5.    The following has been advertised in accordance with the law for action to be taken at 5:30 p.m.:

 

         Receive and open bids for Calcasieu Parish Project No. 2005-04 (Overlaying of Various Roads in Calcasieu Parish, Louisiana), and take appropriate action thereon.

 

6.   Take appropriate action on applications for liquor and beer permits. (Mr. Vickers) 

 

7.    Consideration of approval of the minutes of the Regular Meeting of the Police Jury dated March 23, 2006.

                    

8.    Take appropriate action on a revision to RZ03-038-03 which is a request by Della F. Vick to amend Parish Ordinance No. 4750 to allow the following additional uses – boat sales and service (wholesale and retail), farmer’s market, janitorial service (wholesale and retail), offices, retail and wholesale uses, off-premise signs, radio and television studios, and residential appliance sales and service.  (2017 W. Prien Lake Road in Ward Three, Police Jury District 8, Mr. Brame) 

 

         [The Planning and Zoning Board met on Tuesday, April 18, 2006, and voted unanimously to recommend that the request be granted with the following stipulations: 1) that the development adhere to the site plan on file with the Division of Planning and Development; and 2) that the amendment allow only the following additional uses: a) Boat sales and service (wholesale and retail); b) Farmer’s market; c) Janitorial service (wholesale and retail); d) Offices; e) Retail and wholesale uses; f) Off-premise signs; g) Radio and television studios; and h) residential appliance sales and service.]

 

       AGENDA NOTE:  on September 18, 2003, the Police Jury granted the petitioner’s request to rezone the property from R-1 (Single Family Residential) to C-2 (General Commercial) to allow a paint and body shop and accessories.  On May 20, 2005, the Police Jury granted petitioner’s request to amend Parish Ordinance No. 4620 to allow limited C-2 (General Commercial) development to include auto/truck sales service and rental, laundries and linen, farm equipment sales, and printing and engraving business.)

 

9.     Take appropriate action on RZ01-013-06 which is a request by Kenneth R. Comeaux to rezone from R-2 (Mixed Residential) to R-M (Multi-Family Residential) to allow 14 duplexes.  (Stafford Road in Ward One, Police Jury District 1, Mr. Manuel) 

 

         [The Planning and Zoning Board met on Tuesday, April 18, 2006, and voted 6 (for) to 5 (against) to recommend that the request be granted with the following stipulations: 1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that the development be limited to (14 duplexes); 3) that all drives and parking must be hardsurfaced (concrete or asphalt); 4) that a drainage plan be submitted and approved by Gravity Drainage District #8 of Ward One and the Division of Engineering; and 5) that a road maintenance plan be submitted and approved by the Division of Planning and Development.  The staff recommended that the request be denied.]

 

10.     Take appropriate action on ST03-001-05 which is a request by the Police Jury to conduct a feasibility study for a zoning overlay and zoning reclassification study of property located on Lake Street near Ham Reid Road to Gauthier Road in Ward Three.  (Police Jury District 7, Mr. Landry)

 

         [The Planning and Zoning Board met on Tuesday, April 18, 2006, and voted unanimously to recommend that the commercial overlay district be adopted and approved the reclassifying of certain properties located along the Lake Street corridor.]

 

11.      Take appropriate action on ST03-003-06 which is a request by the Police Jury to conduct a feasibility study for zoning reclassification of property located on L. Ogea Road in Ward Three.  (Police Jury District 8, Mr. Brame) 

 

          [The Planning and Zoning Board met on Tuesday, April 18, 2006, and voted 7 (for) to 3 (against) to recommend that the property remain zoned as R-2 (Mixed Residential).  The Board recommended reclassifying the properties currently zoned R-2 (Mixed Residential) to R-1 (Single Family Residential)]

 

12.   Consideration of rescinding the following subdivision variances which were requests to allow residential development without public road frontage off of Cormier Road in Ward Seven:

 

(12.1) SV07-004-06 (Alan Owens) was approved by the Police Jury on February 2, 2006, with the conditions that: 1) Property owner agrees to participate in the maintenance of the private road, Secretariat Drive, along with the other property owners, and 2) Property owner agrees not to further resubdivide the property; and

 

(12.2) SV07-003-06 (Lori Amico) was approved by the Police Jury on March 2, 2006, with the conditions that: 1) Property owner agrees to participate in the maintenance of the private road, Secretariat Drive, along with the other property owners, and 2) Property owner agrees not to further resubdivide the property.

 

AGENDA NOTE:  the agreement of the property owners in 12.1 and 12.2 above not to further resubdivide the property, is subject to the exception as provided in Calcasieu Parish Ordinance No. 3940, Section 26-21(F)(7) applicable to immediate family members as designated therein. 

 

13.    Consideration of authorizing the Division of Planning and Development to perform a zoning reclassification study for property located in Oak Lane Subdivision, Arizona Oaks Subdivision, and the adjoining properties, off of S. Beglis Parkway and Ravia Road, in Ward Four.  (Police Jury District 15, Mr. Danahay)

 

14.    Consideration of adopting a resolution approving the Calcasieu Parish Coastal Impact Assistance Plan Project List to submit to the Department of Natural Resources for the State's Coastal Impact Assistance Plan Project List, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

15.    Consideration of adopting a resolution approving the renewal of a Joint Services Agreement between the Police Jury and the Calcasieu Parish Sheriff's Office for the purpose of providing heightened security patrols at Parish parks, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

16.    Consideration of adopting a resolution approving a Cooperative Endeavor Agreement between the Police Jury, the City of Lake Charles, and a for-profit research company providing for the joint sharing of the cost of building space suitable for the manufacturing of antiviral vaccines and other similar medical products, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

17.    Consideration of authorizing the President of the Police Jury to execute the necessary documents for the acquisition of right-of-way from John E. Theriot, Jr. and Lonora Theriot on Joe Miller Road in Ward One. (Police Jury District 1, Mr. Manuel)

 

AGENDA NOTE: on April 6, 2006, the Police Jury took action to approve this item as a donation instead of an acquisition.

 

18.    Consideration of authorizing the President of the Police Jury to execute the necessary documents for the acquisition of right-of-way from Ira Joshua Spalding and Louise L. Spalding on Joe Miller Road in Ward One.  (Police Jury District 1, Mr. Manuel)

 

19.    Consideration of approving the following requests from the Office of Juvenile Justice Services:

 

(19.1) adopt a resolution authorizing the Office of Juvenile Justice Services to submit an updated plan, and any revisions thereafter, to the Louisiana State University’s Office of Social Services Research and Development which outlines the duties and responsibilities of the collaboration between the Calcasieu Parish Police Jury, the City of Lake Charles, the Calcasieu Parish School Board, local law enforcement agencies, and state service agencies in the continuation of  the Truancy Assessment and Service Center, and authorize the Director of the Office of Juvenile Justice Services to negotiate on the terms and conditions of a contract or contract(s) between the Police Jury and the Board of Supervisors of Louisiana State University for the continuation of the Truancy Assessment and Service Center, and should residual funds become available, a grant adjustment can be filed to increase the cost of the award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto;

 

(19.2) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a grant application in an amount up to $4,000 to the Children’s Miracle Network to deliver and enhance existing delinquency prevention and intervention programs, and should residual funds  become available, a grant adjustment can be filed to increase the grant award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto;

 

(19.3) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a continuation grant application, and any revisions thereafter, to the Louisiana Commission on Law Enforcement, Office of Juvenile Justice and Delinquency Prevention, Title V, Mental Health Program, in an amount up to $25,000 to continue a mental health program for at-risk youth and families, with a match of 50% being provided from volunteer hours and local funds, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto;

 

(19.4) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a continuation grant application, and any revisions thereafter, to the Louisiana Commission on Law Enforcement, Office of Juvenile Justice and Delinquency Prevention, Family Services Case Manager, in an amount up to $25,000 for the Family Services Case Manager, which identifies problems and needs of juvenile offenders and establishes a family service plan that coordinates community resources, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto;

 

(19.5) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a continuation grant application, and any revisions thereafter, to the Louisiana Commission on Law Enforcement, Office of Juvenile Justice and Delinquency Prevention, Family Counselor, in an amount up to $25,000 for the family services program which provides therapeutic intervention to at-risk juveniles and their families to avoid entering the juvenile justice system, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto;

(19.6) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a continuation grant application, and any revisions thereafter, to the Louisiana Commission on Law Enforcement, Crime Victims Assistance, Case Management, in an amount up to $40,000, with 20% matching funds being provided from volunteer hours, wherein a case manager will assist victims of child abuse with obtaining the needed services to recover from behavioral effects associated with victimization, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto;

 

(19.7) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a continuation grant application, and any revisions thereafter, to the Louisiana Commission on Law Enforcement, Crime Victims Assistance, Counseling Program, in an amount up to $30,000, with 20% matching funds being provided from volunteer hours, wherein this program will assist victims of child abuse with recovering from effects associated with violence, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto;

 

(19.8) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a continuation grant application in an amount up to $60,000, and any revisions thereafter, to the Louisiana Supreme Court, which outlines the certifications and budget of the Families in Need of Services Program, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto;

 

(19.9) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a continuation grant application in an amount up to $180,000, and any revisions thereafter, to the Louisiana Supreme Court which outlines the certifications and budget of the Calcasieu Parish Juvenile Drug Court Treatment Program, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto;

 

(19.10) adopt a resolution authorizing the Office of Juvenile Justice Services to enter into an agreement with the State of Louisiana, Office of Youth Development, wherein the Office of Juvenile Justice Services will participate in the Title IV-E Federal Foster Care Reimbursement Program, through the provision of services and performance of administrative activities to assist and support the agency’s program of foster care services for eligible children, pursuant to the rules and regulations of the Title IV-E Foster Care Program, and should residual funds become available, an adjustment can be filed to increase the contract award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto; and

 

(19.11) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a grant application to the H. C. Drew Estate in an amount up to $25,000 for the purchase of equipment and materials to fund delinquency prevention programs and continue to establish an integrated information-sharing network with juvenile justice-serving agencies, which will improve the educational, vocational and social outcomes for at-risk youth and their families, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto.

 

20.    Consideration of authorizing the disbursement in the amount of $2,000.00 for the first installment for 2006 of Riverboat Recreation Endowment Funds to each of the following qualifying Community Center and Playground Districts and Recreation Districts in Calcasieu Parish: Recreation District No. One of Ward Three, Recreation District No. One of Ward Four, Community Center and Playground District No. One of Ward Six, Community Center and Playground District No. Two of Ward Four, Community Center and Playground District No. Three of Ward Seven, Community Center and Playground District No. Four of Ward One, Community Center and Playground District No. Five of Ward Five, and Community Center and Playground District No. Seven of Ward Two.

 

21.   Consideration of adopting a resolution authorizing Allen L. Smith, Jr., General Counsel to the Police Jury, to contract with and engage legal representation from Frederick L. Cappel (roadway, street, highway, and vehicular claims), Christopher M. Trahan (Louisiana worker’s compensation), Plauche, Smith and Nieset (general liability claims), and Gregory W. Belfour and Edward J. Fonti (employment, personnel, labor, wage, and health claims), with compensation being set at the rate of $125.00 per hour, and requesting the approval of the Office of the Attorney General with reference to this matter, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

22.     Take appropriate action on a vacancy on the Board of Commissioners of Waterworks District No. One of Ward One which was caused by the recent death of Mr. Earl O'Quinn, Jr.  (Mr. O'Quinn represented District 1.  Mr. Manuel is the liaison, and he recommends that Mr. Earl Carlton O'Quinn, III be appointed to fill this vacancy.)

 

23.     Take appropriate action on bids received on April 12, 2006, by the Parish Purchasing Agent for one new and unused mid-size sedan, for use by the Division of Engineering and Public Works (General Office). 

 

24.     Take appropriate action on bids received on April 18, 2006, for one new and unused hybrid sports utility vehicle, for use by the Division of Engineering and Public Works (Traffic). 

 

25.   Consideration of authorizing the Parish Purchasing Agent to advertise for bids for 140 or more stacking chairs with related equipment, for use by the County Agent’s Office.

 

26.   Consideration of authorizing the Parish Purchasing Agent to advertise for bids for two new enclosed utility trailers, for use by the Division of Engineering and Public Works.

 

27.   Consideration of authorizing the Parish Purchasing Agent to advertise for bids for a twenty-eight (28’) trailer, for use by the Office of Homeland Security and Emergency Preparedness.

 

28.   Consideration of authorizing the Parish Purchasing Agent to purchase two skid-steer loaders, utilizing State Contract Purchasing Procedures, for use by the Division of Engineering and Public Works.

 

29.    Consideration of proclaiming the week of May 13-21, 2006, as “See America/National Tourism Week” in Calcasieu Parish.

 

 

EMERGENCY ITEMS

The following items were received after the agenda was faxed out on April 13, 2006, and will require a two-thirds vote to suspend the rules for consideration by the Police Jury:

Consideration of proclaiming the week of April 23-28, 2006, as “County Government Week” in Calcasieu Parish.

 

Item No. Two:

 

Consideration of adopting a resolution approving a Second Amendment to the Cooperative Endeavor Agreement between the Police Jury and the Junior League of Lake Charles, Inc., with reference to amending said agreement regarding requirements on insurance coverage, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

Item No. Three:

 

Take appropriate action to fill the vacancy on the Board of Commissioners of West Calcasieu Port, Harbor and Terminal District created by the resignation of Mr. Larry Currie.  (Mr. Currie represented the Ward Four Jurors.  Mr. Andrepont and Mr. McMillin are the liaisons, and they recommend that Mr. J. C. Cormier be appointed to fill this vacancy.)
