5.    The following has been advertised in accordance with the law for action to be taken at 5:30 p.m.:

 

Receive and open bids for Calcasieu Parish Project No. 2005-03 (Overlaying and Drainage Improvements of Various Roads in Calcasieu Parish, Louisiana), and take appropriate action thereon.

 

6.    The following has been advertised in accordance with the law for action to be taken at 5:30 p.m., and take appropriate action thereon:

 

      Receive and open bids for an oil, gas, and mineral lease on certain tracts of land (1.7 acres, more or less) in Section 12, Township 11 South, Range 9 West, in Ward Three, and take appropriate action thereon.  (Police Jury District 6, Mr. Moon)

 

7.   Take appropriate action on applications for liquor and beer permits. (Mr. Vickers)  (see attached)

 

8.    Consideration of approval of the minutes of the Regular Meeting of the Police Jury dated March 17, 2005.

 

9.   Take appropriate action on RZ01-012-05 which is a request by Joe Miller Road Partners, LLC, to rezone from A-1 (Agricultural) to R-1 (Single Family Residential) to allow single family residential development.  (Joe Miller Road in Ward One) (Police Jury District 1, Mr. Manuel, and Police Jury District 11, Mrs. Treme)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, April 19, 2005, and voted unanimously to recommend that the request be granted.]


10.     Take appropriate action on RZ04-014-05 which is a request by Citicorp Trust Bank FSB F/K/A to rezone from C-1 (Light Commercial) to A-1 (Agricultural) to allow residential development (house).  (7051 Choupique Road in Ward Four)  (Police Jury District 12, Mr. Clement)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, April 19, 2005, and voted unanimously to recommend that the request be granted.]

 

11.      Take appropriate action on RZ04-015-05 which is a request by Stephen H. and Pamela G. Carnahan to rezone from C-2 (General Commercial) to R-MHP (Manufactured Home Park) to allow a manufactured home park (3 spaces).  (139 E. Dave Dugas Road in Ward Four) (Police Jury District 12, Mr. Clement)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, April 19, 2005, and voted unanimously to recommend that the request be granted with the following stipulations: 1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that the manufactured home must be skirted within ninety days of permit issuance; 3) that an occupational license must be obtained; and 4) that a six-foot wood privacy fence must be installed along the east property line prior to issuance of occupational license.]

 

12.     Take appropriate action on RZ04-017-05 which is a request by Moss Family et al to rezone from A-1 (Agricultural) to I-2 (Heavy Industrial) to allow an asphalt plant and borrow pit (11 acres).  (Bayou D’ Inde Pass Road in Ward Four) (Police Jury District 15, Mr. Danahay)

 

         [The Planning and Zoning Board met on Tuesday, April 19, 2005, and deferred action to allow applicant time to submit a $300,000 cash deposit, as per the recommendation of the Division of Engineering and Public Works.]

        

13.     Take appropriate action on RZ03-016-05 which is a request by Loice Firmature to rezone from R-1 (Single Family Residential) to C-1 (Light Commercial), C-2 (General Commercial), and R-M (Multi-Family Residential) to allow commercial and multi-family development.  (Southwest Corner of Ham Reid Road and Lake Street in Ward Three) (Police Jury District 6, Mr. Moon) (see attached)

 

         [The Planning and Zoning Board met on Tuesday, April 19, 2005, and voted 10 (for) to 1 (against) to recommend that the request be granted with the following stipulations: 1) that the development adhere to the site plan on file, provided that the Director of the Division of Planning and Development, or his designee, may authorize adjustments to site plans in light of technical or engineering considerations discovered during development; 2) that all parking must be concrete and located on the side and rear of all commercial buildings; 3) that all signs must be low profile monument signs; 4) that the use be limited to professional offices, medical offices, retail outlets, daycare facility and a convenience store within the C-1 (Light Commercial) area; 5) that the use be limited to restaurants only in C-2 (General Commercial) and the same uses approved in C-1 (Light Commercial), as stated in staff recommendation #4; 6) that the architectural design for the development be limited to the following themes: French Country, Traditional and Contemporary; 7) that all utilities must be underground within the “Le Firm Park” development; 8) that the 5.42 acre tract depicted on site plan as “Reserve” must remain as open space, less and except utilities; 9) that all required parking for the multi family development must be in the rear of the duplexes; and 10) that all development must be landscaped and approved by the Division of Planning and Development.]

 

14.     Consideration of adopting a resolution indicating objection/no objection to the following proposed project in Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers, Best Management Practices during the course of construction set forth by the Environmental Protection Agency guidelines, and approvals are received from all other appropriate state and federal agencies, and further, that any required permits are obtained from the Division of Planning and Development:

 

(14.1) Proposal of Joseph Haiko to install and maintain a vinyl bulkhead, timber wharf, boat house and fill for erosion control and private recreational use.  The proposed structures are to be located within an area approximately 100 feet long and 23 feet wide, extending lengthwise parallel to the mean low water shoreline, the outer edge to be about 18 feet channelward therefrom.  Approximately 60 cubic yards of hauled-in limestone aggregate would be placed as fill behind the bulkhead. Said project is located on the West Fork of the Calcasieu River, 1048 Edwards Road, in Sulphur.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

 

AGENDA NOTE:  any resolution of no objection to any project, if adopted, will stipulate that such “no objection” is based solely on evaluation by the Parish Planning and Development Staff relative to the project’s compliance with current parish ordinances and provisions, and that no environmental assessment was made, and further, requesting the agencies and/or individuals with environmental expertise to make an evaluation and forward their findings to the U. S. Corps of Engineers.

 

15.     Reconsideration of a resolution adopted on November 18, 2004, indicating an objection to a proposal of Joseph R. Palermo, Jr. for a Corps of Engineers’ permit to clear and grade a 47-acre tract, dredge to construct drainage facilities, and place earthen fill for homesites and driveways, all as necessary to develop a 42-lot single family residential subdivision, due to the receipt of a watershed study which examined the impact of the proposed development and made recommendations for improvements within the watershed boundary.  Said project is located on the Northwest Corner of the intersection of High Hope Road and Heurtevant Road near Sulphur.  The work described within the application was partially completed prior to obtaining a Department of the Army permit and was in violation of Section 301 of the Clean Water Act. 

 

AGENDA NOTE:  on November 18, 2004, the Planning Staff recommended that the Police Jury object to this project application due to poor drainage and flooding that is occurring in the area, and the Police Jury adopted a Resolution of Objection relative to this proposal.  Subsequent to adoption of this Resolution of Objection, an engineering study was commissioned by the petitioner, the results of which were presented to the Police Jury at its regular meeting of March 17, 2005, at which time a motion was approved to set April 21, 2005, as a date for reconsideration of the previous action.

 

16.    Consideration of adopting a resolution approving a Joint Services Agreement between the Police Jury, the Airport Authority of Airport District No. One, the City of Lake Charles, and the Calcasieu Parish Library Board of Trustees to provide for matching funds up to $25,000 from the Police Jury relating to a joint effort to recognize Dr. Michael E. DeBakey, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

17.     Consideration of adopting a resolution approving Amendment No. Two to the Joint Services Agreement between the Police Jury and the Calcasieu Parish Sheriff’s Office which is a renewal of said agreement related to the Sheriff’s Office providing heightened security patrols at Parish parks, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

18.     Consideration of adopting a resolution approving an Addendum to a Joint Services Agreement between the Police Jury and West Calcasieu Cameron Hospital previously approved by the Police Jury on October 21, 2004, which provided for the assistance of the Police Jury’s Division of Finance in the investment of hospital district funds, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

19.     Consideration of adopting a resolution authorizing the West Calcasieu Parish Community Center Authority to proceed with a current refunding of certain outstanding certificates of indebtedness of the Authority, involving issuance of not to exceed $3,500,000 of West Calcasieu Parish Community Center Authority Excess Revenue Refunding Bonds, 2005 Series, and providing for other matters in connection thereto.

 

20.   Consideration of the following requests from the Office of Juvenile Justice Services:

 

(20.1) adopt a resolution authorizing the Office of Juvenile Justice Services to submit an updated plan, and any revisions thereafter, to the Louisiana State University’s Office of Social Services Research and Development which outlines the duties and responsibilities of the collaboration between the Calcasieu Parish Police Jury, the City of Lake Charles, the Calcasieu Parish School Board, local law enforcement agencies, and state service agencies in the continuation of the Truancy Assessment and Service Center, and authorize the Director of the Office of Juvenile Justice Services to negotiate on the terms and conditions of a contract or contracts between the Police Jury and the Board of Supervisors of Louisiana State University for the continuation of the Truancy Assessment and Service Center, and should residual funds become available, a grant adjustment can be filed to increase the cost of the award, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto;

 

(20.2) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a continuation grant application, and any revisions thereafter, to the Louisiana Commission on Law Enforcement, Office of Juvenile Justice and Delinquency Prevention-Title V-Mental Health Court Program, in the amount of  up to $25,000 to continue a mental health court program for at-risk youth and families, with a match of 50% from volunteer hours and local funds, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto;

 

(20.3) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a continuation application in an amount up to $60,000, and any revisions thereafter, to the Louisiana Supreme Court which outlines the certifications and budget of the Families in Need of Services Assistance Program, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto;

 

(20.4) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a continuation application in an amount up to $175,000, and any revisions thereafter, to the Louisiana Supreme Court which outlines the certifications and budget of the Calcasieu Parish Juvenile Drug Court Treatment Program, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto;

 

(20.5) adopt a resolution authorizing the Office of Juvenile Justice Services to submit a grant application in an amount up to $4,000 to the Children’s Miracle Network to deliver and enhance existing delinquency prevention and intervention programs, and should residual funds become available, a grant adjustment can be filed to increase the grant award, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto;

 

(20.6) adopt a resolution approving an agreement between the Police Jury, Office of Juvenile Justice Services, and Justice Benefits, Inc. to consult on the Title IV-E Federal Foster Care Reimbursement Program to recover monies for eligible services and activities to juvenile probation children and their families, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto; and

 

(20.7) adopt a resolution approving an agreement between the Police Jury, Office of Juvenile Justice Services, and the State of Louisiana, Office of Youth Development, wherein the Office of Juvenile Justice Services will participate in the Title IV-E Federal Foster Care Reimbursement Program, through the provision of services and performance of administrative activities to assist and support the agency’s program of foster care services for eligible children, pursuant to rules and regulations of the Title IV-E Foster Care Program, and should residual funds become available, an adjustment can be filed to increase the contract award, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

21.    Consideration of authorizing issuance of termination notices in accordance with the terms and conditions of existing leases with current tenants located on the third floor of the Magnolia Building, to accommodate necessary additional office space for the Calcasieu Parish Sheriff’s Office and the Calcasieu Parish Employees Federal Credit Union, and further, authorizing the execution of agreements by the Parish Administrator and said parties for utilization of this third floor space, in accordance with parameters established by the Police Jury Liaison Group for such purpose.

 

22.     Consideration of approving the renewal of lease agreements with the Southwest Louisiana Partnership for Economic Development for a one-year term beginning March 1, 2005, for the certain portion of the seventh floor of the Magnolia Building being utilized by the Partnership and the certain portion of the sixth floor of said building being utilized for the Business Incubator of Southwest Louisiana.

 

23.     Consideration of adopting a resolution approving an agreement between the Police Jury and Air Products and Chemicals, Inc., with reference to their participation in Calcasieu Parish’s Adopt-A-Road Program wherein said organization accepts the responsibility of picking up litter on Trousdale Road in Ward Four, and further, ratifying the execution of said agreement by the President of the Police Jury.  (Police Jury District 14, President McMillin)

 

24.     Consideration of adopting a resolution ratifying the execution of an Application for a Department of the Army Permit Corps of Engineers by the Police Jury for the Prien Lake Park Phase Two Project.

 

25.     Consideration of approval of a Budget Committee Report dated April 21, 2005.

 

26.     Take appropriate action on the vacancy on the Workforce Investment Board (WIB) which was created by the resignation of Mr. Glynn Fontenot.  (Mr. Fontenot represented the private sector-Lake Area Industry Alliance (LAIA). A letter was sent asking for nominations to fill this vacancy, and a letter was received from the LAIA advising of their next meeting on April 11, 2005, at which time they would take action on our request.  The LAIA has responded to our request, by indicating that they wish to be removed from the nomination structure.  It is the staff’s recommendation that this matter be referred back to the Workforce Investment Board for further recommendation as to the nomination structure.  Mrs. Griffin and Mr. Moon are the liaisons.)

 

AGENDA NOTE:  on April 7, 2005, the Police Jury deferred action until April 21, 2005. 

 

27.     Consideration of accepting Calcasieu Parish Project No. 2004-08 (Side Drain Safety End Treatment Project) as substantially complete.

 

28.     Take appropriate action on bids received on April 7, 2005, by the Parish Purchasing Agent for pavement markings (125 mil), with unit prices effective from April 8, 2005, until August 31, 2005.  (see attached)

 

          AGENDA NOTE:  on April 7, 2005, the Police Jury deferred action until April 21, 2005. 

 

29.     Consideration of authorizing the Parish Purchasing Agent to advertise for bids for an above ground aviation fuel farm for use by the Calcasieu Parish Mosquito Control Department.

 

AGENDA NOTE:  this item was included in the 2005 budget and will replace a 1970 fuel truck currently in use.

 

30.     Consideration of authorizing the Parish Administrator to advertise for bids for Calcasieu Parish Project No. 2005-05 (Replacement of Dave Dugas Road Bridge-Structure No. 500147).

 

31.     Consideration of proclaiming the week of May 7-15, 2005, as “See America/National Tourism Week” in Calcasieu Parish.
