6.    Recognition of the Calcasieu Preservation Society, Southwest Louisiana Bar Auxiliary, Southwest Louisiana Historical Association, Mrs. F. W. Raggio, Jr., and Dr. Joe Cash for their generous support toward the design and acquisition of the chandelier in Courtroom A.

 

7.   Take appropriate action on applications for liquor and beer permits. (Mr. Vickers)  (see attached)

 

8.   Consideration of approval of the minutes of the Regular Meeting of the Police Jury dated October 17, 2002.

 

9.    Take appropriate action on RA04-001-02 which is a request by Sasol North America, Inc. for road abandonment.  (Lincoln Heights 2 Subdivision including 6th Avenue, 7th Avenue, 8th Avenue, Electric Drive and Blocks 1, 2, and 3 of Lincoln Heights 2 Subdivision in Ward Four, Police Jury District 14)  (see attached)

 

[The Planning and Zoning Board met on Tuesday, November 19, 2002, and voted unanimously to recommend that the request be granted with the following stipulations: 1) that the Mossville Water District will be allowed to remove a salvageable or reusable portion of the existing water system for future use; 2) that the existing waterlines serving these areas are properly disconnected from the remaining water system; and 3) that the existing sanitary sewer lines serving these areas are properly disconnected from the remaining system.]

10.     Take appropriate action on RZ03-044-02 which is a request by R. G. Constructors of Southwest LA, Inc. to rezone from R-2 (Mixed Residential) to C-1 (Light Commercial) to allow commercial development.  (Bradley Street in Ward Three, Police Jury District 9)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, November 19, 2002, and voted unanimously to recommend that the request be granted with the following stipulations:  1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that all drives and parking be hardsurfaced (asphalt or concrete); and 3) that the use is limited to a construction storage and cabinet workshop only.]

 

11.      Take appropriate action on RZ03-043-02 which is a request by Neal Cormier to rezone from I-1 (Light Industrial) to A-1 (Agricultural) to allow residential development and a barn.  (Tom Hebert Road in Ward Three, Police Jury District 9)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, November 19, 2002, and voted unanimously to recommend that the request be granted, and further, recommended that the development adhere to the site plan on file with the Division of Planning and Development.]

 

12.     Take appropriate action on RZ04-045-02 which is a request by Percy Eloi to rezone from A-1 (Agricultural) to R-2 (Mixed Residential) to allow residential development (manufactured home subdivision).  (Wright and Ravia Roads in Ward Four, Police Jury District 12)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, November 19, 2002, and voted 6 (for) to 4 (against) to recommend that the request be granted with the following stipulations:  1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that the development adhere to the subdivision regulations of Calcasieu Parish; and 3) that a 6’ wood privacy fence be placed along the entire east side of the property.]

 

13.     Take appropriate action to consider amending the Calcasieu Parish Code of Ordinances with reference to the filing of applications for a zoning amendment, rezoning, zoning variance, or exception as follows (strike through sections below indicate language that is being recommended for removal and underlined sections indicate language that is being recommended for addition):

(13.1) An applicant who files an application to petition for a zoning amendment or rezoning may withdraw the application to petition for zoning amendments or rezoning at any time up to its consideration by the police jury. one time within one year from the date of the submission of the application at any time up to seven days prior to public hearing conducted by the board. Any request to withdraw an application within the seven day period shall be placed on the current agenda for action by the board to approve or disapprove the withdrawal request. The board shall consider no further requests for withdrawal for a period of one year from the date of the submission of the application. However, if the application to petition is withdrawn after the

public hearing has been held by the board, or if the police jury disapproves of the request contained in the petition, then no further petition for the same property will be considered by the police jury or the board for a period of one (1) year from the date of the public hearing.

(13.2) An applicant may withdraw his petition at any time up to the public hearing. who files an application to petition for a zoning variance or exception may withdraw the application one time within one year from the date of the submission of the application to petition at any time up to seven days prior to public hearing conducted by the board. Any request to withdraw an application within the seven day period shall be placed on the current agenda for action by the board to approve or disapprove the withdrawal request. The board shall consider no further requests for withdrawal for a period of one year from the date of the submission of the application. However, if a zoning petition is withdrawn by the applicant after the public hearing has been held, or if the board disapproves of the request contained in the petition, then no further petition for the same property will be considered by the board for a period of one (1) year from the date of the public hearing.

         [The Planning and Zoning Board met on Tuesday, November 19, 2002, and voted unanimously to recommend that the Calcasieu Parish Code of Ordinances be amended as stated above.]

 

14.     Consideration of adopting a resolution indicating objection/no objection to the following proposed project in Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers and approvals are received from all appropriate state and federal agencies, and further, that any required permits are obtained from the Division of Planning and Development:

 

(14.1) Proposal of Allen Singletary to clear, grade, and deposit fill and/or aggregate material to facilitate the development of 21 homesites, within an existing subdivision (Moss Bluff estate No. 3 Phase II) to include utilities and drainage infrastructure.  Approximately 13,100 cubic yards of on-site earthen material and an additional 6,500 cubic yards of hauled-in fill and/or aggregate material would be utilized in project construction.  The proposed project would encompass approximately 16.2 acres and would impact approximately 14.2 acres of forested wetlands.  Said project is located in Section 32, Township 8 South, Range 8 West, approximately 0.5 miles west of Highway 171.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

 

(14.2) Proposal of Renee G. Liebendorfer to install and maintain a culvert and fill for drainage.  The proposed work is to be located within an area about 124 feet long and 29 feet wide.  The fill operation will consist of the deposition of 316 cubic yards of hauled material in a wetland area.  Said project is located in wetlands off of Contraband Bayou, north bank, at a point about 0.8 of a mile above the Calcasieu River.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

         AGENDA NOTE:  any resolution of no objection to any project, if adopted, will stipulate that such “no objection” is based solely on evaluation by the Parish Planning and Development Staff relative to the project’s compliance with current parish ordinances and provisions, and that no environmental assessment was made, and further, requesting the agencies and/or individuals with environmental expertise to make an evaluation and forward their findings to the U. S. Corps of Engineers.

 

15.     Consideration of adopting a resolution approving an Enterprise Zone Endorsement Application by Bollinger Calcasieu, LLC, for the company’s 2002 expansion project located in Census Tract 34, Block Group 3.  (see attached)

 

16.     Consideration of adopting a resolution approving a Cooperative Agreement between the Police Jury and the State of Louisiana, Department of Natural Resources, for the 2002-2003 “Parish Coastal Wetlands Restoration Program” (Christmas Tree Recycling Project), and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

17.     Consideration of approving the General Insurance Committee Report dated November 21, 2002.

 

18.     Consideration of approving the Budget Committee Report dated November 21, 2002.

 

19.     Consideration of adopting a resolution supporting the formation of a joint committee of the Police Jury and the Lake Charles City Council to explore and discuss the opportunities of cost saving measures between the Parish and the City where services and resources are duplicated with the goal of this committee to be to determine what specific future actions should be pursued.

 

20.     Consideration of adopting a resolution authorizing a special bond and tax election being called by Ward One Fire Protection District No. One on April 5, 2003, (1) authorizing the levy and collection of a 10-year maintenance tax not exceeding seven mills for the purpose of acquiring, constructing, improving, maintaining, and operating the district’s fire protection or emergency medical service facilities and equipment, and (2) authorizing the issuance of not exceeding $1,750,000 of up to 15-year public improvement bonds for acquiring, constructing, and improving buildings, machinery, fire trucks, and other fire fighting equipment within and for the district.

 

21.     Consideration of adopting a resolution approving a Franchise Agreement with the Jefferson Davis Parish Water Commission No. One to provide water services to residents in the Bell City/Hayes area of Calcasieu Parish, and further, authorizing the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

22.     Consideration of adopting a resolution approving an Amendment to a Lease between the Police Jury and the Estate of Joe J. Tritico to provide for a month-to-month lease pending the relocation of parish departments currently housed in said building, and further, authorize the President of the Police Jury, or his designee, when appropriate, to execute all documents related thereto.

 

23.     Consideration of approving the following requests from the Office of Juvenile Justice Services:

 

(23.1) adopt a resolution approving the submittal of a grant application in an amount up to $30,000, with twenty percent matching funds, from the Louisiana Commission on Law Enforcement for Crime Victims Assistance, Crime Victim’s Act, a program that assists victims of  child abuse with recovering from effects associated with violence, and should residual funds become available a grant adjustment can be filed to increase grant award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto;

 

(23.2) adopt a resolution approving the submittal of a grant application in an amount up to $50,000 from the H. C. Drew Estate to provide technical assistance and to purchase equipment and software to establish an integrated information-sharing network with juvenile justice-serving agencies, which will improve the educational, vocational and social outcomes for at-risk youth and their families, and should residual funds become available a grant adjustment can be filed to increase grant award, and further, that the President of the Police Jury, or his designee, when appropriate, be authorized to execute all documents related thereto.

 

         (23.3) authorize the Parish Purchasing Agent to advertise for bids for the purchase of  a 2003 eight passenger van for use by the Office of Juvenile Justice Services.

 

24.     Consideration of authorizing the President of the Police Jury to execute the necessary documents for acquisition right of way from Goldsmith Farms, L.L.C. on Paul Bellon Road in Ward One, in accordance with criteria established by the Police Jury and recommendation of the Parish Engineer.

 

25.     Consideration of ratifying the advertisement for bids for one 2003 construction dump truck, for use by the Division of Engineering and Public Works (Special Drainage).

 

26.     Take appropriate action on bids received by the Parish Purchasing Agent on November 14, 2002, for two aircraft DGPS agricultural guidance systems with pilot display units and two factory remanufactured zero (0) timed Lycoming IO-540-K1B5 airplane engines, for use by the Mosquito Control Department.  (see attached)

 

27.     Take appropriate action on bids received by the Parish Purchasing Agent on November 14, 2002, for two 2003 one-half ton extended cab pickup trucks, one 2003 four-door utility vehicle, and one 2003 three-quarter ton four-door extended cab pickup truck, for use by the Facility Management Department.  (see attached)

28.     ADVISE that Calcasieu Parish was found to be in full compliance by the Louisiana Department of Transportation and Development for the 2002 Annual review which will assure continued participation in the Federal Bridge Replacement Program for the year 2003.
