NOTICE OF PUBLIC MEETING
A public hearing relative
to the correction of an ad valorem tax millage levied on August 3, 2006, within
Calcasieu Parish will be held on Thursday, October 19, 2006, at 5:30 p.m., in
the Parish Government Building, 1015 Pithon Street, Lake Charles, Louisiana, as

7. Take appropriate action on RZ08-032-06 which is a request
by Hiram Durousseau to rezone from A-1 (Agricultural) to R-1 (Single Family
Residential) to allow single-family residential development. (Hungerford Road in Ward Eight, Police Jury
District 10, Mr. Stelly) (see
attached)
[The Planning and Zoning Board met on Tuesday, October 17,
2006, voted unanimously to recommend that the request be granted.]
8. Take appropriate action on RZ02-031-06 which is a request
by William J. Daughenbaugh to rezone from A-1 (Agricultural) to C-2 (General
Commercial) to allow commercial development (boat storage). (6028 Earl Daughenbaugh Road in Ward Two,
Police Jury District 10, Mr. Stelly) (see
attached)
[The Planning and Zoning Board met on Tuesday, October 17,
2006, voted unanimously to recommend that the request be granted with the
following stipulations: 1) that the development adhere to the site plan on file
with the Division of Planning and Development; 2) that an occupational license
must be obtained; 3) should the business cease, the property shall revert to
A-1 (Agricultural); and 4) that no outside storage is allowed.]
9. Take appropriate action on RA07-006-06 which is a request
by J & L Jardell Partnership to abandon the east 261.7 feet of J. Jardell
Road. (Portion of J. Jardell Road in
Ward Seven, Police Jury District 12, Mr. Clement) (see attached)
[The Planning and Zoning Board met on Tuesday, October 17,
2006, voted unanimously to recommend that the request be granted, provided that
the property owner donates property, as depicted on attached map for a
turnaround.]
10. Take appropriate action on RZ08-029-06 which is a
request by Preston Lee Duplichan, Jr. to rezone from C-3 (Central Business
Commercial) to I-1 (Light Industrial) to allow a light industrial park. (Highway 397 in Ward Eight, Police Jury
District 4, Mr. Guillory) (see
attached)
[The Planning and Zoning Board met on Tuesday, October 17,
2006, voted unanimously to recommend that the request be granted with the
following stipulations: 1) that the
development adhere to the site plan on file with the Division of Planning and
Development; 2) that all signs must be low profile monument signs; 3) that the
dumpster and all storage areas must be in the rear and within an enclosed 6
foot wooden fence; 4) that all buildings must have a façade that is non-metal
(i.e. brick, stucco, hardy-plank or vinyl); 5) that all alcohol sales are
prohibited; 6) that all lots must have landscaping as approved by the Division
of Planning and Development; and 7) that lots 1 and 11 must have restricted
driveway access to the interior subdivision road only.]
11. Take appropriate action on RZ03-033-06 which is a
request by John K. Broussard to rezone from A-1 (Agricultural) to C-2 (General
Commercial) to allow commercial development (RV/boat storage). (6515 Lake Street in Ward Three, Police Jury
District 7, Mr. Landry) (see
attached)
[The Planning and Zoning Board met on Tuesday, October
17, 2006, voted unanimously to recommend that the request be granted with the
following stipulations: 1) that the development adhere to the site plan on file
with the Division of Planning and Development; 2) that all drives and parking
must be hardsurfaced (concrete or asphalt) upon completion of the storage
facility; 3) that a solid 6’ wood or masonry fence must be installed along the
west property line (Lake Street) for a distance of approximately 175’ prior to
permit issuance; and 4) that a landscape plan must be submitted and approved by
the Division of Planning and Development for the area along the required fence
line prior to permit issuance.]
12. Take appropriate action on RZ04-030-06 which is a request by
Petrologistics Olefins, LLC, to rezone from A-1 (Agricultural) to I-2 (Heavy
Industrial) to allow industrial development (ethane storage facility). (Highway 90 West in Ward Four, Police Jury
District 13, Mr. Andrepont)
AGENDA NOTE: the applicant has requested a deferral until
November, 2006, to allow him time to educate the public regarding this project.
13. Consideration of
adopting a resolution extending the provisions as set forth in a resolution
adopted on October 11, 2005, which authorized temporary waivers from zoning
restrictions for temporary housing acquired by property owners due to damages
caused by Hurricane Rita, said extension to be for a period of nine months.
14. Consideration of adopting a resolution indicating objection/no
objection to the following proposed projects in Calcasieu Parish, Louisiana,
provided said work meets with the rules and regulations of the Corps of
Engineers, Best Management Practices during the course of construction set
forth by the Environmental Protection Agency guidelines, and approvals are
received from all other appropriate state and federal agencies, and further,
that any required permits are obtained from the Division of Planning and
Development:
(14.1) Proposal of The Meridian Resource and
Exploration, LLC, to install, operate, and maintain structures and equipment
necessary for oil and gas drilling, production, and transportation
activities. Such activities include
installation of typical marine barges and keyways, and production structures
with attendant facilities in support of Well Nos. 1 and 2. Said project is located on a canal off the
Sabine River in Calcasieu Parish. The
Planning Staff recommends that the Police Jury indicate no objection to this
project application.
(14.2) Proposal of Clifton and Bridget Smith to
construct and maintain a 178-feet long by 120-feet wide pond, install three
18-inch culverts and one 6-inch corrugated overflow pipe, dredge approximately
4,485.3 cubic yards from pond area and use to construct 15-feet wide by 4-feet
high levee around the pond. Said
project is located on the right descending bank of Indian Bayou at 2538
Sutherland Road. The work described
herein was partially completed prior to obtaining a Department of the Army
permit and was in violation of Section 301 of the Clean Water Act. All legal issues concerning the unauthorized
work have been deferred. The
Planning Staff recommends that the Police Jury indicate no objection to this
project application.
AGENDA
NOTE: any
resolution of no objection to any project, if adopted, will stipulate that such
“no objection” is based solely on evaluation by the Parish Planning and
Development Staff relative to the project’s compliance with current parish
ordinances and provisions, and that no environmental assessment was made, and
further, requesting the agencies and/or individuals with environmental
expertise to make an evaluation and forward their findings to the U. S. Corps
of Engineers.
15. Consideration of
authorizing the Director of Planning and Development to notify the following
property owners in accordance with Article II of Chapter Six of the Code of
Ordinances of the Parish of Calcasieu, Louisiana, to show cause at a public
hearing on November 16, 2006, or the first regular Police Jury meeting
thereafter, as to why the structures on the properties as stipulated should not
be condemned:

purchase two GPS Rover Stations with Real Time Capacity/Datalink to the CORS
Station, utilizing State Contract Purchasing Procedures, for use by the
Division of Engineering and Public Works.
20. Consideration of going into executive session to discuss Lawsuit
No. 2005-5616 (Stagg vs. Police Jury).

received after the agenda was faxed out on October 13, 2006, and will require a
two-thirds vote to suspend the rules for consideration by the Police Jury:

Consideration of ratifying
and approving the Proclamation for a State of Emergency, declared and signed by
the President of the Police Jury and effective on October 16, 2006, proclaiming
a State of Emergency to exist in the Parish of Calcasieu, due to the recent
heavy rains and widespread property damage that may result from flooding of
most waterways in the Parish of Calcasieu, and that all Emergency Preparedness
emergency plans have been activated.
