5.   The following item has been advertised in accordance with the law for action to be taken at 5:30 p.m.:

 

(5.1) Receive and open sealed bids for Calcasieu Parish Project No. 2003-03 (Ward 1 – Birdnest Road, Helen Lane, Kirby Lane, Marilyn Road, Podrasky Road, Joshua Lane, Cypress Lake Drive, Kingfisher Road, Wachsen Drive, Rothwood Drive, Atlanta Drive, Hampton Avenue, and Ashley Avenue), and take appropriate action thereon; and

 

(5.2) Receive and open sealed bids for Calcasieu Parish Project No. 2003-05 (Pavement Striping of Various Roads in Wards 1, 3, 4, 5, 6, 7, and 8), and take appropriate action thereon.

 

6.    The following item requires action at 5:30 p.m.:

 

Consideration of adopting a proces verbal and resolution promulgating the results of an election held on May 3, 2003, for the continuation of a 1.5 mill property tax to be levied for a period of ten years, beginning in 2003, for the purpose of operating, maintaining, and improving the Burton Coliseum, and for funding other agricultural and community services.

 

7.   Take appropriate action on applications for liquor and beer permits. (Mr. Vickers)  (see attached)

 

8.   Consideration of approval of the minutes of the Regular Meeting of the Police Jury dated April 17, 2003.

 

9.   Presentation of checks to the following public entities which represents a one-time allocation from the 2002 Delta Downs Slots Proceeds:

 

·            City of DeQuincy      $250,000

·            Town of Iowa      $200,000

·            City of Sulphur      $300,000

·            Town of Vinton      $400,000 ($250,000-Proceeds, $150,000-Impact Adjustment)

 

10.     Take appropriate action on RZ03-020-03 which is a request by Allen and Thelma Shepherd to rescind Ordinance No. 3676 and revert property from I-2 (Heavy Industrial) to A-1 (Agricultural) due to non-development of the property.  (9564 Gulf Highway in Ward Three, Police Jury District 9)  (see attached)

 

         AGENDA NOTE:  on July 19, 1995, the Police Jury granted the petitioners’ request to rezone their property from A-1 (Agricultural) to I-2 (Heavy Industrial) to store topsoil, sand, and related materials.

 

         [The Planning and Zoning Board met on Tuesday, May 20, 2003, and voted unanimously to recommend that the request be granted with the following stipulations:  1) that the development adhere to the site plan on file with the Division of Planning and Development; and 2) that the manufactured home must be skirted within 10 days of zoning approval.]

 

11.      Take appropriate action on RZ03-010-03 which is a request for a revision by Port Aggregates, Inc. to revise the site plan to allow a concrete batch plant.  (Goodman Road in Ward Three, Police Jury District 2)  (see attached)

 

         AGENDA NOTE:  on March 20, 2003, the Police Jury granted the petitioners’ request to rezone from I-1 (Light Industrial) to I-2 (Heavy Industrial) to allow bulk storage and processing of concrete (crushing) on Goodman Lane in Ward Three.

 

[The Planning and Zoning Board met on Tuesday, May 20, 2003, and voted unanimously to recommend that the request be granted with the stipulation that the development adhere to the site plan on file with the Division of Planning and Development.]

 

12.     Take appropriate action on RZ03-022-03 which is a request by Jane Trahan to rescind Ordinance No. 3932 and revert property from R-1 (Single Family Residential) to A-1 (Agricultural) due to non-development of a subdivision.  (1567 E. Lincoln Road in Ward Three, Police Jury District 9)  (see attached)

 

         AGENDA NOTE:  on October 16, 1997, the Police Jury granted the petitioners’ request to rezone the property from A-1 (Agricultural) to R-1 (Single Family Residential) to allow the petitioner to develop a subdivision and future home sites.

 

         [The Planning and Zoning Board met on Tuesday, May 20, 2003, and voted unanimously to recommend that the request be granted.]

 

13.     Take appropriate action on RZ01-021-03 which is a request by Terrell Properties, LLC, to rezone from R-2 (Mixed Residential) to R-M (Multi-Family Residential) to allow two duplexes.  (Marlin Road in Ward One, Police Jury District 1)  (see attached)

 

         [The petitioner withdrew his request to allow two duplexes.  The Planning and Zoning Board met on Tuesday, May 20, 2003, and voted 7 (for) and 2 (against) to recommend that the request be granted with a revised site plan depicting one duplex and the following stipulations: 1) that all drives and parking must be hardsurfaced (concrete or asphalt); and 2) that the duplex must have landscaping as approved by the Division of Planning and Development.]

 

14.     Take appropriate action on RZ08-019-03 which is a request by Ronald and Cherie Young to rezone from C-2 (General Commercial) to A-1 (Agricultural) to allow residential development.  (2091 Corbello Road in Ward Eight, Police Jury District 2)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, May 20, 2003, and voted unanimously to recommend that the request be granted with the following stipulations: 1) that development must adhere to the site plan on file with the Division of Planning and Development; 2) that the manufactured home must be skirted prior to utilities being connected; and 3) that the proper permits must be obtained within 5 days of zoning approval.]

 

15.     Take appropriate action on RZ03-014-03 which is a request by Jeanis Air Conditioning to rezone from C-2 (General Commercial) to R-2 (Mixed Residential) and R-M (Multi-Family Residential) to allow residential development (6 duplexes and one manufactured home).  (Manuel Road in Ward Three, Police Jury District 9)  (see attached)

 

         AGENDA NOTE:  on April 15, 2003, the Planning and Zoning Board voted 6 (against) and 4 (for) to recommend that the request be denied.  The staff recommended that the request be granted with the following stipulations:  1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that all drives and parking for the duplexes be hard surfaced (concrete or asphalt); 3) that a centralized postal approved mailbox must be provided; and 4) all buildings and vehicles must be removed from the premises within one year of zoning approval.  On April 17, 2003, the Police Jury voted 11 (for) and 2 (against) to uphold the Planning and Zoning Board which was to deny the request to rezone the property.  On May 1, 2003, the Police Jury voted 9 (for) and 4 (against) to rescind the previous action of the Police Jury on April 17, 2003, and to direct the Planning staff to set a new public hearing date for consideration of the rezoning request and implement appropriate notice provisions related thereto.

 

16.     Receive report from the Division of Planning and Development staff regarding the following two properties as it relates to condemnation of property:

 

(16.1) 214 PREDIUM ROAD, South Lake Charles area, Lot 14, Predium Subdivision, Ward 3, Calcasieu Parish, Louisiana (one house) Owner: Irene Clark, 2802 Hinton Drive, Lake Charles, LA 70601, TA# 00059641 (Police Jury District 9);

 

         AGENDA NOTE:  the Police Jury conducted a public hearing on March 6, 2003, and the property owner was given 120 days to make adequate repairs, and further, requested that the property owner provide a report on the progress in 60 days.

 

         (16.2) 9442 BIG LAKE ROAD, South Lake Charles area, Lots 3 and 4, Treasureland Subdivision, Ward 3, Calcasieu Parish, Louisiana (one house) Owner: Joseph Rodney Henry, 167 David Lane, Lake Charles, LA 70607, TA#00056103 (Police Jury District 9).

 

         AGENDA NOTE:  the house on this property was previously condemned on October 10, 2002 (Parish Ordinance No. 4416).  On November 7, 2002, the Police Jury granted Mr. Henry sixty days to repair the house after obtaining a variance from the Planning and Zoning Board on December 17, 2002.  The sixty-day extension expired on February 17, 2003.  Mr. Henry appeared before the Police Jury on March 6, 2003, and requested an additional 60 days to repair, and the Police Jury granted his request.

 

17.   Consideration of adopting a resolution indicating objection/no objection to the following proposed projects in Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers and approvals are received from all appropriate state and federal agencies, and further, that any required permits are obtained from the Division of Planning and Development:

 

(17.1) Proposal of Robbie Primeaux to clear, grade, and place approximately 1,960 cubic yards of earthern fill to construct house pads, streets, and driveways, all to make 10 lots available for single-family residences and one lot for commercial development.  Said project is located off of Louisiana Highway 14 near Lake Charles.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

        

         (17.2) Proposal of First Apostolic Church to clear, grade, grub, excavate, and place approximately 8,600 cubic yards of hauled-in clay and aggregate fill for construction of house pads, access roads, and drainage ditches, all to implement a 34-lot single-family residential subdivision.  Said project is located off of Musser Road located near Moss Bluff.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

 

         (17.3) Proposal of Travis R. Pauley to clear, grade, and place approximately 9,317 cubic yards of earthen fill material for the construction of a house pad, driveway, yard, barn, and arena for livestock.  Said project is located off of Nelson Road near Lake Charles.

 

AGENDA NOTE:  any resolution of no objection to any project, if adopted, will stipulate that such “no objection” is based solely on evaluation by the Parish Planning and Development Staff relative to the project’s compliance with current parish ordinances and provisions, and that no environmental assessment was made, and further, requesting the agencies and/or individuals with environmental expertise to make an evaluation and forward their findings to the U. S. Corps of Engineers.

 

18.   Consideration of authorizing the Director of Planning and Development to notify the following property owners in accordance with Article II of Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to show cause at a public hearing on July 10, 2003, or the first regular Police Jury meeting thereafter, as to why the structures on the properties as stipulated should not be condemned:

19.   Consideration of adopting an ordinance rescinding Ordinance No. 4499 which was adopted by the Police Jury on March 6, 2003, which conveyed a parcel of adjudicated property to Mr. Robert B. Pouchie, Sr., due to the fact that said property has been redeemed by the original owner.

 

20.   Consideration of adopting a resolution approving an Amendment to the Local Service Agreements between the Police Jury and applicable taxing entities providing for donations of adjudicated property within those taxing entities, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

21.     Receive report from Director of the Division of Planning and Development concerning proposed Administrative Rules for the sale of adjudicated property.

 

22.   Consideration of approval of the Ad-Hoc Ambulance Request-for-Proposal Review Committee Report dated April 30, 2003.  Said Committee:

 

(22.1) received a presentation of the proposal submitted by Acadian Ambulance for provision of ambulance service in Calcasieu Parish through an exclusive franchise agreement.  (Acadian Ambulance was the only company which submitted a proposal);

 

(22.2) recommended that Acadian Ambulance be awarded an exclusive franchise to provide emergency and non-emergency ambulance service in Calcasieu Parish and that the Police Jury enter into a contract with said company in accordance with terms stipulated in the Request-for-Proposal document.

 

23.   Consideration of adopting an ordinance establishing an exclusive franchise agreement with Acadian Ambulance Service, Inc., for a five (5) year term with an option to renew for an additional five (5) year period, for the provision of emergency and non-emergency ambulance service within the service area defined in the ambulance Request-for-Proposal document, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

24.   Consideration of adopting a resolution approving a Joint Services Agreement between the Police Jury and the Lake Charles Harbor and Terminal District to repair three washouts on Henry Pugh Boulevard caused by deteriorated cross-pipe, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

AGENDA NOTE:  the Lake Charles Harbor and Terminal District would be responsible for the purchase of 960 feet of culverts, bedding and backfill material, and the use of revetment materials that are in stock for an out-of-pocket cost not to exceed $30,000, and the Calcasieu Parish Police Jury would supply the manpower and equipment necessary to install said culverts. These repairs are necessary to allow MSRC and Talen Marine access to their sites and for the public to have safe access to the new Calcasieu Point Landing due to open near the end of June.

 

25.   Consideration of adopting a Resolution authorizing the Division of Engineering and Public Works to submit an Application for Transportation Enhancement Projects to the Louisiana Department of Transportation and Development (LA DOTD) for the construction of a sidewalk on Park Road approximately 1300’ north of Recreation Boulevard and ending at Pine Cone Drive, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

AGENDA NOTE:  the Police Jury will assume full responsibility for the local matching funds, the responsibility for managing and maintaining the project, and the responsibility for legal liability incurred by LA DOTD as a result of the project.  The Police Jury will be reimbursed 95% of eligible expenses.

 

26.   Consideration of adopting a resolution approving the renewal of a Joint Services Agreement between the Police Jury and the Calcasieu Parish Sheriff’s Department for the purpose of providing heightened security patrol at all Parish parks, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

27.   Consideration of adopting a resolution requesting that the Louisiana Congressional Delegation support the restoration of Juvenile Accountability Incentive Block Grant (JAIBG) funds to the Fiscal Year 2002 level and removal of all Project Childsafe earmarks, including all existing restrictions that effect the Fiscal Year 2002 and Fiscal Year 2003 JAIBG funds, and further, that copies of this resolution be forwarded to the members of the Louisiana Congressional Delegation.  (Mrs. August)

 

28.   Consideration of adopting a resolution joining in the efforts of Beauregard and Vernon Parishes in their solicitation of support from the Louisiana Department of Culture, Recreation and Tourism and the Louisiana Department of Transportation and Development to establish a scenic byway along the Sabine River.

 

29.    Take appropriate action on bids received on May 20, 2003, by the Parish Purchasing Agent for three new and unused animal transport units, for use by the Division of Engineering and Public Works (Animal Control Department).  (see attached)

 

30.    ADVISE that a response has been received from Congressman Richard H. Baker in regard to the Police Jury’s resolution of April 3, 2003, which requested the Louisiana Legislative Delegation to support U. S. Senate Bill 170 and U. S. House of Representatives Bill 20 to amend the Federal Water Pollution Control Act to authorize appropriations for state water pollution control revolving funds.  Congressman Baker expressed his support of H.R. 1560, the “Water Quality Financing Act,” the provisions of which he felt would help address the wastewater infrastructure funding shortfall and which he believed to be the most efficient means by which to extend federal assistance to local communities.  Also, Congressman Baker expressed his opposition to H.R. 20, the “Clean Water Infrastructure Financing Act” because he felt the requirements pertaining to the award of contracts for architectural and engineering services would artificially inflate the cost of infrastructure projects, thereby offsetting the value of the funds original intent.
