5.   The following has been advertised in accordance with the law for action to be taken at 5:30 p.m., and take appropriate action thereon:

 

Receive and open bids for an oil, gas, and mineral lease on certain roads located in Sections 22, 26, 27, 28, 33, and 34, Township 10 South, Range 8 West, in Ward Three.

 

6.   Presentation of a plaque to Mr. Zeke Dixon who recently was recognized by the Lake Charles American Press as an Outstanding Athlete of the Year.  (Mr. McMillin)

 

7.   Presentation of the Calcasieu Parish Police Jury Comprehensive Annual Financial Report for the year ending December 31, 2000.  (Mr. Milner)

 

8.   Take appropriate action on applications for liquor and beer permits. (Mr. Vickers) (No action required due to the fact that no applications have been submitted.)

 

9.   Consideration of approval of the minutes of the Regular Meeting of the Police Jury dated June 21, 2001.

 

10.   Receive report from Mr. Cornelius Moon, Police Juror-District Six, with reference to on-going activities within his Police Jury District and liaison affiliations.

11.     Take appropriate action on RZ03-023-01 which is a request by Levorel J. Moreau to rezone from A-1 (Agricultural) to C-2 (General Commercial) to allow a trenching business. (Bennett Road in Ward Three, Police Jury District 9)  (see attached)

 

[The Planning and Zoning Board met on Tuesday, July 17, 2001, and voted unanimously to recommend that the request be granted with the following stipulations: 1) that the development adhere to the site plan on file with the Division of Planning and Development; 2) that a 6’ wooden fence be installed along the east property line after 30 days of completion of the building; 3) that all drives and parking areas be hardsurfaced (concrete or asphalt) within 6 months; and 4) that the use be limited to a trenching service only.]

 

12.     Take appropriate action on RZ03-024-01 which is a request by Burt Jewery Webb to rezone from C-2 (General Commercial) to I-2 (Heavy Industrial) to allow a salvage yard.  (101 Carpenter Lane in Ward Three, Police Jury District 2) (see attached)

 

[The Planning and Zoning Board met on Tuesday, July 17, 2001, and voted 6-3 to recommend that the request be granted with the following stipulations: 1) that the use is limited to a salvage yard only; 2) should the business cease, the I-2 (Heavy Industrial) zoning classification is non-transferable and the property will automatically revert to R-2 (Mixed Residential); 3) that a Parish occupational license be obtained within 5 days of zoning approval; 4) existing building must have appropriate siding installed around the entire building within 60 days of zoning approval; 5) petitioner must provide documentation on an approved sewage system within 15 days of zoning approval; 6) existing fence must be repaired within 30 days of zoning approval; 7) 6’ privacy fence must be installed along east property line (south of driveway) to provide a screening within 30 days of zoning approval; and 8) all vehicles must be stored behind the fence.]

 

13.     Take appropriate action on RZ03-027-01 which is a request by the Calcasieu Parish Police Jury to rezone from R-2 (Mixed Residential) to I-2 (Heavy Industrial) to allow for future industrial use.  (Airhart Road in Ward Three, Police Jury District 9) (see attached)

 

[The Planning and Zoning Board met on Tuesday, July 17, 2001, and voted unanimously to recommend that the request be granted.]

 

14.     Take appropriate action on RZ04-025-01 which is a request by Twins R Us to amend Ordinance 4188 (Stipulation No. 2) to read as follows:  Stipulation No. 2:  that the development must adhere to the revised site plan dated June 25, 2001, on file with the Division of Planning and Development.  (Beglis Parkway in Ward Four, Police Jury District 12) (see attached)

AGENDA NOTE:  on April 19, 2000, the Police Jury approved the request of Stephen and Diana Khoury to rezone R-1 (Single Family Residential) to C-2 (General Commercial) to allow a truck stop with five stipulations.  Stipulation No. 2 was worded as follows:  that the development must adhere to the site plan on file with the Division of Planning and Development.

 

15.     Take appropriate action on ST08-002-01 which is a study to examine the feasibility of rezoning parcels located on P. E. Daigle Road in Ward Eight.  (P. E. Daigle Road in Ward Eight, Police Jury District 10) (see attached)

 

[The Planning and Zoning Board met on Tuesday, July 17, 2001, and voted unanimously to recommend that the request be withdrawn at the request of the residents.]

 

AGENDA NOTE:  on June 21, 2001, the Police Jury authorized the Division of Planning and Development to prepare a staff recommendation to reclassify some properties currently zoned A-1 (Agricultural) in Ward Eight.  The study area includes parcels on P. E. Daigle Road in Section 5, Township 10 South, Range 7 West.

 

16.     Consideration of adopting a resolution indicating objection/no objection to the following proposed project in Calcasieu Parish, Louisiana, provided said work meets with the rules and regulations of the Corps of Engineers and approvals are received from all appropriate state and federal agencies, and further, that any required permits are obtained from the Division of Planning and Development:

 

·         Proposal of Palermo Properties to deposit fill for the closure of existing drainage ditches as part of the construction of a 22-lot subdivision.  Preliminary determinations have shown that the proposed ditch closures will impact approximately 2.00 acres of jurisdictional wetlands along the existing drainage ditches.  The proposed activity will be located within an area approximately 3,100 feet long and 30 feet wide and the fill operation will include the deposition of approximately 1,400 cubic yards of earthen material to be placed within the existing drainage ditches.  Said project is located in Sections 34 and 35, Township 10 South, Range 11 west, adjacent to Louisiana Highway 108, near Sulphur.

 

AGENDA NOTE:  any resolution of no objection to any project, if adopted, will stipulate that such “no objection” is based solely on evaluation by the Parish Planning and Development Staff relative to the project’s compliance with current parish ordinances and provisions, and that no environmental assessment was made, and further, requesting the agencies and/or individuals with environmental expertise to make an evaluation and forward their findings to the U. S. Corps of Engineers.

 

17.          Consideration of adopting a resolution authorizing that a letter be sent to the Louisiana Department of Transportation and Development requesting that consideration be given in order of the priority shown to various railroad crossings within Calcasieu Parish for the installation of signal devices under the Highway Safety Funding Program 203 as follows:

18.     Consideration of adopting a resolution providing for the employment of Plauche, Smith & Nieset, a Professional Law Corporation, as general counsel for the Calcasieu Parish Police Jury, pursuant to LSA¾R.S. 42:261(G), as amended, and further, authorize the President of the Police Jury, or her designee, to execute all documents related thereto.

19.     Consideration of ratifying an amendment to the contract between the Calcasieu Parish Police Jury and Local Union No. 1377 of the American Federation of State, County and Municipal Employees that establishes a revised employee grievance procedure to be utilized on a trial basis for a seven month period beginning August 1, 2001.

 

20.         Consideration of adopting resolutions with reference to the assignment of the following oil, gas, and mineral leases:

 

(20-1) Assignment of an oil, gas, and mineral lease dated September 7, 2000, between the Police Jury and Basin Properties, Inc. on 5.82 acres (roads and streets) in Sections 32 and 33, Township 8 South, Range 7 West in Ward Eight, to Samson Resources Company and Helmerich & Payne, Inc.;

 

(20-2) Assignment of an oil, gas, and mineral lease dated April 6, 2000, between the Police Jury and Basin Properties, Inc. on 3.633 acres (roads and streets) situated in the South Half (S/2) of Section 9, Township 9 South, Range 7 West, Calcasieu Parish, Louisiana, and being more particularly identified as a street known as Yvonne Drive, in Ward Eight, to Samson Resources Company and Helmerich & Payne, Inc.; and

 

(20-3) Assignment of an oil, gas, and mineral lease dated March 22, 2001, between the Police Jury and Basin Properties, Inc. on 4.75 acres (roads and streets) in the Northeast Quarter of the Northeast Quarter of Section 18, Township 9 South, Range 7 West, in Ward Eight, to Samson Resources Company.

 

21.     Consideration of adopting a resolution calling an election on October 20,
2001, for the continuation of a 10-year maintenance tax not to exceed 8.65 mills on all properties within the boundaries of Ward Four Fire Protection District No. Four for the operation and maintenance of said Fire District.

 

22.    Consideration of adopting a resolution approving an Addendum to the existing Services Agreement between the Calcasieu Public Transit System and the Calcasieu Voluntary Council on Aging (CCOA) wherein the CCOA will pay a regular and consistent monthly fee of $5,666.66 per month to the Calcasieu Public Transit System to purchase transit rides for those seniors 60 and older who have been certified by the CCOA for their participation in the Title II-B Supportive and Assisted Services (medical, medically-related, and grocery shopping), as provided by the CCOA, and further, authorize the President of the Police Jury, or her designee, when appropriate, to execute all documents related thereto.

 

23.    Consideration of adopting a resolution approving a contract between the Police Jury and Mr. Paul Kerr to provide pilot services for the Calcasieu Parish Mosquito Control Department, and further, authorize the President of the Police Jury to execute all documents related thereto.

24.    Consideration of adopting a resolution approving a Cooperative Agreement between the Police Jury and the State of Louisiana, Department of Natural Resources, for the 2001-2002 Calcasieu Parish Coastal Restoration Program (Christmas tree recycling project), and further, authorize the President of the Police Jury, or her designee when appropriate, to execute all documents related thereto.

 

25.    Consideration of adopting a resolution approving the renewal of written agreements between the Police Jury, Office of Juvenile Justice Services, and the Louisiana Department of Education, School Food Service Section, for the continued administration, operation, supervision, and accountability of such program as well as the maintenance of all required records and reports, with said agreements to continue on a monthly basis unless cancelled by either party in accordance with the agreements, and further, authorize the President of the Police Jury, or her designee when appropriate, to execute all documents related thereto.

 

26.    Take appropriate action on the expiration of the term of Mr. Kevin Billiot as a member of the Workforce Investment Board. (Mr. Billiot represented the public sector –Title I and Title V.  A letter has been sent to the Inter-Tribal Council of Louisiana, Inc. requesting a nomination.  Ms. Griffin and Ms. Treme are the liaisons.  A letter has been received from the Inter-Tribal Council of Louisiana recommending that Mr. Billiot be reappointed.)

 

AGENDA NOTE:  action was deferred by the Police Jury on June 7, 2001, and on July 5, 2001.

Consideration of approving a Joint Services Agreement between the Police Jury and Ward Two Fire Protection District No. One providing for the installation of a dry fire hydrant on the Government Ditch by the Division of Engineering and Public Works with reimbursement for time and fuel, estimated at approximately $898.05, to be made by the Fire District, and the Fire District will be responsible for the purchase of all materials.
