7. Consideration of approval of the minutes of the Regular Meeting
of the Police Jury dated October 21, 2004.
8. Take appropriate action on RZ04-037-04 which is a request
by Thomas C. Arville to rezone from C-2 (General Commercial) to A-1
(Agricultural) to allow residential development. (1860 W. Burton Street in Ward Four, Police Jury District
11) (see attached)
[The Planning and Zoning Board met on Tuesday, November
16, 2004, and voted unanimously to recommend that the request be granted with
the following stipulations: 1) that the
development adhere to the site plan on file with the Division of Planning and
Development; 2) that the manufactured home must
be skirted prior to utilities being connected; and 3) that the proper permits
must be obtained within thirty days of zoning approval.]
9. Take appropriate action on RZ01-038-04 which is a request
from Ron A. and Maria A. Fogal to rezone from C-1 (Light Commercial) to R-2
(Mixed Residential) to allow residential development (five manufactured
homes). (Moss Lane in Ward One, Police
Jury District 1)
[The Planning and Zoning Board met on Tuesday, November
16, 2004, and voted unanimously to recommend that action be deferred for thirty
days to allow the petitioner time to revise the site plan.]
10. Take appropriate action on RZ03-040-04 which is a request
by Glenn and Joan Fuselier to rezone from A-1 (Agricultural) to I-1 (Light
Industrial) to allow a contractor’s office, shop, and mechanical sewer business
(2120 Pujol Road in Ward Three, Police Jury District 2) (see attached)
[The Planning and Zoning Board met on Tuesday, November
16, 2004, and voted unanimously to recommend that the request be granted with
the following stipulations: 1) that the
development adhere to the site plan on file with the Division of Planning and
Development; and 2) that an occupational license must be obtained for both
businesses.]
11. Consideration of adopting an ordinance amending the Code of
Ordinances of Calcasieu Parish, Louisiana, (Coastal Zone Management), as it
relates to the definition of words and terms, administrative action, and
mitigation. (see attached)
[The Planning and Zoning Board met on Tuesday, November
16, 2004, and voted unanimously to recommend that the Code of Ordinances of
Calcasieu Parish, Louisiana, be amended, as per attachment.]
12. Consideration of adopting an ordinance amending Parish Ordinance
No. 4801, as it relates to a request from the buyer, L. Gene DeVilier, who is
purchasing the property from Mr. Rayford Jeanis, to allow one of the existing
metal buildings located on the northeast corner to remain on the property for
storage of lawn equipment and small tools.

Police Jury District 7)
AGENDA NOTE:
on September 23, 2004, the Police Jury adopted an ordinance amending
previous action of the Police Jury on May 22, 2003, to add the following
stipulation: that the two buildings,
two manufactured homes, a flat bed trailer, and three vehicles must be removed
from the premises within thirty days of zoning approval,” no later than October
23, 2004. The Planning and Zoning Board
met on November 1, 2004, and voted unanimously to recommend that the building
be allowed to remain on the property.
13. Consideration of adopting a resolution indicating objection/no
objection to the following proposed projects in Calcasieu Parish, Louisiana,
provided said work meets with the rules and regulations of the Corps of
Engineers, Best Management Practices during the course of construction set
forth by the Environmental Protection Agency guidelines, and approvals are
received from all other appropriate state and federal agencies, and further,
that any required permits are obtained from the Division of Planning and
Development:
(13.1) Proposal of Stine
Brothers, LLC, to clear, grub, grade, and place fill, as necessary, to
construct a retail building materials store and parking lot and dredge a
stormwater retention pond for drainage improvements. Approximately 5,502 cubic yards of native earthen material, 5,524
cubic yards of hauled-in clays and silts, and 3,776 cubic yards of limestone
aggregate will be deposited in wetlands, as required to construct the proposed
facility. Said project is located off
of Nelson Road in Lake Charles. The
Planning Staff recommends that the Police Jury indicate no objection to this
project application.
(13.2) Proposal of
ConocoPhillips to dredge an area to provide adequate depths for marine vessel
access. The dredging operation will
occur within an area approximately 900 feet long by 250 feet wide and consist
of the removal of approximately 40,000 cubic yards of channel bottom
material. Said project is located in
the Calcasieu River near Sulphur. The
Planning Staff recommends that the Police Jury indicate no objection to this
project application.
(13.3) Proposal of Oliver
G. Richard III to drive timber pilings as necessary to construct a 56 feet long
x 54 feet wide elevated boat house with upper and lower decks, screen porch,
storage area, and access walkway. The
proposed structures are to be located approximately perpendicular to the mean
high water shoreline and extending 80 feet channelward therefrom. Said project is located at 1301 Shell Beach
Drive in Lake Charles. The Planning
Staff recommends that the Police Jury indicate no objection to this project
application.
(13.4) Proposal of Joseph
R. Palermo, Jr. to clear and grade a 47-acre tract, dredge to construct
drainage facilities, and place earthen fill for homesites and driveways, all as
necessary to develop a 42-lot single family residential subdivision. Said project is located on the northwest
corner of the intersection of High Hope Road and Heurtevant Road near
Sulphur. The work described within
the application was partially completed prior to obtaining a Department of the
Army permit and was in violation of Section 301 of the Clean Water Act. All legal issues concerning the authorized
work have since been deferred. The
Planning Staff recommends that the Police Jury object to this project application
due to poor drainage and flooding that is occurring in the area.
AGENDA NOTE:
any resolution of no objection to any project, if adopted, will
stipulate that such “no objection” is based solely on evaluation by the Parish
Planning and Development Staff relative to the project’s compliance with
current parish ordinances and provisions, and that no environmental assessment
was made, and further, requesting the agencies and/or individuals with
environmental expertise to make an evaluation and forward their findings to the
U. S. Corps of Engineers.
14. Consideration of adopting a resolution
authorizing the purchase of property and improvements located at 3716 Backbay
Court from Jack Reed, in accordance with federal guidelines for Project No. HMGP
1437-019-0002. (Police Jury District
14)
AGENDA NOTE: the Police Jury received a flood mitigation
grant and this is one of the houses that will be mitigated (acquired). We
are purchasing the house for $136,948.75 (75% of market value), and it will be
demolished. The property will be used as open space, and the adjoining
property owner may lease it.
15. Consideration of approving the Budget
Committee Report dated November 18, 2004.
16. Consideration of
adopting a resolution approving an
agreement between the Police Jury and the Louisiana Department of
Transportation and Development for the construction of a sidewalk on the west
side of Prater Road, from Old Spanish Trail to the Southern Pacific railroad
tracks, and further, authorizing the President of the Police Jury, or his
designee, when appropriate, to execute all documents related thereto.
17. Consideration of
adopting a resolution accepting State Project No. 713-10-0103, Federal Aid
Project No. BRO-002(492) (Welcome Road Bridge) as complete.
18. Consideration of
adopting a resolution authorizing the President of the Police Jury to execute
the necessary documentation with reference to the dedication of a road located
on the West Calcasieu Cameron Hospital Service District’s property adjacent to
their Dynamic Dimensions facility in Ward One, with the Hospital Service
District being responsible for the costs related to the repairing of said road
to Police Jury standards, which is estimated to be between $30,000-$35,000.
19. Consideration of
adopting resolution approving an agreement between the Police Jury and Moss
Architects, Inc. for improvements to the Burton Memorial Coliseum Complex, and further, authorizing the President of the
Police Jury, or his designee, when appropriate, to execute all documents
related thereto.
20. Consideration of
accepting the Calcasieu Parish Health Unit Parking Addition as substantially
complete.
21. Take
appropriate action on bids received by the Parish Purchasing Agent on
November 9, 2004, for audio and video equipment for use at the Calcasieu Parish Health Unit. (see attached)
22. Take
appropriate action on bids received by the Parish Purchasing Agent on
November 9, 2004, for one new one-half ton crew cab pickup truck for use by the
Mosquito Control Department. (see
attached)
23. Consideration
of authorizing the Parish Purchasing Agent to advertise for bids for one new
2005 mid-size four-door utility vehicle for use by the Workforce Investment Act
(WIA), Program Department.
REGULAR MEETING – NOVEMBER 18, 2004

received after the agenda was faxed out on November 12, 2004, and will require
a two-thirds vote to suspend the rules for consideration by the Police Jury:

Police Jury to execute the necessary documents for donation of right-of-way
from Terry Lee Mooney and Cynthia Diane Mooney for drainage improvements on
Soileau Road in Ward One, in accordance with criteria established by the Police
Jury and recommendation of the Parish Engineer.
Item No. Two:
Consideration of authorizing the Parish Purchasing
Agent to advertise for bids for the materials necessary to replace Bridge No.
050 on Pete Seay Road in Ward Four.
