5. The following has been advertised in accordance
with the law for action to be taken at 5:30 p.m., and take appropriate
action thereon:
HOLD A
PUBLIC HEARING to receive comments regarding the proposed reduction of the
boundaries of the Calcasieu-Cameron Hospital Service District to exclude all of
Ward One of Calcasieu Parish, Louisiana, less and except property located at
602 Sam Houston Jones Parkway located in Ward One.
6. In accordance with the election procedures, the
following action must be taken at 5:30
p.m.:
(6.1)
adopt a proces verbal and resolution promulgating the results of the special
election held on March 9, 2004, for continuation of a property tax in the
amount of 4.06 mills for a period of ten (10) years, beginning in the year
2004, for the purpose of paying the cost of expenses, equipment, and supplies
related to construction, hardsurfacing and improving roads, highways, and
bridges, and the necessary ditching and drainage related thereto, and
continuation of the Parish’s Road and Drainage Trust Fund in the amount of
$1,000,000 annually to be appropriated to projects which have local, state or
federal matching funds;
(6.2)
adopt a proces verbal and resolution promulgating the results of the special
election held on March 9, 2004, for renewal of a 1% (one percent) sales tax to
run for a period not to exceed twenty (20) years beginning September 1, 2004,
for the purpose of acquiring, constructing, improving, maintaining, operating,
equipping, repairing and draining public roads, highways, bridges and parks,
and purchasing, operating and maintaining equipment and supplies therefor, with
not less than one-third (1/3) of the avails, proceeds, and revenues of the Tax
to be used for the purchase of materials, equipment and services for the
repair, maintenance and overlaying of Parish roads;
(6.3)
adopt a proces verbal and resolution promulgating the results of the special
election held on March 9, 2004, for continuation of a property tax of 3.49
mills for a period of ten (10) years, beginning in the year 2004, for the
purpose of maintenance and operation of the Juvenile Detention Center,
maintenance and operation of the Juvenile Probation Office, paying the cost of
improvement to or construction of facilities at the Juvenile Detention Center,
and providing and/or contracting for the provision of juvenile care, shelter,
evaluations, treatment and counseling services; and
(6.4)
adopt a proces verbal and resolution promulgating the results of the special
election held on March 9, 2004, for continuation of a property tax of 2.48
mills for a period of ten (10) years, beginning in the year 2004, for the
purpose of maintaining, operating, improving or constructing facilities and
services of the Calcasieu Parish Health Unit and for providing and/or
contracting for health-related services and responsibilities under the
Calcasieu Parish Police Jury.
7. Presentation of a plaque to the St. Louis
Saints Division III Boys State Soccer Champions. (Dr. Mackey)
8. Take appropriate action on applications for liquor
and beer permits. (Mr. Vickers)
9. Consideration
of approval of the minutes of the Regular Meeting of the Police Jury dated
February 19, 2004.
10. Take appropriate action on RZ01-006-04 which is a request by
Louis Whittington to rezone from R-2 (Mixed Residential) to A-1 (Agricultural)
to allow for agricultural uses.

11. Consideration of amending the Code of Ordinances of Calcasieu
Parish, Louisiana as it relates to zoning ordinance and floodplain
ordinance.
12. Consideration of adopting a resolution indicating objection/no
objection to the following proposed projects in Calcasieu Parish, Louisiana,
provided said work meets with the rules and regulations of the Corps of Engineers,
Best Management Practices during the course of construction set forth by the
Environmental Protection Agency guidelines, and approvals are received from all
other appropriate state and federal agencies, and further, that any required
permits are obtained from the Division of Planning and Development:
(12.1) Proposal of
Trunkline LNG Company for the explosive removal of four 42-inch diameter pipes
used as breasting dolphins by Trunkline LNG Company, LLC. The dolphins are located in 35 feet of water
and will be removed approximately 15 feet below the mudline. The piles will be severed using a 4.5 lb.
shape charge to be placed within the piles.
Either single charges will be used to sever each piling or multiple
charges will be used and detonated at a 1-s delay. The piles will then be removed with a crane on a barge. Said project is located in the Calcasieu
River southwesterly of Lake Charles.
(12.2) Proposal of Richard
Don Clements to remove an existing pier and wharf and replace with a new 88’ x
4’ pier, 28’ x 12’ wharf, and two 28’ x 14’ boat shelters. Said project is located in Prien Lake.
(12.3) Proposal of Hunter
Lundy to dredge and remove 135 cubic yards of bottom sediments to provide
adequate navigation depths and construct a 38 foot long by 32 foot wide covered
boat shed for private recreational purposes.
Said project is located in a tributary off of the Calcasieu River.
(12.4) Proposal of Samuel
C. and Joyce L. Anderson to clear, grade, and deposit approximately 200 cubic
yards of hauled in riversand for construction of a homesite, a 170 feet
driveway, and a 20-feet by 20-feet workshop.
Said project is located off of Anthony Ferry Road.
AGENDA NOTE:
any resolution of no objection to any project, if adopted, will
stipulate that such “no objection” is based solely on evaluation by the Parish
Planning and Development Staff relative to the project’s compliance with
current parish ordinances and provisions, and that no environmental assessment
was made, and further, requesting the agencies and/or individuals with
environmental expertise to make an evaluation and forward their findings to the
U. S. Corps of Engineers.
13. Consideration
of adopting a resolution, as recommended by the Board of Commissioners of Lake
Charles Harbor and Terminal District, ordering and calling a special election,
in accordance with provisions of State Law, to be held on September 18, 2004,
to provide for a vote of the electorate in Calcasieu Parish to exempt from
property tax in Calcasieu Parish all drilling rigs and any property
incorporated in or used in the operation thereof, used outside of the state
exclusively for the exploration and development of minerals, but which are
located within the state for the purpose of being stored, stacked, converted,
renovated or repaired.
14. Consideration of
adopting a resolution authorizing the issuance by the Calcasieu Parish Public
Trust Authority of not exceeding $10,000,000 of its single-family mortgage
revenues bonds, Series 2004.
15. Consideration of adopting a resolution ratifying an Amendment to
the Contract between the Police Jury and Local Union No. 1377 of the American
Federation of State, County, and Municipal Employees (AFSCME) that adds
contract provisions specifically applicable to the Office of Juvenile Justice
Services’ operation.
16. Consideration of authorizing the execution of an agreement by the
Parish Administrator for the renewal of a lease with a tenant and user of the
Magnolia Building, in accordance with parameters established by the Police Jury
Liaison Group for such purpose.

17. Consideration of
adopting a resolution approving the submittal of an application with the
Louisiana Department of Transportation and Development to aid in the financing
of operating and/or capital assistance projects pursuant to the Rural Public
Transit Program, 49 CFR 5311 and/or Discretionary Capital Program, 49 CFR 5309,
and further, authorizing the President of the Police Jury, or his designee,
when appropriate, to execute all documents related thereto.
18. Consideration of
authorizing the President of the Police Jury to execute the necessary
documentation for expropriation of right of way from Joseph Rodney Henry on
Miracle Lane in Ward Three on property described as follows (Police Jury
District 9):
Commencing
at the Northeast corner of the West Half of the West Half of the East Half of
the West Half of the Northeast Quarter of Section 36, Township 11 South, Range
9 West, in Calcasieu Parish, Louisiana, thence South along the East line of
said West Half of the West Half of the East Half of the West Half of the
Northeast Quarter a distance of 30.0 feet to the South Right of Way line of
Arsene LeBleu Road and point of beginning, thence continuing South along said
East line a distance of 1655.89 feet, thence West 30.0 feet, thence North along
a line that is parallel to and 30.0 feet West of said East line a distance of
1655.89 feet, thence East a distance of 30.0 feet to point of beginning. Contains 1.14 acres more or less.
19. Consideration of
accepting Calcasieu Parish Project No. 2003-01 (Ward 2: Fruge Road, Lynn Road;
Ward 3: August Drive, Berwick Lane, Brighton Lane, Cobb Road, Constance Lane,
Dobbertine Road, East Hebert Road, Ellen Drive, Eva Lane, Gauthier Road,
Goodman Road, South Goodman Road, McDaniel Drive, McHugh Drive, Monoghan Drive,
North Constance Lane, No-So Road, Prestwick Lane, Ryan Lane, Ryan Road,
Scarbourgh Drive, South Constance Lane, Stonehaven Lane, Thomas Lane, Toussaint
Road, West Tank Farm Road, Western Drive, Eva Lane, Patricia Lane and Striping
of Gossett Road and Burton Lane; Ward 8: Boys Village Road, Claude Hebert Road,

20. Consideration of
accepting Calcasieu Parish Project No. 2003-04 (Ward 1: Cascio Road, Debra
