1.    Call to order by President Danahay.

 

2.    Invocation.  (Mr. Moon)

 

3.   Roll Call.

4.   The following has been advertised in accordance with the law for action to be taken at 5:30 p.m.:

 

·     Receive and open bids for Calcasieu Parish Project No. 2006-10 (Construction of McNeese Street Extension, Phase 2, in Calcasieu Parish, Louisiana), and take appropriate action thereon.

 

5.   The following has been advertised in accordance with the law for action to be taken at 5:30 p.m.:

 

·     Receive and open bids for the Chiller Replacement for the Calcasieu Judicial Center, and take appropriate action thereon.

 

6.   The following has been advertised in accordance with the law for action to be taken at 5:30 p.m.:

 

·     Receive and open bids for of an oil, gas, and mineral lease on certain tracts of land (18 acres, more or less) in Sections 28, 29, 30, 31, 32, and 33, Township 11 South, Range 7 West, in Ward Two, and take appropriate action thereon.  (Police Jury District 10)

 

7.   In accordance with the election procedures, the following action must be taken at 5:30 p.m.:

 

adopt a proces verbal and resolution promulgating the results of the election held on July 15, 2006, for the purposes of acquiring, constructing, developing, and/or improving streets and roads, water and waste water systems, medical, legal, educational, cultural, tourism and recreational facilities and operations, law enforcement and emergency preparedness facilities and operations, economic development facilities and operations, and governmental infrastructure facilities within the parish, title to whichshall be in the public (“Projects”); which projects shall be funded through (A) levy and collection of (i) gaming revenues received by the Parish or pursuant to cooperative endeavor agreements, (ii) a twenty (20) year sales and use tax of ¼ of 1% within the limits of the Parish, that portion of which is not necessary for debt service payments to be shared, for Project purposes, on a pro-rata basis between the Parish and all municipalities located therein, and (iii) a twenty (20) year ad valorem tax of not less than 5 mills on all taxable property within the Parish, that portion of which is not necessary for debt service payments to be dedicated to economic development activities (collectively “Revenues”), and (B) issuance of bonds in an amount not exceeding $200,000,000, in various series, not to exceed 20 years from January 1, 2007, with interest at a rate not exceeding eight (8%) percent per annum, which bonds shall be retired with, paid from and secured by a pledge and dedication of Revenues.

 

8.   Take appropriate action on applications for liquor and beer permits. (Mr. Vickers) 

 

9.   Consideration of approval of the minutes of the Regular Meeting of the Police Jury dated June 15, 2006.

 

10.     Take appropriate action on RZ08-022-06 which is a request by Robert Russell Moss to rezone from R-2 (Mixed Residential) to R-M (Multi Family Residential) to allow multi-family development (three duplexes).  (Mary Ann Street in Ward Eight, Police Jury District 10, Mr. Stelly) 

 

         [The Planning and Zoning Board met on Tuesday, July 18, 2006, voted unanimously to recommend that the request be granted with the stipulation that the development adhere to the site plan on file with the Division of Planning and Development.]

 

11.      Take appropriate action on RZ08-023-06 which is a request by Rumplestiltskin, L.P. to rezone from C-1 (Light Commercial) and I-1 (Light Industrial) to C-2 (General Commercial) to allow manufactured home repairs and sales.  (2465 Highway 397 in Ward Eight, Police Jury District 10, Mr. Stelly) 

 

         [The Planning and Zoning Board met on Tuesday, July 18, 2006, voted 10 (against) to 1 (for) to recommend that the request be denied.  Should the Police Jury grant the request the following stipulations are recommended: 1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that the 6 ft. wood privacy fence be repaired and maintained around the renovations yard; 3) that all manufactured homes for repair must be stored in the renovations yard; and 4) that the use be limited to the sales and repair of manufactured homes.]

 

12.   Consideration of adopting a resolution indicating objection/no objection to the following proposed projects in Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers, Best Management Practices during the course of construction set forth by the Environmental Protection Agency guidelines, and approvals are received from all other appropriate state and federal agencies, and further, that any required permits are obtained from the Division of Planning and Development:

 

(12.1) Proposal of SG Interests, Inc. to dredge and place approximately 833 cubic yards of native material to construct perimeter containment levees surrounding a 300’ x 300’ work area to contain a drill pad and reserve pit, all to drill the Hayes Minerals, LLC, et al, Well No. 1.  Said project is located off of Louisiana Highway 397, approximately 3.5 miles southerly from Lake Charles.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

 

(12.2) Proposal of Tony Terrell to clear and grade a 2.4 acre tract, redistribute approximately 600 cubic yards of onsite graded material, place 460 cubic yards of hauled-in clay and stabilized fill material and deposit 600 cubic yards of concrete, all to construct a four duplex residential development with associated driveways and parking.  Said project is located on a vacant lot on Vern Lane in Lake Charles.  The work described herein was partially completed prior to obtaining a Department of the Army permit and was in violation of Section 301 of the Clean Water Act.  All legal issues concerning the unauthorized work have been deferred.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

 

AGENDA NOTE:  any resolution of no objection to any project, if adopted, will stipulate that such “no objection” is based solely on evaluation by the Parish Planning and Development Staff relative to the project’s compliance with current parish ordinances and provisions, and that no environmental assessment was made, and further, requesting the agencies and/or individuals with environmental expertise to make an evaluation and forward their findings to the U. S. Corps of Engineers.

 

13.    Receive report from the Division of Planning and Development regarding recent action taken by the Louisiana State Uniform Code Construction Council.

 

14.        Consideration of adopting a resolution approving a Coastal Use Permit application for Phillip Guzzino.

 

AGENDA NOTE:  the petitioner’s property is located on the north bank of the Gulf Intracoastal Waterway (Intracoastal Canal) and east of Ellender’s Bridge near Hwy 27 in Calcasieu Parish.  The applicant is proposing to dredge approx. 1 acre and fill approximately .83 acres along the Gulf Intracoastal Waterway (Intracoastal Canal) to construct an industrial storage site. The applicant will provide private use facilities for the loading and unloading of oilfield related services for Calcasieu Parish.  Additional infrastructure for the proposed facility includes a 40' x 80' office/storage building, a storage yard with bulkhead, gravel access road, and associated parking areas.

 

15.   Consideration of adopting a resolution supporting the Junior League of Lake Charles in their newest project, the Family Resource Center, which will bring together in one location services designed to assist families in leading healthier, happier, and more productive lives by learning life skills such as parenting, home safety, financial management, computer proficiency and nutritional cooking, and further, to offer a wide variety of counseling, medical, and referral services.  (Dr. Mackey)

 

16.   Consideration of adopting a resolution authorizing a letter being sent to Louisiana Department of Transportation and Development requesting consideration be given in order of the priority shown to various railroad crossings within Calcasieu Parish for the installation of signal devices under the Highway Safety Funding Program 203. 

 

17.    Consideration of adopting a resolution authorizing the Office of Juvenile Justice Services to submit a continuation grant application for an amount up to $15,000, with a 10% match from existing funds, to the Office of Juvenile Justice and Delinquency Prevention, Juvenile Accountability Block Grant (JABG), to continue improvements to the Calcasieu Parish Juvenile Detention Center and enhance programming for at-risk youth, and should residual funds become available, a grant adjustment can be filed to increase the cost of the award, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

18.    Consideration of the following requests from the Office of Community Services:

 

(18.1) adopt a resolution authorizing the Office of Community Services to enter into a collaborative effort with the Calcasieu Parish Voluntary Council on Aging for grant funding, through the Louisiana Senior Outreach and Recovery Project available through the Governor’s Office of Elderly Affairs, to provide transportation services to displaced victims of both Hurricanes Katrina and Rita, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto;

 

AGENDA NOTE:  the total amount of the grant application is $2,160,970.00, but total amount of the grant application applicable to the Office of Community Services for the transportation of Senior Citizens is $371,800.00.

 

(18.2) adopt a resolution authorizing the Office of Community Services to enter into a Program Administration Agreement with the Louisiana Housing Finance Agency, effective July, 2006, through June, 2009, for the continuation of LIHEAP (the Low Income Home Energy Assistance Program), which is intended to assist qualified citizens with the payment of their energy bills, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto; and

 

(18.3) adopt a resolution authorizing the Office of Community Services to submit an application for funding in the amount of $10,000.00 to the Louisiana Association of Community Action Partnerships, Inc. for a Disaster Relief Grant, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

AGENDA NOTE: this grant is designed to offset any post disaster expenses incurred by OCS, including but not limited to, buildings, equipment, and employee expenses.

 

19.        Consideration of adopting the following resolutions:

 

(19.1) authorizing advertising of an oil, gas, and mineral lease on certain tracts of land (1.667757 acres, more or less) in Thomas Place Subdivision in Section 20, Township 10 South, Range 12 West, in Ward Seven.  (Police Jury District 12, Mr. Clement); and

 

(19.2) authorizing advertising of an oil, gas, and mineral lease on certain tracts of land (1.0331152 acres, more or less) in Batchelor Subdivision in Section 20, Township 10 South, Range 12 West, in Ward Seven.  (Police Jury District 12, Mr. Clement)

 

20.     Take appropriate action on the selection of seven citizen representatives to the Citizens Wastewater Advisory Panel, as authorized by Act 445 of the 2005 Regular Session of the Legislature.

 

         The following citizen representatives have been nominated:

 

Ward One: Mr. Manuel nominated Mr. Vic Stelly.

Wards Two and Eight: Mr. Stelly nominated Mr. Terry Dubard.

Ward Three: Mr. Landry nominated Mr. Lee Thibodeaux, and Mr. Brame nominated Mr. Donny Greene.

Wards Four and Seven: (two to be selected)

Wards Five and Six: Mrs. Treme nominated Mr. David L. Clark.

 

          AGENDA NOTE:  on June 1, 2006, the Police Jury approved a 7-member panel as follows:  Ward One – 1 member, Wards Two and Eight – 1 member, Ward Three – 2 members, Wards Four and Seven – 2 members, and Wards Five and Six – 1 Member.  On July 6, 2006, the Police Jury deferred action on all nominations until Thursday, July 20, 2006.

 

21.     Take appropriate action on bids received on June 5, 2006, by the Parish Purchasing Agent for the repainting of the water tower located on Grogan Street for Waterworks District No. Five of Wards Three and Eight. 

 

22.     Take appropriate action on bids received by the Police Jury on July 6, 2006, for Calcasieu Parish Project No. 2006-08 (Installation of New Horizontal Pressure Filter and Controls for use by Waterworks District No. Five of Wards Three and Eight).

 

         AGENDA NOTE:  action on bids was deferred until July 20, 2006.  The Project Engineer recommends that the low bid in the amount of $154,235.00 of Trek, Inc. be accepted.

 

23.     Take appropriate action on bids received by the Parish Purchasing Agent on July 12, 2006, for one hundred forty or more stacking chairs with related equipment for use by the County Agent’s Office. 

 

24.  Consideration of authorizing the Parish Purchasing Agent to advertise for bids for the following:

 

·         one 2007 sport utility vehicle, for use by the Division of Engineering and Public Works (Traffic);

 

·         purchase and installation of mobile command post communications equipment, for use by the Division of Engineering and Public Works;

 

·         one 2007 one-half ton extended cab pickup truck, for use by the Division of Finance;

 

·         railroad cars, creosoted bridge lumber, concrete bridge decks, with unit prices effective from August 18, 2006, until July 31, 2007; and

 

·         one new 15-passenger van, for use by the Office of Juvenile Justice Services.

 

25.  Consideration of authorizing the Parish Administrator to advertise for bids for 2006 Repairs and Upgrades to the Office of Juvenile Justice Services located at 3615 E. Prien Lake Road.

 

26.     ADVISE that the following letters have been received from members of the Louisiana Congressional Delegation:

 

·         a letter has been received from Senator Mary Landrieu in response to the Police Jury's resolution requesting assistance in the cleanup of Choupique Bayou wherein she advised that she had contacted the Natural Resources Conservation Service to inquire about programs and funding that may be available for this purpose.

 

·         letters have been received from Senator Mary Landrieu and Senator David Vitter in response to the Police Jury's resolution regarding funding cuts to the Community Development Block Grant (CDBG) program in the 2007 federal budget, both of whom stated that they would continue to work with their colleagues in the Senate to restore and properly fund this program. Additionally, Senator Vitter advised that in addition to his signing a bipartisan letter with 20 other Senators urging the Budget Committee to reinstate funding, he had voted for and helped pass an amendment to the Senate Budget Resolution that would stop cuts and maintain funding, and further, would keep the program in the Department of Housing and Urban Development.

 

EMERGENCY ITEMS

REGULAR MEETING – JULY 20, 2006

 

The following items were received after the agenda was faxed out on July 14, 2006, and will require a two-thirds vote to suspend the rules for consideration by the Police Jury:

 

Item No. One:

 

ADVISE that the voting precincts (367N and 368) at the polling place at the former St. John Elementary School will remain at said school for the upcoming elections in 2006 as the Calcasieu Parish School Board continues their renovations to said school.  Electricity will be available for the remaining elections in 2006, but the plumbing will not be completed this year.  The staff recommends that the voting precincts (367N and 368) continue to vote at this site and not be moved due to the large number of voters.

 

AGENDA NOTE:  a generator and portable potties had to be located at the school for last Saturday’s election, which created somewhat of an inconvenience to the voters and the election commissioners working the polling places.
