5.   Hold a public hearing at 6:00 p.m., in accordance with Article II-Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, requesting authorization to condemn immediately said structure due to the structure being in danger of collapse and constituting a menace to public safety:  (see attached)

7.   Consideration of approval of the minutes of the Regular Meeting of the Police Jury dated December 19, 2002.

 

8.    Take appropriate action on RZ02-001-03 which is a request by Jerry and Deloras Campbell to rezone from C-1 (Light Commercial) to R-2 (Mixed Residential) to allow residential development.  (N. Railroad Avenue and Fourth Street in Ward Two, Police Jury District 10)  (see attached)

 

    [The Planning and Zoning Board met on Tuesday, January 14, 2003, and voted 9 (for) and 1 (against) to recommend that the request be granted with the following stipulations: 1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that the proper permits must be obtained within five days of zoning approval; and 3) that the manufactured home must be skirted prior to utilities being connected.]


9.    Take appropriate action on RZ03-002-03 which is a request by Bernice Gauthier to rezone from R-2 (Mixed Residential) to C-2 (General Commercial) to allow a lounge.  (4015 E. Broad Street in Ward Three, Police Jury District 2)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, January 14, 2003, and voted unanimously to recommend that the request be denied.  Should the Police Jury grant the request, the staff recommends the following stipulations: 1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) a parish occupational license must be obtained; 3) adhere to the Parish Noise Ordinance; 4) install a six-foot (6’) wood privacy fence along the North and West property lines upon completion of the building; 5) install adequate insulation in the building to prevent loud noise from unnecessarily interfering with the comfort of nearby residents; and 6) all parking and driveways must be hard surfaced (asphalt or concrete).]

 

10.     Consideration of adopting a resolution indicating objection/no objection to the following proposed project in Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers and approvals are received from all appropriate state and federal agencies, and further, that any required permits are obtained from the Division of Planning and Development:

 

(10.1) Proposal of Mayne & Mertz, Inc. to construct a ring levee to prepare a well site to drill and produce the Northwest Vinton Field – Richard Well No. 1.  The proposed ring levee will measure 300 feet by 300 feet and will require the discharge of approximately 267 cubic yards of material into jurisdictional wetlands.  The levee will measure two feet high by five feet wide and one-foot-wide crown and a 1:1 side slope configuration.  All material used to construct the levee will be excavated from within the levee perimeter.  A total of 2.1 acres of wetland habitat will be impacted as a result of the proposed activity.  The site will be accessed by means of an existing limestone access road.  If productive, the site will be restored to the minimum area necessary for production activities.  Within 120 days of cessation of drilling activities, the well site will be degraded, and the site will be restored to pre-construction contours.  To compensate for impacts to the wetland habitat, the applicant will purchase 2.1 acre-credits from an appropriate wetland mitigation bank.  The applicant’s plans are enclosed in three sheets.  Said project is located in wetlands, adjacent to Gum Gully, northeast of Toomey.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

 

         AGENDA NOTE:  any resolution of no objection to any project, if adopted, will stipulate that such “no objection” is based solely on evaluation by the Parish Planning and Development Staff relative to the project’s compliance with current parish ordinances and provisions, and that no environmental assessment was made, and further, requesting the agencies and/or individuals with environmental expertise to make an evaluation and forward their findings to the U. S. Corps of Engineers.

 

11.     Consideration of approving a Revised Coastal Use Permit application for Lester Langley to develop property located at the end of Lake Breeze Road in Ward Three with reference to the placement of additional fill to raise the house pads and widen by ten additional feet for residential subdivision development.

 

AGENDA NOTE:  on May 6, 1999, the Police Jury granted approval for this development, however, these modifications are being requested.

 

12.     Consideration of authorizing the Director of Planning and Development to notify the following property owners in accordance with Article II of Chapter Six of the Code of Ordinances of the Parish of Calcasieu, Louisiana, to show cause at a public hearing on March 6, 2003, or the first regular Police Jury meeting thereafter, as to why the structures on the properties as stipulated should not be condemned:

13.     Consideration of amending the Calcasieu Parish Code of Ordinances, Chapter 15-Licenses and Miscellaneous Business Regulations, to correctly outline various cross references contained within said Chapter.

 

14.     Consideration of adopting a resolution approving an amendment to the Joint Services Agreement between the Police Jury and the Calcasieu Parish Sheriff’s Office for the use of inmate labor for litter abatement to reflect the revised budget for this program beginning January 1, 2003, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

15.     Consideration of authorizing the President of the Police Jury to execute the necessary documents for acquisition of right-of-way from HFB Properties, LLC, Donald Wayne Meadows, Jr., and Anita Faye Arceneaux-Meadows on Nelson Road in Ward Three (Calcasieu Parish Project No. 1999-07).

 

16.     Consideration of authorizing the Parish Purchasing Agent to advertise for bids for two 2003 one-half ton extended cab and chassis pickup trucks and one 2003 three-quarter ton extended cab pickup truck to be used by the Division of Engineering and Public Works (Animal Control Department).

 

17.     Consideration of going into executive session to discuss Claim No. 270A201674 (Miller vs. Police Jury).

 

18.     ADVISE that the Consulting Service Agreement between the Police Jury and Lake Charles Memorial Hospital has been assigned to the Institute of Neuropsychiatry for the Employee Assistance Program, in accordance with the provisions of said Agreement.
