5.   Take appropriate action on applications for liquor and beer permits. (Mr. Vickers)  (see attached)

 

6.   Consideration of approval of the minutes of the Regular Meeting of the Police Jury dated August 15, 2002.

 

7.   Take appropriate action on RZ03-040-02 which is a request by Wilton and Fay Red to rezone from R-2 (Mixed Residential) to R-1 (Single Family Residential) to allow a residential subdivision (God’s Property).  (Deshotel Lane and Tommy’s Lane in Ward Three, Police Jury District 2)  (see attached)

 

[The Planning and Zoning Board met on Tuesday, September 17, 2002, and voted unanimously to recommend that the request be granted with the following stipulations: 1) that the development adhere to the site plan on file with the Division of Planning and Development, and 2) that the development adhere to the subdivision regulations of Calcasieu Parish.]

 

8.    Take appropriate action on RZ08-022-01 which is a request by Jennifer Bufford McCracken to allow a revised site plan for a second warehouse on the property.  (Highway 3256/E. Opelousas Street in Ward Eight, Police Jury District 10)  (see attached)

 

[The Planning and Zoning Board met on Tuesday, September 17, 2002, and voted unanimously to recommend that the request be granted with the following stipulations:  1) that all drives and parking will be hardsurfaced (concrete or asphalt) 2) that the development adhere to the site plan on file with the Division of Planning and Development; 3) that the proper permits must be obtained and 4) that the petitioner agrees to construct parking areas in accordance with the revised site plan.]

AGENDA NOTE:  the Planning and Zoning Board met on Tuesday, June 19, 2001, and the Police Jury met on Thursday, June 21, 2001, and voted unanimously that the request to rezone the property from R-MHP (Manufactured Home Park) to I-1 (Light Industrial) to allow a warehouse be granted with the following stipulations:  1) that only the north 250’ be rezoned; 2) that all drives and parking will be hardsurfaced (concrete or asphalt); 3) that the development adhere to the site plan on file with the Division of Planning and Development; 4) that the proper permits must be obtained within thirty days of zoning approval; 5) that the use be limited to a warehouse; and 6) that the petitioner agrees to construct parking areas in accordance with the revised site plan which will be submitted at the meeting.

     

9.    Take appropriate action on RZ01-036-02 which is a request by Henry and Glenda Watkins to rezone from C-1 (Light Commercial) to R-1 (Single Family Residential) to allow residential development (house).  (1870 N. Perkins Ferry Road in Ward One, Police Jury District 1)  (see attached)

10.     Take appropriate action on RZ04-037-02 which is a request by Eary Elmer Bennett, Jr. to rezone from C-1 (Light Commercial) and A-1 (Agricultural) to C-2 (General Commercial) to allow commercial development (store and horse trailers sales).  (2893 Highway 90 West in Ward Four, Police Jury District 13)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, September 17, 2002, and voted unanimously to recommend that the request be granted with the following stipulations:  1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that the proper permits must be obtained within 5 days of zoning approval; 3) a Parish occupational license must be obtained within 30 days of zoning approval; and 4) that the use be limited to the storage and sales of horse trailers.]

 

11.      Take appropriate action on RZ03-038-02 which is a request by RCS Land Company LLC to rezone from R-1 (Single Family Residential) to C-2 (General Commercial) to allow a Family Dollar Store.  (5723 Highway 14 in Ward Three, Police Jury District 10)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, September 17, 2002, and voted unanimously to recommend that the request be granted with the following stipulations:  1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that all parking and drives must be hardsurfaced (asphalt or concrete); 3) that the use be limited to a retail store only; 4) that proper permits must be obtained; 5) that an occupational license must be obtained from the Division of Planning and Development; and 6) that the dumpster(s) be placed in a six foot fenced in containment area.]

12.     Take appropriate action on RZ04-039-02 which is a request by David Dewayne Sexton to rezone from R-2 (Mixed Residential) to R-MHP (Manufactured Home Park) to allow a manufactured home park (4 spaces).  (135 Carlyss Drive in Ward Four, Police Jury District 12)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, September 17, 2002, and voted unanimously to recommend that the request be denied, and should the Police Jury grant the request, the staff recommends the following stipulations:  1) that the development adhere to the revised site plan on file with the Division of Planning and Development; 2) that the proper permits must be obtained within 30 days of zoning approval; 3) that the manufactured homes must be skirted within 90 days of zoning approval; and 4) that all drives and parking must be hardsurfaced (asphalt or concrete).]

 

13.     Take appropriate action on RZ04-035-02 which is a request by residents of Fontenot Road to rezone from R-2 (Mixed Residential) and C-3 (Central Business Commercial) to R-1 (Single Family Residential) to maintain a single family residential character.  (Fontenot Road in Ward Four, Police Jury District 14)  (see attached)

 

         [The Planning and Zoning Board met on Tuesday, September 17, 2002, and voted unanimously to recommend that the property currently zoned as a manufactured home park (Bob’s Trailer Park) remain R-MHP (Manufactured Home Park).]

 

14.     Consideration of amending the Calcasieu Parish Code of Ordinances to remove as a permitted use a dwelling for a resident watchman or caretaker employed on the premises and provide that this use may be permitted as an exception by the Planning and Zoning Board in all commercial zoning districts, and further, add “dwelling for resident watchman or caretaker employed on premises” to I-1 (Light Industrial) “Permitted Uses.”

 

[The Planning and Zoning Board met on Tuesday, September 17, 2002, and voted unanimously to recommend the following changes:  remove the following from Zoning Districts C-1 (Light Commercial), C-2 (General Commercial), and C-3 (Central Business Commercial) “Permitted Uses” dwelling for resident watchman or caretaker employed on premises and add as “Permitted as Exceptions by Planning and Zoning Board” in C-1 (Light Commercial), C-2 (General Commercial), and C-3 (Central Business Commercial), add “dwelling for resident watchman or caretaker employed on premises” to I-1 (Light Industrial) “Permitted Uses”.]

 

AGENDA NOTE:  the Police Jury deferred action on August 15, 2002, until September 19, 2002, as per the request of the Division of Planning and Zoning staff in order that the Planning and Zoning Board may add additional recommendations regarding deferrals and withdrawals of zoning applications.

 

15.     Consideration of adopting a resolution indicating objection/no objection to the following proposed project in Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers and approvals are received from all appropriate state and federal agencies, and further, that any required permits are obtained from the Division of Planning and Development:

(15.1) Proposal of Chemical Waste Management to clear a 50-foot by 50-foot area for each of 23 sample sites for soil borings to determine soil composition and properties prior to final landfill design.  Said project is located on a 360-acre tract in Sections 8 and 17, Township 11 South, Range 10 West, of which approximately 29.2 acres are classified as wetlands subject to Corps of Engineers jurisdiction near Carlyss.  The Planning Staff recommends that the Police Jury indicate no objection to this project application.

 

         AGENDA NOTE:  any resolution of no objection to any project, if adopted, will stipulate that such “no objection” is based solely on evaluation by the Parish Planning and Development Staff relative to the project’s compliance with current parish ordinances and provisions, and that no environmental assessment was made, and further, requesting the agencies and/or individuals with environmental expertise to make an evaluation and forward their findings to the U. S. Corps of Engineers.

 

16.                      Consideration of the various options concerning the possible closure of the railroad crossing on Packing House Road (DOT No. 767-959B).

 

AGENDA NOTE:  action was deferred by the Police Jury on September 5, 2002, to September 19, 2002, to allow Mr. Breaux an opportunity to contact Conoco officials. On August 29, 2002, the Police Jury was given a report with the following options: (1) railroad crossing closed -- road construction costs for cul-de-sacs ($15,000); (2) signals and gates installed at crossing with minor improvements to approaches – road construction costs ($50,000) + signal and gates ($200,000); and (3) no signalization and bring crossing up to AASHTO Standards – road construction costs ($90,000) + right-of-way costs and relocation costs for purchase of home and business based on appraised value.  On August 1, 2002, the Police Jury deferred action for thirty days and recommended that a committee, composed of police jurors to be appointed by President Derbonne, and Mr. Smart, Mr. Vickers, and Mr. Gremillion, meet with officials of Conoco to determine what contingency plans would have to be put in place in the event of an emergency involving Conoco’s pipeline, which is located in the vicinity of the railroad crossing, should said crossing be closed. The Committee further recommended that at the same time, the committee also meet with owners of a pipeline located in the vicinity of the Stegall Road railroad crossing, which is scheduled for closure, regarding a similar situation involving said pipeline, and its effect on the residents of Burton Street and Kim Road in Sulphur.

 

17.     Consideration of adopting a Resolution whereby Calcasieu Parish agrees to install and maintain both advance warning signs and pavement markings for the railroad crossing located at Prater Road (DOT NO. 768-109P) in Ward Four in conjunction with the installation of railroad crossing signals by the Federal Highway Administration under the Federal Railroad Safety Program.

 

18.     Consideration of adopting a resolution authorizing the advertisement for bids for an oil, gas, and mineral lease in Oak Grove Estates Subdivision in Section 30, Township 10 South, Range 12 West, in Ward Seven.  (Police Jury District 12)

19.     Consideration of approval for the drafting of a Request-for-Proposal document to be advertised and sent to interested parties for development of the Mullers property in accordance with guidelines established through the Downtown Development Authority of Lake Charles' Strategic Plan.

 

20.     Consideration of adopting a resolution encouraging our Louisiana Congressional Delegation to request that the funding levels to the Louisiana Community Development Block Grant Program for Fiscal Year 2003 not be reduced as projected by the U. S. Department of Housing and Urban Development.

 

21.     Consideration of approval of the Budget Committee Report dated September 19, 2002.

 

22.     Take appropriate action on request for proposals received on August 5, 2002, by the Parish Purchasing Agent for the purchase of a GPS vehicle tracking system, for use by the Division of Engineering and Public Works.  (see attached)

 

23.     ADVISE that a resolution has been received from the Rapides Parish Police Jury supporting Algie Breaux in his candidacy for Third Vice President of the Police Jury Association of Louisiana.
