6.   Take appropriate action on applications for liquor and beer permits. (Mr. Vickers)  (see attached)

 

7.   Consideration of approval of the minutes of the Regular Meeting of the Police Jury dated December 18, 2003.

 

8.    Receive report from Mr. Allen Smith, General Counsel to the Police Jury, with reference to the Police Jury’s options and legal obligations with respect to the vacancy that exists in the District Nine Police Jury seat, and take appropriate action thereon.

 

9.    Take appropriate action on RZ03-002-04 which is a request by Dennis and Cynthia Scott to rezone from C-1 (Light Commercial) to C-3 (Central Business Commercial) to allow mini-warehouses.  (Herman Road off of Gulf Highway in Ward Three, Police Jury District 7)  (see attached)

 

          [The Planning and Zoning Board met on Tuesday, January 20, 2004, and voted unanimously to recommend that the request be granted with the following stipulations: 1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that all drives and parking must be hardsurfaced (concrete or asphalt); and 3) that a security fence must be installed upon completion of the building(s) per phase development.]

 

10.     Take appropriate action on RZ03-001-04 which is a request by Michael and Norma McVey to rezone from R-2 (Mixed Residential) to C-2 (General Commercial) to allow a restaurant and future expansion of a non-conforming use (Mary’s Lounge).  (Broad Street in Ward Three, Police Jury District 2)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, January 20, 2004, and voted 8 (for) to 3 (against) to recommend that the request be granted with the following stipulations:  1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that a parish occupational license must be obtained; 3) that a 6’ wooden privacy fence must be installed along West property line prior to opening of the business; 4) that all parking and driveways must be hardsurfaced (asphalt or concrete); 5) that each driveway must be marked as an entrance or exit; and 6) that the sale of alcohol be limited to low alcohol content (beer).]

 

11.   Consideration of adopting a resolution authorizing the Director of Planning and Development and the Calcasieu Parish Clerk of Court to file the Lake Caroline Subdivision plat of Survey located off of Goodman Road in Ward Three in Section 26, Township 9 South, Range 8 West, Calcasieu Parish, Louisiana, as requested by Mr. Robert Davis.  (Police Jury District 2) 

 

AGENDA NOTE: the recording of the survey shall not be construed to mean that the Police Jury and/or Planning and Zoning Board, or anyone acting on their behalf, has accepted and/or approved the streets, roads or drainage system or any facilities in the subject survey.

 

12.   Consideration of adopting an ordinance to amend Parish Ordinance No. 4666 which was adopted on December 18, 2003, to correct an error in the legal description of property which was rezoned in conjunction with Zoning Case RZ01-051-03.

 

         AGENDA NOTE:  on December 18, 2003, the Police Jury approved a request by Coffey Pines Part I to rezone from A-1 (Agricultural) to R-1 (Single Family Residential) to allow a residential subdivision (Coffey Pines Subdivision Part I).  (Coffey Road in Ward One, Police Jury District 14)

 

13.   Consideration of approving the following persons to serve on the Metro Planning Task Force, in accordance with the agreement between the Parish and the City of Lake Charles, with each person representing the areas as indicated herein:  Former Elected Official-Enos Derbonne; Developer-Jimmy Taussig; Attorney-Glen James; Architect/Engineer-Joe Champeaux; McNeese State University-Dr. Harold Stevenson; and League of Women Voters-Lollion Elmer.

 

14.   Consideration of adopting a resolution indicating objection/no objection to the following proposed projects in Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers, Best Management Practices during the course of construction set forth by the Environmental Protection Agency guidelines, and approvals are received from all other appropriate state and federal agencies, and further, that any required permits are obtained from the Division of Planning and Development:

 

(14.1) Proposal of Charles Bird to dredge approximately 3,400 cubic yards of native material to construct a 438 foot long by 25 foot wide by 8 feet deep access canal, 36 foot by 30 foot area for a boat house, and 24 foot by 14 foot swimming pool, install 1,046 feet of timber bulkhead with backfill.  The excavated material will be deposited within a shallow pond at an elevation conducive to marsh establishment and an additional 66 cubic yards of hauled-in aggregate material will be deposited to construct a driveway and foundations for a workshop and RV shed, and erect a single family residence on piles.  Said project is located near Maplewood.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

 

(14.2) Proposal of David Hanchey to install and maintain a bulkhead, fill, wharf, and boatslip for erosion protection and recreational purposes.  The proposed work is to be located within an area about 125 feet long and 55 feet wide.  The fill operation will consist of the placement of approximately 28 cubic yards of hauled-in material which is to be deposited behind the bulkhead.  Said project is located in the Calcasieu River, in Section 21, Township 10 South, Range 9 West, in Lake Charles.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

 

AGENDA NOTE:  any resolution of no objection to any project, if adopted, will stipulate that such “no objection” is based solely on evaluation by the Parish Planning and Development Staff relative to the project’s compliance with current parish ordinances and provisions, and that no environmental assessment was made, and further, requesting the agencies and/or individuals with environmental expertise to make an evaluation and forward their findings to the U. S. Corps of Engineers.

 

15.   Consideration of adopting a policy relative to adjudicated property wherein if a purchaser fails to complete the requirements of the ordinance, that no future offers be accepted from the same purchaser on the same piece of property.

 

          AGENDA NOTE:  this item was deferred on November 20, 2003.

 

16.   Consideration of adopting a resolution approving a Joint Services Agreement between the Police Jury and the City of Sulphur wherein the Parish will provide plumbing inspection services within the City of Sulphur, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

17.   Consideration of adopting a resolution approving the calling of an election by the Board of Commissioners of Waterworks District No. Seven of Wards Four and Six for the renewal, levy, and collection of a tax of six mills on all property subject to taxation within the District for a period of ten years beginning on January 1, 2005, and ending December 31, 2014, for the purpose of acquiring, constructing, improving, maintaining or operating waterworks facilities in the District.

 

18.   Consideration of adopting a resolution approving the assignment of working interest in an oil, gas, and mineral lease dated August 26, 2003, between the Police Jury and Mayne & Mertz, Inc. to Duncan Oil Partners, Adams Resources Exploration Corporation, Sharp Family Partnership, Ltd., Hackberry Partners L.P., James L. Powell, K. S. Adams, Jr., Michael C. Puzio, Erick C. Nefe, Brinkerhoff Exploration, Inc., and Mayne & Mertz Partnership on certain roads and streets in North Sam Houston Forest Subdivision in Section 14, Township 8 South, Range 9 West, located in Ward One. 

 

19.   Consideration of authorizing the President of the Police Jury to execute the necessary documents for acquisition of right-of-way from Joshua Timberlands LLC on Paul Bellon Road (west tract) in Ward One, in accordance with criteria established by the Police Jury and recommendation of the Parish Engineer.

 

20.   Consideration of the following requests from the Office of Community Services:

 

(20.1) adopt a resolution approving the submittal of a funding application to the Louisiana Department of Transportation and Development for a grant from the 5310 Elderly Grants Program for Elderly and Disabled Persons with Disabilities for Fiscal Year 2004-05 for use by the Calcasieu Parish Police Jury Public Transit System, and further, authorize the President of the Police Jury, or his designee, when appropriate to execute all documents related thereto;

 

(20.2) adopt a resolution approving the submittal of a funding application to the Louisiana Department of Transportation and Development for a grant under 49 CFR 5311, Non-Urbanized Area Formula Program and/or 49 CFR 5309, Discretionary Capital Program for Fiscal Year 2004-05 for use by the Calcasieu Parish Police Jury Public Transit System, and further, authorize the President of the Police Jury, or his designee, when appropriate to execute all documents related thereto;

 

21.   Consideration of approval of a revised nomination structure for Police Jury-appointed boards.  (see attached)

 

22.   Consideration of authorizing the Parish Purchasing Agent to solicit Request for Proposals for enhancement of the existing software applications for use by the Division of Planning and Development.

 

23. Consideration of authorizing the Parish Purchasing Agent to solicit Request for Proposals for an Automatic Vehicle Location (AVL) and Mobile Data System for use by the Office of Community Services.

 

24. Consideration of authorizing the Parish Purchasing Agent to advertise for bids for four one-half ton pickup trucks, six GPS flow monitoring systems, and nine GPS tracking units for use by the Division of Engineering and Public Works (Mosquito Control Department).

 

25.   Consideration of authorizing the Parish Purchasing Agent to advertise for bids for the purchase of sound equipment for use at the Burton Memorial Coliseum.

 

26.   Consideration of authorizing the Parish Purchasing Agent to purchase two 2004 small utility spray units, one 2004 35 horsepower four-wheel drive tractor with front end loader, and one 2004 five-foot rotary mower, utilizing State Contract Purchasing Procedures, for use by the Division of Engineering and Public Works.
