeasterly along a curve with a radius of 776.20 feet, 320.81 feet; thence S 34 degrees 54 minutes 05 seconds W, 51.2 feet; thence N 88 degrees 43 minutes 00 seconds W, 830.3 feet to the POC. Motion was made by Mr. McMillin, seconded by Mr. Manuel and carried unanimously that the Division of Planning and Development be authorized and directed to conduct a feasibility study to consider reclassifying certain parcels of property located off of North Perkins Ferry Road between Joe Miller Road and Spooner Lane in Ward One, Police Jury District 14.
It was moved by Mrs. August, seconded by Mrs. Griffin and carried unanimously that the Division of Planning and Development be authorized and directed to conduct a feasibility study to consider reclassifying certain parcels of property located off of Niel Road, Police Jury District 3.
Upon motion made by Mr. Andrepont, which was duly seconded by Mrs. Treme and carried unanimously, the following resolutions were adopted:
RESOLUTION
WHEREAS, notification has been received that an application for a Department of the Army Permit has been made to the U.S. Corps of Engineers by Dunham Price, Inc. to install and maintain two wharves for a travel lift located in the Calcasieu River, right descending bank, at a point about 35.6 miles above the mouth of the waterway, at Westlake, in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Dunham Price, Inc. relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation Systems; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection of the permit application based on parish ordinances and provisions, provided all required permits are obtained from the Parish Division of Planning and Development.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 17th day of February, 2000, that it does hereby indicate no objection to the proposal of Dunham Price, Inc. to install and maintain two wharves for a travel lift located in the Calcasieu River, right descending bank, at a point about 35.6 miles above the mouth of the waterway, at Westlake, in Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers and approvals are received from all appropriate state and federal agencies, and further, that all required permits be obtained from the Parish Division of Planning and Development.
BE IT FURTHER RESOLVED that the no objection position of the Police Jury in this permit application is based solely on the evaluation of the parish staff of the project's effect on current parish ordinances and provisions.
BE IT FURTHER RESOLVED that a study on the environmental impact of the aforementioned project has not been made due to the lack of expertise of the parish staff to accomplish such a study, and the Police Jury requests that agencies and/or individuals with such expertise make an environmental review of said project and forward their findings to the U.S. Corps of Engineers.

WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection of the permit application based on parish ordinances and provisions, provided a development permit is obtained from the Parish Division of Planning and Development prior to commencement of the project.
NOW THEREFORE,

RESOLUTION
WHEREAS, notification has been received that application for a Department of the Army Permit has been made to the U.S. Corps of Engineers, and application for a Water Quality Certification (WQC) has been made to the Louisiana Department of Environmental Quality by Weingarten Realty Investors to mechanically clear, grub and grade a 32.71 acre forested tract, deposit on-site graded earthen material and hauled-in earthen and aggregate fill, all to prepare surface conditions to facilitate the construction of a multi-use commercial development and associated parking facilities on the north side of Prien Lake Road in the City of Lake Charles in Calcasieu Parish, Louisiana; and
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Weingarten Realty Investors relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation Systems; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development determined that the proposed extension of Nelson Road in conjunction with this development occurring on the north side of West Prien Lake Road where it turns south and crosses under I-210, falls within a proposed new road corridor (commonly referred to as the "Port Access Road") currently being engineered, therefore, the developer's proposed Nelson Road alignment is not consistent with the area Metropolitan Planning Organization's plans for the Port Access Road and should be revised to account for current and projected traffic infrastructure needs; and
WHEREAS, the staff of the Division of Planning and Development has recommended that a resolution be adopted expressing objection to the developer's proposal as it pertains to the extension of Nelson Road, but with no opposition to the remainder of the project.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 17th day of February, 2000, that it does hereby indicate objection to the developer's proposal as it pertains to the extension of Nelson Road for reasons outlined heretofore, but with no opposition to the remainder of the project.
BE IT FURTHER RESOLVED that the Calcasieu Parish Police Jury recommends that Weingarten Realty officials work with the City of Lake Charles, the Louisiana Department of Transportation and Development, the Imperial Calcasieu Planning Commission (IMCAL), and the Port of Lake Charles in determining a layout for their proposed retail development which will address both immediate and long-term traffic issues.
BE IT FURTHER RESOLVED that the no objection position of the Police Jury in this permit application is based solely on the evaluation of the parish staff of the project's effect on current parish ordinances and provisions.

WHEREAS, notification has been received that application for a Class C Permit to install and maintain two wharves for a travel lift located in the Calcasieu River, right descending bank, at a point about 35.6 miles above the mouth of the waterway, at Westlake, in Calcasieu Parish, Louisiana, has been made to the State of Louisiana, Division of Administration State Land Office, by Dunham Price, Inc.
WHEREAS, the staff of the Division of Planning and Development has evaluated the proposal of Dunham Price, Inc. relative to its compliance with current parish ordinances and provisions, such as zoning classification, flood zone regulations, coastal zone regulations, and required development permits, as well as its impact on the Parish Transportation Systems; and
WHEREAS, upon completion of evaluation, the staff of the Division of Planning and Development concluded there is no cause for objection to the permit application based on parish ordinances and provisions.
NOW THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 17th day of February, 2000, that it does hereby indicate no objection to the proposal of Dunham Price, Inc. to install and maintain two wharves for a travel lift located in the Calcasieu River, right descending bank, at a point about 35.6 miles above the mouth of the waterway, at Westlake in Calcasieu Parish, Louisiana.

Motion was made by Mr. Andrepont, seconded by Mrs. August and carried unanimously that the President of the Police Jury be authorized to execute the necessary documents for donation of right-of-way from Nancy Durland Sanner on Nelson Road in Ward Three (Calcasieu Parish Project No. 1999-07), in accordance with criteria established by the Police Jury and recommendation of the Parish Engineer.
Upon motion made by Mrs. August, which was duly seconded by Mrs. Griffin and carried unanimously, the following resolution was adopted:

BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, in regular session convened on the 17th day of February, 2000, that it does hereby approve an amendment to a Joint Services Agreement between the Police Jury and the West Calcasieu Airport (Southland Field), the West Calcasieu Port, Harbor, and Terminal District, the Industrial Development Board of the City of Sulphur, and the City of Sulphur, which grants authority to the Police Jury to appoint two representatives to the Managing Board of said airport.
BE IT FURTHER RESOLVED that the President of the Police Jury is hereby authorized to execute all documents related thereto.

In answer to a question by Mrs. Griffin pertaining to the foregoing resolution, Mr. McMurry explained that historically, the Police Jury did not have representation on the Managing Board of the West Calcasieu Airport (Southland Field); however, a request for riverboat funding had been received from said Board, and the provision had been at that time that said request would be considered if the Police Jury could have representation on the Board. He further explained that the three entities represented on this Board had voted to approve designating two of the existing six seats on the Board as Police Jury seats. Mr. McMurry advised that Mr. Andrepont and Mr. Clement would be responsible for making a recommendation on these appointments.
Following a brief explanation by Mr. McMurry, motion was made by Mr. Derbonne, seconded by Mr. Kleckley and carried unanimously that the following resolutions be adopted:
RESOLUTION
WHEREAS, the completion of Phase Two of State Project No. 315-03-0029, the five-laning of Gulf Highway from the end of the existing five-laning at Petro Point, south to Lincoln Road, is of vital importance to the overall transportation well-being of Lake Charles and all of Calcasieu Parish; and
WHEREAS, the Louisiana Department of Transportation and Development has indicated that said project will not be continued if the sewer discharge from area residential and commercial developments is not re-routed away from the Gulf Highway right-of-way; and
WHEREAS, the Parish's efforts thus far to reach a common sense solution to this problem of sewer discharge into the right-of-way within the parameters of existing state law providing for waivers from the discharge prohibition, have been rejected by DOTD; and
WHEREAS, the State has the authority to require individual property owners to comply with the sewer discharge requirements of the State, but has for some reason chosen not to invoke said authority and, rather placed said requirement on the Parish; and
WHEREAS, due to the extreme importance of the completion of this project to Calcasieu Parish, the Parish is left with no choice but to acquiesce and commit to re-route discharge pipes that are in non-compliance with the existing state law;
NOW, THEREFORE, BE IT RESOLVED by the CPPJ, meeting in regular session on the 17th day of February, 2000, that the commitment of the Police Jury be given to DOTD that, upon approval of funding of the continuation of the Gulf Highway five-laning project, the Parish will be responsible for, and compliance with, the necessary sewer discharge re-routing along said improved section of highway, in compliance with requirements of state law regarding such discharge, and to the extent of parish legal authority to do so.
BE IT FURTHER RESOLVED that this commitment be expressed by way of the forwarding of this resolution to the Calcasieu Legislative Delegation, the House Committee on Transportation, and the DOTD.

Upon motion made by Mrs. Treme, which was duly seconded by Mrs. August and carried unanimously, the following proclamation was issued:
PROCLAMATION
WHEREAS, dogs and cats give companionship to and share the homes of over 50,000,000 individuals in the United States; and
WHEREAS, two unaltered cats and their kittens can produce 420,000 more cats in seven years, and two unaltered dogs and their puppies can produce 67,000 more dogs in six years; and
WHEREAS, humane societies and shelters euthanize more than 8 to 10 million dogs and cats each year, although many of them are healthy and adoptable, simply because there are not enough good responsible homes; and
WHEREAS, the problem of pet overpopulation costs the taxpayers of this country millions of dollars annually through animal control programs trying to cope with the millions of unwanted pets; and
WHEREAS, spaying and neutering dogs and cats has been shown to drastically reduce cat and dog overpopulation; and
WHEREAS, veterinarians, humane societies, and national and local animal protection organizations have worked together to ensure the spaying or neutering of more than 78,000 companion animals through "Spay Day USA" in 1999; and
WHEREAS, veterinarians, humane societies, and national and local animal protection organizations have joined together again to advocate the spaying and neutering of companion animals during "Prevent A Litter Month", and specifically on "Spay Day USA 2000".
NOW, THEREFORE,
BE IT RESOLVED BY THE POLICE JURY OF CALCASIEU PARISH, LOUISIANA, convened in regular session on the 17th day of February, 2000, that it does hereby proclaim the month of February, 2000, as "PREVENT A LITTER MONTH", and Tuesday, February 29, 2000, as "SPAY DAY USA", in the Parish of Calcasieu, Louisiana, and the citizens of Calcasieu Parish are asked to observe this day and month by having their own dogs or cats spayed or neutered or by sponsoring the spaying or neutering of another person's dog or cat.

In accordance with the recommendation of the Parish Engineer, motion was made by Mrs. August, seconded by Mrs. Treme and carried unanimously that all bids be rejected which were received on February 2, 2000, by the Parish Purchasing Agent for two new 2000 transport vehicle chassis 4 x 2, for use by the Division of Engineering and Public Works, and further, that the staff be authorized to readvertise.
It was moved by Mrs. Griffin, seconded by Mr. Breaux and carried unanimously that the low bid of All Star Pontiac GMC Truck, Inc. in the amount of $14,990.00 be accepted for the purchase of one (1) 2000 spray truck for use by the Mosquito Control Department, said bids having been received by the Parish Purchasing Agent on February 16, 2000.
Upon motion made by Mrs. August, which was duly seconded by Mrs. Treme and carried unanimously, the Parish Administrator was authorized to advertise for bids for Calcasieu Parish Project No. 2000-03 (Ward 4 - WPA Road, Wards 5 and 7 - Vinton-Big Woods Road, Ward 6 - Arthur Irwin Road (Safety), and Ward 7 - Broussard Road).
President Mackey advised that a public hearing would be held and conducted by the Joint Legislative Committee on Transportation, Highways, and Public Works to review highway construction priorities for the fiscal year 2000-2001 for the Parishes of Allen, Beauregard, Calcasieu, Cameron, and Jefferson Davis, which comprise Highway District 07. He further advised that the Public Hearing had been scheduled forTuesday, February 22, 2000, at 10:00 a.m., at the Lake Charles Civic Center, Contraband Room, 900 Lakeshore Drive, Lake Charles, Louisiana, and a copy of the Preliminary Program for Fiscal Year 2000-2001 was available for review by interested persons at the Department of Transportation and Development District 07 Administrator's Office, 5827 Highway 90 East, Lake Charles, Louisiana.

With reference to bids received earlier in the meeting on this date for Calcasieu Parish Project No. 2000-01, and in accordance with recommendation of the Parish Engineer, motion was made by Mr. Breaux, seconded by Mrs. Griffin and carried unanimously that action on said bids be deferred until the regular meeting on March 2, 2000.
The hour being 6:00 p.m., President Mackey advised that a public hearing would be held, as advertised in accordance with Article II of Chapter Six of the Code of Ordinances of the Parish of Calcasieu, to allow the owners of properties described below to show cause as to why the structures on said properties should not be condemned:

Mr. Wes Crain, Assistant Director of Planning and Development, briefly explained the process for condemnations for the benefit of the new police jurors. With reference to the first piece of property owned by Patsy Gail Credeur Vincent, he stated that the property owner had been notified, and the staff recommended that the structure on the property (manufactured home) be condemned and removed within thirty days.
President Mackey asked if anyone was present in the audience to discuss this property, and there being no comments, motion was made by Mr. Andrepont, seconded by Mrs. Griffin and carried unanimously that the following ordinance be adopted:

With reference to the next piece of property owned by Janie Parker Heckford (½ interest), Norma Jean Dunn (1/4 interest), and James Heckford (1/4 interest), Mr. Crain advised that Ms. Dunn was present at the meeting on this date, and she had a contractor lined up to remove the structure which he recommended be condemned, and further, that she be given an additional amount of time to accomplish this.
Ms. Norma Dunn of Winnfield, Louisiana, then appeared before the Police Jury and apologized for the condition of the property. She stated that she had come to the area in December of 1999 and found the property to be abandoned, but she thought it was being taken care of. Ms. Dunn stated that she did have someone under contract to clean up the property and would appreciate an extension of time in which to do this.
Motion was made by Mr. Derbonne, seconded by Mr. Andrepont and carried unanimously that the following ordinance be adopted:
