1.        Call to order by President McMillin.

5.   In accordance with the election procedures, the following action must be taken at 5:30 p.m.:

 

·         Adopt a proces verbal and resolution promulgating the results of the election held on January 15, 2005, for the levy and collection of a 2.41 mill special tax on all properties within the boundaries of the Parish for a period of ten years, beginning in 2005, for the purpose of maintaining and operating the facilities and services of the Calcasieu Parish Mosquito Control Program, as well as improving or constructing mosquito control facilities.

 

6.    Presentation of rural development grants totaling $92,000 from the Governor’s Office of Rural Development by the Calcasieu Legislative Delegation as follows:

 

·         Calcasieu Parish Police Jury                (Burton Coliseum-sidewalks)                    $3,930.00

·         Calcasieu Parish Police Jury                (Burton Coliseum-upgrades)                    $17,614.00

·         Calcasieu Parish Police Jury                (Resurfacing Roads)                               $17,614.00

·         Calcasieu Parish Police Jury                (Erosion Control in Starks)                     $17,614.00

·         Town of Iowa                                      (Police Protection)                                  $17,614.00

·         Town of Vinton                                    (Recreation)                                           $17,614.00

(to be presented to the Town of Vinton at a later date)

 

7.    Take appropriate action on applications for liquor and beer permits. (Mr. Vickers)  (see attached)

 

8.    Consideration of approval of the minutes of the Regular Meeting of the Police Jury dated December 16, 2004.

 

9.    Take appropriate action on RZ01-001-05 which is a request by Charles T. White to rezone from A-1 (Agricultural) to R-1 (Single Family Residential) to allow residential development. (Campfire Road in Ward One, Police Jury District 2)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, January 18, 2005, and voted unanimously to recommend that the request be granted with the stipulation that the development adhere to the site plan with the Division of Planning and Development.]

 

10.     Take appropriate action on RA04-001-05 which is a request by Lawrence Nix for road abandonment of the West 155.5 feet of Benoit Road.  (West 155.5 feet of Benoit Road in Ward Four, Police Jury District 12)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, January 18, 2005, and voted 6 (for) to 3 (against) to recommend that the request be granted subject to the “Agreement for Road Abandonment and Granting of Right-of-way for Turnaround and Drainage Easement” to be recorded with the Clerk of Court.]

 

11.      Take appropriate action on RZ01-038-04 which is a request by Ron A. and Maria Fogal to rezone from C-1 (Light Commercial) to R-2 (Mixed Residential) to allow residential development (three manufactured homes).  (Moss Lane in Ward One, Police Jury District 1)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, January 18, 2005, and voted 8 (for) to 1 (against) to recommend that the request be granted with the following stipulations: 1) that the development adhere to the site plan on file with the Division of Planning and Development; and 2) that the three manufactured homes must be skirted prior to the utilities being connected.]

 

         AGENDA NOTE:  the Police Jury has deferred action on Thursday, November 18, 2004, and Thursday, December 16, 2004, to allow the petitioner time to revise his site plan.

 

12.     Consideration of adopting an ordinance amending the Code of Ordinances of Calcasieu Parish, Louisiana, with reference to alternative designs in the Nelson District Overlay.  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, January 18, 2005, and voted unanimously to recommend that the Code of Ordinances of Calcasieu Parish, Louisiana, be amended as per attached.]

 

13.     Consideration of adopting an ordinance amending the Code of Ordinances of Calcasieu Parish, Louisiana, (Off Premises Outdoor Advertising Signs), as it relates to the location.  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, January 18, 2005, and voted unanimously to recommend that the Code of Ordinances of Calcasieu Parish, Louisiana, be amended as per attached.]

 

14.     Consideration of adopting a resolution indicating objection/no objection to the following proposed project in Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers, Best Management Practices during the course of construction set forth by the Environmental Protection Agency guidelines, and approvals are received from all other appropriate state and federal agencies, and further, that any required permits are obtained from the Division of Planning and Development:

 

(14.1) Proposal of William Shaddock to construct and maintain a 22-feet wide by 32-feet long timber wharf along the right descending bank of the Calcasieu River.  The proposed structure will be situated parallel to the existing shoreline extending approximately 6-feet channelward.  Dredging will not be required for this project.  Said project is located at 1451 Shell Beach Drive in Lake Charles.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

 

AGENDA NOTE:  any resolution of no objection to any project, if adopted, will stipulate that such “no objection” is based solely on evaluation by the Parish Planning and Development Staff relative to the project’s compliance with current parish ordinances and provisions, and that no environmental assessment was made, and further, requesting the agencies and/or individuals with environmental expertise to make an evaluation and forward their findings to the U. S. Corps of Engineers.

 

15.                Consideration of a request to rescind Condemnation Ordinance No. 4679, more specifically described as:  property located at 2624 Gulfway Boulevard and described as:  Lot 46, Block A, Gulfway Pines Subdivision, Westlake area of Ward Four, Calcasieu Parish, Louisiana, due to the fact that said structure has been removed.

 

AGENDA NOTE:  this ordinance was filed under the name of Sam Blaney, Jr. (NMN) and Reliable Financial Service, Inc., on January 27, 2004.  This ordinance was filed in two places which are:  File No. 2658676, Conveyance Book No. 3059, Page 626 and File No. 2658648, Mortgage Book 2782, Page 185.

 

16.     Consideration of adopting a resolution authorizing issuance by Waterworks District No. Eleven of Wards Four and Seven of Calcasieu Parish, Louisiana, (Houston River area), of not exceeding $2,000,000 principal amount of water revenue bonds, 2005 Series.

 

17.     Consideration of authorizing the Parish Administrator to negotiate the terms and conditions leading to an agreement allowing IMCAL to co-locate with the Southwest Louisiana Partnership of Economic Development in the Magnolia Building, if approved by the respective Boards of Directors of the Partnership and IMCAL.  (Mr. Kleckley)

 

18.     Consideration of adopting a resolution approving a Proposal for Engineering Services between the Police Jury and Lancon Engineers, Inc. for the Corbina Road Extension Project (Louisiana Highway 14 to McNeese Street Extension), and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents thereto.

 

19.     Consideration of authorizing the President of the Police Jury to execute the necessary documents for donation of right-of-way from Thomas Eugene Baham, et ux, on the Park Road Sidewalk Project in Ward One, in accordance with criteria established by the Police Jury and recommendation of the Parish Engineer.

 

20.     Consideration of approving the Budget Committee Report dated January 20, 2005.

 

21.     Take appropriate action on bids received by the Police Jury on December 16, 2004, for the construction of the Public Works West Maintenance Facility.

 

         AGENDA NOTE:  the Police Jury has deferred action on bids on December 16, 2004, to January 6, 2005, and on January 6, 2005, to January 20, 2005, to allow additional time for review.  The Project Architect, Steven D. Shows, along with the Parish Engineer, recommends that the low base bid in the amount of $3,910,000 of Priola Construction Corporation be accepted.

 

22.     Consideration of authorizing the Parish Purchasing Agent to advertise for bids for two one-half ton pickup trucks and one factory remanufactured zero time Continental aircraft engine, for use by the Mosquito Control Department.

 

23.     Consideration of authorizing the Parish Administrator to advertise for bids for Calcasieu Parish Project No. 2005-02 (Hardsurfacing of Various Roads in Calcasieu Parish, Louisiana).

 

24.     ADVISE that Calcasieu Parish was found to be in full compliance by the Louisiana Department of Transportation and Development for the 2004 Annual Review, which will assure our continued participation in the Federal Bridge Replacement Program through October, 2005.

 

 

EMERGENCY ITEMS

 

The following items were received after the agenda was faxed out on January 14, 2005, and will require a two-thirds vote to suspend the rules for consideration by the Police Jury:
